RESOLUTION VACATING A PORTION OF HANCOCK PLACE RIGHT OF WAY AS
DEDICATED IN THE PLAT OF RED CEDAR POINT LAKE MINNEWASHTA
WHEREAS, Scot Lacek (“Applicant”) has requested the vacation of a portion of public right of way
legally described and depicted in Exhibit A attached hereto and incorporated herein (collectively referred to
herein as “Right of Way”);
WHEREAS, pursuant to Minnesota Statutes § 412.851 the City Council of the City of Chanhassen
has conducted a hearing preceded by the statutorily required two (2) weeks published and posted notice and
mailed notice to the abutting property owners, to consider the vacation of the Right of Way.
WHEREAS, the City Council finds that the Right of Way proposed for vacation is excess right of
way that serves no existing future or public purpose.
WHEREAS, the vacation is subject to and the City hereby reserves a perpetual drainage and utility
easement over, under and across the entire vacated Right of Way.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chanhassen City Council:
1. The City Council hereby vacated the Right of Way legally described in Exhibit A.
2. The vacation shall not affect the authority of any person, corporation, or municipality owning
or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer
lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to
continue maintain the same or to enter upon such way or portion thereof vacated to maintain,
repair, replace, remove, or otherwise attend thereof; and
3. The City Clerk shall transmit a certified copy of this Resolution to the County Auditor and
County Recorder.
PASSED AND ADOPTED by the Chanhassen City Council this 18th day of May, 2026.

PROPOSED VACATED HANCOCK PLACE:
The Northeasterly Half of Hancock Place as dedicated on the recorded plat of RED CEDAR POINT
LAKE MINNEWASHTA, Carver County, Minnesota, that lies Southeasterly of the Southerly
extension of the Southeasterly line of Lot 31, Block 1 of said RED CEDAR POINT LAKE
MINNEWASHTA and Northerly of the North line of Leach Road as dedicated on said plat of RED
CEDAR POINT LAKE MINNEWASHTA.
AND
The Southwesterly Half of Hancock Place as dedicated on the recorded plat of RED CEDAR
POINT LAKE MINNEWASHTA, Carver County, Minnesota, that lies Northwesterly of the
Northeasterly extension of the Northwesterly line of Lot 2, Block 6 of said RED CEDAR PO INT
LAKE MINNEWASHTA, and Easterly of the Easterly right of way line of Aldrett Road as
dedicated on said plat of RED CEDAR POINT LAKE MINNEWASHTA.
