It approved the permit as requested with the following conditions: 1. All work shall be done in a manner to prevent erosion and siltation both during and after construction_ in accordance with the MCWD guidelines, a copy of which is enclosed. 2. All work shall conform to the MCWD Grading and Drainage Guidelines, a copy of which is enclosed. 3. All work shall conform to the requirements of the City of Chanhassen and the Minnesota Department of Natural Resources. 4. Designated storm water ponding areas shall be permanently dedicated for that purpose and legally protected to prevent possible future revision by the use of drainage or flooding easements. Transportation: Pursuant to the adopted Transportation Plan, Minnewashta Parkway (CSAII 15), to which the subject property will egress, is to function as a minor collector. Planner's Comments 1. As shown on sheet 2 of the preliminary development plans, the proposed lots range in size from 12,665 square feet to 38,850 square feet, with an average lot size of 18,899 square feet. For the most part the only unbuildable area of the development, consists of the marsh and creek area at the northern end of the parcel. Methods of protection provision for said marsh and creek area, are mentioned in the developer's proposed covenants and restrictions. 2. Linden Circle, from the intersection of Kirkwood Circle, is appr_ox'i:- mately 700 feet in length. Potential problems of cul-de-sacs this length has been mitigated by requiring the developer to provide 70 foot right -of --way for the construction of two 20 foot roadways bisected with a 10 foot median under which utilities will be installed.. -at the entrance to the.develop-lent. 3. The developer has indicated that he intends to construct double bungalows on lots 15, 16, 17, 27, 28, and 29. For landscaping and noise abatement purposes, a berm is to be constructed along the rear of these lots. 4� The Planning Commission minutes of November 12, 1975, indicate that outlot B would potentially serve as.a water oriented recreation area for the .future residents of outlot A. The applicant has no immediate plans for the development of said outlot B. Planner's Recommendation From a planning perspective I find Mr. Ritter's proposal is positively consistent with the city's plans for this parcel and it's environs. I subsequently recommend that the city council approve the rezoning, preliminary pl.at and development plan for the subject property and encourage the developer to proceed on final development plans. AManager' s Comments Above subject to payment of sewer and water units per report of engineer. \1 Park and Recreation COT ^ssion Minutes Page April 4, 1978 Shirley Chellis made a motion that the Park and Recreation Commission designate Western Hills Park as the Arbor Day planting area. Phyllis Pope seconded the motion. Motion passed. The Commission discussed the merits of vacating Valhalla Street where it terminates on the shore of Lotus Lake. The shore land of a lake is a value to the community. A recent meeting of the Metropolitan Council Open Space Committee had specific concerns about the lack and loss of public lands for fishing in the metro area. Energy shortage is going effect the distance and the number of occasions a g to on will m trips up north and the result will be increased fishinake long the metro area. Another factor which was expressed was the increasingnnum- bers of retired people who will be taking advantage of water based rec- reation on fixed incomes. The sentiment was so intent that the Open Space Committee recommended to the full Council that fishing docks be funded by the Special Use Catagory of Council. Additionally, lake shore will appreciate in value. Pat Boyle made a motion that the City of Chanhassen retain ownership of Valhalla Street and take necessary steps to make certain the land is not misused Shirley Chellis seconded the motion. Motion carried. Pat Boyle would like to be notified when the above issue will be presented for council consideration. Bob Ulaibel reviewed the Ritter Addition with the Park and Recreation Commission. Shirley Chellis voiced concern at the lack of active space in the north and west area of the city. Shirley asked where the closest park was and he replied Leach`s Resort on Lake Minnewashta. Pat Boyle made a motion that the Park and Recreation Commission not accept Mr. Ritter's generous offer to donate land to the city and she recommended that the Park and Recreation Commission endorse the Planning Commission recommendation to abide by ordinance 14-A and contribute cash in lieu of property. Walter Coudron seconded the motion. Motion carried. Bob Waibel reviewed Colonial Grove Addition with the Park and Recreation Commission. After much discussion, Shirley Chellis made amotion that the Park and Recreation Commission recommend that ordinance 1.4-A be applied and further request a donation of cash in lieu of land by the developer. Phyllis Pope seconded by motion. Motion carried. Bob Waibel discussed the Kellynne Development. Shirley Chellis made a motion that Mr. Callahan and Mr. Waibel review the north and west side of Lake Minnewashta and look for a possible park site. Denis Stedman seconded the motion. Motion carried. They can't launch a boat from the beach property. The Planner recommended that the -Planning Commission encourage the applicant to.prepare a preliminary development plan in accordance with Sections 7 through 9 of Ordinance 33 and the Zoning'Ordinance. Said plan should include a narrative statement and drawings that describe the proposed use of the common lot`and detailed dimensions of the sedimentation pond and --the lots adjoining the pond. Frank Kurvers was present and expressed.concern about the drainage. The Engineer -explained that the existing.culvert under Cheyenne has been blocked and the water from this proposed subdivision will -gather in the sedimentation pond and flowathrough a storm sewer to the north. Mr. Bloomberg was told to proceed with preliminary development plans. The purpose of this hearing is to consider rezoning 23.8 acres located in the southeast quadrant of County Road 15 and State. Highway 7 from R-lA to P-1 and subdivide the property into 36 residential lots. .The developer has complied -with -the contingencies setforth by the Planning Commission at its April 12 meeting. The'City Engineer has reviewed the preliminary street, drainage, sanita: sewer,•and water plans and -find them in conformance with City Standards except that all watermain must have a minimum cover of -seven feet (six feet or less is shown on the plans). The Engineer, in his report of May 4th:,-calls attention to things the developer should be aware of and outlines what: -the procedure will be from now on. Mr. Ritter explained they propose to divide the property into 36 lots with six of these proposed for duplexes. John Merz - I see that you^have got some lake access here. I would lik( to know if it is proposed for boat dockage and who is to maintain this? Bob Ritter - At this time that outlot which is already a platted lot, is not being considered as part of this proposal. At a future date that will -be proposed as an. outlot with access for the people living in this development. As far what the requirements are going to be,-1 really can't comment on that because I am not -real --sure.. As -far as being; a boat docking place I can tell you no because it's not Planning Commissio Meeting May- 10, 1978 -2- big enough to dock 36 boats or whatever. Nor deep enough. There will be a homeowners association in charge of the outlot. Roman Roos - Bob, you will have covenants on this homeowners associiatiu and this will be one of the areas that you will be coverin in the covenants. Bob Ritter - Yes. Hud Hollenback - Wouldn't you need those covenants drafted before you sold -the first lot? Russell Larson - 'Yes, we would require an inspection or review of whate• covenants and restrictions they are going to put-on there. We require a title examination and if there is to be a homeowners, association we want to look at the -:enabling charter -and its by-laws. I would like to see the covenants at this point, setforth now exactly what they intend to do or plan to do with respect to that outlot because that is going to hopefully guide you people and the Council in making an ultimate determination. Keith Anderson - What price category of home are you contemplating,? Bob Ritter - I don't know if I can quote the price category but one of things in the covenants will -be a minimum .of -a 1,000 squar( feet on one floor for a rambler If it's -a two story or a split it will be 800.square feet. The subdivision plan was not available at the Chanhassen City Hall on 5-10-79 when I visited there. The 18 acre parcel is outlined in red on the attached soi. map. The Lake Minnewashta outlet stream is the North boundry of the property. Two hundred plus feet adjacent to the outlet stream is lcw wet shallow peat (Pm) and Glencoe (Ge) soils (red lines on map). There is another small area of wet Glencl soils in the Southwest corner and an area of moderately wet LeSueur (LsA) soils ��X along the South property line. The major portion of t. jro erty is Hayden loam on 2-6% slopes (HaB, HaB2) and 6-12% slopes (HaC2 - colo: yellow on soils map). Additional soils information is provided on the attached "Soil Interpretation Record" sheets. SUGGESTED SOLUTION(S): The Minnewashta outlet stream should be protected and access be available to work on the channel_,_if_needed in the future. The project is compatible with the city's current comprehensive and sewer plans. The community's planning commission has reviewed the project and the community has given this project final approval. The site is within the Metro- politan Urban Service Area. The proposed subdivision will be serviced by central sewer and water and other services appear accessible to the site. Council environmental staff noted that a grading plan had not been provided. The city engineer should ensure that the plan provides for adequate street and lot grading. Positive drainage from the area should be provided with a surface water drainage system. Council transportation staff noted that it is likely there may be excessive traffic noise due to the project's proximity to Highway 7. Though it may be impractical to provide noise barriers for this size development, the developer should take some steps to reduce traffic noise such as creating earth berms or planting trees. No major adverse environmental impact is anticipated. The project will not meet the most urgent needs in terms of providing housing for low- and moderate -income persons. Berkey as the fee owners of a tract of land lying within the City of Chanhassen and more particularly described on Exhibit A attached hereto and made a part hereof (hereinafter "subject property"); and by Ritter & Welter, a general partnership consisting of Robert J. Schedule of Work. The Applicants shall submit a written schedule indicating the proposed progress schedule and order of completion of work covered by this contract, which schedule shall be a part of this contract. Upon receipt of written notice from the Applicants of the existence of causes over which the Applicants have no control which will delay the completion of the work, the City, in its discretion, may extend the dates herein- after specified for completion. -2- 5. Roads, Sanitary Sewer, Water, and Storm Sewer Facilities. a. Plans and Specifications. The Applicants agree to cause their engineers to prepare all plans and specifications neces- sary for the installation of roads, curb, gutter, sanitary sewer, water and storm sewer facilities, including a final grading plan in and for said plat, said plans and specifications to be in sub- stantial accord with the proposed plans thereof prepared by Clark Engineering Co., and dated April 26, 1978, with the following modi- fications: All watermains must have a minimum cover of seven feet. All plans and specifications shall be subject to the final approval of the City Engineers. b. As -Built Plan. Upon completion of construction, Applicants shall. cause their engineers to prepare and file with the City an "as built" plan showing the installation of the foregoing facilities within the plat. c. Easements. Applicants, at their expense, shall acquire all easements from abutting property owners necessary to the installation of the sanitary sewer, storm sewer, and water facilities within the plat, and thereafter promptly assign said easements to the City. 6. Reimbursement of Costs. The Applicants shall reim- burse the City for all costs, including reasonable engineering, legal, planning and administrative expenses incurred by the City in connection with all matters relating to the administration and enforcement of the within agreement and the performance thereby by the Applicants. 7. Disclaimer by Cites. It is understood and agreed that the City, the City Council, and the agents and employees of the City shall not be personally liable or responsible in any manner to the Applicants,.the Applicants' contractors or sub-constractors, materialmen, laborers, or to any other person, firm or corporation whomsoever, for any debt, claim, demand, damages, actions or causes of action of any kind or character arising out of or by reason of the execution of this agreement or the performance and completion of the work and improvements hereunder; and that the Applicants will save the City, the City Council, and the agents and employees of the City harmless from any and all claims, damages, demands, actions or causes of action arising therefrom and the costs, disbursements, and expenses of defending the same. 8. Said deposit shall be returned to the Applicants or their assigns upon approval of the installations by the City. 11. Erosion Control. Applicants, at their expense, shall provide temporary dams, earthwork or such other devices and practices, including seeding of graded areas, as shall be needed, in the judg- ment of the City Engineers, to prevent the washing, flooding, sedi- mentation and erosion of lands and roads within and outside the plat during all phases of construction, including construction on individual lots. Applicants shall keep all streets free of all dirt and debris resulting from construction.by the Applicants, their agents or assignees upon the lands described in Exhibit A hereto. 12. Access. Reasonable access, including temporary grading and graveling, shall be provided to all occupied residences -4- -/ .L-,/ i _- ".LcLrL in the plat until the streets are accepted by the City. 13. Street Lighting. The expense of furnishing electrical energy for street lighting purposes shall be assumed by the City months after the completion of installation of the street lighting system, or after JD°la of the building lots have been improved by the construction of residences thereon, whichever is first to occur. 14. Replacement of Defective Work. All work and materials performed and furnished hereunder by the Applicants, their agents and subcontractors, found by the City to be defective within one year after acceptance by the City, shall be replaced by Applicants at Applicants' sole expense. 15.. Liability Insurance. The Applicants shall take out and maintain, so long as the Applicants' obligations under Paragraph 14 above continue, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of the Applicants' work or the work of its subcontractors, or by one -directly or indirectly employed by any of them. Limits for bodily injury or death shall be not less than $100,000 for one person and $300,000 for each accident; limits for property damage shall be not less than $100,000 for each accident. The City shall be named as co-insured on said policy and the Appli- cants shall file a copy of the insurance coverage with the City. . 16. Water and Sewer Revenues. All water and sanitary sewer service charges shall at all times be billed by the City and all revenues derived therefromshall be the sole property of the City. 17. Conveyance of Improvements. Upon completion of the installation by Applicants of the improvements set forth in Paragraph 1 hereof in accordance with the plans and specifications hereunder and the written approval by the City, the Applicants shall convey said improvements to the City free of all liens and encumbrances and with warranty of title. Should the Applicants fail to so convey said improvements, the same shall become the property of the City without further notice or action on the part of either party hereto, other than acceptance -by the City. 18. Building Permits. Upon completion of the grading and placement of rock stabilizing materials for road construction within said plats, the City Building Inspector, upon the approval of the City Manager, shall be authorized to issue building permits for resi- dential construction within said plats upon payment of all fees and charges applicable to the issuance of permits. The occupancy of any structure within said plats for residential purposes shall be prohibited by the City until municipal sanitary sewer and water lines shall have been installed and are available to serve the lot for which a building permit shall have been issued. -5- 3/19/79 Draft 19. Remedies U-=on Default. a. Assessments. In the event the Applicants shall default in the performance of any of the covenants and agreements herein con- tained, and such default shall not have been cured within ten (10) days after receipt by the Applicants of written notice thereof, the City, if it so elects, may cause any of the required improvements to be constructed and installed, and may cause the entire cost thereof, including all reasonable engineering, legal and administrative expense incurred by the City, to be recovered as a special assessment under M.S. Chapter 429, in which case the Applicants agree to pay the entire amount of the assessment roll pertaining to any such improvement within thirty (30) days after its adoption. Applicants further agree that in the event of their failure to pay in full any such special assessment within the time prescribed herein, the City shall have a specific lien on all of Applicants' real property within said plan for any amount so unpaid, and the City shall have the right to foreclose said lien in the manner prescribed for the foreclosure of mechanic's liens under the laws of the State of Minnesota. In the event of an emergency, as determined by the City Engineers, the notice requirements to the Applicants shall be and hereby are waived in their entirety, and the Applicants shall reimburse the City for any expense incurred by the City in remedying the conditions creating the emergency. b. Performance Bond. In addition to the foregoing, the City may also institute legal action against the Applicants and the corporate surety on their performance bond, or utilize any cash deposit made or letter of credit delivered hereunder, to collect, pay or reimburse the City for the cost of making any of said improvements. c. Legal Proceedings. In addition to the foregoing, the City may institute any proper action or proceeding at law or at equity to prevent violations of the within development contract, to restrain or abate violations of the within development contract, or to prevent use or occupancy of the proposed dwellings. 20. Special Conditions. a. Landscaping. -Landscaping and location of structures on individual lots shall be determined through discussions between City staff and Applicants or their assigns prior to issuance of building permits, subject to the following standards and conditions: i. Landscaping and location of structures shall take into consideration the preservation of trees, slope protection, subsurface drainage, prevention of siltation and similar potential problems. ii. In the event agreement cannot be reached between the City staff and Applicants or their assigns, the City shall have the right, at the expense of the Applicants or their assigns, to engage the services of the City Engineer, Planner, a landscape architect, a soil conservation con- sultant, and others, to advise as to specific problems. 3/19/79 Draft iii. In subsequent discussions with Mr. Ritter, this office has attempted to relate the necessity of each of these charges. It is very possible Mr. Ritter will not be present in recognition of these facts. The largest portion of the $3,600 permit fee represents water and sewer units (approximately $2,000). On lots which had structures on them and in all current projects, these costs are placed as a part of the assessment against the property and more easily recognized as costs of sewer and water service. The two SAC charges of $850.00 are outside of city control leaving approximately $760 established as local building charges (building permit and park charges). These costs do not appear significant, again, remembering that this permit is for a duplex building permit (approximately $380 each). In addition to the justifications noted above, this office cannot overstate the significant precedent that would be set via lowering the charges for this specific property. Again, the area of greatest impact for the developer would be the sewer and water units - a charge necessary to insure that the large deficit balance within the north sewer area is reduced. The development contract between the City of Chanhassan and Romarco Development, Inc. calls for duplex or double bungalow zoning on the six lots fronting highway 7. Accordingly, the trunk sewer and water assessments were relevied reflecting the higher density zoning. We have now been in- formed that building permits and the associated charges will total approxi- mately $3,650.00. These charges reflect a building permit fee of approximately $290.00 two SAC sewer charges totaling $850.00, two park charges totaling $471.50, two sewer and water lateral charges of $1,400.00 and interest charges on the laterals totaling $588.00. It is our feeling that the double charging especially on the park, lateral, sewer and water, and interest charges is over charging and unfair. The doubling of fees make it virtually impossible to market these lots QV duplex lots. We therefore ask the council to review these fees and hope- fully reduce them. Without a substancial reduction in the charges it will be necessary for these lots to be marketed as single family lots and thus we will request reassessment of the trunk charges. Jerry Neher - I would want to see I'm not in favor of subdividing regardless of whether water is there or not. Roman Roos - If we grant the recommendation for dividing off the two lots, irrespective of public water, and the July 2 hearing says there will be public water, he will have to attach to it. If the hearing says there will not be water then what is the hang up there? Jerry Neher - Partial subdividing Walter Thompson - This man has some property and he wants to sell it off, on your wording you are making it impossible for him. Clark Horn - I don't know that we should force smaller property owners to go into a whole development effort. I think that is the question we are asking at this point, are we going to make them go about doing things like a large development, or are we going to treat this as a subdivisi by a single property owner. I guess I don't see any problem with it. Gordon Freeburg - I don't see any problem with or without water. The Assistant City Attorney stated that the state law on subdivisions requires a public hearing, but doesn't say anything about what happens if there is a long time delay between the hearing and the ultimate approval. ',-]hat it comes down to is if you feel that there has been no substantial change in the plat shown at the public hearing last November, then you are free to go ahead and process the application. If, however, you feel what you are voting on is quite a bit differ- ent from what you showed the public, I think you have an -obligation to schedule a new public hearing. Walter Thompson moved to grant the Subdivision Request on Lots B and C of Bardwell Acres as marked on the topographic map, Sommer First Addition dated August 2, 1978. The Assistant City Manager/Planner recommended that the area surrounding it be incorporated into a plat as outlots, that these two lots be platted off, and the remainder become outlots. CONDITIONAL USE PERMIT REQUEST, BEACH LOT FOR MINNEWASHTA CREEK ADDITION The Assistant City Manager/Planner stated Romarco, Inc. is proposing to establish Outlot B of the Minnewashta Creek Addition as a beach lot for the residents of the homes to be constructed in the Minnewashta Creek 2nd Addition plat. It was his recommendation that the planning commission order a public hearing to be held for the consideration of establishing a private beach lot at outlot B of Minnewashta Creek Second Addition. REGULAR PLANNING COMMISSION MEETING - June 27, 1979 Page 15 Mr. Robert Ritter stated that at this time they are entertaining no thoughts of constructing any beach house or anything else. If that is ever to be done it will be done by the home owners that will be living in there at that time. The developer will have no part of it. The Assistant City Attorney stated that would require an amendment to the permit that was issued. As he says, he is applying for a permit to run a beach lot not including a beach house, and if the homeowners association in the future decides they want a beach house, they would have to apply for a permit amendment. He described certain alterations that he is going to do and one is the sand blanket, he therefore would have to get the approvals from the Minnesota Department of Natural Resources and Minnehaha Creek Watershed District. Jerry Neher moved to hold a public hearing on July 11, 1979 at a time scheduled by staff. Motion seconded by Gordon Freeburg, and unanimously approved. CANNON BALL RESTAURANT, PRELIMINARY DEVELOPMENT PLAN REVIET.4 The Assistant City Manager/Planner stated that any further review of this proposal would be premature until the applicant can demonstrate that sanitary sewer is available to or imminent to the subject property. He recommended that the planning commission take no action on the proposal except to advise the applicant that he must demonstrate not only how the property will be served with sanitary sewer, but how the improvements will be assessed. That would involve petition for the sewer, feasibility study, guarantees of cost for the feasibility study, guarantees of cost for putting in the sewer, through the public hearing process. Mr. Jim Burdick stated he owns 27 acres of land starting a bit west of Animal Fair and going down to the point. He has a party who igould like to put a restaurant, have me build a restaurant and lease it to them. I would remain the owner on a long to nn lease. The plans are to put it on the point of Powers Blvd., Arboretum Boulevard and the main street of Chanhassen. He discussed the sewer situation and how this would be handled. He stated there is one Cannon Ball Kitchen at the present time at Glenwood, Minn. It is quite similar to a Country Kitchen. Roman Roos stated that we would like to see you exert the most influence you can to give us the greenways area for the entrance to Chanhassen. If that is possible then I think we would be very amen�&IC- to looking at this overall development. The Assistant City Manager/Planner stated that he can at his own option go out and incur the expense and do a feasibility study of his own that meets approval of the city engineers for sewerage, or you can petition the City Council to consider ordering a feasibility study to get the sewer down there, and then maybe go into site plan consideration. The Planning Commission ordered this public hearing pursuant to Ordinance 47 in order to gather neighborhood sentiment to the subject proposal. The Assistant City Manager/Planner recommended that the Planning Commission recommend that the City Council preliminarily approve a conditional use permit for the neighborhood beach lot at the subject property and direct the City Attorneys office to draft a Conditional Use Permit for final approval by the City Council. Mr. Kenneth Durr stated he owns approximately 8 acres within a few hundred feet of the proposed beach property. He wanted to know the planning commission's feeling on docks, and to what use the beach property would be put. He was concerned that if there are accesses allowed to the lake for properties that are not contiguous separated by a county roadway particularly, putting quite a heavy load on the lake, what happens in the years to come when the investors that have property that is contiguous to the lake come for access for those lots that they develop that are not immediately on the waterfront, and the community objects because a lot of accesses to the lake have been allowed for properties not contiguous. Walter Thompson moved to close the public hearing. Motion seconded by Clark Horn, and unanimously approved. Clark Horn - I guess my perception is it would not have a ramp. We would allow a rack for canoes, a sign, no beach houses, no ramps, no motor vehicle access. The real question is dock. Walter Thompson - This gentleman has raised a question in my mind as to how you are going to control dockage. I am not responsive to a long dock out into the lake really. Bob Ritter stated that at the time they submitted their plat, they also submitted the by-laws of the homeowners association with the City Attorney. Construction cannot begin until the Performance Bond and Development Contract: have been signed. This should be settled by the end of the week of April 9, 1979. 2.) Representatives of Schoell & Madson, Inc. would like to be present during the testing of the sanitary sewer and water pipe. 3.) City Inspector will make random visits to the site during construction. 4.) Braun Engineering Testing will take random soil tests during construction. 5.) If binder rock is used beneath the utilities inspector wants the rock put all the way to the top 'of the pipe. b.) Project inspector will be responsible for as-builts on all service connection As-builts will be tied to manholes and.fire hydrants. 7.) City Engineer and Inspector expressed their concern about putting down the bituminous pavement this year. They would like to see it done as late as possible this year or next year so as to allow settlement of the sub -base. 8.) A bituminous pre -construction meeting will be held at a later time to discuss the pavement construction. 9.) Locations for stockpiling of black dirt were marked on grading plan.
