Family Residential Districl (RSF) - Planning Case 2026-08.
On June 2nd, the Chanhassen Planning Commission, acting as the Board ofAppeals and
Adjustments. met at ils regularly scheduled meeling to consider the application. 1-he Planning
Commission conducted a public hearing on the proposed variance preceded by published and
mailed notice. The Board of Appeals and Adjustmenls nrakes lhe following:

l. The property is currently zoned Single Family Residential District (RSF) and located within
the Shoreland Management Overlay District.
2. The property is guided in the Chanhassen Comprehensive Plan for Residential Low Density
3. The property legal description as described in Exhibit A.
4. Varianoe lrindinss - Section 20-58 of the Cit y Code provides the following criteria for the
granting ofa variance:
a Variances shall only be permitted vvhen they are in harmony rvith the general purposes
and inlent of this Chapter and u'hen the variances are consistent with the Comprehensive
Plan.
Finding: The variance is in harmony with the general purposes and intenl of lhe chapter,
as well as the comprehensive plan.
b. When there are practical difficulties in complf ing u'ith the zoning ordinance. "Practical
difficulties" as used in conneclion u'ith the granting ol a variance, means that the propertl
Lr$'ner proposes to use the properl) in a reasonable manner nol permitted by this Chapter.
Practical difficulties include. hut are not limited to. inadequate access to direct sunlight
fbr solar energy systems.
Finding: The requested variance has practical dificult1, in complying with the zoning
ordinance due to the unique layout ofthe home on lhe property. The proSserty owner is
proposing a reasonoble use of the proper\) lhol rcq ires a variance .for construclion.
c. That the purpose ofthe variation is not based upon economic considerations alone.
Finding: The varialion is not based on economic consideralions alone.
d. The plight ofthe landou'ner is due to circumstances unique to the property not created by
the landowner.
Finding: The plight ofthe landowner is due lo circumstance to the property creoted by
the unique layout ofthe home on the property buih in 1932, not created by the property
owner_

Statutes Section 216C.06. subdivision 14, uhcn in harnrony r,' ith this Chapter.
Finding: The proposed is not an earth-sheltered construction and there.fore nol
applicable.

The Planning Commission approves lhe requested variance for a fronl y'ard setback subject to the
conditions of the staff report.
