PLANNING CASE: P-542 APPLICANT: Lewis Woitalla Petition J 1659,and 1660, �'- J Mr. Woitalla is proposing to construct a single family residence and detached garage on a vacant parcel of land containing approximately 8,918 square feet and having corner lot frontages of 102.46 feet on Mandan Avenue and 76.96 feet on Ivy Road. Zoning Ordinance 47 requires that lots in an R-1 district be 15,000 square feet. Subdivision Ordinance 33 requires that corner lots have a frontage of 105 feet on the adjoining streets. Additionally, a three foot variance to the 30 foot front yard setback is being requested. Background 1. Community Location: As shown in enclosure 1, the subject property is located on the southwest quadrant of the intersection of Mandan Avenue and Ivy Road in the Carver Beach Neighborhood. 2. Existing Zoning: The subject property and its environs are zoned R-1, single family residence district. 3. Utilities: Sanitary sewer and municipal water are available to the subject property. 4. Comprehensive Plan Proposal: a. Pursuant to the adopted Comprehensive Plan, the subject property and its environs are to assume and maintain a low density residential identity. Pursuant to the adopted Transportation Plan and the Carver Beach Plan, Mandan Avenue is to function as a local street, and Ivy Road is to function as a local street in addition to being part of the pedestrian trail system. Planner's Comments 1. The subject property has been assessed one water lateral and trunk unit and one sewer lateral and trunk unit. 2. My original recommendation to the Board of Adjustments and Appeals was to recommend approval of the request in light of the unit assess- ments placed against the property. The Board of Adjustments and Appeals were quite concerned over the deficiency of lot area, however, they voted unanimously to recommend approval. Since this action, further investigation of the matter has indicated that there were no special circumstances that predicated this assessment levy, i.e. existing structure etc. It has subsequently been determined that the placement of the assessement was due to an error on the assessment role. The subject property has been assessed 1 water lateral and trunk unit and 1 sewer lateral and trunk unit. 3. In consideration of the small size of the lot, it would be appropriate to situate the garage closer to the house in order to give the visual effect of more yard area.
