its building plans. I'd like to target your letter a little
closer to a spring date and call you and have lunch with both
you and Larry Buchheit.
I want you to know that Chanhassen has a soft spot in my heart
for many reasons. One, of which is not the least important, is
that I only live three miles south of Chanhassen on Lake Riley,
so therefore my interest in building in the area for our company
is a high priority.
However, it is also true that interest rates and money are growing
at a rapid rate and so our timing and our future plans will have
toe re -discussed in the next several months during our budgeting

Petition
As shown in the attached enclosures, Animal Fair, Inc., is proposing
to construct a new 45,000 square foot corporate headquarters in the
City of Chanhassen.
Background
1. Community Location: As shown in the attached, the subject property
is a 9.5+ acre parcel of land located in the southeast quadrant of
STH 5 and CSAH 17. The subject property is part of Dunn and Curry's
proposed Planned Industrial Development.
2. Existing Zoning: The subject property and environs are presently
zoned R-lA, Residence Agricultural District. However, Dunn and Curry,
as you know, is proposing to rezone the subject property to P-4,
Planned Industrial Development; according.Ty, Animal Fair's site plan
review is critiqued pursuant to the P-4 development standard.
3. Utilties: Trunk sewer and water will be available to the subject
property if the city council orders the heretofore considered public
improvement project for the north Lake Susan area.
IF THE CITY COUNCIL DOES NOT PROVIDE THE SUBJECT PROPERTY WITH NECESSARY
UTILITIES', 'ANIMAL FAIR, INC. , WILL HAVE TO LOOK ELSEWHERE FOR DEVELOPMENT
OF THEIR 'CORPORATE HEADQUARTERS. (Reference Ordinance 45).
4. Transportation: CSAH 17, which forms the subject property's western
border, is proposed to function as a collector street in Carver County
and Chanhassen's Comprehensive Plan. The setbacks, curb cut and proposed
road dedication, as shown in the attached, will facilitate the upgrading
of CSAH 17 to collector street standards.

5. Open Space: The Chanhassen City Plan indicates the drainage way,
which forms the subject property's eastern border, should be a linear
open space corridor. Said provision of a linear open space corridor
is articulated in Dunn and Curry's overall planned unit development.
6. Physiography of the Subject Property:
a). Soils: The subject property generally contains upland loams
and clay loam soils on slopes from 2 - 12%. Stronger slopes, plus 12%,
are evident in the southern portion of the subject property.
b). Vegetation: Scattered oaks (approximately 12 in number) are
located on the south facing slope of the subject property.
7. Drainage: As shown in the attached letter from the City Engineer,
dated March 29, 1978, surface water drainage will be handled by a sump
located in the eastern margin of the subject property.
Planning Commission Concerns
As shown in the attached, the Planning Commission duly considered
Animal Fair's request at their meeting on March 8, 1978. At said meeting,
the Planning Commission recommended the City Council approve the concept
as proposed by Animal Fair with minor revisions.
Planner's Recommendation
1. The approval of Animal Fair's site plan, and eventual building
permit, rests on four decisions the City Council should make. First,
the City Council will have to resolve that it is in the public interest
to provide the subject property and environs with necessary infra-
structure (primarily sewer and water). Secondly, the city council
is going to have to resolve the subject property and environs should
assume a planned industrial economy and environment. Thirdly, the city
council is going to have to resolve the creation of the subject property
(proposed lot five, block one, Chanhassen Lakes Business Park) is
in the public interest. And, finally, the city council will have to
waive the provisions of ordinance 45 wherein the applicant will be
allowed a building permit prior to the availability of necessary sewer.
This waiver would take the form of allowing Animal Fair to install
temporary holding tanks for sewage effluent.
2. The criteria for evaluating Animal Fair's request is expressly found
in Sections 9.06 and 17, Ordinance 45.
3. If the City Council provides the subject property with necessary
inTra-structure, sufficient energy sources are available to the subject
property and the city council rezones the land to P-4, I recommend the
council look with favor on Animal Fair's development provided:
a). Riley -Purgatory Creek Watershed District Board of Manager's
approves the drainage plan.
b). The access intersection is redesigned to conform to the
City Engineer's comments, as attached.
c). A detailed landscape plan is developed and submitted for
Planning Commission approval.

d). The parking areas and access roads be designed to conform
to the City Engineer's standards.
e). No outside storage be allowed.
f). All roof top mechanical devices, i-i any, be screened from
public view.
g). Developer prepare a lighting plan submitted for Planning
Commission approval.
h). The developer be bound to the performance standards as
setforth in local, state and federal regulations.
i). The City of Chanhassen and Animal Fair, Inc.,, mutually agree
to the above conditions in writing.

Gentlemen:
The subject drainage plan, as prepared by Lindberg Pierce, Inc.,
appears to be in general accordance with Riley -Purgatory Creek Water-
shed District requirements.
The plan indicates all runoff from the development will be
directed to an inundation type storage basin. This type of basin
will normally be dry due to storm sewer outlet passing under the
berm to accommodate storm water from small storms. When a heavy
rainfall occurs, the outlet will be unable to carry the amount of
runoff entering and storm water will collect in the basin.
The proposed basin, with a storage capacity of approximately
53,000 cubic feet, will provide more than adequate storage to accom-
modate runoff from the proposed development for a 100-year, 24-hour
storm. In addition, capacity is provided to store the difference in
runoff under present undeveloped conditions and the improved site if
expanded by up to 1.1 acres. A 12-inch corrugated metal pipe will
limit the maximum outflow from the area to about 5 cfs which is
approximately the flow that could be expected from the undeveloped
area for a 10-year storm.
We recommend that the basin outlet be further south where the
property is less steep. Installation of rip -rap at the outlet is
recommended. The north access has been deleted as recommended by
the County Director of Public Works. We recommend increasing the
width of the south access from 24 feet to 32 feet. Approval of the
plan with the above noted changes and additions is recommended.

MC CLEARY PRELIMINARY PLAT: Mr.. McCleary i,s�proposing to subdivide
4-T acres into:,, seven residential' building. sites- and one outl.ot.
The propertyAs located 'approximately 500-feet north of Highway 5
on County Road 15 and abuts Lake- Minnewashta._.The property is
currently zoned R-1: Sanitary,sewer and water are available to
the'property. The petitioner is -proposing a;20 foot wide combination
walkway and private beach lot for -the residents of the subdivision.
This type of land use in an'R-1 use district'is a7conditiona 1 use.
Mr. McCleary plans,to retain and remodel the existing house on Lot 3,
Block 1.
The City Engineer stated that the -street right-of-way and cul-de-sac
radius shown are -in accordance':with 'ordinance°standards. The street
should be constructed'to city'standards (7 ton capacity, concrete
curb and 28'foot-street width): The cul-de-sacradius should be
40 feet. Water runoff•fromtthe street should be directed to the
southwest of•the,property into a,natural sump area.
The developer was instructed to proceed- to. preliminary plat and make
application for a conditional use permit.! -
ANIMAL FAIR SITE PLAN: This property is*.located at the southeast
corner of Hig way 5 and County Road 17:in proposed Chanhassen Lakes
Business Park.. Pat Murphy, -Carver County Director of Public Works,
has reviewed:.the proposal and:commented that additional right-of-way
will be needed for County Road 17 and the northerly access to the
property will have to be eliminated.'
Bob Pierce, Architect, Dave Appelhof and Robert MacDonald, Animal Fair,
were present. The property is 9h•acres in size. The building is
proposed at 45,000 square feet with parking for 117 cars. A combined
access with one curb cut for cars and trucks will be designed. A
berm is proposed along Highway 5 and County Road 17 so that only eight
or nine feet of the building will be exposed: Members cautioned that
high berms are not recommended in order for police officers to have
visual surveillance of parking lots and building entrances.
Al Klingelhutz - As President of the Chanhassen Chamber of Commerce
I would like to say a few words on Animal Fair. You
know they have been a long time resident of Chanhassen
creating much employment for our own people here.
They are going to have to make a move and I feel
we should try and accommodate them as much as possible.
Dave Appelhof - I would like to give you a brief run down on our
timing. Our lease is up in the present building
that:we are-in,:the first of June and we have extended
a•lease:for another three months. Which means we
will be out in the street basically by the first of
September. We are anticipating.right now with
timing going on a very tight'scheduie,--this was
a,ssuming'that,'the zoning would:have:taken place
tonight; subdivision.taking place.next week, public
improvements :next. week, getting a variance to
Ordinance 45 so that we can put in a holding tank
sewer until the sewer is in to the location and
then obtaining a building permit once all of this
took place, that would be in a position to let out
to bid on April 7 which to receive bids the first of
Planning Commission Meeting March 8, 1978, -.15-
May and start building -immediately. This would give
a four month lead time to get into our.,manufacturing,
with -another'month'lead time to get - into - our office
facility. We would appreciate anything you can do
to- enhance- that time. It is my, understanding that
water could 'come 'into the property, by the time we
will need the water. 'Sewer would"not be present or
available for our site until the summer of 1979 which
would then cause us to'have-to go for a variance
�to Ordinance-45. All-that'having to take place prior
to our building permit.
Les Bridger moved that we, as a Planning Commission, encourage Animal
Fair to continue with the necessary processes through the city to
continue this development and we look favorably as a commission on
the design and land use: Motion seconded by Jerry Neher. The following
voted in favor: Ties Bridger, Roman Roos, Dick Matthews, and Jerry
Neher. Hud Hollenback voted no. Motion carried.
Hud Hollenback - I think the Planner's comments would be apropos
in the motion: I think it would hinge on the city's
cooperation on the intra-face on the sewer etc.
ROY TEICH, PROPERTY SPLIT: Mr. Teich wants to sell off five acres
by metes and bounds-descr ption to a neighbor. The property abuts
Lakota Lane and Highway 101. The Planner recommended approval
conditioned upon no building permits be issued for residential
purposes until sewer is available.
Hud Hollenback moved to recommend approval of the land transfer
provided no building permits be issued for residential purposes until
sewer is available. Motion seconded by Dick Matthews and unanimously
approved.
MINNEWASHTA CREEK FIRST ADDITION: -Bob Ritter was present requesting
approval to divide property into 36 residential lots and two outlots.
The property is located on Minnewashta Parkway and Highway 7. Sanitary
sewer and water are available to the property. The plan indicates
50 feet of right-of-way for the'cul-de-sacs. City standards call
for 60 feet of right-of-way. The petitioner intends to use Outlot B
for the purpose of a beach lot for the residents of the development.
Plans for the beach lot have'not been submitted.
Bill Brezinsky gave his report. This plan eliminates the curb cut
onto Highway 7. The cul-de-sac lengths are within ordinance
standards. The drainage for the entire area will go to the creek
on the north part of -the property.'
Bob Ritter - We would like approximately 8 lots with double units.
These are the lot numbers that I would like to have
zoned as doubles: 27, 30, 31, 32, 34, 36, 14, and 15.
We are flexible on that. Those lots along the marsh
could be extended into the marsh. If the city wants
to keep the -marsh als- large as possible, fine, if you
want us to run::the lot lines all the way to the back,
we can do that too. It would never be built on and
that would be in some type of a covenant the fact
that that part'of:the land would never be disturbed.

I have reviewed the proposed plan for a new Animal Fair
facility in the southeast quadrant of CSAH 17 and T.H. 5.
It is my opinion that the driveway entrances to the property
as proposed will create future traffic congestion and safety
problems. I would suggest the following revisions be made
before final approval by the City of Chanhassen.
1. The south entrance is located at about the minimum
desirable distance from T.H. 5 for an access point.
This entrance should be re -designed to serve as the
only entrance and the principal exit. This would
permit future channelization to the north when needed.
2. The proposed north entrance should be deleted. Another
solution would be to permit a temporary exit for right
turns only designed as a free right turn lane. This
would require some rather minimal widening on CSAH
17 to `ie into the existing acceleration lane on
T.H. 5. This exit should be removed when traffic
volumes warrant channelization of the T.H. 5, CSAH 17
intersection.
3. In order to provide public right-of-way for future
intersection related work, it is recommended that an
additional 17'be dedicated from T.H. 5 to the southerly
driveway and a minimum of 7'additional from the
southern driveway to the south boundary of this property.

As shown in the attached, the applicant, Animal Fair, Inc., is proposing
to move their corporate headquarters onto a parcel of land located
in the southeast quadrant of STH 5 and CSAH 17. The subject property
is located in Dunn and Curry's Chanhassen Lakes Business Pare and is
commonly called Lot 5, Block 1.

1. Community Location: The subject property contains 9.9 acres of
land located on uroposed Lot 5, Block 1, Chanhassen Lakes Business
Park.
2, Comprehensive Plan proposal;
a. .Land Use; Pursuant to the adopted City's Plan, the subject
property and environs are to assume an industrial economy and environment.
b, Transportation;
1), State Trunk Highway 5; State Trunk Highway 5, which
dorms the subject property's northern border, is proposed to remain as
a minor arterlal it the transportation plans of Carver County,
Metropolitan Council and MnDC'..
2). CS H' 17: County Road 17, which forms the subject
property's western :order is proposed to be turned back to Chanhassen
after the construction of new County Road 17 located h mile to the
east. Old County Road 17 is proposed in Chanhassen's Transportation
Plan to functic:-a as a collector street.

C. Utilities: Presently sanitary sewer and eater is unavailable
to the subject property; however, the city council is investigating the
possibility of bringing necessary infra -structure to the subject property'.
If the city council does not provide the subject property with necessary,.
utilities, Animal Fair will have to look elsewhere for development of
their corporate headquarters.
3. Physiography of the Subject Property:
a.* Soils: The subject property generally contains upland loams
and clay loam soils on slopes of 2 - 12%. Stronger slopes, +12%, are
evident in the southern portion of the subject property.
b. Vegetation: Scattered oaks (approximately 12 in number) are
located on the south facing slope of the subject property.
4. Existing Zoning: The subject property and environs is presently
zoned R-lA,Residence Agricultural District. However, Dunn and Curry,
as you know, is proposing to rezone the subject property from R-lA
to P-4, Planned Industrial Development. Said proposed P-4 rezoning
is presently under study by the Planning Commission and City Council.
5. Carver County Cc_cerns: As shown in enclosure 5, Pat Murphy,
Carver County Director of Public Works, commented on Animal Fair 's
site plan. Specifically, Pat wants the applicant to eliminate the
northerly most frontage road, dedicate certain rights -of -way and
redesign the southerly most frontage road so as to afford principal
access to the subject property, adequate drainage is maintained and

1. If the city provides the subject property with necessary infra-
structure (principally sewer and water) and sufficient energy sources
are available to the subject property and the city council rezones the
land to P-4, I recommiend the city council look with favor on Animal
Fair's development provided the development will redesign to conform
to the suggestions as contained in Pat Murphy's memorandum., adequate
drainage is maintained and approved by city enginer and a landscape
and lighting plan is provided for commission approval. when these
details are developed, the planning commission should review the
site plan and recommend -approval to the city Council.
