PLANNED RESIDENTIAL DEVELOPMENT CONTRACT
PLAT OF CHAPARRAL AND
CHAPARRAL 2ND, 3RD, AND 4TH ADDITIONS
WHEREAS, the City has made and entered into a development
contract dated November 9, 1979, and entitled "Planned
Residential Development Contract Plat of Chaparral and Chaparral
2nd, 3rd, and 4th Additions" (the "Development Contract"), and
WHEREAS, it was implied in the approval of the
development that decks on quadraminium lots could be constructed
within front yard setbacks.
NOW, THEREFORE, be it resolved by the Chanhassen City
Council:
1. Decks may be constructed in the development of the
quadraminium lots which encroach upon the required front yard
setbacks without a variance subject to the conditions set forth
herein.
2. Decks constructed pursuant to this Addendum are
subject to the following conditions:
a. The deck cannot extend from the building farther
than ten (10) feet.
b. The deck must maintain a twenty (20) foot front
and rear yard setback.
C. The deck must be constructed to a maximum 101x20'
dimension.
d. Decks that meet the above three conditions shall
be approved administratively with a building permit
application without having to receive a variance.

FIRST AMENDMENT TO
PLANNED RESIDENTIAL DEVELOPMENT CONTRACT
PLAT OF CHAPARRAL AND
CHAPARRAL 2nd, 3rd and 4th ADDITIONS
WHEREAS, the parties hereto have made and entered into a
development contract dated November 9, 1979 and entitled
"Planned Residential Development Contract Plat of Chaparral and
Chaparral 2nd, 3rd and 4th Additions" (The Development Contract), and
WHEREAS, Section 6 of said development contract provides
that New Horizon Homes, Inc. (New Horizcn) shall furnish the City
of Chanhassen (The City) with certain performance bonds and letters
of credit to guarantee the payment of various special assess-
ments more specifically described in said development contract, and
WHEREAS, New Horizon has asked the City to certify to
both the United States Department of Housing and Urban Development,
(HUD), and the United States Veterans Administration (VA) that
certain letters of credit filed with the.City by New Horizon pursuant
to The Development Contract guarantee the payment of all pending
special assessments, and
WHEREAS, the original agreement of the parties hereto
contemplated that the Developer would improve and construct that
portion of Kerber Blvd.lying within Phase I and Phase II, and
WHEREAS, the Developer has asked the City to construct
and improve said portion of Kerber Blvd. as a public improvement
project, with the Developer reimbursing the City in full for the
costs of said improvement project, and
WHEREAS, the City has authorized the improvement of Kerber
Blvd., also known as M.S.A.S. 101 and Chanhassen Improvement Project
No. 77-6, consisting of the construction of the aggregate base
street, and
WHEREAS, the City is contemplating the authorization of
an additional public improvement project which would consist of the
further improvement of Kerber Blvd. by the installation of bituminous
surfacing, curbs, gutters, and appurtenances within Phase I and II, and
WHEREAS, certain special assessments are now pending in
connection with said improvement projects, and
WHEREAS, the terms of said development contract do not
specifically authorize the City to draw upon above described letters
of credit in order to reimburse the City for the costs of said
aceuurse improvement projects, and
WHEREAS, the New Horizon, and its contract for deed vendor,
Dunn & Curry Real Estate Management, Inc. now wish to utilize the
above described letters of credit to guarantee the payment of any
pending special assessments arising out of the above described
improvement projects and thus obtain from the City the

certification requested of it,
NOW, THEREFORE, in consideration of the foregoing premises,
the parties hereto agree as follows:
Article I. Section 6.02 of the above described development contract
is hereby amended to read as follows:
6.02 Performance Bond
The Developer agrees to furnish to the City
either a cash deposit or corporate surety bond -approved by the
City and naming the City as obligee thereunder, or a irrevocable
lettersof credit approved by the City in amounts equal to 1100
of the amount of the cost of installation of the improvements
described in If 2.01 as estimated by the City engineer, for the
purpose of assuring and guaranteeing to the City:
a) that the improvements to be constructed
by the Developer as set forth in 9( 2.01 hereof. shall
be installed and furnished according to the terms of this
agreement; and
b) that the Developer shall pay all claims for
work. done and materials and supplies furnished for the
performance of this agreement, and .
c) that the Developer shall fully comply with
all of the other terms and provisions of the agreement; and
d) that the Developer shall reimburse the City
in full for the cost of the improvement by the City of
that portion of Kerber Blvd. also known as M.S.A.S. 101,
which lies within the -geographic boundaries of Phase I
and Phase II, in an amount equal to the cost of a standard
street section.
Article II.
Section 6.03 of the above described development contract is hereby
amended to read as follows:
6.03 Remedies Upon Default
A. Assessments.
In the event the Developer shall default in
the performance of any of the covenants and agreements herein
contained, and such default shall not have been cured
within ten (10) days after receipt by the Developer of
written notice thereof, the City, if it so elects, may
cause any of the improvements described in 11 2.01 above
to be constructed and installed or may take action to cure
such default and may cause the entire cost thereof,
including all reasonable engineering, legal and admini-
strative expense incurred by the City, to be recovered
as a special assessment under M.S. Chap. 429, in which
case the Developer agrees to pay the entire amount of

the assessment roll pertaining to any such improvements
within thirty (30) days after its adoption. Developer
further agrees that in the event of its failure to pay in
full any such special assessment within the time pre-
scribed herein, the City shall have a specificlien on all
of Developer's real property within the subject property
for any amount so unpaid, and the City shall have the
right to foreclose said lien in the manner prescribed for
the foreclosure of mechanic's liens under the laws of the
State of Minnesota. In the event of an emergency, as
determined by the City Engineers, the notice requirements
to the Developer shall be and hereby are waived in their
entirety, and the Developer shall reimburse the City for
any expense incurred by the City in remedying the condi-
tions creating the emergency.
B. Performance Bond.
In addition to the foregoing, the City may also
institute legal action against the Developer and the
corporate surety on its performance bond, or utilize any
cash deposit made or letter of credit delivered hereunder,
to collect, pay or reimburse the City for:
(1) the cost of completing the construction of the
improvements described in §2.01 above; and
(2) the cost of curing any other default by the
Developer in its performance of any of the
covenants and agreements contained herein; and
(3) the full amount of any Phase I assessments or
Phase II assessments for which payment shall
not have been timely received by the City as
provided in §3 of this contract; and
(4) the cost of reasonable engineering, legal, and
administrative expense incurred.by the City in
enforcing and administering this contract, and
(5) all costs incurred by the City, including
reasonable engineering and legal and administra-
tive expense on account of the improvement of
that portion of Kerber Blvd, also known as
M.S.A.S. 101, which lies within the geographic
boundaries of Phase I and II, in an amount equal
to a standard street section.
C. Legal Proceedings.
In addition to the foregoing, the City may
institute any proper action or proceeding at law or at
equity to prevent violations of the within development
contract, to restrain or abate violations of the within
development contract or to prevent use or occupancy of
the proposed dwellings.
Article III.
Section 2.01 of the above described development contract is hereby
amended to read as follows:

Storm and surface water drainage;
f.
Street signs;
g.
Boulevard sodding or seeding;
h.
Driveway surfacing within the public street
right of way;
i.
Underground utility lines, and
j.
Street lighting, provided, however, that the
City may construct and improve Kerber Blvd.
as public improvement project in accordance
with Chapter 429 of Minnesota Statues.
Articel IV.
The above described development contract is further amended by adding
thereto a Section 3.07 reading as follows:
3.07 Kerber Blvd. Improvement Project
In the event that the City elects to complete
the improvement of Kerber Blvd. within Phase I and II as one or
more public improvement projects, the Developer agrees to reimburse
in full for the costs of improving Kerber Blvd to a standard street
section no later than July 1, 1982. In the event that the Developer
shall fail to pay, when due, the full amount of such costs, the City,
at its option, may certify the amount of such default, together
with interest thereon accruing from October 1, 1980, to the Carver
County Auditor for collection with the real estate taxes due and
payable in the year 1983 as to any lot or lots then owned by the
Developer its successors or assigns. Interest shall accrue at the
rate of eight percent per annum or the average annual interest rate
on the bonds issued to finance such improvement, if higher. Any
such certification shall not have the effect of limiting the City's
other remedies under §6 of this contract. The Developer waives its
right to public hearing under §429.061 and §429.071 of Minnesota
Statutes and its right of appeal under §429.081 of Minnesota Statutes
as to the Project 77-6 improvement costs and as to the costs of
completing Kerber Blvd, to a standard street section with the
installation of bituminous surfacing, curbs, gutters and appurtenances.
Article V.
This amendment to the above -described development contract shall
become effective immediately upon execution of this document by
all of the parties to the above -described development contract.

Article VI.
Except as specifically provided herein, all other terms, conditions,
and provisions contained in the above described development contract
shall remain in full force and effect.

Gentlemen:
Dunn & Curry'Real Estate Management, Inc. has reviewed the First
Amendment to Planned Residential Development Contract for the
Plat of Chaparral and Chaparral Second, Third and Fourth Addi-
tions, and, as the contract for deed vendor for the real estate
involved, has no objection to the City of Chanhassen making the
improvements to a portion of Kerber Boulevard as therein des-
cribed, and to assess the costs thereof against benefitted real
estate within the plats referred to above, the fee title to which
is held by Dunn & Curry Real Estate Management, Inc.
We have not participated in any Letters of Credit involving the
Chaparral Projects and are not the developers of them. We do
not have any objection to the development of the Chaparral Pro-
jects by New Horizon Homes, as evidenced by the Development Con-
tract and the First Amendment thereof, and have no objection to
any arrangement regarding those Letters of Credit which the said
New Horizon Homes wishes to make with the City of Chanhassen.

PLAT OF CHAPARRAL AND
CHAPARRAL .2ND, 3RD, & 4TH ADDITIONS
WHEREAS, the parties hereto have made and entered into
a Development Contract dated November 9, 1979, (the "Development
Contract"), and amended November 24, 1980, (the "First Amendment")
concerning the plat of Chaparral, and Chaparral 2nd, 3rd, and 4th
Additions; and
WHEREAS, Sections3.021(B), 3.03(B) and 3.07 of the
Development Contract, as amended, provide that -New Horizon
Homes, Inc. (hereinafter "New Horizon"), is obligated to pay on
July 1, 1982, certain assessments in one lump sum; and
WHEREAS, New horizon has petitioned the City of
Chanhassen (hereinafter the "City"), for an extension of time
beyond July 1, 1982, to pay said assessments; and
WHEREAS, the City, by its Council, has indicated that it
is agreeable to granting an extension of time to New Horizon to
pay said assessments,subject to certain specified conditions.
NOW, THEREFORE, in consideration of the foregoing
premises, the City and New Horizon agree as follows:
ARTICLE I.
Paragraph B. of Section 3.021 of the Development Contract is
hereby amended to read as follows:
B. Regular Payment Schedule for Phase I Assessments.
Anything herein to the contrary notwithstanding, after
credit is given to the Developer for the payments
described in the preceding sentence, the total of the
unpaid Phase I Assessments shall be spread among the
lots in Phase I in the manner set forth on Exhibit C
attached hereto and made a part hereof. The assessment
amounts on Exhibit C shall bear interest at the rate
of 7.5 o per annum accruing from January 1, 1982. Said
assessments shall be amortized on a ten-year semi-annual
payment schedule and .certified to the Carver County
Auditor for collection with the real estate taxes due
and payable in 1982, 1983, and in 1984; provided,
however, that on July 1, 1985, the entire unpaid
balance and accrued interest shall be due and payable
in full.

ARTICLE II.
Paragraph B. of Section 3.03 of the Development Contract is hereby
amended to read as follows:
B. Regular Payment Schedule for Phase II Assessments.
Anything herein to the contrary notwithstanding, after
credit is given .to the Developer for the payments
described in the preceding sentence, the total unpaid
Phase II Assessments shall be spread among the lots in
Phase II in the manner set forth on Exhibit C attached
hereto and made a part hereof. The assessment amounts
on Exhibit C shall bear interest at the rate of 7.5%
per annum accruing from January 1, 1982. Said
assessments shall be amortized on a ten-year semi-annual
payment schedule and certified to the Carver County
Auditor for collection with the real estate taxes due
and payable in 1982, 1983-and 1984; provided, however,
that on July 1, 1985, the entire unpaid balance and
accrued interest shall be due and payable in full.
ARTICLE III.
Section 3.07 of the Development Contract, as amended, is hereby
further amended to read as follows:
The Developer agrees to reimburse the City in full
for the costs of improving Kerber Boulevard (Project
MSAS 101) to a standard street section. Said costs
shall be deemed to be special assessments levied in
accordance with Chapter 429 of Minnesota Statutes and
shall be spread among the lots in Phase I and Phase II
in the manner set forth on Exhibit D attached hereto
and made a part hereof. The amounts on Exhibit D shall
bear interest at the rate of 8% per annum (or at a rate
equal to the net interest rate on the Project MSAS 101
general obligation bonds plus one percentage point,
if higher) accruing from August 31, 1981.
The amounts on Exhibit D shall be amortized on a ten-
year semi-annual payment schedule for collection with the
real estate taxes due and payable in 1982, 1933, and
1984; provided, however, that on July 1, 1985, the
entire unpaid balance and accrued interest shall be due
and payable in full.
The Developer waives its right to a public hearing under
§429.061 and 429.071 of Minnesota Statutes and its
right of appeal under 5429.081 of Minnesota Statutes as
to the assessments set forth on Exhibit D.

ARTICLE IV.
Section 6.02 of the above described Development Contract is hereby
amended to read as follows:
6.02. Performance Bond.
The Developer agrees to furnish to the City either a
cash deposit or an irrevocable bank letter of credit approved by
the City in an amount equal to the sum of a) 110% of the amount
of the cost of completion of the improvements described in
112.01 as estimated by the City Engineer, and b) a sum not less than
50% of the unpaid special assessments (together with accrued interest
thereon) described in Sections 3.021, 3.03 and 3.07 of the
Development Contract, as amended, for the purpose of assuring and
guaranteeing to the City:
a) that the improvements to be constructed by the
Developer as set forth in 112.01 hereof shall be
installed and completed according to the terms of
this agreement; and
b) that the Developer shall pay all claims for work
done and materials and supplies furnished for the
performance of this agreement, and
c) that the Developer shall fully comply with all
of the other terms and provisions of the agreement;
and
d) that the Developer' -shall timely pay the assessments
described in Sections 3.021, 3.03, and 3.07 of
the Development Contract, as amended.
The above described letter of credit and any renewal of
such letter of credit shall have an expiration date not less than
one year from its original date of issuance or its last date of
renewal.
The amount of said letter of credit shall be set by the
Chanhassen City Council in accordance with this section. Not
less than thirty-five (35) days prior to the date of expiration of
said letter of credit, the Developer shall provide another
irrevocable bank letter of credit in the amount last approved by
the Chanhassen City Council and in the same form, with an expiration
date of at least one year from the expiration date of the prior
letter of credit. If the Developer fails to provide the subsequent
letter of credit thirty (30) days prior to the expiration of the
outstanding letter of credit, then the City may demand payment of
the entire outstanding letter of credit, and the letter of credit
shall provide that upon such demand the bank shall honor such demand.

ARTICLE V.
Paragraph B.of Section 6.03 of the Development Contract, as amended,
is hereby further amended to read as follows:
B. Performance Bond.
In addition to the foregoing, the City may also institute
legal action against the Developer and the corporate
surety on its performance bond, or utilize any cash
deposit made or letter of credit delivered hereunder,
to collect, pay or reimburse the City for:
(1) the cost of completing the construction of the
improvements described in §2.01 above; and
(2) the cost of curing any other default by the
Developer in its performance of any of the covenants
and agreements contained herein; and
(3) the full amount of any Phase I assessments or Phase II
assessments or the Project MSAS 101 assessments for
which payment shall not have been timely received
by the City as provided in §3 of this,contract; and
(4) the cost of reasonable engineering, legal, and
administrative expense incurred by the City in
enforcing and administering this contract.
ARTICLE VI.
Paragraph C of Section 6.03 of the Development Contract, as amended,
is hereby further amended to read as follows:
C. Legal Proceedings.
In addition to the foregoing, the City may institute
any proper action or proceeding at law or at equity to
prevent violations of the within development contract,
to restrain or abate violations of the within development
contract or to prevent use or occupancy of the proposed
dwellings.
The certifications of assessments to the Carver County
Auditor as provided in Section 3 shall not have the
effect of limiting the City's other remedies under this
Section 6 of the Development Contract, as amended.
ARTICLE VII.
This Second Amendment to the Development Contract shall become
effective immediately upon execution of this document by'all of
the parties to this document.
The Development Contract, as modified by the First Amendment, and
as further modified by this Second Amendment, shall be binding
upon all of the parties hereto notwithstanding the refusal of
Dunn and Curry Real Estate Management, Inc., to join in either
the First Amendment or this Second Amendment.

ARTICLE VIII.
Except as specifically provided herein, all other terms, conditions,
and provisions contained in the Development Contract, as amended,
shall remain in full force and effect.

THIRD AMENDMENT TO
PLANNED RESIDENTIAL DEVELOPMENT
CONTRACT PLAT OF CHAPARRAL
AND CHAPARRAL 2ND, 3RD, AND 4TH
ADDITION
This Agreement made this 27th day of February, 1984 by
and between New Horizon Homes, Inc. ("the Developer") and the City
of Chanhassen ("the City").
WHEREAS, the parties have previously entered into a De-
velopment Contract dated November 9, 1979 which was amended on
November 24, 1980 and on February 27 , 1984 concerning the
plat of Chaparral and Chaparral 2nd, 3rd and 4th Additions, and
WHEREAS, the Developer has failed to make timely payments
of certain special assessments required by the Development Contract
and the amendments thereto, and
WHEREAS, the parties want to modify their prior agreements.
NOW THEREFORE, in consideration of the mutual covenants
the parties agree as follows:
1. Except as expressly modified herein, the Development
Contract and 1st and 2nd Amendments thereto shall remain in full
force and effect.
2. The Developer shall upon the signing of this agreement
pay the City $500 for attorney's fees in the preparation of this
agreement.
3. On or before May 1,_ 1984, the Developer shall pay
all real estate taxes and special assessments, including penalties
and interest, that were due and payable in the year 1983, for all
lots in Chaparral, Chaparral 2nd, 3rd and 4th Additions with the
exception of Outlot C of Chaparral Addition. Prior to May 1, 1984,

the Developer shall also pay the real estate taxes and special
assessments, including penalties and interest due and payable in
1982 on the following lots:

4. If the Developer fails to timely pay the real estate
taxes and the like in accordance with Paragraph 3 above, then the
City may draw down the entire letter of credit which the Developer
has submitted to the City.
5. If the Developer fails to pay off all real estate
taxes and special assessments, including penalties and interest,
on all lots in Chaparral, Chaparral 2nd, 3rd and 4th Additions
on or before July 1, 1985, the City shall have the right to draw
down the entire letter of credit posted by the Developer. The City
shall not, however, use the proceeds to pay off the special assess-
ment on Outlot C of Chaparral Addition until the City has used
the proceeds to pay off all other special assessments for Chaparral,
Chaparral 2nd, 3rd and 4th Additions.

Contract and Addendums A and B, the following amendments shall apply:

SUBJ: Amendment to the Chaparral 2nd and 3rd Additions Development
Contract to Allow Screened Patios And Enclosed Porches on the
Four-plex Units
The applicant is requesting an amendment to the development contract for
Chaparral 2nd and 3rd Additions to allow screened patios and enclosed porches on
the existing four-plex units.
The site is located east of Powers Boulevard, west of Pima Lane and Meadow
Green Park, and south of Kerber Boulevard and Pontiac Lane. The neighborhood
is completely developed and consists of 39 quad units.
On November 9, 1979, the City entered into a development contract entitled
"Planned Residential Development Contract Plat of Chaparral and Chaparral 2nd�
3rd, and 41h Additions." The development contract required all structures in the
subdivision to maintain a 30 foot front yard setback. The main structures were
built in compliance with this requirement, however, there was a problem with
decks meeting the 30 foot setback.
On August 22, 1988, the City amended the development contract to allow decks
to encroach 10 feet into the required 30 foot setback. The amendment specifically
stated:
1. The deck cannot extend from the building further than 10 feet.
2. The deck must maintain a 20 foot front and rear yard setback.
3. The deck must be constructed to the 10 foot by 20 foot dimension.
Staff received a request from Cimarron Homeowners Association to allow the
building of enclosed and/or screened porches or screened patios. Staff explained
that the current development contract does not address such structures and advised
the applicant to apply for an amendment to the contract. The majority of the units
will be able to meet the 30 foot setback requirement, however, there are some
units located along Pontiac Lane and Pontiac Circle right-of-way that will be 20
feet from the property line. The proposed porches and screened patios will not
encroach any further into the 20 foot setback which was approved for the decks.

The location of the proposed porches and screened patios will not interfere with the location of
existing driveways. Over the past 7 years, the City approved several town house developments
including Autumn Ridge, North Bay, Walnut Grove, Lake Susan Hills Townhomes, Powers
Place, Oak Ponds and Mission Hills. All these developments permit a 20 foot setback from the
right-of-way and rear lot lines. Approving this amendment will permit this development to
maintain similar standards to similar developments.
The Homeowner's Association will be reviewing and approving the enclosed porches to
ensure compatibility with the building's materials colors.
PLANNING COMMISSION UDPATE
On June 2, 1999, this amendment was reviewed and approved by an unanimous decision by the
Planning Commission.
RECOMMENDATION
Staff recommends the City Council adopt the following motion:
"The City Council approves an amendment to the development contract entitled "Planned
Residential Development Contract Plat of Chaparral and Chaparral 2"d, 3rd, and 4th Additions" to
allow screened patios and porches on the four plexes with the following conditions:
1. The screened patios and porches cannot extend from the building further than 10 feet.
2. The screened patios and porches must maintain a 20 foot front and rear yard setback.
3. The screened patios and porches may not exceed a 10' x 20' dimension."

encroach any further into the approved setback.

Kind: Okay. That's all right.
Blackowiak moved, Burton seconded that the Planning Commission recommends the City
Council approve the preliminary plat request (99-4 SUB) to subdivide a 19.68 acre parcel
into a 7.68 acre parcel and a 12 acre outlot as shown on the plans dated received May 4,
1999, subject to the following conditions:
The proposed 7.68 acre parcel shall be shown in the form of a lot and block legal
description and the 12 acre parcel shall be shown as Outlot A on the preliminary plat with a
subdivision name acceptable to the City and Carver County.
2. The applicant shall enter into a development contract with the City establishing that no
building eligibility remains for the 12 acre parcel until such time urban services are
available.
Detailed grading, drainage and erosion control plan showing two approved septic site and
well locations shall be submitted to the City for review and approval prior to issuance of a
building permit.
4. The applicant shall dedicate on the final plat a 30 foot wide right-of-way for Lakota Lane
along the southerly 30 feet of the property.
5. The applicant shall pay the City GIS fees according to city ordinance.
6. Two individual sewage treatment site (ISTS) must be located and shown on the site plan.
The sites must be evaluated by a licensed ISTS designer and must be submitted for
approval by the City.
7. Twenty trees will be required for reforestation. Five of the 20 must meet minimum
ordinance requirements (deciduous 2 %2" diameter). The remaining 15 will be required to
meet a 4' or 3/4" diameter minimum and can be deciduous or evergreen. The deadline for
satisfying the reforestation requirement will be by the time the Certificate of Occupancy is
issued for the proposed home.
Park and trail fees shall be paid at time of building permit application.
All voted in favor and the motion carried unanimously.
Peterson: Motion carries. This goes on to the council on the 281h of June. Thank you.

Peterson: Questions of staff.
Kind: Chairman I have one. Does the City have on record that the footings are strong enough to
support the heavier structure?
Kirchoff: That would be addressed at the time of building permit if they wanted to add on a
screened porch.
Aanenson: When we received requests for this there was two approaches taken. Let each one
come individually or obviously amend the PUD so when we could see it wasn't fitting we
decided it'd probably be more prudent to go ahead and amend the PUD. But each, we did
receive some questions from some of the homeowners in reviewing this. The homeowners
association is the applicant. They would be done a case by case basis. If someone wants to come
in, they'd still have to come in. Get a building permit. We would check the setbacks. The same
process. What we're doing is giving them relief from the ordinance requirements so they would
still have to come in and get a permit and all that so we would check that issue at the time of
application.
Kind: It's not as simple as just putting a porch, or a roof and.
Peterson: Do we need to address the consistency of materials... I just got back from Florida.. .
townhouse down there, every other one has a different kind of screened in porch and/or windows.
Kirchoff: The homeowners association will be reviewing all the plans for the screened in
porches or patios before they apply for the building permit. To make sure that they're consistent
with the existing building materials and roof pitch, etc.
Peterson: Other questions of staff? Would the applicant like to make a presentation? If so,
come forward please.
Conrad Schmidt: Conrad Schmidt, 7251 Pontiac Circle. I'm the Treasurer of the Cimarron
Homeowners Association. Our meeting in February, there were a number of people that came
because of number one, they wanted to, there was about nine homes or nine quads that were

going to be painted and of course they want to look at color schemes and things such as that. But
in addition to that we had a number of requests from people that would like to screen in or
enclose their porches and we said that'd be fine. Of course architecturally have to conform.
We're also going to lay down some guidelines too as well which of course would conform to
your own guidelines as according to your building code. And so subsequently we looked into
this and there was a number that came forward and requested this. We took it under advisement
here at the last meeting and then we also approached the, I think Cynthia. You're the other, with
our plan and they brought it to fruition and we want to thank them very much for helping us.
Helping us out with this. As to when this will begin of course, this will only begin of course on
consent from you from, as well as the city which of course after it had gone through the planning
commission it will go to the city I take it, is that the correct procedure? If there's any questions,
I'd be willing to answer them but that's pretty much sums up I think what, we very much
welcome this and then Herald for a number years and we finally felt it was time to make some
movement on this...

is really on the end. And then this serves as a through road.

Joyce: Condition number 4 was curious. I didn't think we'd have to do, ask for that but.

Peterson: It's funny but it's also, we were very specific as to what other types of things we're

SUBJ: Amendment to the Chaparral 2nd and 3rd Additions Development
Contract to Allow Screened Patios And Enclosed Porches on the
Four-plex Units
The applicant is requesting an amendment to the development contract for
Chaparral 2nd and 3rd Additions to allow screened patios and enclosed porches on
the existing four-plex units.
The site is located east of Powers Boulevard, west of Pima Lane and Meadow
Green Park, and south of Kerber Boulevard and Pontiac Lane. The neighborhood
is completely developed and consists of 39 quad units.
On November 9, 1979, the City entered into a development contract entitled
"Planned Residential Development Contract Plat of Chaparral and Chaparral 2nd
3rd, and 41h Additions." The development contract required all structures in the
subdivision to maintain a 30 foot front yard setback. The main structures were
built in compliance with this requirement, however, there was a problem with
decks meeting the 30 foot setback.
On August 22, 1988, the City amended the development contract to allow decks
to encroach 10 feet into the required 30 foot setback. The amendment specifically
stated:
1. The deck cannot extend from the building further than 10 feet.
2. The deck must maintain a 20 foot front and rear yard setback.
3. The deck must be constructed to the 10' x 20' dimension.
Staff received a request from Cimarron Homeowners Association to allow the
building of enclosed and/or screened porches or screened patios. Staff explained
that the current development contract does not address such structures and advised
the applicant to apply for an amendment to the contract. The majority of the units
will be able to meet the 30 foot setback requirement, however, there are some
units located along Pontiac Lane and Pontiac Circle right-of-way that will be 20
feet from the property line. The proposed porches and screened patios will not
encroach any further into the 20 foot setback which was approved for the decks.

The location of the proposed porches and screened patios will not interfere with the location of
existing driveways. Over the past 7 years, the City approved several town house developments
including Autumn Ridge, North Bay, Walnut Grove, Lake Susan Hills Townhomes, Powers
Place, Oak Ponds, and Mission Hills. All these developments permit a 20 foot setback from the
right-of-way and rear lot lines. Approving this amendment will permit this development to
maintain similar standards to similar developments.
RECOMMENDATION
Staff recommends the Planning Commission adopt the following motion:
"The Planning Commission recommends approval of an amendment to the development contract
entitled "Planned Residential Development Contract Plat of Chaparral and Chaparral 2nd, 3ra, and
4th Additions" to allow screened patios and porches on the four plexes with the following
conditions:
1. The screened patios and porches cannot extend from the building further than 10 feet.
2. The screened patios and porches must maintain a 20 foot front and rear yard setback.

Dear Ms. Annenson:
I represent the Cimarron Home Owners Association, also known as Chaparral and
Chaparral 2"d, 3rd, and 4th Additions (refer to location map). We are requesting an
amendment to the Chaparral Development Contract to allow screened patios and
enclosed porches.
On November 9, 1979, the City of Chanhassen entered into a development
contract entitled "Planned Residential Development Contract Plat of Chaparral
and Chaparral 2nd' 3rd, and 41h Additions". The Development Contract required all
structures in the subdivision to maintain a 30 foot front yard setback. The main
structures were built in compliance with this requirement, however, there was a
problem with decks meeting the 30 foot setback. On August 22, 1988, the City of
Chanhassen amended the Development Contract to allow decks to encroach 10

constructed to the 10' x 20' dimension.
Several residents in our neighborhood have requested to build an enclosed and/or
screened porch or screen their patio to make these areas more usable. The
majority of the units will be able to meet the 30 foot setback requirement,
however, there are some units located along Pontiac Lane and Pontiac Circle that
will be 20 feet from the property line. The porches and screened patios will not
encroach any further into the approved setback.

I am writing in response to the upcoming meeting regarding the amendment to the
Cimarron townhouses. It is exciting that this issue is bung discussed for approval. r live
in the development but on an interior side. Because my location is interior, I didn't need
the city to grant an easement, but feel this will benefit all the homeowners and make the
properties more valuable, when they decide to sell them. So am I sending this note, to Iet
you know I am enthusiastic about this proposal for the other homeowners that do need
this amendment to pass.
The positives axe that homeowners will be able to increase the square footage of their
homes in a very modern and attractive way. I have seen many developments through, out
the metro area where screened and enclosed porches were allowed. When done correctly
there is a lot of enjoyment with the added space,
The obvious is that the value of the home will be increased. Not just the arnowit of the
added building structure, but the value of having something modem and updated that will
allow them to enjoy the outdoors more during mosquito season and inclement weather.
Azad finally, it will give more options to those homeowners looping to purchase existing
homes in the Chanhassen, area. Now they will have an option to purchase a townhouse
with a screen in porch or four -season porch.
