Country Kitchens International is submitting the attached plan for
site plan review as per ordinance 47.
Background
1. Community Location: As shown in enclosure 1, the subject property
is located at the southeast quadrant of the intersection of Dakota
Avenue and Highway 5 (Chanhassen Estates Outlot 2).
2. Existing Zoning: The subject property is presently zoned C-2
commercial district.
3. Utilities: Sanitary sewer and municipal water are available to
the subject property.
4. Comprehensive Plan Proposal:
a. Land Use: Pursuant to the adopted city comprehensive plan,
the subject property is to assume and maintain a single family
residential identity.
b. Transportation: Pursuant to the adopted thoroughfares and
transportation plan, Highway 5 is to function as an expressway.
Planner's Comments
The proposed plan is adequate to ordinance standards for the number
of parking spaces, however, the southeasterly most two spaces encroach

within the setback for parking areas as required by ordinance.
At the writing of this report, the proposed plan meets the requirements
of the site plan review procedures with the exception of the absence
of a landscape plan. The planning commission should not pass on any
final recommendation to the city council until said landscape plan
is available for comments.
It would be the request of this office that the applicant try to
retain as many of the existing healthy trees presently on the
property while carrying out their development.
The subject proposal does meet the threshold for Watershed District's
review before any final city approvals are made.
From the plans submitted to date, it appears that a subdivision of
the outlot will be necessary. The applicant should be advised that
pursuant to State law, subdivisions require public hearing and also
that the exact of the proposed subdivision must be indicated in sketch
plan form and available to city staff for publication two weeks prior
to public hearing.
The sign for the proposed development must be reviewed by the sign
committee and application should be made to initiate that process.
Planner's recommendation
I recommend that the Planning Commission accept the proposed plans for
site plan review purposes and encourage the applicant to proceed with
subdivision plans. The applicant should be advised that it is to his
benefit to seek expeditious Watershed District review, and also to
submit to staffs proposed line of subdivision as early as possible
for public hearing purposes. The plan submitted to date does appear
to have adequate room to meet city ordinance standards and could
substantiate adequate lines of subdivision.

SUBJ: Site Plan Review and Building Permit Approval, Country Kitchen,
Southeast Corner of Dakota Avenue and Highway 5.
It was anticipated that this item would be considered on December 4,
1978. The applicant asked that the item be deleted and considered
on December 18, 1978. Subsequently, I received a letter from the
Chanhassen Estates Residential Association requesting to speak on
this item and I responded to their request basically stating the
city's rules of procedure in addressing the city council (see
attached letters). It should be noted that this is not a public
hearing as the property is properly zoned for the proposed use.
On December 14th I received a call from Country Kitchen asking that
this item be deleted as they desire to make certain parking lot
changes. Given the above comments, I have requested that a representa-
tive of Country Kitchen be present on Monday evening to review
the sketch plan as presented to the Planning Commission and their
building plans. In so doing, citizens of the Chanhassen Estates
area could be allowed to speak on the proposed development with
the city council tabling action on this item until January 15, 1979.
In so doing, the council and Country Kitchen could consider comments
made by the residential community prior to any final consideration
and before final changes are made in the plan. This would additionally
allow time for the item to be re -reviewed by the Planning Commission
should it be determined that the parking lot changes being considered
are significant changes.

In regards to your letter of November 28, 1978, Country Kitchen
will be requesting the city council to issue a building permit for
the construction of a Country Kitchen restaurant located at the
southeast corner of Highway 5 and Dakota Avenue on December 18, 1978.
A copy of the proposed development as well.as Planning Commission
comments are available at City Hall for public review.
At the present time, I am unable to inform you as to whether or not
we will be able to meet at the Chanhassen Elementary School or whether
the meeting will. be scheduled at the old St. Hubert's Church. You
should advise residents in your area to check the proposed agenda
as published in "Karen'ts Corner" in the Carver County Herald the week
prior to the proposed meeting (edition of December 14th).. This will
be.a public meeting and you are invited to be present and speak.
However, this is not a public hearing'where residents of Chanhassen
Estates would be.receiving a personal notice.
It has been the past policy of the City Council to allow both pro-
ponents and opponents. of proposed developments to speak prior to
city council action. Additionally, the city will consider any written
comments presented. To insure that the city council has an opportunity
to review any written comments submitted by yourself or residents of
Chanhassen Estates, I would respectfully request that such comments
be forwarded to City Hall on or before December 14, 1978. This will
allow this office to include copies of this material in the council
packets and allow for the council to consider this information in
advance of the meeting. Written information may also be presented
on the evening of December 18, 1978.
The council established rules of procedure state' "To avoid confusion,

An article in the current edition of the Carver County Herald
states that Country Kitchen is interested in locating one of their
restaurants at the south east corner of the Highway 5 and Dakota
Avenue intersection.
I am writing to you to request your assurance that prior to any
approval being given by the City to a proposal from Country
Kitchen, a Public Hearing on the subject will be held and all
residents of our neighborhood will be informed of the time and
place of the meeting.
My request is made not because opposition has been expressed,
but to make certain that our residents are given the opportunity
to become acquainted with all of the facts and express any opinions
they may have.

Country Kitchen International has made application for site plan
review before the Planning Commission and City Council for the
location of a restaurant in the southeast quadrant of the intersection
of MTH 5 and Dakota Avenue.
Site Plan review is the planning procedure utilized when a particular
development proposal is conforming with respect to the zoning of the
parcel upon which it is to be located. The site plan review process,
more or less acknowledges, that the land use is compatible as the
official zoning map may have it, however, it's primary purpose is
to make certain that the physical planning criteria setforth in the
city ordinances are maintained in the particular development.
Purposefully this planning report has been generalized for the reasons
cited in the city manager's report. Through my correspondence with
representatives of Country Kitchen, I have learned that there are
certain changes being made on' -.their previously submitted plan, and
their representatives have been advised that these changes will
have to undergo further planning commission review.

SITE _PLAN REVIEW -: -COUNTRY KITCHEN:. Country Kitchen International
is proposing to construct a. restaurant on property located east -of
Dakota Avenue known as. Outlot 2 Chanhassen Estates., The property is
zoned C-2 and sewer and, water: are -available. - The proposed plan is
adequate to ordinance standards for the number of parking spaces ,
however, the southeasterly most two spaces encroach within the setback
for parking areas as required by ordinance. The proposal does not meet
the threshold -for- watershed district review as it'is 3/4 acre.- The
property will be --leased from .the owners .of Outlot 2. The sign for
the proposed development must be reviewed by the Sign Committee.
The -Assistant City Planner further recommended that the westerly most
egress onto the property should be eliminated to give more stacking
room from the' -frontage -road to.Dakota Avenue.

"Mr'. _Mason so we would -like to leave the ,parking as
..is. -.-Bob was rtalking about closing off_ the western
curb cut. Initially we would like to request that
:--_we-could have this -curb cut until. the traffic became
severe from MTSfand then at: -the discretion of the
city we would elect to -close it the moment we
.donIt--feel-it would be a stacking problem. We will
try to keep. as much of the trees as we -can. We have
-plans _:to ,.put our own. 'I brought !a -picture of one of
our typical restaurants so you can -see how the decor
will:fit in.- The trash area will. be enclosed and
bricked so that it won't -look -unsightly.
--There about 9.6 acres'in Outlot.-2 of which this is
-approximately 3/4 of. -an acre. ' The:thing that I am really
_-,concerned.about -is -the expanse of the -parking area being
one- solid: blacktop area—, I have to -`go along with staff s.
-.feeling about-- some kind! of -a buffer in- order to give us
-.-,---some -.way of breaking whatever development we might find
east on.that •property. I -think it is a very good use of
the land..__-:
Pat Swenson - As I understand it, this would be facing Dakota so actually
the lands cap ing.would-be facing Dakota and the station
.across.the street, -according - to the:map I see here what
would you propose between the -building and Highway 5?
Are —you. —planning any planting there? .
Terry Savchek - We do have --some small -plantings -there. I believe there
are some trees there now. If anything that is there
is salvageable we will keep it.
Pat Swenson - I think that would be rather important to me.- -We have
such a conglomeration of things .facing Highway 5 and I
am a little concerned about it.
Roman Roos - Last week we were talking about,existing-trees on that
location. I am talking about some of the older trees
a couple of them are dead but some of them are very very
sharp and they felt they could work around a couple of the
trees.

proper zoning.. No subdivision involved. There is no
-conditional use -permit as it. is not in the CBD. This is,
by our ordinance, a site plan review.
Tim Stone -
There are -some issues which I haven't heard addressed.
I see -.some light standards being shown. I don't have any
clear indication -of what kind.of shielding or baffling
devices •are : avai•lable on that.
Roman Roos
- I think -their use of the land, I would have to go along
-with Country Kitchens is a viable use of the land.
Tim Stone -
No disagreement on that.

- I don't think s-o as long as I have got a chance from a
commission point. of view to be sure that some of the points
that we have brought up would be in there. The intensity
of the -light is -a very.:valid point.- - This piece of property
is about- 200 feet from -the property line of the existing
dwellings to the south.
Bob, there is one other question we talked about before
you -came. -down and that was the buffering on the eastern
border -of the -property. .Eventually if -you .were to make
another development to the east you might tie that parking
lot together and that's something I:definitely would -not
want to see.:

for everybody-cto :have -their .own little thing.
Gene Reilley - Certain type of retail use have different peak parking
periods.

_= about would be the deletion of the .curb.- cut. ---Do it now.

elimination ' of two parking - spaces --in the. southeast corner.

Roman'Roos - Another item.we brought up:would be the saving of the
-existing trees that we'can on that property. -Another
would be the enclosing or.the.continuity of the facing
of the northern property to'enclose the trash area.
Sign review. Establish lease lines that would discourage
cross easement parking.
Gene Reilley - Wouldn't you be able to control that when we would come
in -for the use on the other piece of property?
Bob Mason - The thing is though that in talking about the cross.easement,
planning commission's change too and I hate to see us
eliminate something today that we might or might not want
and have another planning commission_ come along.later after
we can't even make the change with Country Kitchen any
more and not get a cross easement if we so desire.
Roman Roos - One nice thing about taking each proposal as it comes in
an outlot development is you can control the landscaping

on each and every --one. Anytime -you put landscaping in
a parking lot you make it much more attractive to the
general -public.:_ If you have 'cross easement parking you
have no way of putting landscaping in whatsoever. It's
almost_impossible.to -consider this=in total we have to
take a look at this one -'section. As�an alternative..
possibly :a' of curb cuts there 'so that you have
access into the parking lot. That's a different ballgame.
We have -to have -some Hof -break -point., j,.j think something
like that could be covered -under the -next. proposal that
might come in. .
Tim Stone.- I would.like.:.to'add one more.. That the landscaping of the
project be. -'consistent with the photograph submitted.
Tim Stone moved to recommend -approval of the sketch plan as submitted
with the eight comments :as .setforth 'above. - Motion seconded by Mal

VARIANCE REQUEST-,- SUPERAMERICA.-SERVICE STATION:_ Superamerica has
submitted :building ng plans ,to :the city to -add a 8 -x 12 -foot metal storage
shed to their building -located at _the lower =Y.. - They want to store
existing equipment that is presently -left outside -at -night and subject
to vandalism and burglarly. A variance is requested=to Ordinance 45.
Craig Mertz -- -The issue of intensification; focus' -on the fact that the
zoning. 'is:�C-3 -and service stations are:permitted in that
area. ._The non -conforming 'is the fact that your Ordinance
'45 `says -we-don't want to'issue:a building permits in
unsewered'areas'-so you�are intensifying a commercial use
in an unsewered area and:not'the fact that you are making
a service station any worse. -or better.
Mal MacAlpine moved to recommend the Council grant:--avariance to
Ordinance 45 to allow the erection of a metal storage shed at the
SuperAmerica-Service-Station.• Motion seconded by Pat Swenson and
unanimously approved.
Members felt it is not -an :intensification of the use. .-It is putting
under cover those things that they normally store outdoors and they
have experienced some. --vandalism -and --burglarly:-of•:.these items.. .
AMEND CONDITIONAL USE PERMIT - HANUS FACILITY::mi% Hanus was present
seeking approval -of an -amendment to his conditional use Permit -to allow
Minnesota Roadways Company in his building'on West- _79th Street.as Eggan
Van is no longer in.the building. Minnesota Roadways`is a road sealer
operation with ten trucks and two small asphalt applicator trucks. No
asphalt material will be stored'on the premises except in the liquid
asphalt distributor trucks.- Members discussed parking of the trucks and
felt the best location would be in the northeast quadrant of the property.
Some of the equipment will be stored inside as well'as repairs will be
done inside. The Assistant City Planner will prepare a proposed
amendment for.Mr. Hanus and Planning Commission review prior to Council
review.
