NOTICE IS HEREBY GIVEN That the Planning
Commission of the City of Chanhassen, Minnesota, will
meet on Wednesday, the 23rd day of April, 1980, at
the City Hall, 7610 Laredo Drive, at 7:45 p.m. for the
purpose of holding a public hearing to consider the
preliminary development plan for Lake Susan Hills

SITUATION: Bob Waibel, city of Chanhassen, requested the Carver Soil and Water
Conservation District review the 10/9/79 Dunn & Curry 'Lake Susan and Lake Ann
PUD' plans designed by Urbanscope, for the city planning commission. The plan
covers approximately 15100 acres of land in Section 11, 13, 14, 15, 22, 23 and
24 (T116 - R23W). The attached soil survey map shows the general soil -slope
conditions of the property. The soil survey map is color coded to show building
site limitations (see attached soil survey map and key). The attached soil in-
terpretation sheets outline the soil characteristics that generally affect the
proposed building activities.
SUGGESTED SOLUTION (S) : The soils information provided with this report shows a
potential for very severe erosion problems (areas colored blue on the soils map),
severe erosion problems (areas colored red on the soils map) and moderate erosion;
problems (areas colored yellow on the soils map). To protect the water quality

in Lake Susan, Lake Ann and Riley Creek, a carefully designed erosion control
plan is needed.
The soils map and interpretation sheets also show that there are many acres
of wet soils distributed throughout the property. The wetness limitation ranges

map). The land use of wet soils is an important part of the plan. Areas
can be ponded or drained;to be successful, drainage has to provide for both
surface and sub -surface water management.
Other problems shown on the soil interpretation sheets, for some of
the soils, are flooding, low soil strength, and susceptibility to frost
action.
The city should require the developer to have a plan showing how he
will control soil erosion on the -red and blue areas shown on the soils
map, especially those draining directly into the two lakes and the creek.
This plan would also show -the drainage practices used on the wet soils
(red lined and blue lined areas shown on the soils map) not set aside as
park land.

Dear Mr. Waivel:
Our wetland inventory shows the wetland in the N2f SE!, Section 23,
T116N, R23W to.be a type II wetland. The Department of Natural
Resources (DNR) does not have regulatory jurisdiction over type II
wetlands: therefore, a DNR oermit is not required to alter the.wet-
land.
The watercourse that runs.through the above wetland has a watershed
area less than two (2) square miles and therefore does not fall with-
in the DNR's jurisdiction. A DNR permit is not required to alter this
watercourse.

Attached please find the planning report draft for the proposed
Chanhassen Lakes North, Lake Susan Hills West, and Lake Susan Hills
South developments. Within the attached report, is the table
titled "Developments Currently Under Review - Population Estimates".
For purposes of our conversation of the other day, I have
denoted each of the developments with a number to be corresponde'
with the attached April, 1978 sanitary sewer map for ease of
location. You will note that a population estimate range for these
developments alone goes from 9,083 to.13,087 persons. Combining
this figure with the 1979 Metropolitan Council population estimate
for Chanhassen of 6,300 persons, a -range of 15,383 to 19,387 persons
is realized. Admittedly these figures will need to be refined when
more definitive household characteristic projections are available.
These estimates do. not include sizable portions of Chanhassen where
sewer service is already available to developable land on which
no proposals have been received as of yet by the City.

RE: Jack -Anderson -and Associates Traffic Report
for Lake Ann and Lake Susan PUD's
Dear Ed:
I read Jack's report, a synopsis of which has been attached, and I
have the following comments to make:
It is my understanding that in the entire site and its immediate vic-
inity, no roads are going to be faced with any capacity problems.
The area which appeared to be of more concern was whether our total
development might preceed development of #212 and thus create cap-
acity problems on any roads but most importantly on U.S. #5.
As I see in Jack's report the initial findings are that there would be
no problem prior to #212's delivery to traffic. Of course, its con-
struction and operation would alleviate any concerns about the capacity
of #5.
Something else I would like to comment on would be the reiteration of
his statement that at P.M. peak hour traffic at the intersection of
T.H. #5 and CSAH #17 in the year 1990, the intersection as presently
designed, will be adequate at that -time and more than adequate after
#212 is open to traffic.

Following our meeting today, I am attempting to summarize with this letter,
the schedule and required material and deadlines that we discussed and
agreed upon. For the Proposed Preliminary Plan Review, the additional
information we will be submitting will be lot sizes and frontages. For

only when available.
Ten days prior to the review of the Preliminary Development Plan I will

The subject items are scheduled.to be on the November 5th.council
agenda with review starting at approximately 9:15 p.m.. The purpose
of this memorandum is to request that you consider attending this
meeting to provide input that you might feel appropriate for the
following reasons.
The first of these reasons is that in the decision on the Dunn and
Curry proposal, the nature of the discussion seemed -to contain
uncertainty as to why this particular request is to receive city
council review before the public hearing. Since there is the
possibility that individually you may have questions or comments
regarding this review, I would invite that you consider attending
so that this overall plan review may be optimized.
The second item which might warrant your.attendance at the.upcoming
council meeting..is that this office has received an opinion from the
Fire Marshal that the emergency access to the condominium area be
left in as part of the overall plan. Although. this information was
not available to the planning commission or staff- at the public hearing,
staff is maintaining a position that the emergency access be deleted
from said plans.

Petition
The applicants are requesting preliminary development plan review
for an approximate 760 acres of land for the development of
approximately 2,038 residential units.
Background
1. Community Location: As shown in enclosure 1, the Chanhassen
Lakes North portion of the proposal is an approximate 220 acre
parcel located in the northwest quadrant of the intersection of
County Road 17 (Powers Blvd.) and MTH 5. Also as shown in enclosure
1, the portion of the proposal titled Lake Susan Hills, is approximately
540 acres bounded on the north by Creek Drive and Lake Susan, on the
west.by County Road.'.17, and on the east by Great Plains Blvd.
(MTH 101). :There is a portion also proposed in the northeast quadrant
of the intersection of Lyman Blvd. and MTH 101.
2. Existing Zoning: The subject property and its environs are
presently zoned R-la, with the exception that the portion adjoining
the property to the north is presently zoned P-4, industrial district,
and the portion adjoining on the southeast shore of Lake Susan is
zoned R-1, single family residential district.
3. Utilities: PVrusuant to the Chanhassen existing sanitary sewer
map dated April, 1978, much of the subject property is unavailable
to sewer service, with the exception of the property adj.oining Lake
Ann on the east to Powers Blvd., and a portion of land, approximately
500 feet wide extending south/southwest approximately 4,000 feet to
Lyman Blvd. from the southcentral shore of Lake Susan.

4. Comprehensive Plan Proposal:
a. Pursuant to the adopted City Comprehensive Guide Plan, the
lions share of the subject property is to assume and maintain a
low density single family identity. The only other land uses in
the plan for the property, are a multiple residential area in
the immediate vicinity of the northwest quadrant of the intersection
of Powers Blvd. and MTH 5, and linear semi-public conservation open
area and drainageway along the western shore of Lake Susan and
meandering south to Lyman Blvd.
b. Transportation: As shown in the Comprehensive Thoroughfares
and Transportation Plan, new County Road 17 and Powers Blvd. are to
function as major collectors, old County Road 17 and MTH 101 are
to function -as minor collectors, a proposed minor collector is planned
to be placed between old 17 and new County Road 17 along the east/
west quarter section line of the south quarter of Section 14, and
Lyman Blvd. is to function as a parkway.
Comments
in the staff discussions of the proposal at.hand, many concerns arose
regarding the procedural review of a proposal of this magnitude.
Some of these concerns are as follows.
In staff, Planning Commission and Park and Recreation Commission meetings
the immediate adequacy and future of Lake Ann Park was discussed.
There was some mention as to the expansion of Lake Ann Park with
possible utilization of portions of the Chanhassen Lakes North
proposed plat. There was additionally mention of potential market
competition with other areas under development within the city that
could result in developments left unfinished for extended periods of
time with full public improvements. This, needless to say, would
place an undue strain upon the municipal operating and maintenance.
requirements for said improvements with a less than desirous absorption
level.
With regard to the Comprehensive Plan currently being updated as per
the Mandatory Planning Act, there needs to be further investigation
as to the allowed sewer flow capacity for Chanhassen and if any
adjustments would be necessitated by this development to those allowances
Although the natural course of events for a proposal such as this
is to proceed through the planned residential development review
process, however, again with the magnitude with the proposal at hand,
this office believes that the city should make certain that the above
concerns are not aborragated through an outright or premature approval
of any or all elements of the plans in question. With this in. mind,
I recommend that the Planning Commission enter into the record their
comments regarding the issues mentioned above, .i.e. phasing, utility
capacity,. land use, and local market competition. It is anticipated
that a more detailed scenario of arguments on these issues will be
delivered under separate cover for purposes of discussion. When the.
Planning Commission finds that they have adequately reviewed all of
the potential long range problem areas, I would recommend that the
subject proposal along with the Planning Commission comments be
referred to the City Council along with a request for direction and/or
conditions upon which any further review of Chanhassen Lakes North and
LaSwan Hills may proceed.

Dear Councilmembers:
We, The Lake Susan Association, are very much opposed to the proposed
Lake Susan development plan. We do not feel that it is in the best interest
of the community to have apartment buildings and other multiple dwelling type
housing adjacent to the lake.
This type of development would have a very pronounced degrading effect on
our property values, and would create many hidden problems.
As you know, the city of Minneapolis has gotten National recognition for its
good planning. One of the most notable things is the way the lake shore was
developed. The majority of the lakes are surrounded by open space, then sin?je
dwelling housing. The Lake Ann development appears somewhat consistent with this
planning technique. However, the Lake Susan plan is not consistent with what is
"Nationally known" as good planning.
In all due respect to apartment dwellers, they would not have a vested. interest
in the upkeep of the lake and therefore the taxpayers would have to finance a park
maintenance crew to maintain the premises.
We urge you to consider single dwelling on all lake shore with the open space
dedicated to the home owners association, which would put the maintenance burden
on the home owners. This is the simplest and most effective method. Behind the
single dwellings a buffer zone and then multiple dwelling would be the most proper
way of developing.
As was mentioned during the phase one planning meetings, we do not feel. the
community is ready for this type of development because of the current road system
which is inadequate and would create an undue hardship on nearly all the
Chanhassen residents that travel to and from the Metro area.

We can understand the contractors interest in getting the highest return on
his investment, but it should not be at the residents perpetual expense.
We sincerely appreciate your consideration of our views and feel confident
that your judgement in this matter will be for the best interest of the City of
Chanhassen.
In summary, we feel that serious consideration should be given to the
following items:
1. Much lower density on the property surrounding the lake.
2. The road system.
3. Environmental impact.
4. Cost of maintenance to the city.
5. School system needs.

SUBJ: Planning Commission Meeting, March 26, 1980
As shown in the attached agenda, there was an inadvertant double
scheduling of public hearings for the subject meeting for the
building moratorium ordinance and Lake Susan West PRD. Upon
staff consultation it is recommended that the building moratorium
public hearing be taken care of before the Lake Susan West review.
It is hoped that this will not cause any more than a 15 minute
postponement for the second public hearing.
With regard to the building moratorium hearing, this office has
little information as to the substance of the proposal other than
such hearings are required by statute to be held by the Planning
Commission, and that it involves mainly the property in Chanhassen
that is located North and South of MTH 5 and east of Dakota Avenue.
The Assistant City Attorney will give a verbal presentation on
this matter at Wednesday's meeting. .
As to the Lake Susan West PRD public hearing, as well as the other
Dunn and Curry proposals of Lake Ann PUD and Lake Susan South PUD
it was decided that, due to the magnitude of the three proposals, it
would be more appropriate to have only a preliminary post public
hearing discussion on the evening that public comments were taken
on the respective proposals and to have a final discussion on the
proposal at the Planning Commission meeting two weeks later. Thus.
the preliminary and final discussion portions of the public hearing
for Lake Susan West PRD, Lake Ann PUD and Lake Susan South PUD
would tentatively be March 26, April 9; April 9, April 23; and
April 23, May 14, respectively. It is felt that with this
schedule both the Planning Commission and staff could better respond
to the public input and prepare their final recommendations to the
City Council.
I have attached for all the Planning Commission, copies of written
public comments this office has received to date. For the new com-
mission members, I have additionally attached staff reports and
developer's materials that have been written and submitted to date.

Lake Ann Development Plan in the area south of Greenwood Shores. In
the letter she stated "how glad she was that her two children were
able to grow up in an area so close to nature". As one of those
children, I would like to express my viewpoint.
During my childhood, I enjoyed the freedom of open fields and wooded
areas. The freedom of being carefree, without a worry in the world.
The kind of freedom that every child has a right to experience.
Today's adults have no right to take this away from tomorrow's
children. By going ahead with the proposed plan I feel you will be
doing exactly that.
It will certainly create more crime and in turn inhibit the children
in their normal activities. Even now in our neighborhood, parents
are afraid to let their children go down to the woods by themselves.
Ten years ago, when I was ten years old, my friends and I would literally
live in these same woods during the summertime, without having to -•worry
at all.
The proposed plan would definitely limit the space for the children
to play. Children should be able to know what it's like to walk
amoung the trees during the fall, surrounded by orange & golden hues,
and not having the mood spoiled by high density housing and all the
problems it creates.
I realize that open fields are unfortunately a thing of the past, but
developers can create a rural atmosphere when planning new areas. That
to me means single-family housing and spacious lots.
I do not u ant Chanhassen to become another Bloomington or Edina.
Chanhassen is a unique place and should stay that way; with it's rural
and open atmosphere. I realize that there is no financial gain in this
idea, but in my opinion, there is no dollar amount that can compare
with the beauty and joy that this area can bring to children and adults
alike. Please don't destroy it.

Gentlemen:
We as residents of the Greenwood Shores Area are strongly
in opposition to the plan for developing the area adjacent to us
as proposed in your letter postmarked Feb. 11, 1980. Greenwood
Shores area consists of single family units on lots of approx-
imately 3/4 acre (low density) and we believe the area adjacent
to the south side of Greenwood Shores should also be developed
as single family units with a resultant low density spacing.
We, for one family, bought and built in the Greenwood Shores
area to get out of the high population density city.apartments
and duplex areas and closer to the country in a low density
development consisting of single family units. This area should
continue to be developed as single family residences with low
density spacing.
Your proposed high population density rental area devel-
opment will by past history be a high crime and other social
problem area and result in Chanhassen having to increase ser-
vices to this area at the expense of tax payers in previously
developed areas. If the developers can not sell single family
homes in this area, then they should leave the land for farming.
We presume they have enjoyed the advantage of a farm tax rate
on the property.
Approximately one year ago, you held a public hearing on
the proposed development of the area east of Greenwood Shores
across County Rd. 17 (now Powers Blvd.). We came away from that
meeting with the understanding that the area was to be developed
as single family residences and it wasn't until we saw four-plex

foundations being constructed in that area that we found out
otherwise. It seems Phase I of that development was all we
were told about at that Public Meeting. The later phases of
the development were not mentioned and we feel we should have
been told the whole plan. The Planning Commission should be
reprimanded for this omission in their presentation on the
development of the area east of Greenwood Shores.
In conclusion, we would like to have a rededication of
this area by the City Council as a single family low density
development area. We as one family in the area will give strong
support to our elected officials who will represent the interests
of the present residents of the area (their constituents) rather
than the real estate promoters who want only to get the most
profit from their development acres.

Gentlemen:
As a longtime resident of Chanhassen and the Greenwood Shores area, I
feel I must strongly protest the plan for developing the area south of
us as specified in your recent letter. The plan definitely advocates
high density housing to which I am firmly opposed.
We built our home here twenty years ago after living in Bloomington
for five years. We left there because of the high density housing
and the problems it created. As the population increased, school
facilities proved to be inadequate and new schools were built, many
of which have now been closed because of lack of attendance. Public
services increased accordingly and so did the tax structure.
We have been very thankful for the opportunity to have lived in the
Greenwood Shores and Chanhassen area for the past twenty years, and
for the opportunity our two children had to grow up so close to nature;
and for awhile, to be free from the problems associated with high density
housing. The Greenwood Shores Park was nothing more than a very rough
piece of terrain bordering Lake Ann twenty years ago. Residents of
the area pooled their resources and energy to construct a beach for all
of us to enjoy. Up to the time of the construction of Lake Ann Park,
our children were able to enjoy the lakes and woods without parents
having to worry about their welfare. Unfortunately, since Lake Ann
Park came into being, our beach and surrounding woods are no longer
safe for children to enjoy without a parent in attendance. We now
have to sit quietly and watch this beach increasingly abused by a
large number of irresponsible individuals from pot snickers to skinny
dippers. This is only one of many problems created by a high density
situation such as the one advocated by the Planning Commission. My
husband tells me this is progress, but I call it a crying shame.
When the public hearing was held for the development of the area east
of County Road 17 (Powers Blvd.), it was my understanding that this
was to be strictly siri.gle family units. I now feel that the model
homes were built merely to "placate the natives", a substantial invest-
ment to be sure, but considering the amount at stake, a small investment
by the developer. It now appears that high -density units were the prime
goal of the developer right from the beginning.
At present, Chanhassen has about 6,000 residents in a 24 square mile
area. If I understand the Lake Ann plan correctly, you propose a total
of 790 units within about a one square mile area. Using a ratio of 2-4
people per unit, this averages out to 2,500 or more residents in that
small area, a portion of which will undoubtedly be residents on a rental
basis only. Unfortunately, with high density rental units, the ratio of
people per unit usually is higher.

It is a definite possibility that a greater number of these residences
will end. up as rental units than is presently anticipated. Duplex units
are commonly purchased by one individual who lives in one half and rents
out the other half. The quads also could be used as an investment oppor-
tunity by an individual financially able to handle it; one who :usually
spends his or her winters out-of-state. Quad housing is relatively new
in this part of the country. Purchasers see it as a splendid opportunity
to own a piece of pro perry, not realizing the multiple problems that
could develop in the future. By the time the problems surface, the
developers are well on their way, leaving the village or city to cope.
In view of the strong possibility that many of these people will not be
here on a permanent basis, I am sure they would not be too interested in
contributing to either the welfare or beauty of the area. High density
housing, individually owned or otherwise, can only result in a high crime
rate and an increase in other social problems. This is proven time and
time again every day in newspapers all over the country. The East Coast
is noted for its multiple housing units, and anyone who has either visited
or lived in the area, is well aware of the problems it has created for
its residents.
I sincerely hope the Planning Commission will reconsider their present
plans and visualize what this high density condition can and undoubtedly
will do to our lovely area within a very short time.

As you know, at the joint City Council/Planning Commission meeting of
February 20, 1980 there was concern expressed about the adequacy of
time allocated for the public hearings for the subject proposals..
As a result of this, the attached letter of February 22, 1980 was
sent to property owners who were given written notice of the public
hearing which outlined the manner in which the public hearings are
anticipated to be held for the subject proposals. You will note
that in this letter it is stated that Wednesday evenings meeting
will be the public informational presentation portion of the proposed
development and that the public commentportion of the public hearing
process will be taken care of at subsequent meetings. As part of
this rescheduling, it is anticipated that staff and the developer
will give overview presentations for each of the developments
during their respective time scheduled, and for time consideration,
the final staff review comments will be delivered after the public
comments session. With respect to this extension of public hearing,
the attached meeting schedules.are proposed and it is hoped that the
planning commission will decide upon this schedule at Wednesday's
meeting.
As of the time of writing this report, the applicant has not submitted
all of the items that are required for the public hearing and due to
the extension of the public hearing stage of the proposed
developments I would submit that any approval of this proposed
schedule would be contingent upon the applicant having all the infor-
mation prescribed by ordinance in this office by noon February 29,

The engineering advisors to the Board of Managers of the Riley -Purgatory
Creek Watershed District have reviewed the preliminary plans as submitted to
the Distrct-for the above referenced project..' The following policies and
criteria_of the.District are applicable to this.project.
I. A grading and land alteration permit application inpst be
submitted to the Watershed District for this project. This
permit application should be accompanied by an erosion con-
trol -plan outlining how sediment will be prevented from
leaving the development site both during and after construc-
tion.
2. More detailed information -must be submitted to the District
regarding the proposed-ponding areas on.the development site.
3. A detailed design of the proposed ditch system must be sub-
mitted to the District. Due_ to the large tributary drainage
area to the ditch, the District requests that the developer;
investigate the possibility of providing an enclosed storm
water system instead of the ditch as the parcels develop.
