Background 1. Community Location: As shown in enclosure 1, the subject property is located approximately 700 feet north of the intersection of Pleasant View Road and Horseshoe Curve. 2. Existing Zoning: The subject property and it's environs are presently zoned R-1, single family residence distrist. 3. Utilities: Sanitary sewer and municipal water are presently available to the subject property. 4. Comprehensive Plan Proposal: a. Land Use: Pursuant to the adopted city Comprehensive Plan, the subject property and it's environs are to assume and maintain a low density single family residential identity. b. Transportation: Pursuant to the adopted City Transportation Plan, Pleasant View Road is to function as a local street. Planner's Comments 1. As shown in enclosure 2, parcel A contains approximately 33,330 square feet, parcel B contains approximately 31,900 feet, and parcel C contains approximately 87,280 square feet. Section 8.06-a:(1) of Mr. Don Ashworth -2- August lr 1978 Subdivision 33, states that in occasion of subdivision "no lot shall be larger than twice the average size of lots in said plat". The applicant has expressed a desire to include the westly most 100 feet with the existing structure on parcel C in order to continue the use of this area for gardening purposes. It is the opinion of this office that the proposed inclusion of this most westerly 100 feet of the property with parcel C, poses no serious problems such as land locking of buildable property, and securement of easements. 2. The applicant has stated to the Planning Commission that he has negotiated the acquisition of the triangular portion of property between Pleasant View Road and the northeastern 96.32 feet of parcel A. This was to be done at the request of the Planning Commission so that parcel A would have the required amount of frontage on a public street pursuant to Subdivision Ordinance 33. 3. The Planning Commission held a public hearing on the subject proposal at it's regular July 26th meeting, and moved to recommend that the city council approve the request and variance to Section 8.06-a(1) of Subdivision Ordinance 33. Planner's RecoMmendation I recommend that the city council approve the subject request as shown in enclosure 2 with the addition of the triangular property between parcel A and Pleasant View Road with the appertainent variance cited in three of the above comments. Planner's Comments 1. The Planning Commission received the proposed subdivision for sketch plan review at it's regular meeting of June 28, 1978, and ordered this public hearing to gather sentiment on the proposed subdivision. At this meeting the issue of frontage on proposed parcel A was brought forth, and since this meeting the applicant has negotiated for the purchase of the property lying directly east of the proposed parcel A up to Pleasant View Road. The purchase would give proposed parcel A more than sufficient frontage on a public street as required by ordinance. 2. At the June 28th meeting, the additional issue of creation of lots greater than twice the average size of lots in a proposed plat was raised, and the applicant was requested to provide information as to the conditions necessitating parcel C to exceed this dimension. In addition to the reasons given by the applicant for the creation of a.,. lot of this size, it is quite apparent that the southeasterly 110 feet of the proposed subdivision can none other than go with the existing residence due to the intrisic geometry of ownership in the vicinity. - The applicant has indicated that it is their preference to include the westerly most 100 feet of the subject property with parcel C because of the potentially marginal building qualities of the soil and the relatively suitable soil conditions for the present gardening and pasture use. It is the opinion of staff that the proposed inclusion of the most westerly 100 feet of the property with parcel C, poses no serious Planning Commissior -2- t July 24, 1978 problems such as land locking of property, and securement of easements. April 6, 1978 Dear Sirs: As you can see by the boring reports that accompany this letter, it is impractical to build two more houses on our property. At the time the assessments were set for special assessments, we were not even considering the possibility of putting more structures on our land. We were assured at that time that we had two very valuable lots that would be buildable because of all the fill from the sewer excavating being dumped there. With an assessment of $18,621.11 being levied we felt that we would have to build. Now we find that it would be too expensive, especially for one family dwellings.
