The attached opinion concerns a case involving outdoor storage as a non -conforming use. The court Is treatment of the non -conformity is particularly interesting since some of the arguments bear a resemblance to those made by the Moon Valley operators. The appeals court ultimately upheld a permanent injunction obtained by the City of Savage over an outdoor storage yard operator. The operator expanded the non -conformity to a different portion of the site after the city enacted an ordinance regulating outdoor storage. John Fitzgerald, District Court Trial Judge) The City of Savage sought a permanent injunction to prevent Richard Knutson, Inc. (RKI), from maintaining open storage on its Boone Avenue property, claiming that RKI's storage area exceeded limits imposed by ordinance and that the company had not obtained a special -use permit to allow, it to deviate from those limits. After a trial to the court, an order permanently enjoining RIG from using the property for open storage was issued. RKI appealed and moved this court for an order staying enforcement of the in junction. We granted the stay pending our decision on the merits of the appeal. RIG asserts that one of the trial court's findings was clearly erroneous, that it was an abuse of discretion for the trial court to admit certain photographs, that the trial court erred in interpreting the nonconforming -use ordinance, and that the court issued an overbroad injunction. DECISION 1. A reviewing court will not set aside the trial court's findings of fact unless they are clearly erroneous. Minn. R. Civ. P.52.01.- The trial court found: 3. That [RKI] used the northern two-thirds of the prop-erty, hereinafter referred to as Boone Avenue • * * for open storage beginning in the summer of 1969, and from 1975 until the present used both the upper and lower portions of the property. 8. That on October 10,1973, at the time of the enact-ment of the open storage non -conforming use regulations, [RKI] used the north- em two-thirds of the Boone Avenue property for storage. 9. That [RKI] impermissibly expanded its use of the Boone Avenue property as an open storage site by using the land on the southern one-third of the parcel for storage beginning in 1975. B13 NOVEMBER 8, 1991 RKI maintains the finding that it did not use the southern portion of the property.for open storage before 1975 is clearly erroneous. The company states that, prior to 1975, if used this part of the land for access and for turning trucks and equipment about to serve the northern portion: We'are unpersuaded by -this argument. Testimony establislied that' the water table was within a foot of the surface on the southern part. of the property prior to 1975: At that time the ground was so wet that the weeds were impossible to cut and it was unsuitable for storage. Knutson himself admitted he did not begin to place fill on the property to raise its elevation until he bought it in April 1975. If the soil was too wet for storage before it was improved, it would. be too muddy for travel because heavy equipment would sink. The trial court's findings of fact cannot be deemed clear error. 2. The admissibilityof photographic evidence rests with the trial court's discretion and the reviewing court will not reverse absent an abuse of discretion. Hueper v. Goodrich, 263 N.W.2d 408, 411 (Minn.1978). RIG challenges the trial court's admission of 1971 and 1974 photographs offered by the city to prove that the southern portion was not used for storage before the open -storage regulation took effect. The company asserts that the photos were taken in spring, when RKI's equipment would be at job sites, that the height from which they were taken obscured details, and that the 1974 photo- graphs were admitted with insufficient foundation. Minn. R. Evid. 901(a) states: The requirement of authentication or identification as a condition precedent to. admissibility is satisfied by evidence sufficient to support a finding that the matter in question is what its proponent claims. RIG's employee, who had been with the company since.1970, hesitantly authenticated all three photos, although he also testi-fied that he had never obtained an aerial view of the property. Concern- ing the 1974 photographs, he stated, "I don't know if, you know, as far as existing in. 1974 if that's "what it looked like. I --the pipes are still there and, I mean; it looks like the same place to me." Thus, the rule was satisfied, someone with knowledge of the prof erty at the relevant time was able to identify it. The questions concerning the date of the photographs, the time of year they were taken, the clarityof details, and the hesitancy of the testimony go to the weight to be given the evidence, not to its admissibility. It must be borne in mind that this was a bench trial, conducted by a judge of considerable experience. A trial judge is more fitted by education and experience to sort out the probative value of evidence than a lay jury can reasonably be expected to be. 3. The interpretation of a zoning ordinance is a question of law, and this court owes no deference to the trial court's inter-pretation. AMOCON Corp. v. City of Eagan, 348 N W.2d 66, 72 (Minn. 1984). Savage, Minn., Ordinance 57,•§ 2.4 (Oct. 10, 1973), provides: The lawful use of any land or buildings existing at the time of the adoption of the Ordinance may be con- tinued; even if such use does not conform to the regula- tions of the Ordinance, except as provided below: 2.3.2.2 Relocations. A nonconforming use shall not be moved to any other part of the parcel of land upon which the same was conducted at the time of the passage of this ordinance. The court found that RKI .did. not use the southern parcel for storage prior to the enactment, of the zoning ordinance and that its use of the southern part of the property for storage constituted an impermissible "relocation" of a nonconforming use. RIG maintains that the trial court's interpretation of "relocate" is overly broad. "Relocate," the company argues, means to leave one point entirely and begin again at a new place. Acoord-ingly, it did not "relocate," since it continuously used the northern part and expanded its prior nonconforming use to the south. RIG asserts, in short, that the subdivision governing relocation does not proscribe expansion. To support its argument, RKI uses the headnote printed before subdivision 2.3.2.2 of the ordinance, entitled "Relocations." Use of N�OVEMBER 891991 FINANCE AND COMMERCE COURT OF APPEALs WnON a headnote is not a proper way to determi gislative intent. See Man. Stat. § 645.49 (1990) (headnote is merely a catchword to indicate the contents of the subdivision and is not part of the statute); Wangensteen v. Northern Pac. Ry. Co., 218 Minn. 318, 322, 16 N.W.2d 50, 52 (1944) (headline is not part of the act and change in headline cannot be used to indicate legislative intent to change the law). The language of the subdivision prohibits "moving" a noncon- forming use to any other part of the parcel of land. We reject as unduly restrictive RKI's view of the term "moving." RKI moved its open -storage activities from the extreme northern end of the prop-erty to the extreme southern end, very near to a well -kept resi-dential neighborhood immediately south of the property. Under these circumstances, the trial court cannot be said to have inisap-plied the ordinance in prohibiting this particular "moving." In changing the impact of the nonconforming use to adjacent proper- ty on the south, RKI "moved" the use and violated the ordinance. 4. Whether to grant an injunction generally rests within the sound discretion of the trial court, and its action will not be disturbed upon appeal unless, based upon the whole record, it appears there has been an abuse of such discretion. Cherne Indus., Inc. v. Grounds & Assoc., Inc., 278 N.W.2d 81, 91(Minn.1979). The court must frame injunctive relief, however, to remedy the specific harm claimed. Hartford -Empire Co. v. United States, 323 U.S. 386, 410, 65 S.Ct. •373, 385 (1945). The trial court permanently enjoined RKI from maintaining open storage on any part of its Boone Avenue property. RIG argues the northern and southern parts of the property are two distinct parcels of land and the court's injunction was overly broad because the activities on the northern parcel were protected by the "grandfather" provisions of the nonconforming -use or- dinance. Issues not raised in the trial court will not be reviewed for the first time on appeal. Woody v. Krueger, 374 N.W.2d 822, 824 (Minn. App. 1985). RIC has not previously alleged that the north -ern and southern parts of the Boone Avenue property were two distinct parcels of land. RKI's answer and counterclaim state: For the time period beginning prior to the enactment of the city's zoning ordinance to the present, [RKI] had used the entire parcel for open storage of equipment, vehicles, and materials, this use has been continuous and uninterrupted and has not been abandoned by [RKI] at any time. (Emphasis added.) RIG's post -trial memorandum states: RIG always considered the storage yard as a single parcel to be used for the storage of vehicles, equipment and materials. Knutson testified he bought the two parcels "as one parcel." RKI also applied for a single permit for the .entire property. The trial court treated the property as one tract, as shown by the legal description in the order, which encompassed both the northern and southern portions. The court found RKI moved its prior non- conforming use from one part to another part of the Boone Avenue property. Because of the move, the activities on the north -ern part were no longer permissible. The scope of the court'sinjunction, dictated by the extent of the violation established, was not over- broad. Evidence showed RKI significantly increased and expanded its nonconforming use on the northern portion, and loss of the protection of the grandfather provisions for the northern part of this single tract does not appear to constitute an abuse of discretion, in view of RIG's violation of the ordinance.' Injunction is an equitable remedy. If the plaintiff has proved that he or she is entitled to a permanent injunction, the court must then balance the equities in determining whether an injunction should be issued. Minnesota Pub. Interest Research Group v. Butz, 358 F. Supp. 584,625 (D. Minn. 1973). In balancing the equities, the court appropriately considered the 'History of this case. The company twice applied for and was granted a special -use permit, conditioned upon its fulfilling certain require- ments regarding improvement of the property. The first permit was B14 extended three time that the company could complete the required work on the pruperty. The city revoked the permit in 1989 for noncompliance with the conditions precedent to obtaining it. In 1990, RKI again applied for a special -use permit, which was granted subject to fulfilling the conditions precedent. Again, RKI did not comply with the conditions. Although RKI loses a storage site, the city would have per-mitted it to continue this use had it complied with the necessary conditions. The city cannot plan uniform property development and control nonconforming uses if it cannot insist that conditions precedent to obtaining these permits are met. It was not an abuse of discretion for the trial court to determine that the equities weighed on the side of granting the injunction, or to apply the injunction to the entire tract. Affirmed. Eugene Minenko, District Court Trial Judge) Insurance premium financing company seeks recovery of money paid to insurance agency but not forwarded to insurer. We affirm the trial court's denial of judgment against the insurer but reverse and remand for entry of judgment against the agency. FACTS As part of its insurance premium financing business, Tifco financed policy premiums for Rainbow, Inc. and Ace Blacktop, Inc. See Minn. Stat. §§ 59A.01-.15 (1990). The policies were issued by Western National Mutual Insurance Co. and written through Mid - Continent Agencies, Inc. Western markets insurance through a network of independent agencies. _ Tifco's premium finance agreements required Rainbow and Ace to remit a cash down payment and pay the remainder in equal installments. Under a purported "appointment of agent," Mid -Con- tinent received notices for and collected payments from the insureds. Although designed primarily for insurance polices that require an annual payment in advance, the premium financing agreements with Rainbow and Ace were on policies that allowed for interest -free Council Meeting July 18.--,1983 -6- Councilman Horn moved to approve the subdivision request, Planning Case 83-6. as depicted on the preliminary plat for Murray Hill Second Addition dated received June 22, 1983, Chanhassen Community Development Department. RILEY/MENTIN DRAINAGE AGREEMENT: RESOLUTION -�?83-33: Councilwoman Swenson moved the adoption —of a resolution accepting the City Engineer's and City Attorney's agreement to install improvements as outlined in the City Engineer's letter to Steven Riley dated June 14, 1983, and present a cash settlement of $3,500 to be split between adjacent owners. The $5,850 to be allocated from MSA Fund interest earnings to cover the expense of the improvements. Resolution seconded by Mayor Hamilton. The following voted in favor: Mayor Hamilton, Councilwomen Swenson and Watson, Councilmen Geving and Horn. No negative votes. Motion carried. OPEN STORAGE: The City Manager asked the Council if the staff should take a more active role in removing trash, junk, business equipment, etc., or should staff look for a more comprehensive review by the Planning Commission. The City Attorney suggested warning letters followed by action for junk, trash, unlicensed cars, etc. As far as potential Zoning Ordinance violations, he recommended that the ordinance should be updated prior to citing violations. Council members requested a list of violators and violations for their review. 1984 PRELIMINARY LAWCON GRANT APPLICATION: The Park and Recreation Commission discussed the question of grant applications at their July 12 meeting. This discussion generated a concensus that at this point the City should be establishing development instead of acquisition as the number one park priority, unless that acquisition was contiguous to an existing park or a step in a developed plan. They recommended the following two prelimi- nary applications be submitted: 1. Development of Herman Field, an 11.3 acre park tract north of the intersection of Oriole and West 64th Street. Cost items would include the access road, parking facilities and overall site grading including drainage improvements. 2. Installation of lights at a softball field at Lake Ann Park (probably Field #1). They pointed out to me several unsightly yards and asked my opinion about what could be done. The city's nuisance ordi- nance, Ordinance No. 22, and junk car ordinance, Ordinance No. 48, can be used to prosecute citizens for accumulation of trash, old machinery and junked cars. The practical problem is that what you and I consider trash and junk is not necessarily what someone else might consider it. The more flagrant the situation, the easier prose- cution becomes. If it appears that the owner might claim that some- thing is not junk but is simply "exterior storage", the best mechanism of control is through the zoning ordinance. Unfortunately, the current ordinance does not adequately address exterior storage. Based upon the current situation, I recommend: 1. When the problem only involves accumulated trash, that the violator be warned or prosecuted under the city's nuisance ordi- nance. 2. Where there is some question that an owner might claim that their junked cars and machinery are in fact not junk, that pro- secution be withheld until the city updates its zoning ordinance to better regulate outside storage. In fact, you have directed me to refrain from making even the smallest of purchases, including film. In light of this fact, I wonder about the advisability of pursuing minor zoning violations, i.e. public nuisance. Many of these cases have gone to litigation at a --considerable cost to the City. At times, I wonder if the results of our efforts are worth the expense incurred by the tax payers. Sometimes a complaint of a violation is nothing more than a neighborhood squabble, with one neighbor using the City as a means of harassment. I realize that I cannot make distictions in.these matters, but perhaps we could have a "cooling -off period" during which some of these disputes may be resolved without City.interference. Of course, I feel we must attend to serious violaticnsas quickly as time will allow. However, until'I am free to buy film,.I will not be.able to collect evidence which is essential to any litigation and does therefore restrict me from attending to current complaints.
