Mayor Hamilton called the meeting to order. The meeting was opened with the
Pledge to the Flag.
MEMBERS PRESENT: Councilman Boyt, Councilman Horn, Councilman Geving and
Councilman Johnson
STAFF PRESENT: Don Ashworth, Gary Warren, Barbara Dacy, Jo Ann Olsen and Todd
Gerhardt
APPROVAL OF AGENDA: Councilman Boyt moved, Councilman Johnson seconder] to
approve the agenda with the following changes and additions: Mayor Hamilton
stated that item 4 had been approved by the Board of Appeals and Adjustments
but Councilman Boyt wanted to discuss the item further so it was moved to
after item 12 on the agenda; Councilman Geving wanted a report from the City
Engineer on the potential for a sprinkling ban for the City. All voted in
favor of the agenda as amended and motion carried.
CONSENT AGENDA: Councilman Geving moved, Councilman Horn seconded to approve
the following consent agenda items pursuant to the City Manager's
recommendations:
a. Site Plan Review, Redmond Building Expansion, 18930 West 78th Street.
Trappers Pass Plat Addition: Final Plat Approval
d. Approval of Change Order Request, Business Park 5th Addition.
e. City Council Minutes dated April 6, 1987 as amended by Councilman
Boyt on page 171 his comment at the bottom of the page should read,
"I just wanted to emphasize that ... and I don't know that it would be
in line with..."; page 177 at the bottom of the page, second line a
typing error "going"; and on page 193 at the bottom of the page on
the second line it should read, "he mentions that he bought his
property..."

Consent Agenda item 1(c) was moved on the agenda to be included with item 6.
VISITORS PRESENTATION:
Arthur Owens: I own the property that you passed a resolution a couple weeks
ago to have a quick take order condemning for the water tower. What I would
like to do is to have -the order rescinded and that we have a public hearing on
that. There are people who would like to talk about that. Especially as
property owners we would like to be able to talk against it. Since there has
been no public hearing on it and since it does take a change in the zoning, I
think that's only right that there should be a public hearing on it.

City Council Meeting - April 20, 1987
Mayor Hamilton: All I can comment on is that that item is in the courts and I
think you know Art you have every opportunity to make any comments you want at
that level and that item would be decided by people who are going to look at
all sides of that issue. It's actually pass the Council's hands at this
point. It is in the Court's system as you know.
Arthur Owens: I think that it seems to me that the Council is more responsive
to the people in the area than the Courts would necessarily be and since there
was no public hearing on it, I think that the Council acted in error to move
to condemn to quick take on this. It really surprises me that we were not
even notified of the fact that the Council was going to vote on it that night.
I understand it was published in the paper but how many of us as citizens look
at the paper at every Council agenda.
Mayor Hamilton: VL-ren't you notified?
Arthur Owens: No sir, we were not notified.
Don Ashworth: I know of no personal notice that went out but it should be
recalled by the Council that the whole water system study has occurred over
the past year and a half and has appeared on numerous agendas since that
time and of course, Mr. Owens was notified and did provide a Right of Entry
and was given various documents through that whole process. I would have
guessed that if there would have been a problem through that timeframe that he
might have approached us. City Council could consider this request. It
could go on for May 4th or it could go on for April 27th.
Mayor Hamilton: I think what we need to do is consider Mr. Owens' request and
ask our legal counsel what our options are and ask for their advice at this
point so we will take your request under advisement. We'll talk to our legal
counsel and see what they suggest we do.
Arthur Owens: Just a reminder that we were in Court on this and your legal
counsel decided that because we had representation that they would rather have
another time on it. It's unfortunate, we were ready to go ahead but they
refused to go ahead on it so an agreement with the Court that we would bring
it back to the Council to have it responded to here before the Court would
take it. With the quick take, the council has to make a decision and they
have to bring it back before I think June 4th.
Councilman Geving: Are you saying Art that there is a possibility that we can
negotiate this before June 4th and resolve it?
Arthur Owens: I think it easily could be resolved before June 4th and pick
another site. There's no question about that.
Mayor Hamilton: I think what we need to do, as stated, is talk to our legal
counsel and we'll see what they suggest and depending on what they advise, put
it on the agenda to have a public hearing. A public hearing would not be
here, it would be at the Planning Commission.

PUBLIC HEARING
METES AND BOUNDS SUBDIVISION REQUEST TO SPLIT A PLATTED LOT FOR A TWIN HOME, LOT 5,
BLOCK 2, CHANHASSEN ESTATES SECOND ADDITION:
Mayor Hamilton called the hearing to order. William Wisely, owner, was present.
Mayor Hamilton - Is there anyone from the public wishing to comment on this item?
If not, I would entertain a motion to close the public hearing.
Councilman Geving moved to close the public hearing. Motion seconded by Councilwoman
Watson. The following voted in favor: Mayor Hamilton, Councilwomen Swenson and
Watson, Councilmen Geving and Horn. No negative votes. Motion carried.
METES AND BOUNDS SUBDIVISION REQUEST TO SPLIT A PLATTED LOT FOR A TWIN HOME, LOT 51
BLOCK 2, CHANHASSEN ESTATES SECOND ADDITION:
Councilman Horn - I guess I am getting confused on what our policy is on metes and
bounds and what isn't. It seems like a few weeks ago we wouldn't let anything go
through on metes and bounds and now we are in an established plat and we are letting
a metes and bounds subdivision go through now.

Barb Dac - The one section of the subdivision ordinance that allowed metes and
bounds division of a platted lot was to avoid the situation where a property owner
did have the ability to subdivide their lot and requiring a plat for that individual
lot would cause probably more cost for them than is necessary if the legal descrip-
tion could be accomplished in the metes and bounds manner that is simple and easy to
read. This particular application, because of the orientation of the unit on the lot
that creates an angle of the lotline which does does create a little more involved
metes and bounds description beyond the east half of Lot 5 and the west half of Lot
5, however it is an existing situation and the only alternative would be that the lot
itself be replatted. The intent of the ordinance was to allow individual platted lot
to be subdivided by a simple description so there is the east half of Lot 5 and the
west half of Lot 5 but this particular situation is unique because of the existing
structure on the lot.
Councilman Horn - What we are saying is if it's a simple description we will go ahead
and do it. This one isn't a simple description but the house already exists. Why
don't we do this with all the twin homes in Chanhassen Estates? We had a request for
this on'e but what says we won't get this request on all of them.
Barb Dac - We may get those requests. What would happen is that we would have to
coordinate a combined plat of all the lots and work with all of the property owners
and property owners share the cost of the replatting of the entire four or five lots
that are now duplexes.
Councilman Horn - Looking at it from my standpoint I think it makes more sense if we
allow metes and bounds on a temporary situation where someone is going to come along
in the future with a known plat and make it final. That this is a temporary
situation, I don't see that in this case and it seems like we are going to have a
metes and bounds description right in the middle of a totally platted area. I find a
little problem with that.
Bill Monk - One of the things that comes up on these all the time is that when you
have a plat, this one Chanhassen Estates, what you see happening and what you want to
get away from a lot of times is a lot by lot subdivision such as this one where all
of a sudden we are requiring this individual to plat and all of a sudden you have
Chanhassen Estates Third Addition and the guy next door wants to plat and you have
got a Chanhassen Estates Fourth Addition, Fifth Addition and on down the line for
each one of these that wants to split so I guess the interpretation that staff has
taken is that if we can get an easy to understand description on a platted lot and in
essense it is not a metes and bounds description because it is a longer description
of a platted parcel, I guess I am of the opinion that is easier to work with than
with requiring him to replat on a lot by lot split basis which could occur on all of
these duplexes. One of the reasons that I am of the opinion that a split of this
kind is easier to understand because the lots then continue to follow in natural
sequence.
Councilman Horn - Can't there be Lot 5A and Lot 5B.
Bill Monk - It would have to have a new name. It can't be the same plat. It would
have to be Chanhassen Estates Fourth Addition. If it's platted it would have to have
a separate legal by law. That's the problem you run into when you replat. If we can
get the description to something understandable, staff wishes to proceed in this
manner and that's why that provision in the ordinance was put in there.
Councilman Horn - We would have the same situation had we required a plat on the
Eide property. He would have come in with Eide Addition One and then as soon as

MINNEWASHTA GATE, SOUTHWEST CORNER OF HIGHWAYS 41 AND 7-L TOMAC DEVELOPMENT:
A. Land Use Plan Amendment Request to Change Low Density Residential
Land Use to Commercial.
B. Rezoning Request to Rezone Subject Property from R-1, Single Family
Residence to C-1, Office Building District and C-2, General Commercial.
C. Preliminary Plat Approval for the Subdivision of a 7_9 Acre Parcel into
Four Lots of 1.1, 1.91 1^4 and 2.0 Acres for Commercial Development.
Barb Dacy: The subject property is located at the southwest corner of Highway 7 and
Highway 41. It totals approximately 8 acres and is now zoned R-1, single family
residential. The request before you is 1) Land use plan amendment from low density
residential to commercial, 2) Rezoning from R-1 to C-2 and C-1 and 3) A preliminary
plat approval. There has been some history regarding this site. From what we could
research, in 1968, the area was designated as service commercial and in 1972, as a
part of the new zoning ordinance at that time, the property was rezoned to R-1 single
family. In 1983, there was a land use plan amendment request by Mr. Reutiman. This
request was denied in 1983. The subject request has been before the Planning Com-
mission and the City Council for a sketch plan review and twice before the Planning
Commission for these items on April 24, 1985 and May 22, 1985. The proposal was of
concern to the Planning Commission and to the neighborhood surrounding the subject
parcel. The Commission felt that the traffic design was a crucial part of the
design of the subdivision. I would like to review the traffic options that have been
discussed in regards to this proposal. When first presented during sketch plan
review, the applicants proposed a "T" intersection from Highway 7 closing Oriole
Lane, 'IT"-ing into a new frontage road that would connect the new street through the
subivision into the intersection of Oriole Lane. It was brought out during this
review that there was concern raised regarding the left turn movement as you go west
on Highway 7 and proceeding into the neighborhood. There was also concern raised on
this proposal because it would require the removal of the existing house there.
Therefore, option two was prepared by the applicants. You no longer have a "T"
intersection, but the Oriole access is closed and moved to the east. In the letter
from MnDot, they are suggesting and we are recommending that median improvements be
made on Highway 7 as well as right turn movements. It was felt that this option
achieved two objectives: 1) to separate the commerical and residential traffic,
meaning that there should be no reason why either direction on Highway 7 or 41 should
travel through the neighborhood. There would be access onto Highway 7 and easy onto
41. 2) To maintain, as much as possible, the existing traffic pattern. We have a
proposed connection from the existing Oriole Lane out onto Highway 7 and also keeping
the 64th Street access open. Another option that has been proposed is to confine the
access to the development from Highway 41. In the letter from MnDot, they stated
that a 600 foot distance to another major intersection on 41 would have to be main-
tained and also that 64th Street would have to be closed. In this option Oriole Lane
would be open and there would be no access onto Highway 7, access contained from 41.
The draw back to this particular option is that is does close 64th Street and there-
fore, another access point into and out of the neighborhood. Traffic would have to
come through the intersection and down into Oriole Lane. Another option that has
been proposed is to keep Oriole Lane open, close the frontage road and access onto
Highway 7 and create a cul-de-sac from 64th Street. While this, to some degree, con-
tains some commercial traffic, there is still the possible traffic pattern of commer-
cial traffic leaving the proposed area and passing through the neighborhood and going
to Oriole Lane to proceed west bound on Highway 7. A fifth option that has been pro-
posed would be to maintain the proposed access onto Highway 7 with the required
improvements; the median and the right turn lane, the access onto 64th Street onto
Highway 41, but closing off the frontage road and the Oriole Lane access. MnDot says
it has to be one or the other, we can't have two accesses onto Highway 7. This would r,
isolate the neighborhood and _still provide some sort of traffic from 64th Street into

we back up on that at this point we are renigging on a past commitment that we had
made and really all we are doing in this case is we are not changing any of the
guidelines of what Type A, B and C mean, all we are doing is changing the mix.
Councilman Gevin - Type C with the five and ten foot side yard setback was approved
for Type C only and we allowed that smaller lot size with the variation of the five
and ten so that the builder could have that capability of adjusting his house on the
lot. There was never any intention on my part of approving that for Type A and Type
B and I think if you look at the minutes of those meetings you will find that we
granted that for only Type C.
Councilman Horn - I was asking a question.
Bill Monk - I believe that Councilman Geving is correct. It is my understanding from
the minutes that five and ten were definitely approved for Type C. That is how they
are going in.
Councilman Horn - The way the report is written it would indicate that those setbacks
are all indicated under the background information. Nothing is mentioned about those
under the section marked proposed changes in the Staff report.
Barbara Dacy - I would apologize for the confusing situation there but during our
staff research on the background of it our records show that the five and ten foot
alternating setbacks were approved for the Type C. I think what that paragraph was
intending was to explain that the developer wanted to use the same setbacks.
Mayor Hamilton - My memory seems to be the same as Clarks.
Peter. Pflaum - We had a copy just like this that had the setbacks on it that was
approved.
Mayor Hamilton - We were going to review each phase but the approval was for five and
ten foot setbacks.
Bill Monk - I think Peter is right. Some of the earlier plans did say Phase A and C
and B would have the five and ten foot setbacks on either side but what we look at
when we go back to the minutes was actually approved by the Council not necessarily
what's on the plan. I know it's been discussed before. We could find no mention in
the Council minutes where the Council actually approved five and ten foot side yard
setbacks for anything but C. That maybe what people are remembering.
Mayor Hamilton - I am afraid I did not understand that to be a issue this evening.
We were talking about the swap of A's, B's, and C's.
Councilman Horn - Could I ask the developer, would this be a big issue for you in the
proper platting of Type B housing?
Peter Pflaum - The only reason we wanted it was for flexibility in locating the
houses on some particular situation. What I would suggest as maybe a way of getting
around this is that let us look, hopefully, you will approve the plat with the ten
and ten, let us look at it and see if we can live with that then there is no issue at
all. If we can't live with that then I guess we have to come back and talk to you.
It is very critical in the Type C lots.

Mayor Hamilton - Are people complaining that they are too close to each other?
Peter Pflaum - The first phase, the models opened in March so in 11 months we have
sold 45. I think it has been fairly well received.
Councilman Horn - I think they were a little close in that area but I don't know what
other option we had. If I compared that to what the alternate was which was quads or
something like that, I think this much more acceptable.
Councilwoman Swenson - You are loosing six condominium units and you are loosing 13
of the Type A which is even better.
Councilman Horn - I was comparing the Type C to what was proposed initially.
Councilwoman Swenson moved to accept the final development plan amendment for the
Near Mountain PRD, Planning Case 79-2, PUD, with the City Engineer's proposed amend-
ment to the plan dated January 15, 1985, with the ten and ten side yard setbacks,
25 foot front yard setback, and Planning Commission recommendations 1-3. Motion
seconded by Mayor Hamilton.
Councilman Horn - This does not cover the Type A, this is Type B at this time?
Barbara Dacy - There may be a certain number of A units as the plans progress that
are developed and on the plan the Type A lots are to be constructed at setbacks of 30
in the front and 10 on each side as it is now in the R-lA. The Type B units are 25
in the front and as your motion, ten and ten.
Mayor Hamilton - They are asking for an amendment to final development approval which
was given some time ago. This is just an amendment and really the amendment is for
the swap of the A's and B's and condos.
Councilman Horn - We are approving both the areas indicated in A and B?

Barbara Dacy - As you approach the 101 and Highway 5 intersection from the east, the
City sign is blocking the applicant's sign which is the reason why he is applying for
a variance. What he is requesting is two variances, one for an additional free
standing sign and a free standing sign to be located off the premises. Each sign is
proposed to measure 32 square feet. The additional free standing sign on the appli-
cants property is proposed to be located near the existing City sign. The other sign
is proposed to be located where the Chanhassen Center Building is on the north side a

Dear Peter and Mike:
I am in receipt of the City of Shorewood's letter wherein they
state no objection to your reviewing all possible means to pro-
vide water service to that portion of the Near Mountain
Development lying within the City of Shorewood (copy attached).
I believe this letter meets the "courtesy" question I posed
approximately 30 days ago, i.e:
"Would the City of Chanhassen consider providing water ser-
vice to your development lying within Shorewood? You noted
that finding an economical means to provide water service to
this development was critical to its success. Further, the
City of Shorewood does not have municipal water service
that could be made available to your development nor,
following problems incurred by them this past year, is it
feasible to consider that such service would be available
within the foreseeable future. Finally, you stated your
knowledge of the fact that the City of Chanhassen was in the
process of starting a feasibility study to analyze our
current and future water capabilities/deficiencies. You
asked if this study could be modified to include the question
of the feasibility providing water service to your develop-
ment."
As I noted earlier, I believe the attached letter from the City
of Shorewood meets the "courtesy" issue discussed during our
telephone conversation.
I would like to place this item on the City Council agenda for
October 15, 1984. I would ask that you attend this meeting to
present your request. As I understand such, the request would
solely be one of asking the City of Chanhassen to expand the
current feasibility study to include determining the feasibility
of providing water service to your properties lying within the

City of Shorewood. It is my understanding that the City of
Shorewood has been notified that the City of Chanhassen would
solely be considering water service for your development. The
City of Chanhassen could not consider making this type of an
extension across the entire length of our borderline with
Shorewood without significantly changing the scope of the study
currently being considered.
The issue to be presented on October 15th is a policy question to
be determined by the Chanhassen City Council. Please notify me
if this date is inconvenient. I could schedule this item for
November 5, 1984.

Dear Mr. Ashworth:
The developers of the Near Mountain residential development, which bounds
through an area of both of our cities, appeared before the Shorewood City
Council on September 24, 1984, to discuss several matters. One of these
matters relates to the City of Chanhassen which is the reason for my
correspondence to you.
As you may be aware, the City of Shorewood has several developers interested
in developing the southeast section of the City. With this development
comes the question of water service to the area. With several Council
meetings devoted to discussion of a water system for this area, the City
Council of the City of Shorewood at its meeting held on September 10, 1984,
passed the following Resolution:
"The Citizens of Shorewood will obtain water by means of individual
.private wells or privately owned community wells until the Citizens
demand municipal water or if the private supply is threatened by shortage
or contamination and when the City can economically afford to provide
municipal water. This policy is not intended to prohibit the purchase
of water from existing municipal facilities at the resident's request".
With this policy in place as to municipal water, the Near Mountain
developers (Peter and Mike Phlaum) questioned if the City of Shorewood
would allow the Near Mountain development located in Shorewood to be
served by municipal water coming from the City of Chanhassen. This, of
course, is dependent upon Chanhassen's support of this proposal. Based
upon Shorewood's policy stating no municipal water at this time, the
Shorewood City Council unanimously supports efforts by the Phlaum's to
obtain municipal water for Near Mountain (Shorewood) from the City of
Chanhassen.
