Application of Comerstone Investors for a Conditional Use Permit (CUP)
The Planning Clonrmission conducted a public hearing on the proposed conditional use permit
u'hich u'as preceded by published and mailed notic€. The Planning Commission heard testimony
from all interested persons wishing to speak and made the following Findings ofFact on the
remaining application.
FINDINGS OF FAC'I'
Permit. On January 29.2026. the city received a completed land use application for the
property legally described in Exhibit A ("Property"), located at 2100 Stoughton Avenue
requesting a conditional use permil Ibr screened outdoor storage on the Property.
2. Property. The Property is currently zoned Industrial Office Park (lOP). The Property is
guided by the 2040 Land Use Plan for Oflice Industrial Use. Screened outdoor storage is
considered a Conditional Use within the Industrial Office Park (lOP) zoning district.
3. Conditions. 'l'he permit is issued subject to the following conditions:
[. Outdoor storage area shall be enclosed with 100% opaque fencing 8'in height. Fencing
shall be maintained in good condition at all times.
2. All materials and equipment slored outdoors shall no1 exceed the height ofthe required
storage area fencing.
3. Outdoor storage area shall not be used as a Contractors Yard, as defined by the City of
Chanhassen.
4. Materials and cquipment placed within the outdoor storage area shall nol emit odors,
produce excessive noise, or be hazardous.
5. Any outdoor lighting for the outdoor storage shall not exceed 25 feet in height when
nrounted to a light pole. Light nreasurement al the prop€rty line shall nol exceed 0-foot
candles.
4. Termination of Permit. The city may revoke the permit follorving a public hearing for
violation of the terms of this permit. The city may institute any proper action or proceeding at
larv or at equity to prevent violations of the rvithin property, to restrain or abate violations of
the within permit, or to prevent use or ocoupancy of the Subject Property.
5. Lapse. If u'ithin one year of the issuance of this permit the authorized construction has not
been substantially completed or the use commenced, this permit shall lapse, unless an
extension is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penaltl'. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
The Planning Commission recommends that the Cily Council approves the Conditional Use
Permit
