TELEPHONE/f (612) 335-9565 Enclosed you will find the original copy of Northwestern National Bank of Minneapolis' Letter of Credit No. 36353 dated October 15, 1979, in the amount of $1,163,260. This amount is consistent with the bond amount recommended by Jim Orr in his letter of October 8, 1979. You should note, however, that the expiration date on the bond is January 15, 1980. Ideally, the Letter of Credit should be in force until the one-year guarantee period on utility construc- tion has expired. However, because of the large number of dollars committed here, it may be more feasible to accept letters of credit which are to be renewed on a year -by -year basis. Thus, I recommend that New Horizon Homes be asked to provide the City with documentation extending the expiration date on Letter of Credit No. 36353 to approximately October 15, 1980. II. Final Draft Development Contract: Revision of Assessment Payment Schedule. Enclosed you will find the original copy of the development contract approved by the City Council on October 15, 1979. This document is identical to the form of the contract included in the City Council packet for October 15, 1979; however, it incorporates the changes made by the Council at that meeting, specifically: Pages 11 and 12, bearing the notation "Rev. 10/17/79 CMM," have been inserted into the enclosed document. These revised pages reflect the new assessment payment schedule established by the City Council. The former provision for the installment payments to be made in 1980, 1981, and 1982 has been eliminated. The contract now provides for (a) the Phase I levied assessments to be paid in one lump sum on October 31, 1981; and (b) for the Phase I deferred assessments, Phase II levied assessments, and Phase II deferred assessments to be paid in one lump sum on October 31, 1982. The developer is not required to make any payments in advance of those dates except on a lot by lot basis as houses are sold. Donald W. Ashwor-,, Chaparral PhaseII -2- 10/19/79 III. Assessment of Kerber Drive Assessment Costs. Enclosed you will find a photocopy of a letter dated October 15, 1979, setting forth Mr. Frank's position that under §4.02 of the develop- ment contract, his company's credit against Kerber Drive construction costs would include the value of dedicated right of way in excess of the standard 50-foot right of way. I believe that Mr. Frank's posi- tion is consistent with the recommendation which you ultimately will be making to the Council at the time the Kerber Drive work is assessed. If Mr. Frank's position is not consistent with your position, I suggest that you so advise Mr. Frank at your earliest convenience. IV. Need to Increase Letter of Credit to Guarantee Assessments. Because of the changes in the development contract mandated by the City Council on October 15, 1979, and reflected on pages 11 and 12 ("Rev. 10/17/79 CMM"), the City Treasurer will not be certifying the Project 75-2 and Project 75-3 levied and deferred assessments to the County on an annual basis. Thus, the City must look to the letter of credit, rather than the tax collection system, for its ultimate security in the collection of these assessments. Accordingly, New Horizon Homes should file with the City an additional letter of credit in the amount of $748,693.71 for the purpose of guaranteeing the ultimate payment of these assessments. This new letter of credit would be in addition to those letters of credit prevously tendered to the City for thepurpose of guaranteeing the completion of utility construction in the First and Second Additions of Chaparral. My worksheet setting forth my manner of computing the $748,693.71 amount is attached to this letter. This new letter of credit should provide that the bank will honor the letter of credit upon receiving "beneficiary's officially signed statement reading: 'sums claimed are due and payable as New Horizon Homes, Inc., has not paid Project 75-2 and Project 75-3 levied and deferred special assessments as per agreement with City of Chanhassen or has not performed its other obligations as per agreement with City of Chanhassen. For purposes of clarity, I suggest that separate letters of credit be maintained for the special assessment guarantee as opposed to the utility construction completion guarantees. On November 19, 1979 Mr. Frank of New Horizon Homes met with the City Council. At that meeting he indicated that his company was willing to partially guarantee the special assessments with a letter of credit, however, they were unprepared to provide a letter of credit for 100% of the amount in question. I was also present at that session of the City Council. At that time I reviewed with the City Council the amounts of the various deferred and levied special assessments set forth on pages 8,9, and 10 of the development contract. According to the minutes of that meeting, the staff was directed to negotiate the matter with New Horizon Homes and a 33% guarantee of the amount of the so-called deferred assessments was suggested by the Council. The sum of the deferred and the levied assessments is $556,771.00. The deferred portion of that amount is $424,304.00. 33% of that amount is $141,434.66. I have had a discussion with Mr. Frank by telephone and he has indicated that his firm would agree to filing a letter of credit in the amount of $152,000. This letter of credit would be in addition to the letters of credit filed for the purposes of guaranteeing completion of public improvements. In view of the City Council motion of November 19, 1979, I recommend adoption of the $152,000.00 figure as the appropriate amount for the special assessments letter of credit. The developer's letter of credit for public improvement construc- tion activities will be reduced from time to time upon the recommendation of the City Engineer. Past practices and current policies do not provide a firm foundation upon which this office can make a recommendation, i.e: 1). Most projects previously carried out have been projects involving numerous property owners and were completed with assessments being placed against such individual properties. In these cases, no letter of credit (guaranteeing repayment of those assessments) can be mandated under state law. 2). Over the years, the city has received numerous requests from developers to carry out public improvements within their subdivisions and have the assessments spread against the lots benefitting. A majority of these were denied;, however, there have been several examples of where this has occurred. In most of these, the "years of assessment" was reduced from a typical 10 to 15 year schedule to a 3 to 5 year schedule. A letter of credit did not exist for most of these projects and such would not be necessary except, as in the case of the W. 79th Street improvements, lots were not sold as anticipated and the developer did not pay assessments as levied by the city. In this type of case, the city is required to use interim financing to make debt payments while waiting to receive monies from the developer from either "development sales" or "forced sales" of the properties. 3). In recent years, the city council has, for the most part, not carried out public improvements within new subdivisions. Where this has occurred, the council has then shortened Mayor and Council -2- November 19, 1979 the number of year•.s of assessment and has required a letter of credit to provide additional security to the city. In the case of Ecklund and Swedlund, the letter of credit approximated 20% of the outstanding assessments. In the case of the business park (this was not a typical "developer subdivision" as such involved several owners) the city required the major developer, Dunn and Curry, to provide a letter of credit approximating 33% of the assessment amount. 4). The City Council has, during the past two months, stated their intention to review the above general policies for new subdivisions. Specifically, the council has been concerned with the overall bond rating of the city and, although no.new subdivision request has been acted upon, the council has generally stated that such would not be considered unless it did not affect the city's bond rating. To accomplish this, a letter of credit in the amount of 100% of assessments would be required. Again, this policy has not been acted upon by the council and has only been generally discussed as it relates to the requests of Hansen and Klingelhutz and Ecklund and Swedlund (phases II and III). Again, it should be noted that the above chronology of public improvement financing relates primarily to new developments. In the specific case of New Horizon, improvements within the development.will be paid solely by the developer and a letter of credit in the amount of 100% has been received to assure that these improvements are made. It is not the new streets, sewer, water, etc. which is in question. The question being raised by New Horizon is the necessity for them providing 100% guarantee of assessments for the previously assessed Carver Beach and Greenwood Shores sewer and water project as it ttaversestheir property. Based upon the fact that the developer has agreed to shorten the number of years from that assessed in the Carver Beach/Greenwood Shores project area (15 years) to 3 years and as the assessments for which a letter of credit is being requested is associated with the larger Carver Beach/Greenwood Shores project and not solely benefitting the developers , this office would recommend that the city council consider some form of reduction in the letter of credit requirement. Dear Bob: In early September, 1979, we had Suburban Engineering submit plans and specifications for Chaparral Plat 3 to Shoell Madsen, Inc. for their review. On September 19, 1979, Mr. Ray Jackson of Shoell Madsen acknowledged receipt of the plans in a letter to Don Ashworth and indicated a problem with the servicing of the quadraminiums and duplex units. A meeting to resolve this problem was subsequently held and on October 22, 1979, Mr. Ashworth acknow- ledged in a correspondence to myself that our proposed method of servicing the units was acceptable to the City. Since that date, we have not received any additional correspondences regarding the review of the plans/specifications for Plat 3. It may be that your engineers letter of September 19 contained all the problems of their review, and no additional review is necessary. Our problem is that we wish to construct a portion of the utility work in Plat 3 this year, and there is some question as to whether the plans/specifi- cations have been approved. We have plans for our utility contractor to move into Plat 3 on Monday, November 26. ' Comments The proposed subdivision, Chaparral 4th Addition, to be located in Chanhassen, will be developed into 47 single.family lots. Flans also include the building of 47 single family homes. The homes will sell in the $75,000 to $95,000 price range. Although the revised Comprehensive Plan for the City of Chanhassen has not yet been approved by the Metropolitan Council, the project is compatible with its current Comprehensive Plan. Both the Planning Commission and the City Council have given this project final approval. The project will be serviced by central sewer and water. All neighborhood and community services are within excellent proximity from the site. MTC service is available. Transit stops are within two blocks from the site. No major adverse environmental impact is anticipated. However, no grading plan was provided which would show the surface water drainage system, current soil and ground water conditions and suitability of the area for development. The city should care- fully examine the development for these conditions before approving the final plan. The project will not meet the most urgent need in terms of providing housing for low- and moderate -income persons, nor will it serve to diversify the type of housing available in Chanhassen. Provide a planned time table for development phases including a land grading plan for soil erosion control practices, surface and subsurface water drainageways, as well as lots, building sites, streets and utilities. Provide for controlled surface water runoff by providing grass waterways (PP 33 to 35) and using storm drains only needed. 4. One of the many types of applications which the Council reviews is Department of Housing and Urban Development Applications for Subdivision Feasibility Analysis, Form No. 2250. One of,the many types of applications which the Council reviews is Department of Housing and Urban Development Applications for Subdivision Feasibility Analysi;-s',- Form No. 2250. This application is submitted to the local area HUD office by a developer as a preliminary step in securing a guarantee from HUD that a future buyer will be able to receive federal mortgage insurance because the property to be pur- chased will have been determined to be in accordance with federal standards. Such applications are forwarded to the Council by the Minnesota Area. Office of HUD for comment concerning; - 1. (Said fee owner and said contract purchaser are hereinafter referred to collectively hereinafter as the Developer), WITNESSETH: WHEREAS, The Developer is the owner. of a tract of land .lying within the City of Chanhassen and more particularly described on Exhibit A attached hereto and made a part hereof; and WHEREAS, the subject property is presently zoned R-JA, Agricultural Residence District; and WHEREAS, the.Developer has made application under the City Zoning Ordinance for City Council approval of a Planned Residential Development District encompassing all of the subject property; said district and plat to contain approximately 46.5 acres more or less divided into approximately 100 single family residential lots in four blocks and to be known as Carver's Pointe - Chanhassen Lakes North; and WHEREAS, the Developer, with the consent of the City, has changed the name of the proposed plat from "Carver's Pointe - Chanhassen Lakes North" to "Chaparral"; and WHEREAS, a public hearing was held by the City Planning Commission on March 8, 1978, to consider public comment on said development plan, plat, and rezoning; and WHEREAS, the City Council, by its resolution dated April 3, 1978, has approved said rezoning to P-1 and the develop- ment plan and preliminary plat of the Developer, subject to and on condition that the Developer enter into this agreement; and WHEREAS, approval of the development plan and preliminary plat of the Developer necessitated the vacation of West 63th Street from the Nez Perce west to County road No. 17; and -1- WHEREAS, a public hearing was held by the City Council on May 1, 1978, to consider public comment on said vacation; and WHEREAS, the City Council, by its resolution dated May 1, 1978, has approved the vacation of that portion of West 68th Street which lies westerly of Nez Perce and easterly of County Road No. 17 ; and WHEREAS, the City has established a policy requiring land developers to furnish surfaced streets, curbs, boulevard sodding, gutters, driveways, storm and surface water drainage facilities, street signs and lighting, municipal water and sanitary sewer faci- lities and underground electric and telephone service lines to all lots in plats approved by the City, all of the foregoing hereinafter sometimes referred to as "improvements"; and IIHEREAS, the Developer has made application to the City to be allowed at Developer's expense to construct, install and perform all work and furnish all materials in connection with the installation of the following improvements: a. Street grading, stabilizing, and bituminous surfacing; b. Surriountable concrete curbs and gutters; C. Sanitary sewer mains; d. Water mains; e. Storm and surface water drainage; f . Street signs; g. Boulevard sodding or seeding; h. Driveway surfacing; i. Underground utility lines; and j. Street lighting. NOW, THEREFORE, in consideration of the foregoing premises and acceptance by the City of the preliminary development plan and plat of Chaparral, the City and the Developer agree as follows: 1. Improvements by Developer. Developer agrees at its expense to construct, install and perform all work and furnish all materials and equipment in connection with the installation of the following improvements in accordance with the preliminary plat described in V Paragraph 28 below: a. Street grading, stabilizing, and bituminous surfacing; b. Surmountable concrete curbs and gutters; C. Sanitary sewer mains; d. Water mains; e. Storm and surface water drainage; f. Street signs; g. Boulevard sodding or seeding;. h. Driveway surfacing within the public street right of way; i. Underground utility lines; and j. Street lighting. -2- 2. Standards of Construction. The Developer agrees that all of the foregoing improvements shall equal or exceed City standards, shall be constructed and installed in accordance with engineering plans and specifications approved by the City engineers and the requirements of applicable City ordinances and standards, and that all of said work shall be subject to the supervision of the City engineers. 3. Materials and Labor. All of the materials to be employed in the making of said improvements and all of the work performed in connection therewith shall. be of uniformly good and workmanlike quality, shall equal or exceed City standards and specifications, and shall be subject to the inspection and approval of the City. In case any material or labor supplied shall be rejected by the City as defective or unsuitable, then -such rejected material shall be removed and replaced with approved material, and rejected labor shall be done anew to the satisfaction and approval of the City at the cost and expense of the Developer. 4. Construction Traffic. All traffic of equipment, supplies, etc., relating to the construction and installation of the improve- ments described in paragraph 1 above shall be limited to the use of MSAS 101. 5. Schedule of Work. The Developer agrees.t.hat it shall have all work done and the improvements described above in Paragraph 1 fully completed to the satisfaction and approval of the City on or before , 19 The Developer shall submit a written schedule indicating the proposed progress schedule and order of completion of work covered by this contract, which schedule shall be a part of this contract. Upon receipt of written notice from the Developer of the existence of causes over which the Developer has no control which will delay the completion of the work, the City, in its discretion, may extend the date hereinbefore specified for completion. 6. Roads, Sanitary Sewer, Water, and Storm Sewer Facilities a. Plans and Specifications. The Developer agrees to cause its engineers to prepare all plans and specifi- cations necessary for the installation of roads, curb, gutter, sanitary sewer, water and storm sewer facili- ties, including a final grading plan in and for said plat, said plans and specifications to be in substan- tial accord with the proposed plans thereof prepared by James R. Hill, Inc., and dated January 6, 1978, with the following modifications: i. Street right of ways within the plat shall be reduced to 50 feet. ii. The entire subdivision pattern shall be shifted 30 feet in an easterly direction. -3- iii. The surface water drainage plan shall be subject to the approval of the Riley Purgatory Creek Watershed District Board of Managers. iv. The Developer, in conjunction with the building inspector, shall develop a street naming plan which precludes the possibility of confusion with. existing street names. V. All plans and specifications shall be subject to the final approval of the City Engineer. b. As -Built Plan. Upon completion of construction, the Developer shall cause its engineers to prepare.and file with the *City an "as built" plan showing the installation of the foregoing facilities within the plat. C. Easements. The Developer, at its expense, shall acquire all easements from a11,,utti_1-1g property owners necessary to the installation o.f.the sanitary sewer, storm sewer, and water facilities within the plat, and thereafter promptly assign said easements to the City. In addition, the Developer, for itself and for its successors and assigns, agree to convey to the City at no cost to the City, the easements which are more particularlydescribed on Exhibit B attached hereto and made a part hereof. 7. Reimbursement of Costs. The Developer shall reimburse the City for all costs, - including reasonable engineering, legal, planning and administrative expenses incurred by the City in connection with all matters relating to the administration and enforcement of the within agreement and the performance thereby by the Developer. 8. Disclaimer by City. It is understood and agreed that the City, the City Council, and the agents and employees of the City shall not be personally liable or responsible in any manner to the Developer, the Developer's contractors or sub -contractors, material- men, laborers, or to any other person, firm or corporation whomsoever, for any debt, claim, demand, damages, actions or causes of action of any kind or character arising out of or by reason of the execution of this agreement or the performance and completion of the work and improvements hereunder; and that. the Developer will save the City, the City Council, and the agents and employees of the City harmless from any and all claims, damages, demands, actions or causes of action arising therefrom and the costs, disbursements, and expenses of defending the same. 9. Written Work Orders. The Developer shall do no work nor furnish mate it als not covered by the plans and specifications for which reimbursement is expected from the City unless a written order for such work or materials is received from the City. Any such work -4- or materials which may be done or furnished by the Developer without such written order first being given shall be at its own risk, cost and expense, and Developer hereby agrees that without such written order, Developer will make no cl-aim for compensation for work or materials so done or furnished. 10. Performance Bond. For the purpose of assuring and guaran- teeing to the City that the improvements to be by the Developer constructed, installed and furnished as set forth. in Paragraph 1 hereof shall be constructed, installed and furnished according to the terms of this agreement, and that the Developer shall pay all claims for work done and materials and supplies furnished for the performance of this agreement and that the Developer shall fully comply with all of the other terms and provisions of this Development Contract. Developer agrees to furnish to the City either a. cash deposit, a corporate surety bond approved by the City and naming the City as obligee thereunder, or an irrevocable letter of credit approved by the City in the following amount $519,370.00. 11. Boulevards and Driveways. The Developer agrees to furnish,. construct and install, at Developer's sole expense, the following improvements for the benefit of each lot within the plat in accordance with the preliminary plat described in Paragraph 23 below: a. Boulevard sod or seeding, either of which shall be of uniformly good quality. b. Driveway surfacing within the public street right-of- way, the materials and installation of which shall be approved by the City Engineers. 12. Erosion Control. Developer, at its expense, shall provide temporary dams, earthwork or such other devices and practices, including seeding or graded areas, as shall be needed, in the judgment of -the City Engineers, to prevent the washing; flooding, sedimen- tation and erosion of lands and roads within and outside the plat during all phases of construction, including construction on indivi- dual lots. Developer shall keep all streets free of all dirt and debris resulting from construction by the Developer, its agents or assignees upon the lands described in Exhibit A hereto. 13. Access. Reasonable access, including temporary grading. and gravelling, shall be provided to all occupied residences in the plat until the streets are accepted by the City. 14. Street Lighting. The expense of furnishing electrical energy for street lighting purposes shall be assumed by the City 24 months after completion of installation of the street lighting system, or after 500 of the building lots have been approved by the construction of residences thereon, whichever is first to occur. -5- 15. Replacement of Defective Work. All work and materials performed and furnished hereunder by the Developer, its agents and subcontractors, found by the City to be defective within one year after acceptance by the City, shall be replaced by Developer at Developer's sole expense. 16. Liability Insurance. The Developer shall take out and maintain so long as the Developer's obligations under Paragraphs 1 and 15 above continue, public liability and property damage insurance covering personal injury, including death, and claims for property damage which may arise out of the Developer's work or the work of its subcontractors, or by one directly or indirectly employed by any of them. Limits for bodily injury or death shall be not less than $100,000 for one person and $300,000 for each accident; limits for property damage shall be not less than $100,000 for each accident. The City shall be named as co-insured on said policy and the Developer shall file a copy of the insurance coverage with the City. 17. water and Sewer Revenues. Fi11 water and sanitary sewer service charges shall at all times be billed by the City and all revenuesderived therefrom shall be the sole property of the City. 18. Conveyance of Improvements. Upon completion of the installation by the Developer of the improvements set forth in Paragraph 1 hereof in accordance with the plans and specifications hereunder and the written approval by the City, the Developer shall convey said improvements to the City free of all liens and encum- brances and with warranty of title. Should the Developer fail to so convey said improvements, the same shall become the property of the City without further notice or action on the part of either party hereto, other than acceptance by the City. 19. Restrictive Covenants. Any proposed covenants or, restric- tions to be placed upon the lots in said plat shall be approved by the City Attorney prior to recording with the County Recorder or Registrar of Titles. 20. Building Permits and Occupancy Permits. Upon completion of the grading and placement of rock stabilizing materials for road construction within said plats, the City Building Inspector, upon the approval of the City Manager, shall be authorized to issue building penAits for residential construction within said plats upon payment of all fees and charges applicable to the issuance of permits. The occupancy of any structure within said plats for residential purposes shall be prohibited by.the City until the rock stabilizing base of the streets shall have been completed and municipal sanitary sewer and water lines shall have been installed and are available to serve the lot for which a building permit shall have been issued. -6- 21. Remedies Upon Default. a. Assessments. In the event the Developer shall default in the performance of any of the covenants and agree- ments herein contained, and such default shall not have been cured within ten days after receipt by the Deve- loper of written notice thereof, the City, if it -so elects, may cause any of the improvements described in Paragraph 1 above to be constructed and installed or may take action to cure said default and may cause the entire cost thereof, including.all reasonable engineerinc legal and administrative expense incurred by the City, to be recovered as a special assessment under M.S. Chap. 429, in which case the Developer agrees to pay the entire amount of the assessment role pertaining to any such improvement within thirty days after its adoption. Developer further agrees that in the event of its failure to pay in full any such special assess- ment within the time prescribed herein, the City shall have a specific lien on' all of Developer's real property within said plat for any amount so unpaid, and the City shall have the right to foreclose said lien in the manner prescribed for the foreclosure of .mechanic's lienE under the laws of the State of Minnesota. In the event of an emergency, as determined by the City.Engineers, the notice requirements to the Developer shall be and hereby are waived in their entirety, and the Developer shall reimburse the City for any expense incurred by the City in remedying the conditions creating the emerger b. Performance Bond. In addition to the foregoing, the City may also institute legal action against the Developer and the corporate surety on its performance bond, or utilize any cash deposit made or letter of credit delivered hereunder, to collect, pay or reim- burse the City for the cost of making any of said improve ments, or for the cost of curing any default by the Developer in its performance of any of the covenants and agreements contained herein. C. Legal Proceedings. In addition to the foregoing, the City may institute any proper action or proceeding at law or at equity to prevent violations of the within development contract, to restrain or abate violations of the within development contract, or to prevent use of occupancy of the proposed dwellings. 22. Special Conditions. Landscaping and location of structures on individual lots shall be determined through discussions between City staff and Developer or their assigns prior to issuance of building permits, subject to the following standards and conditions: a. Landscaping and location of structures shall take into consideration the preservation of trees, slope protec- tion, subsurface. drainage, prevention of siltation and -7- similar potential problems. b. In the event agreement cannot be reached between the City Staff and Developer or their assigns, the City shall have the right, at the expense of the Developer or its assigns., to engage the services of the City Engineer, Planner, a landscape arc1hitect, a soil con- servation consultant and others, to advise as to specific problems. C. Developer shall prepare and submit tot he City for its approval a landscape plan for the screening and buffering of the lots abutting CSAII 17 and MSAS 101. Said land- scape plan may incorporate earth berms, plant materials and fences. d. The certificate of occupancy for each homesite, or covenants and restrictions, may contain conditions for tree maintenance, and restrictions on tree removal, after consultations with the City Forester. e. Individual site drainage, basement waterproofing and footing drains for each residential structure shall be installed when necessary or appropriate. 23. Receipt of Engineers' Report_ Acknowledged. Developer acknowledges receipt of. the report of Schoell & Madson, Inc., City Engineers, dated January 31, 1978, relating to existing water and sewer services to serve the plat, and agrees to be bound by the determination of the City regarding any redistribution of existing assessments. and the imposition of supplemental assessments as defined in Paragraph 29 below. 24. Easements to be Shown on Plat. Easements for drainage, storm water holding ponds, City access to storm water holding ponds for maintenance purposes, and utility easements small be shown on the final plat. 25. Trees to be Provided. The Developer shall provide each lot with one boulevard tree of a specie acceptable to the City Forester and of a diameter of not less than 1-1/2". 26. No Variances. The Developer acknowledges that the City has approved the subject plat with the understanding that the Developer has thoroughly studied lot configurations depicted on the subject plat and that the Developer is satisfied that.no variances from the front yard setbacks and side yard setbacks depicted on the Developer's "Setbacks and Lot Areas" plan dated January 6, 1978, a copy of which is on file in the office of the City's Zoning Administrator, will be necessary. 27. Address of Developer. The address of the Developer for purposes of this development contract is New Horizon Homes, Inc., 3131 Fernbrook Lane, Plymouth, Minnesota, 55441. 28. Final Plat. The Developer agrees to proceed immediately with the preparation of its final plat, which shall conform to its approved preliminary plat as prepared by James R. Hill, Inc.., and dated January 6, 1978 with the following modifications: 29. a. Street rights of way within the plat shall be reduced to fifty feet in width. b. The entire subdivision pattern shall be shifted thirty feet in an easterly direction. C. The number of lots in Flock 3 shall be reduced from thirty lots to a maximum of twenty-eight lots. d. The number of lots in the northerly half of Block 1 shall be reduced from six lots to a maximum of five lots. Special Assessment Payment Schedule. a. Developer Consents to Supplemental Assessment. The Developer acknowledges tfiat the subject property derives special benefit from the sewer lift station facilities, trunk and lateral sanitary sewer facilities, and trunk and lateral water facilities which were con- structed as a part of Chanhassen Improvement Project 75-2 (Carver Beach Sewer and Water Project,) and as a part of Chanhassen Improvement Project 75-3 (Greenwood Shores Sewer and Water Project.) The Developer acknowledges.that the amount of said special benefit so derived from Project 75-2 and Project 75-3 exceeds the amount of the special assess- ments levied pursuant to Chapter 429 of Minnesota Statutes by resolutions of the Chanhassen City Council adopted and dated October 6, 1976. The amount of said excess is One hundred Sixty -Three Thousand Five Hundred Seventy Nine Dollars ($163,579.00), which sum is hereinafter referred to as the "Project 75-2/75-3 supplemental assessments" or as the "Project 75-2 supplemental assessments" and the "Project 75-3 supplemental assessments." The developer agrees that the entire amount of the Project 75-2/75-3 supplemental assessments shall be paid by the Developer as special as s essme-nts levied against the properties proposed plat in twenty- six (26) equal semi annual installments, together with interest on unpaid installments at the rate of seven and one-half (7 1/20) percent per annum accruing from October 6, 1976. Said semi annual installments shall commence on May 30, 1.979, with installments due on the 31st day of each October thereafter and the 30th day of each May thc2reafter until October 31, 1991, on which date any remaining principal balance plus accrued interest shall be paid. Said semi annual installments shall be inclusive of and applied first to accrued interest and the remainder shall be applied to reduce principal. The Developer shall have the right and privilege to prepay the full amount of the then outstanding Project 75-2 supplemental assessments or the full amount of the then outstanding Project 75-3 supplemental assessments, together with accrued interest thereon, at any time. b. Developer Waives Public Hearing and Right of Appeal. The Developer -waives its right to public hearing . under §429.061 and 429.071 of Minnesota Statutes and its right of appeal under §429.081 of Minnesota Statutes as to the Project 75-2 supplemental assess- ments and as to the Project 75-3 supplemental assess- ments. c. Acceleration of Payment Schedule. In the event that an occupancy permit is applied for for any residential structure constructed upon any lot in the proposed plat, the payment of the Project 75-2 supplemental assessments and the Project 75-3 supplemental assessments shall be accelerated as provided in -Paragraph 29(d) below. d. Payments Due Prior to Occupancy. No residential structure within the proposed plat shall be occupied until the developer has paid in full all unpaid special assessments levied against the lot on which said structure has been erected. The term "all unpaid special assessments" shall be deemed to include: i. Any outstanding City sewer and water hook-up charges and any charges owing to Metropolitan J.aste Control Commission. ii. One ninty-fifth (1/95) of the total amount of the Project 75-2 supplemental assessments, including accrued interest thereon, less the sum of any principal payments made theretofore and applied against said Project 75-2 supplemental assessments. iii. One ninty-fifth (1/95) of the total amount of the Project 75-3 supplemental. assessments, including accrued interest thereon, less the sum of any -10- principal payments made theretofore and applied against said Project 75-3 supplemental assessments, ani iv. One ninty-fifth (1/95) of the then outstanding principal balance, together with accrued interest thereon of the Project 75-2 and Project 75-3 special assessments which were levied by the Chanhassen City Council by resolutions adopted October 6, 1976. 30. Proof of Title. Upon request, the Developer shall furnish the City with evidence satisfactory to the City that they are fee owners. of the subject property. 31. Successors and Assigns. It is agreed by and between the parties hereto that the agreement herein contained shall be binding upon and inure to the benefit of their respective legal representa- tives, successors and assigns. Comments Attached hereto, is a report from Bruce Patterson of Suburban Engineering which is in response to the previous meetings staff recommendation that the interior streets of the development have roadways 36' wide. The city engineer will be presenting and outlining the problems that occur when street widths are not adequate. In the last few weeks, staff has been studying the possibility of the vacation of Dogwood Avenue in lieu of the New Horizon proposal. Dogwood Avenue forms the northeastern border between Chaparral and Carver Beach. Dogwood Avenue is presently a paper street in the Carver Beach plat. After studying the Dogwood Avenue situation, it is staff's recommendation that Dogwood Avenue not be vacated at this time, even though the proposed lots in the northeastern portion of the subject property could potentially have double frontages, should Dogwood Avenue ever be improved. Should the proposed development plan at hand be approved, it would predicate that in the eventuality that Dogwood Avenue be improved, the cost of improvements would be born solely by the property owners abutting Dogwood Avenue in the Carver Beach Neighborhood. The unusual situation of Dogwood Avenue in relationship to the proposed development, is another extension of the problems created by the incompatible and obsolete platting methods applied in the Carver. Beach plat. As you well know the Carver Beach area is not suited to adequately the volumes PLANNING REPORT -2- 2-12-''9 of traffic created by the neighborhood itself. From a planning standpoint, it is best that whenever possible, potential additional traffic within the Carver Beach area be discouraged to enter the neighborhood on a regular basis. This is essentially why the northeastern lots of New Horizon should not gain access onto Dogwood Ave. Although the following is not attributable to the proposed development, it is a concern that should be addressed and analyzed by the Park and Recreation Commission within the next few weeks. Approximately a quarter mile northeast of the Chaparral addition, there is a mini -beach along Huron Avenue in the Carver Beach neighborhood. There is no doubt that the availability of a beach area within such a short distance of an urbanized development such as the magnitude of the one at hand, will undoubtedly experience an increase in usage. This particular item will be discussed between myself and the Park and Recreation Commission tomorrow evening and a verbal report elaborating the potential problems for the mini -beach will be given to the Planning Commission at the public hearing. PLANNING CASE: P-;580 Petition New Horizon Homes, Inc. is proposing to construct 160 units of townhomes, 102 units of duplex, and 74 units of single family in the area indicated as outlots B and C of the Chaparral Addition. This request would require rezoning from R-lA, agricultural residence district to P-1, planned residential development, wherein is required preliminary development plan review. By the provisions of ordinance 47, the preliminary development plan review stage might also be called concept plan review. From the materiAls required by ordinance 47 for preliminary development plan review, it is obvious that the intention is to have the applicant demonstrate the viability of a concept for preliminary city approval before investing money into costly final engineering plans and reports. Essentially what is needed at this time is for the council to render their decision on the overall lay out, density, and compatibility of the proposed plan. The preliminary development plan review decision, is necessarily contingent to the workability of the final development plan documents. As noted in the attached reports, the subject development involves approximately 106 acres located in the southeast quadrant of the intersection of Powers Blvd. and MSAS 101. As shown in enclosure A, the land use proposed for the property is as follows: Four unit townhomes - blue Duplex - green Single family - yellow Park - olive Storm Water ponding (possible) - pale blue Mr. Don Ashworth -2- march 1, 1979 The development area is traversed by newly constructed 11,SAS 101. The applicant has requested that MSAS 101 be brought to full urban collector standards along their properties. As noted in the attached planning reports, it was staff's recommendation that sidewalks be provided along the south and west sides of DISAS 101 along the length of the property and that a bike trail be provided for along the north and east side of MSAS 101 the total length of the development and that these facilities be a requirement of the development conditioned upon the city's commitment to complete this connection to West 78th Street. An environmental assessment worksheet was completed as per State law, and was published in the EQB Monitor on February 12, 1979 for the mandatory 30 day review period. Prior to proceeding with publication of - 'the hearing, staff believes such.be reviewed in light of the concept plan with staff now recommending that vacation not.be considered. However, it was noted in the planning report of February 12, 1979, that although the proposed circulation in the New Horizon development east of MSAS 101 is preferable from a planning standpoint, it would also have the affect that should Dogwood Avenue ever be put in, there would be no benefit realized to the New Horizon property adjoining Dogwood Avenue, and also., should Dogwood Avenue be improved the burden of cost would be shifted to the properties along Dogwood Avenue in Carver Beach. Attached hereto are excerpts from the sample covenants and restrictions for the townhome units provided to staff by New Horizon Homes. The only problem I have with this document is that State law limits the effectiveness of covenants to 30 years. In regards to architectural review and property maintenance, I would prefer a perpetuous document. Although the minutes of the Planning Commission meetings of February 14, 1979, and February 28, 1979, have not yet been transcribed at the time of writing this report, my notes indicate that the planning commission recommended that the applicant be required to place 32 foot roadways throughout the multiple area of development, and 28 foot roadways through the single family area of the development. In the past, the city council has made it quite clear about their concerns for the drainage along this area's watershed into Lotus Lake. Should the city council approve the preliminary development plans of New Horizon Homes, and encourage them to prepare final plans, said final plans should have sufficient hydrological assurances that this project will not cause any increased stream bank erosion downstream. As you recall, the reports by both Mr. Bruce Patterson and the City Engineer wbre very informative, however, the final recommendation is apparently left to this office. I agree whole-heartedly with the arguments that the greater the amount of impervious area, the greater need for land areas dedicated to drainage holding areas for the increased run off, that the cost of housing increases along with the increase in street size, and that at least for the time being, smaller vehicles are being used. It is my understanding that many street standards are based upon the criteria that provides for 12 foot driving lanes and 10 foot - parking lanes. Based on this principal, 34 feet of roadway would be needed to provide for two driving lanes and one parking lane. From the surveys and information obtained to this point, it appears that most cities do not adhere to this principal. Since the public hearing I have called several cities which have similar developments with four unit townhomes, and their information is as follows: Don Elvrum, of Bloomington, indicated that they require a 36 foot roadway face to face with no parking restrictions. Mike Falk of the Planning Department from Burnsville indicated they required 31 foot roadway augmented by a no overnight parking regulation. Mr. FAlk also mentioned that they had experienced no parking problems within the multiple area. The planning department at Woodbury stated that they had required a 24 foot roadway curb to curb with no parking regulations. The development in Woodbury is presently not absorbed sufficiently to protect any possible problems in the parking arrangment. g February 28, 1979 Planning Commissio -2- '� From looking at the layout of the townhome lots, it would appear that the driveway areas and the double garages would combine to provide adequate off street parking, however, if a problem would arise, it would most likely be on weekend evenings when home entertainment is more likely. In reviewing the materials to date, I believe that a 34 foot wide roadway with parking limited to one side would be optimal. Should it be the pleasure of the planning commission and the city council to allow a 32 foot roadway, I believe it would be needed to be subject to more restrictive parking regulations and greater enforcement effort.
