The proposed depth of the garage to be constructed is 22 feet. This request compounded with the fact that Mr. Tock lives on a parcel of land with three frontages and has a width of 40 feet necessitates a three foot variance to side yard setback requirements of 10 feet and 19 foot front yard variance to the setback from the right of way of West 66th Street. Background 1. As shown in enclosure 1, the subject property is located at the intersection of West 66th Street and Huron in the Carver Beach neighbor- hood. 2. Existing Zoning: The subject property is presently zoned R-1, single family residence district. 3. Utilites: Municipal water and sanitary sewer are presently available to the subject property and the subject parcel has been assessed one sewer and water unit as per public improvement project 75-2. Planner's Comments 1. The subject property is non -conforming in that it contains approxi- mately 8,000 square feet whereas ordinance 47 requires 15,000 square feet for parcels in a R-1 district. Mr. Don Ashworth -2- October 12, 1,978 2. As previously mentioned this property has unique difficulty in that it has three frontages, however, it is my opinion that Iroquois would prove to be of marginal benefit improved to city street standards due to the fact that the only egress from the general area would be Devil's Slide with the exception of Huron which has been designated as trailway in the Carver Beach Plan. 3. The Board of Adjustments and Appeals duly held a public hearing on October 3, 1978, to obtain neighborhood sentiment to the subject proposal. The Board of Adjustments and Appeals subsequently voted to recommend that the city council grant a 7 foot side yard variance and a 15 foot front yard variance, which would essentially place the north side of the garage three feet from the north property line which is the same distance of the existing house from the north property line. The Board of Adjustments and Appeals based their recommendation upon the applicant's inability to obtain surrounding lands to carry -out the proposed construction, the applicant's desire to have the garage as close to the house as possible, and that the construction of a double detached garage is a common practice within an R-1,single family residence district.
