Petition
Mr. Jacobson is requesting to replat, (1) lots 2569, south 81.89
feet of lot 2670 and south 82.82 lot of 2571 and lots 2578 through
2581, (2) lots 2572 through 2577 and the north 21 feet of lots 2570
and 2571 into two single family residential building sites.
Background
1. Community Location: As shown in enclosure 1, this subject property
is located on the west side of Mandan Road, between Elm Road and Forest
Road of the Carver Beach Plat.
2. Existing Zoning: The subject property and its environs are
presently zoned R-1, single family residential district.
3. Utilities: Sanitary sewer and municipal water are presently available
to the subject property. The subject property (672DO) has been assessed
two sewer lateral and trunk units and two water lateral and trunk units.
Planner's Comments
1. As shown in enclosure 2, the applicant had originally proposed that
the 20 x 20 foot remnant be replatted as part of the proposed southern
lot. Staff had requested that this remnant be assigned to the northern
most parcel for continuity with the proposed property split and also to
bring the two lots closer to each other in size by 800 square feet.
(reference enclosure 3).
2. The Planning Commission duly held a public hearing on the subject
proposal on June 14, 1978 and recommended the City Council approve the
replat with the requirement that a hardshell be filed. The Planning
Commission also recommended approval for the lot area variances of both
lots and the dot frontage variance for the northerly lot.

Planner's Recommendation
In concurrence with the Planning Commission's recommendation of
June 14, 1978; I recommend that the City Council approve the
request of Mr. Jacobson upon the condition that a hardshell be
filed and that an escrow deposit in the amount of $300.00 be made
to assure that said hardshell is completed and filed.

Roman Roos - In the worst case that piece of land could sit there
forever, undeveloped.
Peter Throdahl - The original plan was to go in with the millwork building
first simply because we were outgrowing what we had in
Excelsior. Then the distribution yard. Then the
component plant and then an office building in the future.
That was out original proposal to the city. The use we
are using in the back is permitted under the zoning.
Mal MacAlpine moved to close the public hearing. Motion seconded by Walter
Thompson and unanimously approved. Hearing closed at 9:50 p.m.
LYMAN LUMBER PLAN AMENDMENT:
Mal MacAlpine - I have no problem with the plan as proposed. I think there
is always a risk that you are going to run into in any
phasing. I think they are conscious of what we are trying
to do from a standpoint of concealment from the main road.
It is a permitted use in that area. I think Lyman is a
reputable company. I have no problems with it•.
Les Bridger - As far as phase 2, if it were to pass that they were to come
and want to build some more shed type structures like they
will have, it would still have to come before this body.
We have control in that respect and the worst thing that
could happen would be it would grow up in weeds. We have.
already seen what it would look like without phase 2 in
there. With that in mind I have got no problems with it
at all. I think it is a good use of the land.
Jerry Neher - I have no problems. I can't see that we could not gamble
on the future. It is good for the city. It's employment.
Tax base. It's the thing we are looking for. You can't
say what the future is going to be a few years down the
line. I am in favor of it.
Walter Thompson - Very much in favor of it. I have no objections.
Roman Roos - I also am excited to have them in here. I think the city
needs it and I think Lyman has got an excellent location.

Mr. Jacobson is proposing to subdivide Lots 2569, south 81.19' of Lot 2670
and south 82.82' of Lot 2571, Lots 2578-2582, Lots 2572-2577 and north

Commission recommended that a 20 foot remnent in the west central portion
of the property be shifted to the northern proposed lot. The applicant
has done this.
Mr. Schwartz, owner of property across Mandan, asked if his property

question had no bearing on the public hearing and he should see city
staff regarding his property.
Les Bridger moved to close the public hearing. Motion.seconded by Jerry
Neher and unanimously approved. Hearing closed at 10c00 p.m.
JACOBSON REPLAT, FOREST ROAD AND ELM ROAD,CARVER BEACH: Mal MacAlpine
moved to recommend the Council approve the replat of the subject parcel
into two building sites as identified on Exhibit A dated June 14,'• 1978,
with the understanding thata new survey will be taken as required.
The Planning Commission further recommends the Council approve lot area
variances for both lots and frontage variance on the northern lot
abutting on Forest Road. Motion seconded by Les Bridger and unanimously
approved.

Bob Waibel = As you recall, at the last Planning Commission meeting, • there
was concern.whether or not the road cut in the northwest
corner of the plat,which would egress onto the proposed
Lotus Lake Neighborhood Park, should remain in the plans or
not. Because of the neighborhood status of this park, it
is the feeling of this planner, that the proposed park will
not generate unduly large volumes of traffic through this
development, but will simply provide safer access from this
development to the park. The Park and Recreation Commission
has voted to that Outlot B.be set aside for public use,
open space, and lakefront preservation, and trail corridor
serving the Lotus Lake Park. The Park and Recreation
Commission recommended that the park dedication fee be
maintained and remitted for each lot at the time of building
permit issuance. I was contacted by Jean Lovetank who
expressed concern about Lots 1-8 of Block 1 with respect to
landscaping and grading on said lots because of their
proximity to Purgatory Creek. Upon consultation with the
City Engineer and my personal review of the plans and the
property, I believe that any cut and fill activities on the

The petition before the Planning Commission at this time is to
hold a public hearing as prescribed by ordinance to assess neighborhood
sentiment to the subject replat.
Planner's Comments
1. As you remember, the Planning Commission went through preliminary
plat review of the subject request at its May 19, 1978 meeting.
The applicant at that time was requested to submit a new plan showing
the present boundary lines including distances and square footages on
all structures and land uses within 100 feet of the subject property
and remit an escrow deposit in the amount of $150.00 to the City.
The applicant has since fulfilled these requests to the satisfaction
of this office.
2. The only change of plan recommended
of the 20 x 20 foot remnant in the west

NOTICE IS HEREBY GIVEN That the Planning Commission of the City
of Chanhassen, Minnesota, will meet on Wednesday, the 14th day of June
1978, at 9:45 p.m. at the City Hall, 7610 Laredo Drive, Chanhassen,

As shown in enclosure 2, the northern parcel of the proposed subdivision
as diagramed will contain approximatlly 10,898 square feet, and the
southern parcel is to contain approximately 13,956 square feet. The
20 x 20 foot remnant in the west central portion of the proposed replat
should be included with the proposed northern parcel. This change would
raise the total lot area of the northern parcel to approximately 11,298
square feet, and reduce the lot area of the southern parcel to approximately
13,556 square feet. As shown in enclosure 3, the Carver Beach Guide
Planning Commission -2- May 19F 1978
Plan shows Elm Road and Forest Road to have cul-de-sac service from
Mandan and Nez Perce. Also, Elm Road is indicated to serve as part of
the linear trail system.
Before further consideration and publication arrangements are made for
this request, the applicant should submit a new plan showing the
present boundary lines including distances and square footages and all
structures and land uses within 100 feet of the subject property,
and remit an escrow deposit in the amount of $150.00 to the city
treasurer to defray city staff costs in processing this request.
Planner's Recommendation
I recommend that the Planning Commission order a public hearing to
consider the proposed replat of Cliff Jacobson to be held on June 14,
1978.

Planner's Comments
1. The subject property currently has two sewer lateral and
trunk units and two water lateral and trunk unit assessments placed
on it.
2. As shown in enclosure 3 proposed Lot 1 contains approximately
10,898 square feet and proposed Lot 2 contains approximately 13,956
square feet. Since these lots are deficient to lot arearequirements
for R-1 districts, it should be incumbant upon the applicant to
submit final building plot plans before a public hearing is held.
Planner's Recommendation
I recommend that the Planning Commission order- a public hearing to
be held on June 14, 1978 for a proposed subdivision and lot area
variance. Said public hearing is contingent upon the applicant
submitting final building plot plans to the planning office on or
