Unlike the Baltic case, if the application is approved, the city will be entering into a development contract with the developer and the landscaping requirements will be made a part of the contract and part of the required improvements. I think you can appreciate my frustration with the property owner who has valid concerns regarding screening of an office building and is questioning the city's ability to require landscaping on a property that is near to his home. I firmly believe that the development contract mechanism that the city has in place will insure installation of the landscaping that is indicated on the Tomac plans. If the plat as proposed is approved each of those lots will have to go through some type of site plan review or public hearing process. The city will have additional control at that time for additional landscaping and we can make recommendations as to the placement of the building and parking areas to minimize any potential impacts from the development onto the neighborhood. Background 1. As shown in enclosure 1, the subject property is located at the intersection of Orchard Lane and MTH 7. 2. Existing Zoning: The subject property and it's environs are presently zoned R-1, single family residential district. 3. Utilities: Sanitary sewer and municipal water are presently available to the subject property. 4. Comprehensive Plan Proposal: a. Land Use: Pursuant to the adopted City Comprehensive Guide Plan, the subject property is to assume and maintain a multiple family residential identity. b. Transportation: Pursuant to the adopted Transportation and Thoroughfares Plan, Orchard Lane is to function as a local street, and MMTH 7 is to function as an expressway. Planning Commission -2- March 26, 1979 C'nmmen t�q As you know, the subject property is the site of the Cermak Sales and Services operation and is presently being used as mixed nursery sales and storage. There was a request in 1975 to rezone the property to C-3, commercial service district, however, this request was denied for various reasons one of which was probable poor access to the property. In studying the case for rezoning of this property, the planning commission and staff should debate the impact of the proposed use in li aht of the residential properties to the south and west of the subject property. From an initial standpoint, I believe that single family residential use would be incompatible to the highly travelled MTH 7 and likewise multi -family would also suffer detriments from the traffic. Conversely the multiple family land use would create higher traffic volumes intrinsic to the property than the proposed use. Of all the possible land uses, an office building is the most appropriate for the property because of it's low traffic generation characteristics, visual attractiveness, and compatibility with thoroughfares. One of the most attractive features of this proposal, is that it is proposed office and thus a relatively a low traffic generator, however, within the C-1 zoning category, there are provisions for accessory uses of higher traffic generators such as restaurants. Upon consulting this matter with the Assistant City Attorney, it was agreed that in order to best assure that the functionality and compatibility of this property with that of the surrounding property is maintained, that a P-2 zoning be considered with the management of a development contract premitting only office uses on the subject property. The Planning 'Commission should request that the applicant enter into the minutes a detailed verbal presentation on the make up of the Baltic Companies and it's relationship to the proposed development. The City Council reviewed the Baltic matter on December 3rd and January 7th. As I read the minutes, no change in the permit is necessary. Section 3 (1) (a) of the August 10, 1979 non -conforming use permit calls for the city forester to develop a specific landscaping plan which is to be approved by the City Council. The only action which is necessary at this time, would be to prepare a composite landscape plan based on the City Council's motion of January 7, 1980. That com:osite__plan should be transmitted to Baltic Corporation under cover of a letter notifying them that the composite plan is being tendered to them pursuant to Section 3 (1) (a) of the non -conforming use permit. The permit calls for the completion of the landscaping by November 1, 1979. Since the City Council did not approve the necessary landscaping plan until January 7, 1980, it is obviously necessary that you administratively determine a deadline for completion of the composite landscaping plan. It is my suggestion that you adopt a completion deadline of approximately May 31st, as this would allow a 90-day completion period similar to the 90-day completion period originally contem- plated by the City Council. The site shall be rehabilitated and cleared of all nursery accessory buildings and structures, above ground fuel tank-, tractors, vans, trucks, camper tops, tractor bodies, pallets, steel piping, nursery materials, timbers, machines, vehicles, junk and debris; and shall be improved and landscaped in accordance with the site plan/landscape plan designated as Exhibit A herein, except that the existing garden structure shown on said plan shall be removed and the driveway shall remain in its present location. The said site improvement and landscaping shall be completed and installed by November 1, 1979. a). I cannot comment on this at this time since the structure and landscaping are not complete, but it does appear they are trying. 7. Motor vehicle parking upon said premises at any one time shall be limited to 13 private passenger vehicles, which shall include employee parking, and two parking spaces for the handicapped. All parking shall be limited to the spaces designated. Except for trucks furnishing essential services to the premises, no truck parking shall be allowed. 7. At the time of inspection, there were no. trucks and nine cars. The handicapped parking was not marked, the blacktop parking was just installed and is not yet complete. 8. The driveway and parking area shall be constructed with curb and gutter and bituminous surfacing, the specifications for which shall be as directed by the city engineer. 8. No part of the premises shall be leased to other persons, firms or corporations, without the prior written consent of the city. 14. For the purpose of insuring complaince with its terms, the within permit shall be reviewed by the city council at the first regular council meeting following the first anniversary date of the permit. 15. My impressionis that the city council intends to go over each of the conditions of the permit individually and then decide on the appropriate- ness of the overall development plan in light of the permit conditions proposed by staff. The following is a synopsis of the conditions outlined in the permit that need council decision as to deadlines, or standards, etc. Conditions 1, 2, and 3 need completion deadlines for the overall site preparation of the property, and completion of the cosmetic :renovation of the structure. On the lighting plan and signage as addressed in condition a, such items have been traditionally reviewed by the city engineer and sign committee with recommendation to city council for their approval. I would recommend that this procedure remain intact on this item. The driveway and parking area specifications as outlined in condition 8 will be addressed by the city engineer at the July 2, 1979, meeting. Section 12 speaks to the water and sewer hookup requirements of the permit. I believe that this section should be amended to simply state that the premises be connected to sanitary sewer and municipal water systems of the city prior to occupancy of the principal structure for business use. I have been informed by the city engineer's office, that the performance bond provisions -of condition 13, will be estimated within the next couple weeks. -tee June 27, 1979 Chanhassen City Council Chanhassen, Minnesota 55317 Reference: Proposed Non -Conforming Use Permit, City of Chanhassen with Baltic Corporation et al, con— cerning development and use of lots 1 and 2, Minnewashta Park addition (Cermak Nursery Property) Gentlemen: As the most immediate neighbors to the Cermak property, we have been vitally concerned with both the past abuses and proposed future use of the property. We remain apprehensive about any commercial usage from a precedent setting standpoint and the impact on possible, future spread of commercial activities in the area. From a practical standpoint, however, we have looked at all the alterratives to the proposed use permit, including expensive and probably painful litigation, and have come to the conclusion that a sensible agreement of the kind proposed is probably the most intelligent compromise available, with one very emphatic objection concerning wording of the proposed agreement. Under Section 3, "Permit and Conditions," paragraph 14 concludes with the clause "which consent shall not be unreasonably withheld". We believe that this implies unnecessary restraint on the actions of the City Council in considering leasing actions proposed by Baltic Corporation, and that further in any event Baltic Corporation would always have recourse to the courts for any City Council action that might be deemed unreasonable by Baltic. We then would like to request that this concluding clause of paragraph 14, be struck from the agreement. Also, before finalization we would like to have included in the proposed landscape plan plantings, preferably evergreen, along the south side of the property to the western boundary with sufficient height and density to provide an effective and attractive visual screen with the prime consideration being esthetics. In the event that Baltic receives approval to use the property for a professional building on a nonconforming use permit, we hope that the record clearly shows the constraints to which use of the property is subject. In this regard, it may be desirable to clearly define the terms retail, business office, and financial. Also, there should be limits on the use of off-street parking incident to business operation on the property. Whether limiting the number of parking places on the property to 13 spaces, while desirable, will effectively limit the degree of business activity is subject to question. We fully concur with the Council's view that Baltic, et al, should clearly understand and permanent record reflect limitations on the intensity of business use available for the property. We also agree with the Council's view as clearly enunciated by Mayor Hobbs and Councilman Neveaux that it is not the intent that further variances will be granted for this property and it is not intended that there should be zoning changes granted in the future. That is, that the R-1 zoning continue in effect but recognizing the property owners' right to economic utilization through the economic life of the improvement placed on the property prior to the residential zoning. A primary reason for our concern as to the ultimate use of this property was stated at the June 18, 1979, Council meeting by John Schumacher. Based upon what we have heard, albeit unsubstantiated, it appears that Baltic, et al, are investing $1,000 per square foot of office space and 13 parking places. By any measure, it is difficult to perceive this as an economically justified investment based upon the purported use. Consequently, we have to suspect that there are undisclosed motives and that there will be efforts to use the property ultimately for purposes other than those which have been indicded to date. Thus, we petition the Council to proceed with extreme caution and that, whatever decision is reached, the record be clear as to the Council's intent and that such record be incorporated as a part of the permanent record for the property. Under the P (Planned) districts, any approvals are associated directly to and an exhibit plan and any changes to that plan, i.e. intensification of use, would be considered a plan amendment to wit a public hearing would be required. 2). In making this or any property in the city a commercial or industrial zone, it would probably make the future reverting of the property back to a residential zone more difficult to accomplish. (The converse of the above is also applicable to all properties in Chanhassen, in that no property is absolutely inviolate to extensive zoning or land use changes because of unfore- seen events, etc. * This proposition is premised upon the realization that Section 20.01 subsection 5 of Zoning Ordinance 47 allows for lots 1 and.2-of Minnewashta Park to continue as a nursery use until the year 2002 and that presently the courts are loathe to uphold such amortized termination of non-donforming uses. Rezoning Recommendation for Cermak Nursery Property from R1 to P2. Members of the Council: This appeal is in response to the April 25, 1979 Planning Commission reaction to its community. When duly appointed commission members reacted negatively to the wishes of the people whom it represented, the homeowners of Chanhassen, I was left somewhat in awe. We live directly behind the Cermak property, were represented in the homeowner's petition to maintain Rl zoning, and are directly affected by the Council's decision. We moved to this fine community one year ago from Colorado and spent three months looking at over sixty potential homes from Edina to Plymouth to Chanhassen. I feel we were very selective and settled in the Minnewashta Lakeside community because of the "environmental integrity" of the area. We researched the Cermak situation before buying our home and were told by the City of Chanhassen that the property was zoned R1 and would remain so, having been changed from commercial zoning in 1963. I assure the Council that had we perceived the Cermak property as anything other than R1, we would not be here today. I challenge you, the Council, to thoroughly research the consequences, short and long term, to rezoning this land. 1. The future value of property to the homeowners in the lakeside area. 2. The effect to the proposed Minnewashta Park directly South of the Cermak property for which land has been donated, and the conflict of traffic and the resulting danger to children in the area. Bob Waibel, Assistant Manager/Planner for the City presented the recommendation for rezoning to the Planning Commission. Following much discussion between the Commission and the audience, Mr. Waibel stated that the rezoning proposal was made by him to get a feel of the community attitude towards the idea. At the risk of another Watergate, I remind you that the meeting was "taped" by the City and invite you to review this. The community responded to the rezoning request with -a petition against rezoning with approximately 100 names of concerned homeowners. The meeting room was packed and more chairs had to be added. The community attitude was certainly well represented, yet a favorable response by the Planning Commission towards rezoning? Why would the City not have rezoned this land for Cermak rather than forcing him to earn a living within the restraints of R1 zoning, yet favorably consider a rezoning request now? I submit that Baltic bought the property knowing full well of its zoning restrictions and see no reason to change the restrictions on this land now. I feel Chanhassen has adequately planned for.business locations within its development plans, and that areas exist where good business partners can co- exist with the community. I also suggest, as a businessman myself, that a reputable growth oriented business would prefer such an area in which it could support and promote itself and the community. Let's keep the current integrity we have in the Minnewashta area. You, the City fathers, have a fantastic lakeside community developing to the North of Chanhassen. It was evident from the reaction from some of neighboring property owners that there are some gross misconceptions as to our inten- tions surrounding the purchase of this property. The property was purchased April 1, 1979 for the express purpose of office space for myself and a few employees. We currently office in the downstairs of my home in Greenwood and do not have adequate space for the nine persons on my staff, comprised of clerical and executive personnal. We were very lax in our public relations on this property prior to the public hearing as we assumed that the surrounding property owners would be totally pleased with our intended useage, as we are well aware of the history of the problems with the previous owners. It is our intention to clean up the property, have it fully land- scaped and totally renovate the interior and exterior of the build- ing per the elevations submitted to the planning commission. We do not have nor do we plan to have any retail traffic in con- junction with our business. As I indicated, there are presently nine employees which should certainly qualify the useage as less intense than the previous application. A special use permit or any other mechanism which would allow us to use this property for an office would be satisfactory. Contrary to rumors, we have no in- tentions to try to convert the property into a shopping center or fast food restaurant. All interested persons were heard at the meeting and not one tax -paying, homeowner favored the proposed change. A petition with nearly 100 signatures was presented to the Council protesting a change in zoning. Several residents from the surrounding neighborhood have contacted this office with questions regarding the present zoning, the proposed land use and zoning, and their compatibility with the surrounding neighborhood. In summary, questions were raised as to whether or not this property has market viability as single family because of its proximity to Highway 7 and with no present noise abatement measures, the possible compatability of multiple residential on the property, and the zoning contract limitations that would assure that the presently proposed office facility is not, over a period of time, unrealistically intensified. My comments regarding the above stated issues are as follows. In its present R-1 zoning, there is no question that the property is compatible with the surrounding area, however I -do believe that there is questionable marketing attributes of the property as single family due to influences of Highway 7 and the costs of diminishing that influence. As multiple residential., the future residents would likewise feel the effects of Highway 7 and would additionally be a more intensive traffic generator than the proposed use. As to the overall compatibility of the present request, I believe that the office use is benign to the residential neighborhood with respect to traffic generation and visual impact. There is presently no complete assurance that any properties in Chanhassen will maintain their character into perpetuity, however the development contract provisions are a more comprehensive means by which the spirit and intent behind a rezoning are.k.ept intact. Presently the P zoning gives much more control over the present and future land uses on a particular parcel than any of the C zoned categories.
