SUBJ: Possible Code Violations In The Area Of Trappers Pass
4th Addition
Paul,
I have been working on a matter involving code violations in the
area that I have indicated on the attached section map. In
talking with Councilman Johnson, I understand that this area
may be platted in the future.
I am writing you this memo to advise you that a significant
number of code violations possibly exsit on this property,
including many cars being stored on the property, illegal
outside storage, etc., etc., etc. I have initiated, with Jay's
help, efforts io obtain voluntary compliance in cleaning the
property up; however, if my information is correct that
Lundgren Brothers owns the property, as well as one possible
private owner, the platting process may provide an excellent
opportunity to obtain compliance.
Would you keep me in mind as this potential platting progresses.

Dear Mike:
On March 26, 1990, the City Council approved the final plat for
Trappers Pass at Near Mountain =th Addition with the following
conditions:
1. A tree removal plan shall be provided at the time of building
permit application for Lots 1-5, Block 1, Lots 1-71 Block 2
and Lots 1-8, Block 3.
2. Compliance with the conditions of the wetland alteration
permit.
3. All erosion control measures shall be in place prior to the
initiation of any grading, and once in place shall remain in
place throughout the duration of construction. All of the
erosion control measures shall remain intact until an
established vegetative cover has been produced, at which time
removal shall be the responsibility of the developer. All
erosion control shall be Type III.
4. Wood fiber blankets or equivalent shall be utilized to
stabilize slopes greater than 3:1.
5. All street and utility improvements shall conform to the
City's standards for urban construction.
6. The applicant shall submit for approval by the City Engineer
details for the construction of the barricade on the dead end
and temporary turnaround of Trappers Pass between Outlot A and
Lot 1, Block 1 and Lot 8, Block 3. In addition, a sign shall
be posted on the barricade indicating that "This street shall
be extended in the future".

7. Details for the construction of the proposed retaining wall
along both sides of Trappers Pass dead end shall be submitted
as a part of the plans and specifications review for approval
by the City Engineer.
8. All appropriate drainage and utility easements along the side,
front and rear of the lots in addition to all appropriate
drainage and utility easements for ponding sites and storm
sewer facilities shall be shown on the final plat.
9. All driveways shall access internal streets to the
subdivision. No driveways shall be allowed to access Pleasant
View Road.
10. The final plat shall describe the ponding area within Block 2
as a drainage and utility easement.
11. On Lot 1, Block 2 an existing storm sewer line intersects the
east corner of the lot. A 20 foot wide drainage and utility
easement, 10 feet on each side of the line, shall be dedicated
on the final plat.
12. A storm sewer line is proposed through Lots 2, 3, 4 and 5,
Block 2. A 20 foot wide drainage and utility easement shall
be dedicated along the lot lines on the final plat to reserve
enough room for the City to perform maintenance on the line
and the ponding area.
13. The applicant shall submit for approval detailed construction
plans and specifications to the City Engineer. Any conditions
from plans and specifications review that may impact the plat
shall be incorporated into the plat, i.e. additional
easements.
14. The applicant shall enter into a development contract with the
City and provide the City with the necessary financial
sureties prior to commencement of any construction or grading.
15. The applicant shall obtain and comply with all conditions of
the Watershed District permit.
16. The applicant shall stake the 75 foot wetland setback line
(Lots 1-4, Block 3) with iron monuments.
As we discussed, if there are certain lots that are required to
have a tree removal plan which actually do not have trees, staff
will confirm such at the time of the building permit application.

Don Ashworth: If I may Mr. Mayor, Tom had stopped in earlier questioning the
wine license as it appears in the Council's packet. We show the fee for that as
$2,000.00. We took that from State Statute and if you see by the handout I
distributed, it appears to be saying that the fee will be $2,000.00 or 1/2 of
the on -sale license. Since on -sale licenses range from s8,000.00 to $13,000.00,
1/2 of that would be far more than the $2,000.00 we're showing. The key word

This is to follow up on our conversation this morning regarding the
inadvertent addition of two lots to the list, compiled at the time of
Preliminary Plat approval, of lots in Trappers Pass 3rd Addition for
which tree removal plans were to be required.
Condition #1 of the March 21, 1990, Staff Recommendation to the City
Council extends this requirement to all of the lots in subject Final
Plat. You will note, however, that tree removal plans had not been
required for Lots 1-6, Block 4, of the Trappers Pass 3rd Addition
Preliminary Plat. Lots 1 & 2, Block 3, Trappers Pass 4th Addition,
occupy the same area as Lots 5 & 6, Block 4, of the Preliminary Plat.
As I pointed out, and you or your representative may wish to verify
personally, there are no trees on these lots.
I would appreciate it if you would place a copy of this letter in the
Building Department file for this subdivision, in the hope that by so
doing we will prevent any delay in the issuance of the applicable
permits.

Re: Proposed Street Name Change in Trappers Pass
at Near Mountain 3rd Addition
Dear Paul:
Lundgren Bros. Construction herewith petitions Chanhassen to re -name
that portion of Oxbow Bend which lies to the west of Timber Hill Road
in subject plat. We now believe that this, too, should be called
Timber Hill Road.
When Summit at Near Mountain (the "mountaintop") is developed, most of
its homeowners, prospective buyers and visitors will use the Timber Hill
Road entrance to Near Mountain as their primary access. If they need
only follow Timber Hill Road to their destie.tion, there is certain to
be less potential for confusion.
With no name change and the street realignment which we have incorporated
in the proposed Trappers Pass at Near Mountain 4th Addition plat, one
would take Timber Hill Road to Oxbow Bend, and Oxbow Bend to the top of
the mountain. Oxbow Bend does not seem as appropriate a name for the
street which makes this climb as Timber Hill Road would be. (Prior to
the alignment change the route would have been Timber Hill Road - to -
Oxbow Bend - to - Trappers Pass. While not as appropriate as Timber Hill
Road, Trappers Pass would have been better than Oxbow Bend.)
There are only two lots in Trappers Pass 3rd Addition which this
proposed re -naming would affect, Lot 1, Block 3, and Lot 3, Block 1, and
neither has yet been sold.
Please advise me of what we must do to effectuate this proposal.

Re: Summit at Near Mountain (Amendment of the Near Mountain P.R.D.
Preliminary Plat and Final Development Plan)
Dear Paul:
On September 13, 1989, the Chanhassen City Council approved Lundgren
Bros. Construction's proposed amendment of the Near Mountain P.R.D. to
substitute 43 large single family lots for 114 multi -family attached
living units.
A provision of the Chanhassen Subdivision Ordinance, I believe,
stipulates that if a final plat is not filed within six months of the
City Council action approving the preliminary plat, the approval of
that preliminary plat is rescinded.
Inasmuch as development of Summit is dependent upon the extension of
utilities and streets through Outlots A and C of Trappers Pass at Near
Mountain 3rd Addition, an area we are only now preparing to develop,
it would be decidedly premature for Lundgren Bros. Construction to
file a Summit final plat by March 13, 1990, the last day before its
preliminary plat approval would expire.
We accordingly herewith request that Chanhassen approve the maximum
extension of the deadline for the filing of the Summit at Near
Mountain final plat which its ordinances will permit.

The City has received your request to rename a portion of Oxbow
Bend to Timber Hill Road. The portion of Oxbow Bend proposed to be
renamed connects with Timber Hill at a "T" intersection. Since
there is not a smooth continuity: between the two road alignments,
staff would not recommend renaming the portion of Oxbow Bend to
Timber Hill Road. Planning Staff has received the same
recommendation from both the Engineering and Public Safety
Departments.

BACKGROUND
On April 25, 1988, the City Council, approved the preliminary plat
for Trappers Pass at Near Mountain to subdivide 32Z acres into 34
single family lots (Attachment #1). The preliminary plat was
approved with the following conditions:

permit application for Lots 1-5, Block 1, Lots 1-11, Block 2
Lot 1, Block 3 and Lots 7-14, Block 4.
2. Compliance with the conditions of the wetland alteration
permit.
3. The developer shall enter into a development contract with the
City and provide the necessary financial sureties to guarantee
the proper installation of these improvements.
4. The developer shall obtain and comply with all conditions of
the Watershed District permit and the permit from the
Department of Natural Resources.
5. All erosion control measures shall be in place prior to the
initiation of any grading, and once in place shall remain in
place throughout the duration of construction. All of the
erosion control measures shall remain intact until an
established vegetative cover has been produced, at which time
removal shall be the responsibility of the developer.
6. Wood fiber blankets or equivalent shall be utilized to

9. Type II erosion control shall be placed on the upstream side
of the Class B wetland along the rear of Lots 1-9, Block 4.
The City's standard detail for the installation of Type II
erosion control (staked bales and snow fence) shall be placed
on the grading plan.
10. Details for the construction of the proposed retaining wall
along both sides of Trappers Pass dead end shall be submitted
as a part of the plans and specifications review for approval
by the City Engineer.
11. Lots 15 and 16 of Block 4, as depicted on Sheet No. 1 of the
plan set dated February 18, 1988, shall be revised to show the
correct property boundaries.
12. The driveway for Lot 16, Block 4, shall be constructed such
that it forms a "T" intersection with Valhalla and Iroquois
Avenue.
13. The plans and specifications shall show a drainage swale along
the common lot line of Lots 1 and 2, Block 4 which will serve
as an emergency overflow swale for the ponding site of Lot 2,
Block 3.
14. All appropriate drainage and utility easements along the side,
front and rear of the lots, in addition to all appropriate
drainage and utility easements for ponding sites and storm
sewer facilities shall be shown on the final.
15. All private drives shall access internal streets to the
subdivision. No driveways shall be allowed to access Pleasant
View Road.
16. The outlet configuration shall be further reviewed at the time
of plans and specifications submittal and design adjustments
made accordingly, if necessary, to facilitate proper
conveyance of storm water under Pleasant View Road.
On February 27, 1989, the City Council approved the final plat for
Trappers Pass at Near Mountain 3rd Addition (Attachment #2). The
final plat was approved with the following conditions:

1. The applicant shall enter into a development contract
agreement with the City and provide necessary financial
sureties.
2. Lots 1-3, Block 1, and Lot 1, Block 2, shall provide a tree
removal plan at time of building permit application.
3. Lot 1, Block 4 and Lot 1, Block 5 shall be amended on the
final plat so that the lot lines are longer within the street
right-of-way.
4. The driveway for Lot 1, Block 4 shall be constructed so as
that it forms a "T" intersection with Valhalla and Iroquois
Avenue.
5. The most northerly lot of Block 3 (shown as Lot 3) should
become Lot 1 and shown on the amended on the final plat.
6. The applicant shall meet all of the conditions of approval of
the preliminary plat and wetland alteration permit.
7. The applicant will revise notes on the plan referring to the
sheets within the final plat documents so that the references
are correct as to the number of sheets in the plans.
The applicant is proposing to final plat the remaining lots in
Trappers Pass (Attachment #3 shows the proposed area for final
platting as the outlot). The preliminary plat contained 23 single
family lots, some of which are adjacent to a Class B wetland. The
applicant is proposing to amend the preliminary plat by realigning
Oxbow Bend and moving the Rojina Lane cul-de-sac. The proposed
amendment reduces the number of lots to 20, straightens Oxbow Bend
and provides more separation between the lots and the Class B
wetland. Attachment #4 overlays the proposed changes onto the
original plat. (The proposed plat is in bold lines.) Since the
changes to the plat were minor and actually improved the road
alignment and preservation of the wetland, staff agreed the
amendments could be part of the final plat rather than going back
through the preliminary plat process.
The 20 lots meet or exceed the lot areas and zoning ordinance
requirements of the original plat. The new lot configuration for
Lots 1, 2, 3 and 4, Block 3 provides more separation between the
building sites and the 75 foot wetland setback. There is a remnant
piece shown as Outlot A which should be combined with the adjoining
lot to the west as part of Summit Pass final plat.

STAFF RECOMMENDATION
Staff recommends the City Council adopt the following motion:
"The City Council approves the final plat for Trappers Pass at Near
Mountain 4th Addition as shown on the plat dated March 9, 1990, and
subject to the following conditions:
1. A tree removal plan shall be provided at the time of building
permit application for Lots 1-5, Block 1, Lots 1-7, Block 2
and Lots 1-8, Block 3.
2. Compliance with the conditions of the wetland alteration
permit.

species of wildlife feeding in shallow water (0.5 - 3.0
feet) and (b) encourage growth of emergent vegetation in
areas of shallow water and thereby increase interspersion
of open water with emergent vegetation.
d. The basin will have a layer of topsoil (muck from an
existing wetland being filled) on bottom of basin to pro-
vide a suitable substrate for aquatic vegetation.
e. The basin will have water level control (culverts, riser
pipe, etc.) to minimize disturbances of wildlife using
the wetland.
f. The basin will have fringe of shrubs on upland
surrounding the basin to minimize disturbances of
wildlife using the wetland.
2. Upon submission of plans and specifications for construction
of the pond within the Class B wetland, the applicant shall
provide details on area of construction for the pond within the
wetland and how the remaining wetland will be preserved.
3. The erosion control fence shall be continued across Lots 7
and 8, Block 4 to completely protect the wetland from any
construction activity.
4. All structures adjacent to the wetland (Lots 1-9, Block 4)
must meet the 75 foot setback from the edge of the wetland.
5. The developer shall provide deed restrictions prohibiting ,
alteration of the wetland area on Lots 1 through 9, Block 4,
beyond the 914 elevation. \
6. The developer shall make every effort in it's pond design to
improve the wetland and make the wetland an attractive useful
wildlife habitat.
Please be advised that preliminary plat approval is valid for one

Upon review of the final plat for Trappers Pass at Near Mountain
4th Addition prepared by Sathre-Bergquist, Inc., stamped
"Received March 21, 1990", I offer the following comments:
As you may recall, due to constraints with topography in portions
of this development, street grades will be in excess of the
City's maximum requirement of 7% slope. The street grades will
range from 0 .6 % to 10 % in grade. The 10 % grade is through the
intersection of Oxbow Bend and Trappers Pass. This could create
slippery conditions during the winter months. However, again due
to the topography, it is very difficult to design a street with a
lower percent of grade without trade-offs, i.e. excessive grading
which would require additional tree loss.
The applicant is proposing retaining walls along the area of the
10% grade to reduce the amount of tree removal and grading. The
retaining walls are proposed to be constructed with large
boulders which will be located outside of the City's right-of-
way. Therefore, maintenance of the retaining walls will be the
responsibility of the property owner.
The overall plat is generally acceptable with the following
conditions and recommendations:
1. The final plat shall describe the ponding area within Block 2
as a drainage and utility easement.
2. On Lot 1, Block 2, an existing storm sewer line intersects
the east corner of the lot. A 20-foot wide drainage and
utility easement, 10 feet on each side of the line, shall be
dedicated on the final plat (see Attachment No. 1).

This is to confirm that on September 13, 1989, the City Council
approved the PUD Amendment to replace 114 condominium units with
45 single family lots with the following conditions:
1. The applicant provide a plan showing the exact location of
the Class A wetlands adjacent to Lots 1, 2, and 3, Block 2
and adjacent to Silver Lake and that the final plat would
provide a drainage easement over.the protected wetlands.
2. A tree removal plan approved by the DNR Forester and City
Staff will be required for each lot in the subdivision prior
to the issuance of a building permit. There shall be no
clearcutting permitted for any lot except for the placement
of the house pad and utilities. Clearcutting is defined as
removal of any vegetation with a 4" caliper or more at four
feet in height.
3. A conservation easement will be provided at the 945 contour
along Lots 1 through 7, Block 2 and the 910 contour on Lots 8
and 9, Block 2. The area below the 945 and 910 contour,
including the wetland and shoreland, will not be permitted to
be altered.
4. Lots 3 through 9, Block 2 which have lakeshore on Silver Lake
will not be permitted to have docks accessing Silver Lake
without receiving a wetland alteration permit.
5. Development of this site shall not take place until roadway
and utility improvements have been completed on Outlot A.
6. The applicant shall obtain and comply with all conditions of
the Watershed District permit.

7. Detailed construction plans and specifications including
calculations for sizing utility improvements shall be sub-
mitted for approval by the City Engineer. As -built mylar
plans will also be required upon completion of the
construction.

20. The developer dedicate 4.5 acres for park purposes including

21. Provide a conservation easement over the 30 foot section of

22. Work with the city to properly finish off the end of the
Iroquois including a turn around.
23. Direct staff to review the possibility of integration of
trails into an overall trail plan if possible.
24. Check whether Lots 8 or 9 as part of the park dedication, is
to maintain a trail on Outlot B as far removed from the
people's lot in question as possible so as not to be intru-
sive with their back yard.
25. The developer shall work with staff to develop some assurance
through the use of covenants or whatever, who is responsible
to maintain the retaining walls.
26. All lots shall conform with any future tree protection ordi-
nances.
27. The applicant shall redefine the triangular lot.
28. All trees to be saved shall be staked off prior to issuance
of building permits and approved by the DNR Forester and City

e. The basin will have water level control (culverts, riser
pipe, etc.) to minimize disturbances of wildlife using
the wetland.
f. The basin will have fringe of shrubs on upland
surrounding the basin to minimize disturbances of
wildlife using the wetland.
2. Upon submission of plans and specifications for construction
of the pond within the Class B wetland, the applicant shall
provide details on area of construction for the pond within the
wetland and how the remaining wetland will be preserved.
3. The erosion control fence shall be continued across Lots 7
and 8, Block 4 to completely protect the wetland from any
construction activity.
4. All structures adjacent to the wetland (Lots 1-9, Block 4)
must meet the 75 foot setback from the edge of the wetland.
5. The developer shall provide deed restrictions prohibiting
alteration of the wetland area on Lots 1 through 9, Block 4,
— beyond the 914 elevation.
6. The developer shall make every effort in it's pond design to
improve the wetland and make the wetland an attractive useful
wildlife habitat.
Please be advised that preliminary plat approval is valid for one
year. Please contact Gary Warren regarding execution of the
development contract for this project. You may submit a final
plat for approval by the Council. Please'submit the final plat
two weeks in advance of the Council meeting at which it is to be
considered. The plat would be approved subject to execution of
the development contract and submission of the financial securi-
ties.

Willow Ridge Addition as amended on page 14, condition 10 deleting the first
sentence and directing staff to meet with the applicant in regard to discussions

Charles Folch: Mr. Mayor, members of -the Council. Just one quick clarification
on page 12 of your staff report. Condition a as it relates to the construction
of an emergency access. The paragraph should read, it should be changed to
read. Instead of the public, it should be changed to read, a Class V street
shall be extended from the permanent Phase I construction of Ox Bow Bend to the
emergency access and then it continues on as stated. Basically what's happening
here is, the emergency access from Iroquois to the future Ox Bow Bend will be
paved. The developer has agreed to pave that entrance and the remaining
portion, which would be about 250 feet between where Phase I of Iroquois ends,
permanent construction to this emergency access, would be constructed with Class
V to our standards. Basically because the utilities improvements will not be
installed at this point in time.
Mayor Chmiel: Alright. Thank you. With that clarification is there any other
discussion? I would make that motion for item 1(c).
Councilwoman Dimler: Second.

Councilman Workman: Mr. Mayor, I don't have a problem with approval of the
1992/93 liquor licenses, although it has brought to my attention the last time
we discussed approving a liquor license, the one at 7 and 41, and a comment was
raised by a Councilmember that we have too many liquor .stores and I had noted at
the time that well we only have one liquor store in town but when I kind of
assumed that when we say we have too many liquor stores, it means society and
that was a whole different other argument. But it did raise the question to me

On September 10, 1990, the City Council approved a final plat
extension for Summit at Near Mountain (Lundgren Brothers) until
January 13, 1991. The extension was granted because of the poor
economic conditions affecting housing development. Those economic
conditions still exist and Lundgren Brothers is again requesting an
extension to final plat Summit at Near Mountain.
Staff is recommending that the City Council approve a one year
extension for final platting Summit at Near Mountain addition. A
final plat for Summit at Near Mountain will be required by January
11, 1993.

Preliminary Plat approval of subject phase of the Near Mountain PUD
(612)473-1231 to January 13, 1992. This letter is Lundgren Bros.' request that the
Preliminary Plat approval be further extended.
As you are already aware, 1991 has been a difficult year for home
builders. Although all price brackets have been affected,.the more
expensive "executive" category (about $300,000 and up) has been
particularly hard hit. Trappers Pass 4th Addition and Summit at Near
Mountain are both intended for this segment of the market. If both
were available concurrently, our lot supply would greatly outstrip
consumer demand.
Lundgren Bros.' intention has been to delay development of the first
Addition of Summit until the majority of the lots in Trappers Pass_
4th Addition have been sold, but, to date, only four of the twenty
Trappers Pass 4th Addition lots have been sold. (Weather related
delays in the physical development of the site and consumer queasi-
ness over economic instability are the primary causes.)
Our current expectation is that there will be sufficient Trappers
Pass 4th Addition sales over the winter months to warrant development
of the first 'addition of Summit in the coming year. We can not yet
be certain of this, however, and believe that it would be imprudent
to prepare a final plat and construction plans before we are able to
determine how many lots the first phase should comprised of. I
accordingly am requesting that the deadline for submitting this final
plat be again extended for as long as your ordinances will permit.

On September 13, 1989, the City Council approved the preliminary
plat for Summit at Near Mountain (Lundgren Brothers). The
preliminary plat is valid for one year by which time the final plat
must be submitted to and approved.by the City Council.
Mike Pflaum from Lundgren Brothers Construction has requested an
extension to the preliminary plat approval. Summit at Near
Mountain is a phase of the Near Mountain/Trappers Pass PUD which
was to follow development of Trappers Pass 4th Addition. Due to
the reduced demand for upper bracket housing, development of
Trappers Pass 4th Addition will not begin until this fall, which
further pushes back development of Summit at Near Mountain.
The City Council has granted extensions to preliminary plat
approvals when circumstances do not allow the development to
progress as soon as planned. Since Lundgren Brothers are
developing the property in a timely manner and the market for
housing has slowed down, staff has no objection to extending the
preliminary plat approval.

housing has softened. As a consequence, Lundgren Bros. has delayed

fall, at the earliest, and will be unable to consider proceeding with
the Summit project before 1991.
I accordingly herewith petition the Chanhassen City Council to extend

On September 13, 1989, the Chanhassen City Council approved Lundgren

A provision of the Chanhassen Subdivision Ordinance, I believe,
stipulates that if a final plat is not filed within six months of the

Inasmuch as development of Summit is dependent upon the extension of
utilities and streets through Outlots A and C of Trappers Pass'at Near
Mountain 3rd Addition, an area we are only now preparing to develop,
it would be decidedly premature for Lundgren Bros. Construction to
file a Summit final plat by March 13, 1990, the last day before its

5. Time of Performance. The Developer shall install
all required improvements by July 31, 1992. The Developer may,
however, request an extension of time from the City. If an
extension is granted, it shall be conditioned upon updating the
security posted by the Developer to reflect cost increases and
the extended completion date..

This breakdown is for historical reference; it is not a
restriction on the use of the security. The security shall be
subject to the approval of the City. The security shall be for a
term ending December 31, 1992. The City may draw down the
security, without notice, for any violation of the terms of the
Contract. If the required public improvements are not completed
at least thirty (30) days prior to the expiration of the
security, the City may also draw it down. If the security is
drawn down, the draw shall be used to cure the default. With
City approval, the security may be reduced from time.to time as
financial obligations are paid, but in no case shall the security
be reduced to a point less than 10% of the original amount until
all improvements are complete and accepted by the City.
7. Notices. Required notices to the Developer shall

Dear Mr. Pflaum:
On February 8, 1993, the City Council approved The Summit at Near Mountain 2nd Addition
Final Plat as shown on plans prepared by Sathre-Bergquist, Inc. stamped January 22, 1993, with
the following conditions:
1. A tree removal plan approved by city staff will be required for each lot in the subdivision
prior to the issuance of a building permit. There shall be no clearcutting permitted for
any lot except for the placement of the house pad and utilities. Clearcutting is defined
as removal of any vegetation with a 4" caliper or more at four feet in height.
2. A conservation easement shall be provided at the 945' contour along Lots 1-4, Block 4.
The area below the 945' contour, including the wetland and shoreland, will not be
permitted to be altered.
3. Lots 3 and 4, Block 4, which have lakeshore on Silver Lake, will not be permitted to
have docks accessing Silver Lake without receiving a wetland alteration permit.
4. The applicant must receive and comply with conditions of final construction plans and
specification approval from the City Council. All street and utility improvements shall
conform to the city's 1993 Standard Specifications and detail plates.
5. Wood fiber blankets or equivalent shall be utilized to stabilize slopes greater than 3:1.
6. Additional spot elevations and necessary grading plan contours shall be provided with the
building permit application for proper surface drainage around proposed buildings and
driveway grade.

7. The applicant shall enter into a development contract with the city to provide the city
with the necessary financial sureties to guarantee the proper installation of the
improvements.
8. The applicant shall notify property owners of their maintenance responsibilities and
ownership of the boulder retaining wall by means of covenants and verbiage in the chain
of title and the secondary emergency access to Indian Hills Road (Iroquois).
9. All lots shall conform with any future tree protection ordinances.
10. The City and watershed district will require that individual lot grading plans be submitted
for all lots proposed along the "outside" perimeter of Oxbow Bend with the exception of
Lots 1 and 2, Block 1. Upon review of the individual lot grading plan, including soils
information, the district may require that roof runoff drainage systems be installed to
minimize the potential of an erosion problem occurring along the steep slope areas.
11. Upon completion of construction and restoration of all areas disturbed, the applicant is
responsible for the removal of all erosion control measures installed throughout the site.
Two mylars may be submitted, along with 1" equals 200' and 1" equals 500' scale reduction

Pursuant to your request I have reviewed our files and found the
following items need to be completed prior to final plat recording
or proceeding with construction of the above -mentioned subdivision.
1. The developer should replace page SP-2 in the Development
Contract with the attached page. This modification
extends the time of performance and security requirements
1 year. This extension is being incorporated to allow
for sufficient time to complete installation of the final
bituminous wear course next year.
2. The developer applicant needs to enter into the
Development Contract with the City and provide the City
with the necessary financial guarantees and
administrative fees.
3. The final plat needs to be amended to reflect the City
Council's conditions of approval stated in your letter to
Lundgren Brothers Construction dated April 3, 1990 (see

Dear Mike:
On March 26, 1990, the. City -Council approved the final plat for
Trappers Pass at Near Mountain 4th Addition with the following
conditions:
1. A tree removal plan shall be provided at the time of building
permit application for Lots 1-5, Block 1, Lots 1-7, Block 2
and Lots 1-8, Block 3.
2. Compliance with the conditions of the wetland alteration
permit.
3. All erosion control measures shall be in' place prior to the
initiation of any grading, and once in place shall remain in
place throughout the duration of construction. All of the
erosion control measures shall remain intact until an
established vegetative cover has been produced, at which time
removal shall be the responsibility of the developer. All
erosion control shall be Type III.
4. Wood .fiber blankets or equivalent shall be utilized to
stabilize slopes greater than 3:1.
5. All street and utility improvements shall conform to the
City's standards for urban construction.
6. The applicant shall submit for approval by the City Engineer
details for the construction of the barricade on the dead end
and temporary turnaround of Trappers Pass between Outlot A and
Lot 1, Block 1 and Lot 8, Block 3. In addition, a sign shall
be posted on the barricade indicating that "This street shall
be extended in the future".

7. Details for the construction of the proposed retaining wall
along both sides of Trappers Pass dead end shall be submitted
as a part of the,plans and specifications review for approval
by the.City Engineer.
8.. All appropriate drainage and utility easements along the side,
front and rear of the lots in addition to all appropriate
drainage and utility easements for ponding sites and storm
sewer facilities shall be shown on the final plat.
9. All driveways shall access internal streets to the
subdivision. No driveways shall be allowed to access Pleasant
View Road.
10. The final plat shall describe the ponding area within Block 2
as a drainage and utility easement.
il. On Lot 1, Block 2 an existing storm sewer line intersects the
east corner of the lot. A 20 foot wide drainage and utility
easement, 10 feet on each side of the line, shall be dedicated
on the final plat.
12. A storm sewer line is proposed through Lots 2, 3, 4 and 5,
Block 2. A 20 foot wide drainage and utility easement shall
be dedicated along the lot lines on the final plat to reserve
enough room for the City to perform maintenance on the line
and the ponding area.
13. The applicant shall submit for approval detailed construction
plans and specifications to the City Engineer. Any conditions
from plans and specifications review that may impact the plat
shall be incorporated into the plat, i.e. additional
easements.
14. The applicant shall enter into a development contract with the
City and provide the City with the necessary financial
sureties prior to commencement of any construction or grading.
15. The applicant shall obtain and comply with all conditions of
the Watershed District permit.
16. The applicant shall stake the 75 foot wetland setback line
(Lots 1-4, Block 3) with iron monuments.
As we discussed, if there are certain lots that are required to
have a tree removal plan which actually do not have trees, staff
will confirm such at the time of the building permit application.

While I believe we have attended to everything that is
necessary from your end, I would like you to check and make
sure --while we can still attend to unfinished business
without causing a delay.
The Trappers Pass 4th Addition Final Plat was approved March
26, 1990, and the Development Contract and construction
plans were approved April 10, 1990. We received amended
copies of the development agreement the first week of June,
but have not yet signed and returned the document.
Will we need an extension of our earlier approvals if we are
unable to close our land development loan (which is when we
would record the plat) before the end of April?
