RESOLUTION APPROVING AN AGREEMENT WITH THE METROPOLITAN COUNCIL
ENVIRONMENTAL SERVICES FOR SANITARY SEWER CONNECTION TO THE MCES
INTERCEPTOR FOR EDEN SPRINGS ASSISTED LIVING AND MEMORY CARE
DEVELOPMENT, CARVER COUNTY, MINNESOTA
WHEREAS, The City of Chanhassen (“City”) is a Minnesota municipal corporation; and
WHEREAS, the Metropolitan Council Environmental Services (“MCES”) is a public
corporation and political subdivision of the State of Minnesota that owns and operates the regional
sanitary sewer interceptor system, including the “Chanhassen Interceptor” and MH 35 located
adjacent to 1620 West 78th Street, Chanhassen Minnesota;
WHEREAS, Lighthouse Homes, LLC (“Developer”) has received City approval for the Eden
Springs Assisted Living and Memory Care facility located at 1620 West 78th Street, Chanhassen
Minnesota;
WHEREAS, the City’s sanitary sewer network is not available in proximity to the subject
property, and the MCES “Chanhassen Interceptor” and MH 35 is directly adjacent to the property,
making a direct connection to the MCES interceptor the only viable sanitary sewer solution for the
development;
WHEREAS, the City and MCES have negotiated an agreement (“MCES Agreement”) setting
forth the terms and conditions under which the Developer’s private sanitary sewer system may
connect to the MCES interceptor manhole within the public right-of-way, including provisions
addressing construction standards, maintenance responsibilities, cost allocation, and indemnification.
WHEREAS, the City and Developer have negotiated an agreement (“Developer Agreement”)
setting forth the terms and conditions under which the Developer’s private sanitary sewer system may
connect to the MCES interceptor manhole within the public right-of-way, including provisions which
the Developer shall be responsible for all construction standards, maintenance responsibilities, cost
allocation, and indemnification.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chanhassen City Council
hereby authorizes:
1. The MCES Agreement between the City of Chanhassen and the Metropolitan Council
Environmental Services for sanitary sewer connection to the MCES interceptor at MH 35 for the Eden

Springs Assisted Living and Memory Care development at 1620 West 78th Street is hereby approved,
subject to any minor revisions as may be approved by the City Attorney.
2. The Developer Agreement between the City of Chanhassen and the Developer for
sanitary sewer connection to the MCES interceptor at MH 35 for the Eden Springs Assisted Living
and Memory Care development at 1620 West 78th Street is hereby approved, subject to any minor
revisions as may be approved by the City Attorney.
