Petition
Mr. Hendrickson is proposing to subdividean approximate 5 acre parcel
in order to create one single family residential building site.
In so doing, he is utilizing the proviso of ord.inarne33-B, which
permits the conveyance of land by metes and bounds description
(sewered or unsewered) if said parcel'is not less than 5 acres
and having a width of not less than 300 feet and it's conveyance
does not result in a subdivision of the parcel into two or more
lots or parcels any one of which is less than 5 acres in area or
300 feet in width'; and section 2.02 of ordinance 45 wherein'kesidential
building permits in areas not presently platted or subdivided by
registered land surveys and which are not served by the Village
sanitary sewer system shall be limited to one single family residential
permit for each 21,- acre tract, which have a front yard of not less
than 50 feet, a side yard on one side of not less than 100 feet and
a side yard on the other side of not less than 10 feet and a rear
yard of not less than 50 feet, and which shall adjoin a public
road or Village street."
Background
1. Community Location: As shown in enclosure 1, the subject property
is located in the southwest corner of the intersection of Powers Blvd.
and Pioneer Trail.
2. Existing Zoning: The subject property and it's environs are
presently zoned R-lA, agricultural residence district.
3. Utilities: The subject property is not presently available to
sanitary sewer and municipal water.

4. Comprehensive Plan Proposals:
a. Land Use: Pursuant to the adopted city Comprehensive Guide
Plan, portions of the property are planned to be semi-public, conser-
vation, drainage, and open area -district -with other portions multiple.
b. Transportation: Pursuant to the adopted Thoroughfares and
Transportation plan, the new County Road 17 and new Highway 212 are
to intersect at the eastern boundary of the subject property with
new County Road 17 planned as a major collector, and new Highway 212
planned as a freeway.
Comments
This request is the first of it's kind since the expiration of the
building moratorium for the unsewered area wherein a precedent could
be set that could allow for a multitude of scattered site single
family residential development in the unsewered area. Although
ordinance 45 does not permit the subdivision or platting of land
within the unsewered area of the city, ordinance 33-B which was
adopted via Attorney General's ruling, permits subdivision as proposed
in this request. Since the discussion of the estate type developments
in the Spring of 1978, there has been no new provisions created
that would prevent interim subdivisions such as the subject request.
This particular request is an excellent example of a potentially
reactive situation that could present problems in the future, because
of its location and proximity to the probable future intersection
of a major collector and freeway. The Southwest Corridor Alternative
Concepts for Trunk Highway 212 released in April, 1979, show a portion
of the proposed driving surfaces, and right of ways to traverse the
subject property, which could minimally make a residential land use
in this proximity to a freeway unbearable, or, for the residents, raise
the project cost through relocation.
Although apparently there are no legal means by which this subdivision
could be prohibited, and there is no firm intent to acquire right of
ways for proposed 212, this proposal is obviously anti-thetical to
planning principals and should serve as a reminder that better
development control in the unsewered area is strongly needed.
The soil survey for Carver County shows the subject property to have
Hayden loam soils ranging in slopes from 69-.to 40%. The planning
commission should advise the applicant to crnstruct any driveways
so that they would be accessible to any emergency vehicles at all times,
i.e. 7% grade or less.
The area of the subject property that has been designated as drainage
and public open space area coincides with the area designated on the
subject property as being a high flood propensity zone in which building
of any structure is to be prohibited. This flood way links up to
the Bluff Creek floodway which was dedicated as public open space in
the Hesse Farm, Phase I plat and similar dedication and building setback
is recommended for this subdivision.

Due to the horizontal curve of Pioneer Trail and the resultant poor
sight distances on the western portion of the property, the access
should be placed on the eastern boundary of the property.
Recommendation
I recommend that the Planning Commission recommend the city
council approve the subject request with the following conditions:
1). That the applicant dedicate the ravine area for public
open space.
2). That the applicant place the access on the eastern boundary
of the property.
3). That the applicant's building plans show all setbacks
conforming to Ordinance 45, and do not encroach, upon the
flood zone and open space area.
