Public_ Safety Director DATE: May 24, 1990 SUBJ: Possible Code Violations In The Area Of Trappers Pass 4th Addition Paul, I have been working on a matter involving code violations in the area that I have indicated on the attached section map. In talking with Councilman Johnson, I understand that this area may be platted in the future. I am writing you this memo to advise you that a significant number of code violations possibly exsit on this property, including many cars being stored on the property, illegal outside storage, etc., etc., etc. I have initiated, with Jay's help, efforts io obtain voluntary compliance in cleaning the property up; however, if my information is correct that Lundgren Brothers owns the property, as well as one possible private owner, the platting process may provide an excellent opportunity to obtain compliance. Wayzata Boulevard Wayzata, MN 55391 Dear Mike: On March 26, 1990, the City Council approved the final plat for Trappers Pass at Near Mountain =th Addition with the following conditions: 1. A tree removal plan shall be provided at the time of building permit application for Lots 1-5, Block 1, Lots 1-71 Block 2 and Lots 1-8, Block 3. 2. Compliance with the conditions of the wetland alteration permit. 3. All erosion control measures shall be in place prior to the initiation of any grading, and once in place shall remain in place throughout the duration of construction. All of the erosion control measures shall remain intact until an established vegetative cover has been produced, at which time removal shall be the responsibility of the developer. All erosion control shall be Type III. 4. Wood fiber blankets or equivalent shall be utilized to stabilize slopes greater than 3:1. 5. All street and utility improvements shall conform to the City's standards for urban construction. 6. The applicant shall submit for approval by the City Engineer details for the construction of the barricade on the dead end and temporary turnaround of Trappers Pass between Outlot A and Lot 1, Block 1 and Lot 8, Block 3. Details for the construction of the proposed retaining wall along both sides of Trappers Pass dead end shall be submitted as a part of the plans and specifications review for approval by the City Engineer. 8. All appropriate drainage and utility easements along the side, front and rear of the lots in addition to all appropriate drainage and utility easements for ponding sites and storm sewer facilities shall be shown on the final plat. 9. All driveways shall access internal streets to the subdivision. No driveways shall be allowed to access Pleasant View Road. 10. The final plat shall describe the ponding area within Block 2 as a drainage and utility easement. 11. On Lot 1, Block 2 an existing storm sewer line intersects the east corner of the lot. A 20 foot wide drainage and utility easement, 10 feet on each side of the line, shall be dedicated on the final plat. 12. A storm sewer line is proposed through Lots 2, 3, 4 and 5, Block 2. A 20 foot wide drainage and utility easement shall be dedicated along the lot lines on the final plat to reserve enough room for the City to perform maintenance on the line and the ponding area. 13. The applicant shall submit for approval detailed construction plans and specifications to the City Engineer. Any conditions from plans and specifications review that may impact the plat shall be incorporated into the plat, i.e. additional easements. 14. The applicant shall enter into a development contract with the City and provide the City with the necessary financial sureties prior to commencement of any construction or grading. 15. The applicant shall obtain and comply with all conditions of the Watershed District permit. 16. The applicant shall stake the 75 foot wetland setback line (Lots 1-4, Block 3) with iron monuments. As we discussed, if there are certain lots that are required to have a tree removal plan which actually do not have trees, staff will confirm such at the time of the building permit application. Condition #1 of the March 21, 1990, Staff Recommendation to the City Council extends this requirement to all of the lots in subject Final Plat. You will note, however, that tree removal plans had not been required for Lots 1-6, Block 4, of the Trappers Pass 3rd Addition Preliminary Plat. Construction herewith petitions Chanhassen to re -name that portion of Oxbow Bend which lies to the west of Timber Hill Road in subject plat. We now believe that this, too, should be called Timber Hill Road. When Summit at Near Mountain (the "mountaintop") is developed, most of its homeowners, prospective buyers and visitors will use the Timber Hill Road entrance to Near Mountain as their primary access. If they need only follow Timber Hill Road to their destie.tion, there is certain to be less potential for confusion. With no name change and the street realignment which we have incorporated in the proposed Trappers Pass at Near Mountain 4th Addition plat, one would take Timber Hill Road to Oxbow Bend, and Oxbow Bend to the top of the mountain. Oxbow Bend does not seem as appropriate a name for the street which makes this climb as Timber Hill Road would be. (Prior to the alignment change the route would have been Timber Hill Road - to - Oxbow Bend - to - Trappers Pass. While not as appropriate as Timber Hill Road, Trappers Pass would have been better than Oxbow Bend.) There are only two lots in Trappers Pass 3rd Addition which this proposed re -naming would affect, Lot 1, Block 3, and Lot 3, Block 1, and neither has yet been sold. Preliminary Plat and Final Development Plan) Dear Paul: On September 13, 1989, the Chanhassen City Council approved Lundgren Bros. Construction's proposed amendment of the Near Mountain P.R.D. to substitute 43 large single family lots for 114 multi -family attached living units. A provision of the Chanhassen Subdivision Ordinance, I believe, stipulates that if a final plat is not filed within six months of the City Council action approving the preliminary plat, the approval of that preliminary plat is rescinded. Inasmuch as development of Summit is dependent upon the extension of utilities and streets through Outlots A and C of Trappers Pass at Near Mountain 3rd Addition, an area we are only now preparing to develop, it would be decidedly premature for Lundgren Bros. Construction to file a Summit final plat by March 13, 1990, the last day before its preliminary plat approval would expire. We accordingly herewith request that Chanhassen approve the maximum extension of the deadline for the filing of the Summit at Near Mountain final plat which its ordinances will permit. Details for the construction of the proposed retaining wall along both sides of Trappers Pass dead end shall be submitted as a part of the plans and specifications review for approval by the City Engineer. 11. Lots 15 and 16 of Block 4, as depicted on Sheet No. 1 of the plan set dated February 18, 1988, shall be revised to show the correct property boundaries. 12. The driveway for Lot 16, Block 4, shall be constructed such that it forms a "T" intersection with Valhalla and Iroquois Avenue. 13. The plans and specifications shall show a drainage swale along the common lot line of Lots 1 and 2, Block 4 which will serve as an emergency overflow swale for the ponding site of Lot 2, Block 3. 14. All appropriate drainage and utility easements along the side, front and rear of the lots, in addition to all appropriate drainage and utility easements for ponding sites and storm sewer facilities shall be shown on the final. 15. All private drives shall access internal streets to the subdivision. No driveways shall be allowed to access Pleasant View Road. 16. The outlet configuration shall be further reviewed at the time of plans and specifications submittal and design adjustments made accordingly, if necessary, to facilitate proper conveyance of storm water under Pleasant View Road. On February 27, 1989, the City Council approved the final plat for Trappers Pass at Near Mountain 3rd Addition (Attachment #2). The final plat was approved with the following conditions: r Mr. Don Ashworth March 21, 1990 Page 3 1. The applicant shall enter into a development contract agreement with the City and provide necessary financial sureties. 2. Lots 1-3, Block 1, and Lot 1, Block 2, shall provide a tree removal plan at time of building permit application. 3. Lot 1, Block 4 and Lot 1, Block 5 shall be amended on the final plat so that the lot lines are longer within the street right-of-way. 4. The driveway for Lot 1, Block 4 shall be constructed so as that it forms a "T" intersection with Valhalla and Iroquois Avenue. 5. The most northerly lot of Block 3 (shown as Lot 3) should become Lot 1 and shown on the amended on the final plat. 6. The applicant shall meet all of the conditions of approval of the preliminary plat and wetland alteration permit. 7. The applicant will revise notes on the plan referring to the sheets within the final plat documents so that the references are correct as to the number of sheets in the plans. The applicant is proposing to final plat the remaining lots in Trappers Pass (Attachment #3 shows the proposed area for final platting as the outlot). The preliminary plat contained 23 single family lots, some of which are adjacent to a Class B wetland. The applicant is proposing to amend the preliminary plat by realigning Oxbow Bend and moving the Rojina Lane cul-de-sac. The proposed amendment reduces the number of lots to 20, straightens Oxbow Bend and provides more separation between the lots and the Class B wetland. Attachment #4 overlays the proposed changes onto the original plat. (The proposed plat is in bold lines.) Since the changes to the plat were minor and actually improved the road alignment and preservation of the wetland, staff agreed the amendments could be part of the final plat rather than going back through the preliminary plat process. The 20 lots meet or exceed the lot areas and zoning ordinance requirements of the original plat. The new lot configuration for Lots 1, 2, 3 and 4, Block 3 provides more separation between the building sites and the 75 foot wetland setback. There is a remnant piece shown as Outlot A which should be combined with the adjoining lot to the west as part of Summit Pass final plat. The street grades will range from 0 .6 % to 10 % in grade. The 10 % grade is through the intersection of Oxbow Bend and Trappers Pass. This could create slippery conditions during the winter months. However, again due to the topography, it is very difficult to design a street with a lower percent of grade without trade-offs, i.e. excessive grading which would require additional tree loss. The applicant is proposing retaining walls along the area of the 10% grade to reduce the amount of tree removal and grading. The retaining walls are proposed to be constructed with large boulders which will be located outside of the City's right-of- way. Therefore, maintenance of the retaining walls will be the responsibility of the property owner. The overall plat is generally acceptable with the following conditions and recommendations: 1. The final plat shall describe the ponding area within Block 2 as a drainage and utility easement. 2. On Lot 1, Block 2, an existing storm sewer line intersects the east corner of the lot. Just one quick clarification on page 12 of your staff report. Condition a as it relates to the construction of an emergency access. The paragraph should read, it should be changed to read. Instead of the public, it should be changed to read, a Class V street shall be extended from the permanent Phase I construction of Ox Bow Bend to the emergency access and then it continues on as stated. Basically what's happening here is, the emergency access from Iroquois to the future Ox Bow Bend will be paved. The developer has agreed to pave that entrance and the remaining portion, which would be about 250 feet between where Phase I of Iroquois ends, permanent construction to this emergency access, would be constructed with Class V to our standards. Basically because the utilities improvements will not be installed at this point in time. Mayor Chmiel: Alright. Thank you. With that clarification is there any other discussion? This letter is Lundgren Bros.' request that the Preliminary Plat approval be further extended. As you are already aware, 1991 has been a difficult year for home builders. Although all price brackets have been affected,.the more expensive "executive" category (about $300,000 and up) has been particularly hard hit. Trappers Pass 4th Addition and Summit at Near Mountain are both intended for this segment of the market. If both were available concurrently, our lot supply would greatly outstrip consumer demand. Lundgren Bros.' intention has been to delay development of the first Addition of Summit until the majority of the lots in Trappers Pass_ 4th Addition have been sold, but, to date, only four of the twenty Trappers Pass 4th Addition lots have been sold. (Weather related delays in the physical development of the site and consumer queasi- ness over economic instability are the primary causes.) Our current expectation is that there will be sufficient Trappers Pass 4th Addition sales over the winter months to warrant development of the first 'addition of Summit in the coming year. We can not yet be certain of this, however, and believe that it would be imprudent to prepare a final plat and construction plans before we are able to determine how many lots the first phase should comprised of. Summit at Near Mountain is a phase of the Near Mountain/Trappers Pass PUD which was to follow development of Trappers Pass 4th Addition. Due to the reduced demand for upper bracket housing, development of Trappers Pass 4th Addition will not begin until this fall, which further pushes back development of Summit at Near Mountain. The City Council has granted extensions to preliminary plat approvals when circumstances do not allow the development to progress as soon as planned. Since Lundgren Brothers are developing the property in a timely manner and the market for housing has slowed down, staff has no objection to extending the preliminary plat approval.
