As you are aware, the City Council waived the buildability
restriction on Outlot A of Andy's-Acres so that one residence
could be constructed on the north side of the sanitary sewer
easement. A building permit will still be required before any
construction can proceed, but this application should cause no
difficulties if all setbacks and other ordinance requirements are
met.
Again, as a building permit is processed, the City will move to
levy a sewer and water assessment in the amount of $6,749.76 (if
construction occurs by October 1, 1984). This cost will be
reduced by the costs you incur in stubbing utility services to
your property line.
Should you have any questions concerning the above or the
Council's action, please let me know.

3UILDING PERMIT REQUEST, OUTLOT A, ANDY'S ACRES:
Bill Monk - The request tonight by the Ellsworth's is to build on the
northern portion of Outlot A north of the sewer easement that bisects
the property. When Bob Waibel and I reviewed this initially some weeks
ago we didn't see any problem with issuing a permit. It was only upon
finding that there was a restriction on the plat itself that required
it to come before the Council for their review. My comments are that
since utilities can be extended in on a permanent basis that will not
have to be relocated as the extension of the road would be undertaken.
I do not have a problem and find the request quite reasonable and I am
recommending that the Council approve the request by waiving the
buildability restriction as originally placed when the plat was
approved.
Councilman Horn moved approval of the building permit request for
Outlot A, Andy's Acres. Motion seconded by Councilman Geving. The
following voted in favor: Mayor Hamilton, Councilwomen Watson and
Swenson, Councilmen Horn and Geving. No negative votes. Motion
carried.
PRELIMINARY AND FINAL PLAT APPROVAL, KETTNER'S FIRST ADDITION:
Scott Martin - The Kettner's prepared the final plat and came here
during the period when the Council changed the policy to allow simple
subdivisions of three lots or less to be done by metes and bounds.
They are subdividing it because there are two existing residences on
the property and they want to be able to sell off one of those.
Councilwoman Swenson - How does the applicant propose to have ingress
and egress from this when they are not allowed to go out onto Stoughton
Avenue and not allowed to go out onto Highway 212?
�= Scott Martin - They would be required to use the same access that is
there today which is on Stoughton Avenue. The county is saying that
they are not allowing more. There are two homes on one lot and they
want to subdivide into two lots so they can sell off one of those.

SUBJ: Building Request for Outlot A of Andy's Acres - 1-211'e'l
At its last meeting the City Council denied a building permit request
for Outlot B of Andy's Acres due to the high probability that serious
improvement/assessment problems would result in the future. An
inquiry has now been received from Roger and Kelly Ellsworth con-
cerning the buildability of the northern portion of Outlot A (see
attachments) that raises many of the same questions.
The circumstances in this instance are less severe in that sanitary
sewer is available along a portion of the east property line as well
as running east to west through the center of the lot. Watermain is
available at the northeast corner of the property while an existing
but unused gravel driveway already runs into the lot from the inter-
section of 64th Street and Oriole Avenue.
The request before the Council with this item is to waive the original
plat requirement that restrictions be placed on the Outlots' build -
ability until further platting or subdivision take place. Since uti-
lity services and a driveway can be permanently installed in such a
way as not to be affected by a future extension of Oriole Avenue, this
office views the request as reasonable.
Should the Council concur with this position and lift the buildability
restriction, it should be noted that only one structure would be per-
mitted until the Outlot is further subdivided when improvements are
extended. Also, the approval would constitute grounds for levying a
water and sewer unit assessment without street restoration costs being
included. Instead, the northern portion of Outlot A would be fully
assessed for streets if and when Oriole Avenue is extended. The
southern portion of the Outlot would be eligible for future
assessments as improvements are made available. This arrangement
would allow for orderly improvement extention and assessment of costs
to benefitting property in the future.
Again, waiving of the buildability restriction of Outlot A of Andy's
Acres is recommended so that a building permit can be issued at this
time.

Andersons were present seeking approval to subdivide approximately five

Councilman Matthews moved to grant approval to the Anderson Subdivision,

1. That the right-of-way of Oriole Lane and Forest Avenue be dedicated,
2. That Lot 4 become a part of Outlot A, .

Mr. Anderson is requesting to subdivide an approximate 5 acre parcel
into three residential building sites, and two outlots.
Comments
As shown in enclosure 1, the subject property is located in the
southwest quadrant of the intersection of Pleasant Avenue and Oriole
Lane.
At the outset of reviewing this case, there was some question of
how the Anderson property related to the Minnewashta Park plat since
the official.rmap indicated the existence of the Minnewashta Park
addition, recorded in 1887, and the Anderson deed description had
no recognition of elements of the Minnewashta Park plat. The major
problem regarding this was whether the Anderson Legal description was
totally accurate, and the findings were that the right
of way for Forest Avenue and Oriole Lane are to be dedicated at this
time.
Sanitary sewer and municipal water are presently available to the
subject property, and there exists a sanitary sewer easement along
the southern edge of proposed lot 3.

As part of the plat requirements, it is recommended that the applicant
be *nermitted to reduce the 60 foot right of way, as depicted
in the Minnewashta Park plat, to 50 feet along and through his property,
and also that the applicant dedicate an additional 10 feet to the existing
30 foot cartway representing Oriole Lane.

The Planning Commission held a public hearing on the subject proposal
at its meeting of February 14, 1979 and February 28, 1979, and
recommended that the city council approve the Anderson Subdivision
under the conditions that 1) that the right of ways for Oriole Lane
and Forest Avenue be dedicated, 2) that lot 4 become part of outlot A,
3) that outlot A be that part of the Anderson property south of Lot 3
and North of Forest Ave, and that the Anderson property south of proposed
Forest Avenue be platted as outlot B.
Recommendation
I recommend that the city council approve the J. Harold Anderson
Subdivision request upon the conditions setforth by the Planning Commissioi

SUBDIVISION VARIANCE REQUEST, 615 LAKOTA_ LANE, MAYN__ARD_ HA_PPE: Mr. Happe
was present seeking variances to create three lots in the unsewered area
of the City. The following variances are requested:
1. Lot shall have a depth not greater than two times its width.
2. Lot shall have a minimum frontage of at least 180 feet at the
building setback line.
3. One side yard of not less than 100 feet.
The Planning Commission recommended denial of the request.
Councilman Horn moved to grant the variances for the subdivision at 615

to grant approval of the subdivision conditioned that no building permits
will be considered for 0utlots A and B prior to platting or subdivision
of such lots. Mr. Ahlm is requesting to use approximately 375 feet of
the unimproved Oriole Lane right-of-way south of West 64th Street as a
temporary driveway and utility easement.
Councilman Geving moved to deny the request for a building permit for
Outlot B, Andy's Acres. Motion seconded by Mayor Hamilton. The

SEWER AND WATER ASSESSMENT, LOTS 490-496, CARVER BEACH: Mr. and Mrs.
Jerry Cziok were present requesting building permit approval to construct
a home on Lots 490-496, Carver Beach. The City Engineer recommended
denial of the request due to the City's inability to provide year round
access until the street is upgraded and that the sewer and water
assessment be abated. Mr. Cziok submitted a letter stating his arguments
with this recommendation. The Council discussed the situation in terms
of safe access, other lots in a similar position in this area and the
applicant's ability to petition for street improvements.

This letter is in regard to the outlot adjacent to the Oriole
Road and Forest Avenue proposed extensions.
What I am proposing to do is put a driveway in the proposed
Oriole Road extension which I have marked out in red on this
plot map. I would like to build a house on the furthest south
outlot of Andy's Acres. I have received approval from the
people who border this property. (See signatures)
In addition, I've had a sewer and water contractor look at this
property, and had him give me a proposal of what type of pipe
would be used. His recommendations are six (6) inch PVC for
the sewer pipe and one and one quarter (14) inch PVC water pipe.
From my prior conversations with both you and Bill Monk, It has
became my understanding that your main concern is that the
driveway to the proposed hamesite will be built over a future road
extension of Oriole Road. It was also my understanding from
our conversations that these two intersecting roads will probably
never go in. It's my opinion that if Oriole Road or Forest
Avenue ever would go in, an existing.driveway would not hinder
any new development.
I would appreciate it if you would give this some thought and
consideration. Please contact me if you have any questions.

build your home in Chanhassen and that we may get the opportunity
to work together in the future.

SUBJ: Building Request for Outlot B of Andy's Acres
Inquiries concerning the buildability of Outlot B and the
northern portion of Outlot A of Andy's Acres have been received
by the City recently. However, only the request for Outlot B was
received in time to be placed on Monday's agenda.
The inquiry concerning Outlot B was submitted by Mr. Greg Ahlm in
the form of a request to use approximately 375 feet of the
unimproved Oriole Avenue right-of-way south of 64th Street as a
temporary driveway and utility (services) easement. In checking
the original plat conditions of 1979 (see attachments), however,
it was found that the Council would also have to consider
rescinding a previously established condition (No. 5) that
restricts the buildability of both Outlots until the property is
further platted or subdivided.
In initial conversations with the applicant, I stated my reluc-
tance to support this type of situation. Review of the orginal
plat documents has only reinforced my belief that until orderly
platting and extension of improvements is initiated, issuance of
a building permit for Outlot B is premature.
Even though this proposal would generate much needed revenue for
the North Service Area, it would have a negative impact on
assessments when improvements are actually extended. This office
finds that it must reluctantly recommend denial of the submitted
request.

Mr. Anderson is requesting to subdivide an approximate 5 acre parcel

As shown in enclosure 1, the subject property is located in the
southwest quadrant of the intersection of Pleasant Avenue and Oriole
Lane.
At the outset of reviewing this case, there was some question of
how the Anderson property related to the Minnewashta Park plat since
the official map indicated the existence of the Minnewashta Park
addition, recorded in 1887, and the Anderson deed description had
no recognition of elements of the Minnewashta Park plat. The major
problem regarding this was whether the Anderson leqal description was
totally accurate, and the findings were that the right
of way for Forest Avenue and Oriole Lane are to be dedicated at this
time.
Sanitary sewer and municipal water are presently available to the
subject property, and there exists a sanitary sewer easement along
the southern edge of proposed lot 3.
As part of the plat requirements, it is recommended that the applicant
be permitted to reduce the 60 foot right of way, as depicted
in the Pinnewashta Park plat, to 50 feet along and through his property,
and also that the applicant dedicate an additional 10 feet to the existinc
30 foot cartway representing Oriole Lane.

The Planning Commission held a public hearing on the subject proposal
at its meeting of February 14, 1979 and February 28, 1979, and
recommended that the city council approve the Anderson Subdivision
under the conditions that 1) that the right of ways for Oriole Lane
and Forest Avenue be dedicated, 2) that lot 4 become part of outlot A,
3) that outlot A be that part of the Anderson property south of Lot 3
and North of Forest Ave, and that the Anderson property south of proposed
Forest Avenue be platted as outlot B.
Recommendation
I recommend that the city council approve the J. Harold Anderson
Subdivision request upon the conditions setforth by the Planning Commissio
Manager's Comments
Additional Conditions:
1). The number of deferred units equal the number of lots
('units) proposed to be platted at this time. Placing
such deferred units on the property is recommended.
2). That the attorney's office be empowered to carry out or
require that restrictions be placed on both Outlot A
(as amended to include lot 4) and Outlot B that no
building permits will be considered prior to platting
or subdivision of such lots.

Andersons were present seeking approval to subdivide approximately five
acres into three lots and two outlots.
Councilman Matthews moved to grant approval to the Anderson Subdivision,
Planning Case P-92, with the following conditions:
1. That the right-of-way of Oriole Lane and Forest Avenue be dedicated,
2. That Lot 4 become a part of Outlot A,
3. That outlot A be that part of the Anderson property south of Lot 3
and north of Forest Avenue and that the Anderson property south of
proposed Forest Avenue be platted as Outlot B.
4. That the number of deferred sewer and water units equal the number
of lots proposed to be platted at this time. Placing such deferred
units on the property.
5. That the attorney's office be empowered to carry out or require
that restrictions be placed on both Outlot A (as amended to include
Lot 4) and Outlot B that no building permits will be considered prior
to platting or subdivision of such lots.
6. That the right-of-way of Oriole Lane be 40 feet on the Anderson
property and that the Forest Avenue right-of-way be 50 feet.
Motion seconded by Councilman Geving.. The following voted in favor:

SUBDIVISION VARIANCE REQUEST, THOMPSON/DANIEL PROPERTY, 7722 FRONTIER
TRAIL: A variance to the Subdivision Ordinance is request to allow
the conveyance of a three foot strip of land from St. Hubert's to
the Daniels.
RESOLUTION..479-17: Councilman Matthews moved the adoption of a resolutior
approving the Thompson conveyance. Resolution seconded by Councilman
Geving. The following voted in favor: Acting Mayor Pearson, Councilmen

On March 19, 1979, the City Council conditionally approved the
Anderson Subdivision. Mr. Anderson's attorney, Luke Melchert,
provided me with a copy of his title opinion dated June 7, 1979.
While my preliminary review of the title opinion indicates that
the Andersons have adequately established their ownership of the
subject property, I must reserve judgment until I have had an
opportunity to compare the legal description stated in the title
opinion with the legal description utilized in the dedication
section of the plat itself.
If and when the Andersons file their proposed final plat, please
provide me with a copy of that document. Also please advise as to
whether this office is to prepare a planning agreement setting forth
the building restrictions on Outlots A and B, and also setting
forth the status of the formerly deferred sewer and water assessment
units.

The Assistant City Manager/Planner read the official notice as published
in the Carver County Herald.
The applicant has incorporated the recommendations of the City Engineer
regarding the 40 foot right-of-way for Oriole and the alignment of
Forest Avenue. Lot 4 is presently ineligible for a building permit
since it does not have sufficient frontage on a public street. If
Oriole Lane were cul-de-saced it would probah?y have adequate frontage
at the building setback line.
Luke Melchert - What constitutes an improved public street?
Craig Mertz - At least gravel I would think.
Luke Melchert - Oriole Lane as it presently exists, I am sure probably
is not up to what your standards would be. Could the
Andersons improve that area in front of Lot 4 to
something less than what your existing standards
would be to qualify for a public road?
Craig Mertz - I think that we could but that's up to the City Council.
It would set a precedent for new subdivisions. -
Jerry Neher moved to continue the public hearing to the next meeting.
Motion seconded by Gordon.Freeburg and unanimously approved.

Walter Thompson called the meeting to order at 7:30 p.m. with the
following members present: Jerry Neher, Mal MacAlpine, and Gordon
Freeburg. Roman Roos came at 8:15 p.m. Pat Swenson was absent.
OATH OF OFFICE: The Assistant City Attorney administered the oath of
office to Mal MacAlpine as a member of the Planning Commission.
MINUTES: Jerry Neher moved to table action on the February 14, 1979,
a�nning Commission minutes. Motion seconded by Mal MacAlpine and
unanimously approved.
INSPECTION OF NEW HOMES: Planning Commission members discussed the
current building inspections of new homes. It has been brought to the
attention of some members that the homes in the New Horizon Subdivision
do not meet current construction codes, specifically the footing
insulation.on unprotected basement walls and floors has not been done
and a 6 inch inside diameter stack is required, 5 inch have been
installed. Planning Commission members did'go to the homes and found
the above to be true. Members would like to have the building inspector
attend a future meeting.
Staff was asked to contact communities that have some of the prefab
type homes being built where the opportunity for the homeowner is
there to finish off some of the home. The Planning Commission wants
to know stages of inspection and if there is a time table for
completion of exterior work.

Recreation Commission will review the proposed plan.
Members expressed concern as to the location of the proposed east -west
street from Lake Lucy Road to Hennepin County Road 62.

Petition
Mr. Anderson is requesting to subdivide a parcel containing approximately
5 acres into 3 residential. sites.
Background
1. Community Location: As shown in enclosure 1, the subject property
is located at the intersection of Pleasant Avenue and Oriole Lane.
2. Existing Zoning: The subject property and its environs are presently
zoned R-1, single-family residential district.
3. Utilities: Sanitary sewer and municipal water are presently available
to the subject property.
4. Comprehensive Plan Proposal:
a). Land Use - Pursuant to the adopted City Comprehensive Guide Plan,
the subject property is to assume and maintain a multiple family
residential identity. The property adjoining the subject property
across Oriole Lane and W. 64th Street is to assume and maintain a
service commercial identity, and the property adjoining to the west and
south of the subject property is to assume and maintain a single-family
residential identity.
b). Transportation - The adopted Comprehensive Transportation Plan
indicates the intersection of Pleasant Avenue and Oriole Lane has an
intersection of a minor collector with Highway 7.
Planner's Comments
1. The subject proposal meets and exceeds the dimensional requirements of
Zoning Ordinance 47 and Subdivision Ordinance 33'for single-family

residential sites. The City assessment records show that the subject
property has one sewer and water unit assessed plus three water and sewer
units deferred as per the North service area public improvement project.
2. As shown in enclosure 2, the subject property has a dedicated right-
of-way in the form of Forest Avenue which is 60' wide and additionally,
Oriole Lane is a 33' roadway to the intersection of 64th Street and a
30' cartway south of 64th: Street. Initially it appears that the Oriole
Lane right-of-way may have to be increased inorder to meet the 50'
right-of-way requirements of Subdivision Ordinance 33.
3. The soil survey map for the City of Chanhassen indicates that the
area around the 960 elevation, has glencoe soils which pose impediments
to construction due to severe moisture problems.Befom further review of
the subject proposal, the City Engineer should: render an opinion as to
the affect of the local soil situation on the ability to construct Forest
Avenue, extend Oriole Lane, and the further subdivision of the subject
property for residential, building sites.
4. The Planning Commission at this time should restrict their comments
to the applicability of the proposed plans to the adopted plans and
ordinances of the City.
Recommendation
I recommend that the Planning Commission advise Staff to order a public
hearing upon receipt of the Casty Engineer's determination as mentioned
above.

Enclosed herewith please find topographical survey as prepared
by Gordon Coffin and a copy of same with proposed sketches I have
made in pencil of proposed subdivision of the property described
therein.
I have drawn Forest Avenue as closely as I could scale it and
Oriole Lane to the south where the forty foot of right of way from
the east boundary line of the Anderson property.
Outlot A and B as shown thereon are further subdivided by
dotted lots running in a northerly and southerly direction and penciled
in are the approximate square footages of each proposed lot in the
proposed future subdivision.
I have also indicated doted lines ten feet on each side of the
sanitary sewer line running along the southerly boundary of Lot 4 of
the proposed subdivision.
The square footage as I calculate for Lots 3 and 4 would be 25,300
square feet and 26,400 square feet respectively.

Subdivision Request
Gentlemen:
We have reviewed Mr. Anderson's proposal to subdivide a
five -acre parcel into three lots. Our comments are as follows:
STREETS.
A 30-foot right-of-way for Oriole Lane exists along the
eastern Anderson property line and a 60-foot right-of-way for
Forest Avenue bisects the south part of the property as shown
on the attached drawing. While neither Oriole Avenue (south
of 64th Street) nor Forest Avenue is presently improved, we
feel both will be improved in the future.
An extension of Oriole Lane will be necessary to serve
Herman Field, the south part of the Anderson property, and
the southwest part of the Reed property. We suggest a 28-foot
wide paved street within a 50-foot right-of-way. Ten feet of
additional right-of-way should be obtained from both the
Anderson and the Reed properties. Additional right-of-way will
not be needed north of 64th Street.
Forest Avenue construction could make further subdivision
of the Anderson property possible and may be needed to serve
properties to the west. The right-of-way, therefore, should be
retained. We feel, however, that the southerly ten feet could
be vacated resulting in a 50-foot right-of-way. This right-of-
way and the existing sanitary sewer easement divide the southern
portion of the Anderson property into two parcels with approxi-
mate areas of 38,250 and 39,375 square feet.

SANITARY SEWER AND WATERMAIN.
Sanitary sewer exists as shown on the attached sheet. Service
to.the southern portion of the Anderson property would require
an 8-inch sewer extension southward with Oriole Lane as shown on
the attached sketch.
Watermain exists at the Oriole Lane-64th Street intersection.
Service to the two southerly parcels would require construction of
a 6-inch watermain in the proposed Oriole Lane extension.
CONCLUSIONS.
While Mr. Anderson has proposed subdivision of his property
into three lots, -Forest Avenue and the sanitary sewer easement
have effectively created two more. We suggest.Mr. Anderson con-
sider subdivision of the property into five lots at this time and
would recommend approval of this subdivision with dedication of
an additional ten feet of right-of-way for Oriole Lane and receipt
of a petition for extension of Oriole Lane and utilities as
recommended herein. Construction of Forest Avenue could make
further subdivision of the two southerly parcels possible in the
future.

SUBJ: J. Harold Anderson Subdivision Request
As you remember, at the sketch plan review of the subject item, there
appeared to be a total absence of relationship of the purported
ownership of J. Harold Anderson to that of the official records of
Carver County. I have attached the following correspondence of
November 28, 1978, from Luke Melchert to myself which recognizes the
officiality of the plat of Minnewashta Park and the dedicated
easements of Forest Avenue and Oriole Lane. It is my belief, that
at this time, additional information such as a recorded deed be
furnished to the city which would substantiate the actual ownership
of J. Harold Anderson which could be related to the Minnewashta
Park plat. I feel that the survey presented to the planning commission
and staff is not sufficient proof in order for us to review this
request any further, especially since it will probably involve a
public improvement feasibility study for the ultimate alignment of
Forest Avenue and Oriole Lane.

Dear Bob:
Enclosed herewith please find a copy of the plat of Minnewashta
Park and also a copy of the half section map which indicates various
plats within various sub -divisions platted out of Minnewashta Park.
It would appear though a good portion of Minnewashta Park has
been replatted that it, nevertheless, maintains the integrity of the
road system.
On both the half section and the plat I have colored in yellow
as accurately as possible the property owned by the Andersons. On
the half section I have also penciled four lots on the North part
of the Anderson property. The sanitary sewer line runs basically
along the South line of the Southern most lot, from there Southerly
the property is quite low and is of questionable buildability.
I trust the enclosed is satisfactory for your purposes in
determining whether or not Forest Avenue continues through the Anderson
property. Based on my knowledge of the property it appears that the
road as shown on the maps would'be going through the lowest part of
the Anderson property. Perhaps your City Engineer has knowledge of the
soil conditions in that area and could better advise you as to the
desirability of constructing a road in that area.
In any event the Andersons are very anxious to do something with their
property. They are of the age that they are not capable of maintaining
the property as it exists and do not have the financial ability to do
extensive planning, etc. Therefore, we would appreciate your assistance
in this matter and hope to hear from you as soon as possible.
