A RESOLUTION REQUESTING VARIANCES FROM MUNICIPAL STATE AID
STANDARDS FOR THE PLEASANT VIEW ROAD REHABILITATION PROJECT
(SAP 194-109-002)
WHEREAS, the City of Chanhassen is preparing construction plans for the rehabilitation of
Pleasant View Road (MSAS 109) from Powers Boulevard (CSAH 17) to Chanhassen Road (TH 101);
and
WHEREAS, Minnesota Rules for State Aid Operation 8820.9936 require alignments to meet
30 mph design speeds for horizontal and vertical curves; and
WHEREAS, Minnesota Rules for State Aid Operation 8820.2500 require a minimum of 60 feet
of Right-of -Way; and
WHEREAS, the reason for the variance request is due to various factors including the width of
existing right-of -way, proximity of adjacent private property, and proximity to environmentally
sensitive areas, all of which limit the possible elevation changes and changes to alignments of the
roadway to incorporate the standard geometry.
NOW, THEREFORE BE IT RESOLVED, that the City of Chanhassen City Council does
hereby request a variance from the Minnesota Department of Transportation State Aid Operations Rules
Chapter 8820.9936 to permit the rehabilitation of Pleasant View Road be designed with less than 30
mph design speed for various horizontal and vertical curves along the corridor;
BE IT FURTHER RESOLVED, that the City of Chanhassen City Council does hereby
request a variance from the Minnesota Department of Transportation State Aid Operations Rules
Chapter 8820.2500 to permit the continued use of 30-foot Right-of-Way in certain locations along the
corridor;
BE IT FURTHER RESOLVED, that the City of Chanhassen City Council hereby
indemnifies, saves and hold harmless the State of Minnesota and its agents and employees of and from
claims, demands, actions, or causes of action arising out of or by reason of sub-standard municipal state
aid design in accordance with Minnesota Rules 8820.9936.
