RESOLUTION VACATING THE WEST 94TH STREET PUBLIC RIGHT OF WAY AS
DEDICATED IN THE PLAT OF BANDIMERE HEIGHTS 2ND ADDITION
WHEREAS, The property owner at 600 W 94th Street (“Applicant”) has requested the
vacation of the public right of way legally described and depicted in Exhibit A attached hereto and
incorporated herein (collectively referred to herein as “Right of Way”); and
WHEREAS, pursuant to Minnesota Statutes § 412.851 the City Council of the City of
Chanhassen has conducted a hearing preceded by the statutorily required two (2) weeks published
and posted notice and mailed notice to the abutting property owners, to consider the vacation of the
Right of Way; and
WHEREAS, the City Council finds that the Right of Way proposed for vacation is excess
right of way that serves no existing or future public purpose; and
WHEREAS, the vacation is subject to the property owner at 600 West 94th Street formally
changing that property’s address to Kiowa Trail, as determined by the city’s Building Official; and
WHEREAS, and the City hereby reserves a perpetual public drainage and utility easement
over, under and across a 6-foot-wide strip of land on both sides of the centerline of West 94th Street.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chanhassen City Council:
1. The City Council hereby vacates the West 94th Street public Right of Way legally
described in Exhibit A subject to the conditions noted; and
2. The vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas lines, sanitary and
storm sewer lines, water pipes, mains, hydrants, and natural drainage areas ther eon or
thereunder, to continue maintain the same or to enter upon such way or portion thereof
vacated to maintain, repair, replace, remove, or otherwise attend thereof; and
3. The City Clerk shall transmit a certified copy of this Resolution to the County Auditor
and County Recorder.

Exhibit A
That part of West 94th Street as dedicated on the recorded plat of Bandimere Heights 2nd Addition,
Carver County, Minnesota, that lies Northwesterly of a line drawn parallel with and 10.00 feet
Northwesterly of the Southeasterly line of said plat of Bandimere Heights 2nd Addition as measured
perpendicular to said Southeasterly line.
