application is approved, the city will be entering into a
development contract with the developer and the landscaping
requirements will be made a part of the contract and part of the
required improvements. I think you can appreciate my frustration
with the property owner who has valid concerns regarding
screening of an office building and is questioning the city's
ability to require landscaping on a property that is near to his
home. I firmly believe that the development contract mechanism
that the city has in place will insure installation of the
landscaping that is indicated on the Tomac plans. If the plat as
proposed is approved each of those lots will have to go through
some type of site plan review or public hearing process. The
city will have additional control at that time for additional
landscaping and we can make recommendations as to the placement
of the building and parking areas to minimize any potential
impacts from the development onto the neighborhood.
This memo is intended to alert the Council that this may become
an issue regarding the Tomac case.

The Baltic Corporation is Insurance and Finance orientated.
Our functions are basically those of Mortgage Bankers for
the Mobile and Modular Housing Industry. We provide Banks
and Mobile/Modular Home Dealers the essential tools to
assist in financing and insuring retail business. Necessary
insurance relative to retail financing is placed by The Baltic
Corporation with nationally recognized insurance companies.
The Baltic Corporation is also involved in various real
estate investments. Another Corporation, but part of the
same family, is the Tonka Del Restaurant, Tonka Bay on
County Road 19. Also, property that you may be more familar
with consists of 7.6 acres in Chanhassen immediately to the
west of Burdick Park addition between Hwy 5 and 78th street.

to determine whether this reduction in flow is enough to eliminate
the existing erosion problem in the creek. Additional controls
within the Chapparal development are not recommended. The storm
sewer system has adequate capacity except that a second catch basin
should be added in the most southeasterly cul-de-sac. The watermain
in Kerber Blvd. should be 18 inch instead of 16 inch. The slopes on
the pond should be 3:1 or possibly 4:1 for maintenance and safety.

the plat as proposed with the shifting of the boundary of the second
addition to encompass the southern boundary of the road (Exhibit A,
Road A)and subject to the conditions of staff. Motion seconded by
Mal MacAlpine and unanimously approved.
DEVELOPMENT CONTRACT AMENDMENT - HANSEN AND KLINGELHUTZ, BURDICK PARK:
Tom Klingelhutz and Doug Hansen were present requesting amendments.to
items 4 and 5 in their development contract.
Mal MacAlpine moved to recommend the council amend the development
contract, item #4 be amended to read licensed vehicle parking, item #5
increase the weight restriction from 7,000 to 9,000 lbs. for overnight
parking on the east and south, that outside storage be confined to the
west side of the building with no storage of vehicles larger than 8 x 20
feet. Motion seconded by Jerry Neher and unanimously approved.
MC GINN LOT SPLIT, LOT 4, BLOCK 1, HARVIR HILL: Mr. McGinn is seeking
approval to subdivide Lot 4, Block 1, Harvir Hill into two lots.
Pat Swenson moved to hold a public hearing on April 25, 1979, to
consider the lot split conditioned upon receipt of an abstractor's
certificate by April 9. Motion seconded by Mal MacAlpine and
unanimously approved.
THE BALTIC COMPANY - SITE PLAN: The Baltic Company is requesting
rezoning of Lots 1 and 2, Minnewashta Park from R-1 to C-1. The
property currently is the site.of_Cermak Sales and Service. Reynold
Roberts, representing the owners, gave a presentation. They are
proposing to remodel the existing building into an office building.
The remaining structures and equipment would be removed from the
property. Eleven parking spaces would be provided on the east side
of the building. The Baltic Company would be the owner/user of
the building. The Assistant City Attorney asked for vertification
of ownership of the property.
Mal MacAlpine moved to hold a public hearing on April 25, 1979, to
consider rezoning from R-1 to C-1 subject to proof of ownership.

Petition
The Baltic Company is requesting to rezone lots 1 and 2 of Minnewashta
Park from R-1, single family residential district to C-1, office
building district and additionally is requesting to receive site
plan approval for the development proposed.
Background
1. As shown in enclosure 1, the subject property is located at the
intersection of Orchard Lane and MTH 7.
2. Existing Zoning: The subject property and it's environs are
presently zoned R-1, single family residential district.
3. Utilities: Sanitary sewer and municipal water are presently
available to the subject property.
4. Comprehensive Plan Proposal:
a. Land Use: Pursuant to the adopted City Comprehensive Guide
Plan, the subject property is to assume and maintain a multiple
family residential identity.
b. Transportation: Pursuant to the adopted Transportation and
Thoroughfares Plan, Orchard Lane is to function as a local street, and
MMTH 7 is to function as an expressway.

As you know, the subject property is the site of the Cermak Sales
and Services operation and is presently being used as mixed nursery
sales and storage. There was a request in 1975 to rezone the property
to C-3, commercial service district, however, this request was denied
for various reasons one of which was probable poor access to the
property.
In studying the case for rezoning of this property, the planning
commission and staff should debate the impact of the proposed use in
li aht of the residential properties to the south and west of the subject
property. From an initial standpoint, I believe that single family
residential use would be incompatible to the highly travelled MTH 7
and likewise multi -family would also suffer detriments from the traffic.
Conversely the multiple family land use would create higher traffic
volumes intrinsic to the property than the proposed use. Of all
the possible land uses, an office building is the most appropriate for
the property because of it's low traffic generation characteristics,
visual attractiveness, and compatibility with thoroughfares.
One of the most attractive features of this proposal, is that it is
proposed office and thus a relatively a low traffic generator, however,
within the C-1 zoning category, there are provisions for accessory
uses of higher traffic generators such as restaurants. Upon consulting
this matter with the Assistant City Attorney, it was agreed that in
order to best assure that the functionality and compatibility of
this property with that of the surrounding property is maintained,
that a P-2 zoning be considered with the management of a development
contract premitting only office uses on the subject property.
The Planning 'Commission should request that the applicant enter into
the minutes a detailed verbal presentation on the make up of the
Baltic Companies and it's relationship to the proposed development.

Enclosed you will find a copy of a letter dated February 27,
1979, which I received from Mr. Nehls, attorney for the
Cermaks. While Mr. Nehls was unwilling to permit this office
to examine a copy of the contract for deed between the Cermaks
and Mr. Kreslins, I have no reason to doubt that such a trans-
action did in fact take place. Once possession is transferred
to Mr. Kreslins, the City's lawsuit against the Cermaks will be
rendered moot, as Mr. Nehls suggests in his letter. I have
been informed that the purchase agreement requires the Cermaks,
as sellers, to remove all unattached debris from the property by
April 1, 1979, weather permitting.
It is my suggestion that we take no further action on this matter
until the weekend of March 31, 1979, at which time an on -site
review of the clean-up efforts can be made. If the clean-up is
unsatisfactory, then the new owner should be brought into the
suit as an additional defendant.

firmed to you that the Cermak property more particularly described as Lots 1
and 2, Minnewashta Park, situated in the North 1/2 of the Northeast 1/4 of
Section 4, Township 116, Range 23, Carver County, Minnesota, except that part
thereof taken by the State of Minnesota for State Trunk Highway No.7 has been
sold by the Cermak brothers to Mr. Hary T. Kreslins whose address has been given
to me as 21965 Minnetonka Boulevard, Excelsior, Minnesota, 55331.
Possession will be given on or before April 1, 1979 and sellers agreed to remove
all unattached debris from the property within 30 days, weather permitting. The
other personal property of the sellers will, of course, be removed in its entire-
ty from the premises at the time possession is given to the purchaser.
With reference to our previous conversation regarding this matter, we would feel
somewhat inclined to suggest that the pending lawsuit as between the City of
Chanhassen and Ladislav A. Cermak and George A. Cermak will be rendered moot.

I have received your memo inquiring whether any revision of the
non -conforming permit for Baltic Corporation is necessary in view
of the Council's actions of December 1979 and January 1980.
The City Council reviewed the Baltic matter on December 3rd and
January 7th. As I read the minutes, no change in the permit is
necessary. Section 3 (1) (a) of the August 10, 1979 non -conforming
use permit calls for the city forester to develop a specific
landscaping plan which is to be approved by the City Council. The
only action which is necessary at this time, would be to prepare
a composite landscape plan based on the City Council's motion of
January 7, 1980. That com:osite__plan should be transmitted to
Baltic Corporation under cover of a letter notifying them that the
composite plan is being tendered to them pursuant to Section 3
(1) (a) of the non -conforming use permit. The permit calls for
the completion of the landscaping by November 1, 1979. Since the
City Council did not approve the necessary landscaping plan until
January 7, 1980, it is obviously necessary that you administratively
determine a deadline for completion of the composite landscaping
plan. It is my suggestion that you adopt a completion deadline of
approximately May 31st, as this would allow a 90-day completion
period similar to the 90-day completion period originally contem-
plated by the City Council.

City's Building Inspector in regards to the non -conforming use permit
presently in force for your property. As a number of items listed
within the Conditional Use Permit were to be completed by November 1,
1979, I must place this item as a -City Council agenda item for
December 3, 1979.
My cover report to the City Council will acknowledge the fact that
you have cooperated to the fullest extent possible in working with
City staff and have made steady progress in completion of work
required by you, under the permit, in remodeling your property for
professional offices. Additionally, I believe the council will
recognize the fact that you were delayed in starting work on the site
until after the conditional use permit had been drafted by the
Attorney's office and properly executed.
Barring the above comments, you should be informed that the question
which will be posed -to you by the City Council will be "When will
the work required under this,permit be completed and Why has such
not been completed as required?" I believe you should be in a position
to answer these.questions.and, as such, I would request your presence

1. The site shall be rehabilitated and cleared of all nursery
accessory buildings and structures, above ground fuel tank-,
tractors, vans, trucks, camper tops, tractor bodies, pallets,
steel piping, nursery materials, timbers, machines, vehicles,
junk and debris; and shall be improved and landscaped in
accordance with the site plan/landscape plan designated as
Exhibit A herein, except that the existing garden structure
shown on said plan shall be removed and the driveway shall
remain in its present location. The said site improvement
and landscaping shall be completed and installed by November 1,
1979.

most other miscellaneous materials mentioned within this section.

2. The incidental alterations to the principal structure shall
be made strictly in accordance with the floor plan designated
as Exhibit B herein and shall be completed and installed by
November 1, 1979. The presently existing canopy on the front of
the principal structure and the lean to structure at the rear
thereof shall be removed as a part of the permitted incidental
alterations.
2. Alteration to the structure has been made in accordance with
Exhibit B.
3. The exterior of the principal structure shall be cosmetically
renovated in accordance with the exterior elevations plan
designated as Exhibit C herein, and shall be completed and
installed by November 1, 1979.

shall be as approved by the City November 1, 1979.

for trucks furnishing essential services to the premises, no

7. At the time of inspection, there were no. trucks and nine cars.
The handicapped parking was not marked, the blacktop parking
was just installed and is not yet complete.
8. The driveway and parking area shall be constructed with
curb and gutter and bituminous surfacing, the specifications
for which shall be as directed by the city engineer.

Kreslins and Baltic shall furnish to the City either a cash

attorney and naming the City as obligee thereunder, or an
irrevocable letter of credit approved by the city, an
amount equal to 1100 of the costs of said improvements as
computed by the city engineers.
13. The city has a bond in the amount of $5,000.
14. It is intended that the premises shall be used by Kreslins
and Baltic solely as the business office of Baltic, for
its finance and insurance operations, which use shall not
involve retail traffic on said premises. No part of the
premises shall be leased to other persons, firms or
corporations, without the prior written consent of the city.
14. There is no retail business, no part of the building is being
rented out to other firms.
15. For the purpose of insuring complaince with its terms,
the within permit shall be reviewed by the city council at the
first regular council meeting following the first anniversary
date of the permit.

16. The establishment, maintenance and operation of the proposed
use shall not be detrimental to or endanger the public health,
safety, or general welfare.

days' mailed notice of hearing given to Cermak, Kreslins, and
Baltic.

19. Unless terminated by the provisions of S3(18) above or by
SS20.03, Restoration, of the Chanhassen Zoning Ordinance, this
permit and the non -conforming use granted hereby shall terminate
on February 28, 2002, on which date the use of the premises
shall conform in all respects to the then existing zoning in force
with respect to said premises.

20. Forthwith, upon invoicing therefor, Kreslins and Baltic
shall reimburse the City for all costs, including reasonable
engineering, legal, planning and administrative expenses,
incurred by the city in connection with all matters relating to the
preparation of this permit, the administration and enforcement of
the within agreement, and the performance thereof by Kreslins and
Baltic; said costs to be inclusive of all reasonable city legal
expense and suite costs incurred by the city in the defense of the
within permit in any litigation instituted by third persons. The
city is hereby given the right to specially assess said costs
as a lien against the premises, collectible along with the general
ad valorem taxes payable thereon.
20. There is an outstanding bill of $1,360.42.
21. Upon execution of this agreement by all parties, the City shall
dismiss without prejudice the pending litigation against Cermak.

22. This agreement shall be binding upon the parties hereto, and
their respective heirs, personal representatives, successors
and assigns.

here on a timely basis due to other committments. All work
has been ordered and we have little choice but. to wait for
these contractors to perform these services to fulfill our
end of the contract. As you can see, we have put in a new
sidewalk and are nearly finished with the exterior of the
building and have had the excavating work done for the
driveway area. We are held up with some of the landscape
work due to the debris still left by George Cermak. He,
too, has been busy on other projects and has not cleaned
up the area per his original promise.
We will take steps to insure that there is absolutely no
overnight parking of semi -tractors in the yard and were
possibly a little lax in this regard as we have not been
concerned with general appearances of the property because
of its mid -construction status, however, once the area is
beautified to our satisfaction I can assure you there will
be no trucks parked in this area. As for the motor home,
that is a personal vehicle and will be removed permanently
as soon as we have it winterized and put away for storage.

The following is a list of plant materials recommended for screening
along the south line of the Baltic Corporation property. The
most effective plant materials for year round screening would be
evergreen trees. In this situation, I would recommend a mixture of
deciduous shrubs with evergreens where space permits it. The
shrubs should be located directly in front of the evergreens on
the south side. This would protect the evergreens from winter
burn and would add variety to the planting.
Those plant materials that would do best under the existing soil
and climatic conditions and being of sufficient height (i.e. 10')
to screen the premises would be:

City Manager and the City Attorney, and based upon that discus-

The city council at its June 18, 1979, meeting, moved to consider the
issuance of a non -conforming use permit to the Baltic Company as
presented with their plans and additionally moved to table the action
on the non -conforming use permit until the July 2, 1979, meeting.
My impressionis that the city council intends to go over each of the
conditions of the permit individually and then decide on the appropriate-
ness of the overall development plan in light of the permit conditions
proposed by staff.
The following is a synopsis of the conditions outlined in the permit
that need council decision as to deadlines, or standards, etc.
Conditions 1, 2, and 3 need completion deadlines for the overall site
preparation of the property, and completion of the cosmetic :renovation
of the structure.
On the lighting plan and signage as addressed in condition a, such items
have been traditionally reviewed by the city engineer and sign committee
with recommendation to city council for their approval. I would
recommend that this procedure remain intact on this item.
The driveway and parking area specifications as outlined in condition
8 will be addressed by the city engineer at the July 2, 1979, meeting.
Section 12 speaks to the water and sewer hookup requirements of the
permit. I believe that this section should be amended to simply state
that the premises be connected to sanitary sewer and municipal water
systems of the city prior to occupancy of the principal structure for
business use.
I have been informed by the city engineer's office, that the performance
bond provisions -of condition 13, will be estimated within the next
couple weeks.

Reference: Proposed Non -Conforming Use Permit, City of
Chanhassen with Baltic Corporation et al, con—
cerning development and use of lots 1 and 2,
Minnewashta Park addition (Cermak Nursery Property)
Gentlemen:
As the most immediate neighbors to the Cermak property, we
have been vitally concerned with both the past abuses and
proposed future use of the property.
We remain apprehensive about any commercial usage from a
precedent setting standpoint and the impact on possible, future
spread of commercial activities in the area.
From a practical standpoint, however, we have looked at all
the alterratives to the proposed use permit, including
expensive and probably painful litigation, and have come to
the conclusion that a sensible agreement of the kind proposed
is probably the most intelligent compromise available, with
one very emphatic objection concerning wording of the proposed
agreement.
Under Section 3, "Permit and Conditions," paragraph 14 concludes
with the clause "which consent shall not be unreasonably
withheld". We believe that this implies unnecessary restraint
on the actions of the City Council in considering leasing
actions proposed by Baltic Corporation, and that further in
any event Baltic Corporation would always have recourse to
the courts for any City Council action that might be deemed
unreasonable by Baltic. We then would like to request that
this concluding clause of paragraph 14, be struck from the
agreement.
Also, before finalization we would like to have included in the
proposed landscape plan plantings, preferably evergreen, along
the south side of the property to the western boundary with
sufficient height and density to provide an effective and
attractive visual screen with the prime consideration being
esthetics.

driveway in the proposed site plan should be moved back to
the location of the existing drive into the Cermak property.
The location as proposed in the site plan we. feel is completely
unacceptable both from a traffic flow standpoint, and most

Members of the Council:
We live in close proximity to the property in question. In the event
that Baltic receives approval to use the property for a professional building on
a nonconforming use permit, we hope that the record clearly shows the constraints
to which use of the property is subject. In this regard, it may be desirable to
clearly define the terms retail, business office, and financial. Also, there
should be limits on the use of off-street parking incident to business operation
on the property. Whether limiting the number of parking places on the property
to 13 spaces, while desirable, will effectively limit the degree of business
activity is subject to question.
We fully concur with the Council's view that Baltic, et al, should
clearly understand and permanent record reflect limitations on the intensity of
business use available for the property. We also agree with the Council's view as
clearly enunciated by Mayor Hobbs and Councilman Neveaux that it is not the intent
that further variances will be granted for this property and it is not intended
that there should be zoning changes granted in the future. That is, that the R-1
zoning continue in effect but recognizing the property owners' right to economic
utilization through the economic life of the improvement placed on the property
prior to the residential zoning.
A primary reason for our concern as to the ultimate use of this property
was stated at the June 18, 1979, Council meeting by John Schumacher. Based upon
what we have heard, albeit unsubstantiated, it appears that Baltic, et al, are
investing $1,000 per square foot of office space and 13 parking places. By any
measure, it is difficult to perceive this as an economically justified investment
based upon the purported use. Consequently, we have to suspect that there are
undisclosed motives and that there will be efforts to use the property ultimately
for purposes other than those which have been indicded to date.
Thus, we petition the Council to proceed with extreme caution and that,
whatever decision is reached, the record be clear as to the Council's intent and that
such record be incorporated as a part of the permanent record for the property.

Baltic Corporation is requesting a non -conforming special use permit
for their property on Highway 7. Such permit would allow them to
use the property for a professional building to the year 2002. The
concept of the special non -conforming use permit has not been discussed
by the Planning Commission since their original approval of rezoning
the property to commercial. As the Planning Commission did approve
a use charge, this office assumes.such recommendation is valid
regardless of the technique used.
I believe the city attorney's draft of the non -conforming use permit
establishes a chronological history, applicable uses, and conditions
as recommended by staff.

Dear Mr. Waibel:
This is to summarize the meeting I had with the leaders of the
various homeowner groups regarding the above property. Nothing
was totally resolved as they wanted to check again with Mr.
Larson to get a better feel for the legal positions in this
matter. The consensus seems to be that they are satisfied with
us as neighbors but would like assurances that we would agree
to allow the actual useage of the property to revert to resi-
dential in the year 2002, which would probably be o.k. from our
standpoint, but would also be quite impractical, if not impos-
sible to project what will happen to that area by then. There
was also'a request that we agree never to expand, however, we
feel there are adequate safequards in the contract where it calls
for approval of the council. We have no immediate intentions for
expansion, but it would be unreasonable for us to sign away that
option forever as the complexion of that neighborhood could change
dramatically in the next few decades. These points should be able
to be worked out in a rational manner at the council meeting.
The other point made clear was to leave the driveway where it is

The following land use paradigm is being presented in hope that it
will aid in delineating the issue at hand.
1. Zoning: R-1, single family residential district.
a. Advantages:
1). Consistent with adjoining land uses.
2). Low traffic generater.
b. Disadvantages:
* 1). Marketing
a. Due to the cost of site preparation, i.e.
subdivision, demolition of existing structures,
site grading, and the influence of Highway 7,
it appears that there is little, if any, market.:
incentive for a builder or developer to construct
single family residences on the subject property.
2. Zoning: R-2, two family duplex district.
a. Advantages:
1). Possible transitional land use for property with
marginal marketability as single family.
2). Moderate traffic generates.
b. Disadvantages:
1). Same as 1. b. 1) a. of the above.

a. Disadvantages:
1). Office use of the property could be intensified
within the permitted limits of the zoning ordinance
and not necessarily with regard to the unique
circumstances of the property.
6. Zoning: P-2, planned unit development district.
a. Advantages:
1). Under the P (Planned) districts, any approvals are
associated directly to and an exhibit plan and any
changes to that plan, i.e. intensification of use,
would be considered a plan amendment to wit a public
hearing would be required.
2). Moderate traffic qenerater.
b. Disadvantages:
1). In making this or any property in the city a commercial
or industrial zone, it would probably make the future
reverting of the property back to a residential zone
more difficult to accomplish. (The converse of the
above is also applicable to all properties in Chanhassen,
in that no property is absolutely inviolate to
extensive zoning or land use changes because of unfore-
seen events, etc.
* This proposition is premised upon the realization
that Section 20.01 subsection 5 of Zoning Ordinance
47 allows for lots 1 and.2-of Minnewashta Park to
continue as a nursery use until the year 2002 and
that presently the courts are loathe to uphold such
amortized termination of non-donforming uses.

Another concept that can possibly be applied to the
proposed change of use for the subject property is the
so-called non conforming use permit. Attached hereto is
a sample which was developed for a similar situation
involving the BMT Company located on Hazeltine Blvd.
The city attorney will give an indepth verbal presenta-
tion on the application of the non -conforming use permit
at Monday evenings meeting.
Also attached hereto please find the minutes of the
Township Board giving approval of commercial zoning r
the subject property. The post merger zoning ordinance
47 changed the zoning of the subject property to it's
present R-1, single family residential district status.

Reference: Planning Commission. Rezoning Recommendation for Cermak
Nursery Property from R1 to P2.
Members of the Council:
This appeal is in response to the April 25, 1979 Planning Commission reaction
to its community. When duly appointed commission members reacted negatively
to the wishes of the people whom it represented, the homeowners of Chanhassen,
I was left somewhat in awe.
We live directly behind the Cermak property, were represented in the homeowner's
petition to maintain Rl zoning, and are directly affected by the Council's
decision.
We moved to this fine community one year ago from Colorado and spent three
months looking at over sixty potential homes from Edina to Plymouth to
Chanhassen. I feel we were very selective and settled in the Minnewashta
Lakeside community because of the "environmental integrity" of the area. We
researched the Cermak situation before buying our home and were told by the
City of Chanhassen that the property was zoned R1 and would remain so, having
been changed from commercial zoning in 1963.
I assure the Council that had we perceived the Cermak property as anything other
than R1, we would not be here today.
I challenge you, the Council, to thoroughly research the consequences, short
and long term, to rezoning this land.
1. The future value of property to the homeowners in the
lakeside area.
2. The precedent established as a result, whether intentional or
not towards strip zoning. _

3. The effect to the proposed Minnewashta Park directly South
of the Cermak property for which land has been donated, and
the conflict of traffic and the resulting danger to children
in the area.
Bob Waibel, Assistant Manager/Planner for the City presented the recommendation
for rezoning to the Planning Commission. Following much discussion between the
Commission and the audience, Mr. Waibel stated that the rezoning proposal was
made by him to get a feel of the community attitude towards the idea. At the
risk of another Watergate, I remind you that the meeting was "taped" by the
City and invite you to review this. The community responded to the rezoning
request with -a petition against rezoning with approximately 100 names of
concerned homeowners. The meeting room was packed and more chairs had to be
added. The community attitude was certainly well represented, yet a favorable
response by the Planning Commission towards rezoning?
Why would the City not have rezoned this land for Cermak rather than forcing
him to earn a living within the restraints of R1 zoning, yet favorably consider
a rezoning request now? I submit that Baltic bought the property knowing full
well of its zoning restrictions and see no reason to change the restrictions
on this land now.
I feel Chanhassen has adequately planned for.business locations within its
development plans, and that areas exist where good business partners can co-
exist with the community. I also suggest, as a businessman myself, that a
reputable growth oriented business would prefer such an area in which it could
support and promote itself and the community.
Let's keep the current integrity we have in the Minnewashta area. You, the
City fathers, have a fantastic lakeside community developing to the North of
Chanhassen. The planned park area will enhance this. Don't lose this long
term potential now. Vote on behalf of your concerned appointees and vote
R1.

We obviously had not done our homework prior to the public hearing, mainly
because we did not anticipate any problems from adjacent property owners

Our position is flexible enough to accommodate almost any reasonable

has been rescheduled for May 21 instead of May 7th as shown in

You noted in your letter that the property owners in that general
area may be misinformed as to the specific nature of your business,
proposed use, or nature of improvements:., In cases similar to
this, several developers/applicants have met with concerned citizens
to attempt to resolve any differences prior to final action by the
City Council. This approach has also helped the City Council from
the standpoint of not necessitating going through each specific
detail of the proposal. Additionally, compromises can be worked out
in advance of the council meeting, i.e. agreement to planting lilac
bushes adjacent to one owner instead of evergreens. I will not
guarantee that this type of approach will work and, it is possible that
such a meeting could result in a greater difference of opinion than
presently exists: I leave the decision with you as to whether such
a meeting should be called. Karen, at City Hall, can give you the names
of residential association presidents and/or a copy the petition
showing names and addresses of individual protesting to'the development.

We were on the Planning Commission agenda last Wednesday for a
zoning change on the property known as the Cermak property, with
us scheduled to appear before the council on May 7th.
It was evident from the reaction from some of neighboring property
owners that there are some gross misconceptions as to our inten-
tions surrounding the purchase of this property.
The property was purchased April 1, 1979 for the express purpose
of office space for myself and a few employees. We currently
office in the downstairs of my home in Greenwood and do not have
adequate space for the nine persons on my staff, comprised of
clerical and executive personnal.
We were very lax in our public relations on this property prior
to the public hearing as we assumed that the surrounding property
owners would be totally pleased with our intended useage, as we
are well aware of the history of the problems with the previous
owners.
It is our intention to clean up the property, have it fully land-
scaped and totally renovate the interior and exterior of the build-
ing per the elevations submitted to the planning commission.
We do not have nor do we plan to have any retail traffic in con-
junction with our business. As I indicated, there are presently
nine employees which should certainly qualify the useage as less
intense than the previous application. A special use permit or any
other mechanism which would allow us to use this property for an
office would be satisfactory. Contrary to rumors, we have no in-
tentions to try to convert the property into a shopping center or
fast food restaurant. My business is primarily in the area of
insurance and finance, with the majority of the transactions tak-
ing place elsewhere, so there would be no danger of creating a
traffic problem.

I am in receipt of your letter of April 27, 1979, regarding the
proposed rezoning of the Cermak property. A copy of your letter
will be forwarded to the City Council.
The rezoning request by Baltic Corporation has been scheduled for
the Chanhassen City Council meeting of May 21, 1979. This item was
incorrectly published as May 7th in the Carver County Herald.
City Council procedure has been: Staff report including recommendations
of various commissions (a Planning Commission member is usually
present should their be council questions); presentation by developer
(limited to five minutes); public comments (spokesperson presentations
encouraged) ; close public presentations and allow for Council
discussion/action.
Council packets for each item typically include: 1) staff report
reviewing nature of request, pertinent facts, and recommendation;
2) copies of relevant commission minutes; 3) any developer
submitted information, i.e. drawings, etc.; 4) other relevant infor-
mation including citizen correspondence, petitions, etc. Copies
of all information being submitted to the City Council is available
at City Hall after 2:00 p.m. on Friday, May 18th.

Dear Dick,
The City of Chanhassen Planning Committee met Wednesday,
April 25, 1979 at 8:15 at the City Hall in Chanhassen for
the purpose of holding a public hearing to consider the
site plan and re -zoning from R-1 to P-2 on lots l and 20
Minnewashta Park Addition, otherwise known as Cermacts
Nursery.
All interested persons were heard at the meeting and not
one tax -paying, homeowner favored the proposed change. A
petition with nearly 100 signatures was presented to the
Council protesting a change in zoning.
It appears, that in spite of the valid objections of the
residents adjacent to the proposed re -zoning under con-
sideration, the Planning Committee recommended approval
of P-2 classification to the City Council.
It would seem, that we are living in an age of officials
telling us that we do not know what is good for us and
that they are better qualified to judge what is best for
our community.
!"de will be sorely disappointed in the Democratic process
if we are told, "try it--you=re going to like it, whether
we like it or not
As one of our council members, tare ask that you withhold
your approval of a change in zoning and ask other council
members to do likewise.

The Chanhassen City Council, at its April 16, 1979 meeting, voted
to grant Mr. Smith's request for a variance to the street frontage
requirement of the ordinance pertaining to the Austin Lange
Estate property. This action qualifies the Lange Estate property
for the issuance of a single family dwelling building permit.
The grant of the variance, however, was conditioned upon Mr. Smith
dedicating to the City of Chanhassen a public right-of-way easement
over the westerly twenty feet of the Lange Estate property. Your
client should prepare the necessary easement deed and tender that
document to this office after it has been duly executed. For your
reference, I enclose a photocopy of an easement deed in an acceptable
format. Because your client has not yet closed his purchase from the
Lange Estate, you may wish to substitute "quit claim" language for
the warranty language in the enclosed specimen. The name of the
grantee should be The City of Chanhassen rather than the Village
of Chanhassen. Mrs. Smith must join in the easement deed.

We are among the 150-plus homeowners in the Chanhassen Annex #2 that petitioned
the Planning Commission at its May 25, 1979, meeting, to deny a zoning change
to other than residential for the property occupied by Cermak's Nursery. It
was our understanding that the property, formally known at Lots 1 and 2,
Minnewashta Park Addition, would revert to residential zoning in the early
1980's or, if sold sooner, at the effective date of any sale of the property.
The vote by the Planning Commission, to us, reflected a lack of responsiveness
or compassion for the views of homeowners of the area. We acknowledge being a
somewhat remote annex to the City of Chanhassen, but feel our collective voices
should be heard. We, in turn, heard no compelling reasons for the Commission's
acquiescence to the desires of The Baltic Company, which recently purchased the
property.
We acknowledge that Cermak's Nursery has been an eyesore, that they apparently
have not completely adhered to restrictive provisions set forth in zoning the
property to accomodate their business pursuits. However, we feel that the
present action by the Planning Commission, as we perceive it, will create a
greater problem than presently exists.
We petition the Council to thoroughly study the entire question prior to any
permissive action being taken.
We also question the due process provided by the Commission; discussion of the
subject was limited to only one hour, a vote was summarily cast and approval
granted to Baltic's proposal. Baltic had a proponent on the Commission based
on Commissioner Waibel's presentation at the meeting, whereas property owners
did not. The property had not been posted to reflect that a change of zoning
was being considered.
In summary, we are opposed to the zoning change, feel that the Planning
Commission acted with haste, and that more than a small legal notice in the
Carver County Herald indicating that a change of zoning was contemplated would
have been appropriate under the circumstances.
By a copy of this letter, we are requesting the City Attorney, the State
Attorney General's office, and the Carver County Attorney s office

As you recall, this public hearing was ordered to consider the
site plan, and rezoning from R-1, Single Family Residential District
to P-2, Planned Unit Development, for the subject property.
Several residents from the surrounding neighborhood have contacted
this office with questions regarding the present zoning, the proposed
land use and zoning, and their compatibility with the surrounding
neighborhood. In summary, questions were raised as to whether or
not this property has market viability as single family because of
its proximity to Highway 7 and with no present noise abatement measures,
the possible compatability of multiple residential on the property,
and the zoning contract limitations that would assure that the
presently proposed office facility is not, over a period of time,
unrealistically intensified.
My comments regarding the above stated issues are as follows. In its
present R-1 zoning, there is no question that the property is
compatible with the surrounding area, however I -do believe that there
is questionable marketing attributes of the property as single
family due to influences of Highway 7 and the costs of diminishing
that influence. As multiple residential., the future residents would
likewise feel the effects of Highway 7 and would additionally be
a more intensive traffic generator than the proposed use. As to the
overall compatibility of the present request, I believe that the
office use is benign to the residential neighborhood with respect
to traffic generation and visual impact. There is presently no
complete assurance that any properties in Chanhassen will maintain
their character into perpetuity, however the development contract
provisions are a more comprehensive means by which the spirit and
intent behind a rezoning are.k.ept intact. Presently the P zoning
gives much more control over the present and future land uses on a
particular parcel than any of the C zoned categories.

Dear Mr. Spalmanis:
In our recent conversation, we discussed the current Non -
Conforming Use Permit. I foresee no difficulties in maintaining
this permit for you or any other property owner as long as it is
used for business office purposes, but such will require City
Council approval.
The other question you presented was the possibility of addi-
tional development of the property. I would have to advise you
that due to the difficulties we have had with the past owners, a
petition for development at this time would probably not be
approved.
I would advise that by complying with the general guidelines of
the Non -Conforming Use Permit and by maintaining the property as
a good neighbor, the owner would in a year be able to petition
for further development. It should be understood, however, that
the decision on future development of the property rests solely
with the City Council.

SPECIAL ASSESSMENT
LOTS 1 & 2, MINNEWASHTA PARK ADDITION
THE BALTIC CORPORATION & HARY T. KRESLINS
RECITALS
1. The provisions of that certain Non -Conforming Use
Permit, dated August 10, 1979, between the City of Chanhassen,
The Baltic Corporation, Hary T. Krelins and others, provides
at Section 20 thereof that the City is given the right to
specially assess as a lien against the premises therein described
certain costs incurred by the City in the enforcement of said
agreement and performance thereof by The Baltic Corporation
and Hary T. Krelins.
2. The City has incurred costs in the amohnt of
$2,244.60 for the enforcement of and performance of said
agreement, which costs are found by the City to be reasonable.
3. That although duly demanded, no part of said costs
have been reimbursed to the City.
4. That due notice by mail was given to the owners of
the premises involved herein that the Council would meet to hear,
consider and pass upon all objections, if any; and an opportunity
has been given to all interested persons to present their
objections, if any, to the assessment herein undertaken.
RESOLUTION
BE IT RESOLVED:
1. The amount proper and necessary to be specially
assessed at this time for reimbursement to the City of costs
incurred pursuant to the aforementioned permit is $2,244.60, which
assessment is hereby levied against the following described
property lying and being within the County of Carver, State
of Minnesota, to -wit:
Lots 1 and 2, Minnewashta Park Addition
2. The assessment against said parcels, together with
interest at the rate of 8% per annum accruing from the date of
the adoption of this assessment roll on the full amount thereof
shall be alien concurrent with general taxes upon such parcels
and all thereof. The total amount of such assessment shall be
