The number of variance requests handled by the City during any one year is significant. There is no means by which the city treasurer and planner can keep` individual records for this many accounts without incurring a larger cost for accounting than for processing the variance. Approximately 1 year ago, it was determined that a flat fee of $35.00 per variance would be established - assuming that no input or work -would be required by either the engineer or city attorney's office. No requests for work to be completed by the engineer or attorney should be made by any,o-ffice on variance requests unless the city treasurer- has approved. l.how payments for such will be made....: Additionally, ..the city attorney and/or engineer shouJd-not bill; nor will the city pay,-for,:such work unless such authorization has occurred. 2). Work completed on the Proshek variance request. occurred prior to the time in which a set fee was established. If this application would have occurred today, under the guidelines above, such would have necessitated requiring the developer to place additional -monies with the city prior to initial submission to the city council.. This did not occur. The billing has occurred. The city needs to collect this unpaid bill. The, property owner will be required to pay the amount shown in the city treasurer's report prior to receiving a building permit. To my recollection this case has been a variance request from its inception. As you well know the City has instituted a standard variance fee of $35.00 for such requests and to my knowledge has no provision for time expended over and above the $35.00. Backqround Community Location: As shown in enclosure 2, the subject property is legally described as lots 7 and 8, Red Cedar Point Addition. Existing Zoning: The subject property and environs is zoned R-1, Single Family Residential. Municipal Services: Sanitary sewer and water is in place and in service to the subject property. Because Lots 7 and 8 were in separate ownership and did not meet the lot area requirements for single family structures, the city council assessed only an "area" assessment for the construction of sewer, water and hardsurfaced roads. The combination of lots 7 and 8 into a buildable parcel, however, will cause the city to place one unit assessment on the combined lot. Previous Council Action In September, 1976, the city council granted a variance to Dr. Lumir Proshek to construct a home on Lots 7 and 8 even though said Lots 7 and 8 did not meet the 90 foot frontage requirement of city ordinance 47. At that time, however, the city placed Dr. Proshek on notice any structure which is proposed to be constructed on lots 7 and 8 shall meet all city setback requirements. These setback requirements 'Mr. Don Ashworth -2- June 17, 1977 include, but are not limited to, side yard setbacks (10 feet); front yard setbacks (30 feet); and lake side setbacks (75 feet). Planner's Comments 1. Prior to the adoption of ordinance 47, a seasonal dwelling existed on lot 7. Subsequently, said seasonal dwelling was destroyed by fire. Evidence of the original structure presently exist on Lot 7. 2. The petitioner is requesting permission to construct a new residential dwelling unit utilizing the foundation of the original structure which was constructed on Lot 7. As you know, non -conforming uses which previously existed prior to the enactment of the zoning ordinance, which have been destroyed more than 500, shall be reconstructed in compliance with the current zoning standards. The variance petition, at hand, begs the following hypothetical question: Will the cit, permit owner of lot 7 to utilize the previously constructed foundation for a new dwelling unit, when the foundation is only seven feet of the existing right-of-way? Planner's Recommendation Although there are many natural and manmade constraints having a impact on the placement of a new structure on lot 7 and 8, I feel the petitioner should be required to prepare and submit building plans in complaince with the setback provisions of Ordinance 47 pursuant to the Board of Adjustments and Appeals recommendation of September, 1976. Board of Adjustments and Appeals Recommendation The Board of Adjustments and Appeals duly met on Tuesday, June 7, 1977, to consider Dr. Lumir Proshek's second variance request. Proshek and Elizabeth M. Bruzek. Willard .Johnson and Craig 5huistad were present as members of the Board. The applicant desires to combine Lots 7 and 8, Ebck 4, Red Cedar Point into one buildable single family lot. The lot width will be SO feet, whereas City Ordinance No. 47 requires a 90 foot lot width at the buildable setback line. The Board sees merit in the request. Lot —laths on Red Cedar Point are 40 feet, making it impossible to meet lot width minimums unless three lots are combined for a total of 120 feet. The two lots in question have rubbl-r. from two cottages which 'o--merly existed on them. They are not mzin}ained and contain debris. Adjacent neighbors have voiced no objections. Variances for combining two 40 foot lots have previously J.)een granted in Red Cedar Point. KENNEL PERMIT - BOB GOLLA: Mr. Golla was unableto attend this meeting and asked that this item be postponed. Several residents -of Bluff Creek Drive were present. On July 12 the Council acted to deny Mr. Golla a kennel license.and he was given 30 days to remove all but two of the dogs. This. has not been done. Craig Mertz reviewed the grounds for denying the kennel license. 1. There is continuing violation of the other terms of the Animal Control. Ordinance. 2. There is not proper zoning for a kennel. 3. City Manager/Planner, Bob Waibel SUBJ: Proshek Variance Request APPLICANT: Doctor Lumir Proshek PLANNING CASE: P-359 Petition As shown in the attached planning materials, Dr. Proshek is proposing to construct a single-family residence on a parcel containing 11,280 sq. feet and utilizing a sideyard setback of eight feet, and frontyard setbacks of ten feet, and eighteen feet. Ordinance 47 requires that residential lots in R-1 Districts be 15,000 sq. feet in size, and maintain frontyard setbacks of 30 feet and sideyard setbacks of 10 feet. Additionally the Shoreland Management Ordinance requires lots on Minnewashta Lake to be 20,000 square feet in area. As shown in the attached community location enclosure, the subject property is located on lots 7 & 8 of Red Cedar Point. The Board of Adjustments and Appeals previously reviewed this case in 1977, and recommended action be tabled until the City receives specific building plans. Also among the attached materials, are copies of the minutes of the September 13th, 1976 City Council meeting wherein the variance request for the construction of a house on lots 7 & 8 was approved. It cannot be directly ascertained at this time what setbacks were involved or proposed with this particular request, however, it is believed that they would be similar as those presently requested. From all appearances, this request is being initiated because of the statute of limitations of one year on variance approvals. In assessing this particular request, it seems that the best way to arrive at a decision is to look at the positives and negatives of this request. In my opinion the positives are as follows: 1. The frontyard setbacks are relative to a road at a, point close to a dead end. Z.believe that the PLANNING REPORT -2- rch 23, 1978 traffic generated by the two or three houses beyond the subject property is negligible to the need for a 30-ft. frontyard setback, and is additionally of negligable consequence to sight lines. 2. Being that one of the major reasons for side ,yard setbacks is to maintain a fire break, the problem is diminished in this case because the adjoining residence is constructed of brick. 3. The subject property is located in a plat created in 1913, and presents the same situations that have been of concern for variances in Carver Beach. NEGATIVES 1. The subject property was deemed unbuildable as per the 15,000 sq.ft. requirement of the Red Cedar Point water and sewer project. The city council at one time recommended that the.square footage requirement for Red Cedar Point be considered for possible exception to the 15,000 sq. ft. requirement, however no final figure was arrived at. 2. Approval of the subject request would not be entirely consistent with past interpretations of Zoning Ordinance 47 and could be possibly'be detrimental to the future integrity of this ordinance. RECOMMENDATION I feel that by and large, this request is very much a judgement call, however I also believe'in order to preserve the integrity of the ordinance standards, that the.requ_:st should not be app- roved until the city council establishes an exceptional square footage requirement for Red Cedar Point similar to that of Carver Beach. Should a recommendation of approval be forthcoming from the Board of Adjustments and Appeals, I recommend that sewer and water unit assessements be levied on the subject pro- perty as per the local public improvement project. Specifically, you failed to mention: 1). That the city council has approved a variance for building on these lots and that the assessment for such was levied at that time; 2). That the Board of Adjustments and Appeals,at the time of considering the variance for a buildable lot;.noted their concern for the 30 foot setback requirement and thus should have placed the applicant on notice,at that time.of the city's concern relative to this issue; 3). The map provided to this office is grossly inadequate and in error. This of and in itself would not be significant except several excellent maps were prepared by the city attorney's office explicitly depicting right-of-way, foundation location, etc.; 4). The street and utility easement shown by the attorney does not appear to represent the actual location of the existing street. Specifically, you should direct Schoell and Madson to determine where the northeast corner of lot 8 is, the location of the 30 foot radius point for street purposes, and the intersection of the 30 foot radius and the east line of lot 8 - all in an effort to determine the existing roadway location and/or the location of such from the proposed structure. 5). The city presently holds an outstanding bill of $108.00 from the previous variance request without considering non -receipt of the present $35.00 requirement.
