Attached hereto is a copy of the -final plat for the subject
applicant and the council minutes, of June 19, 1978 approving
said subdivision.request. This,°memorandum is to notify you
that this subdivision was unusual in that it created two
building sites out of what was essentially three. As you will
note in the attached city council minutes that a request was
accompanying this subdivision request to delete one.of the
three assessments placed on the subject property. Since the
City Council disapproved the assessment deletion request, your
office should split the remaining 3 assessment accordingly.
In your absence, I reviewed the escrow account for the subject
planning case, and apparently there is an approximate .$155
surplus remaining. This office does not anticipate any more
legal, engineering, or planning work to be done on this case
and thus any surplus remaining should be remitted back to the
applicant.

The petition before the City Council is to approve or disapprove the
subdivision request of John Schevenius. (Ref. Enclosure 1).
Background
1. Community Location: As shown in enclosure 2, the subject
property is located between Iroquois and Pleasant View Road on the
northeast shore of Lotus Lake.
2. Existing Zoning: The subject property and it's environs are
presently zoned R-1, single family residence district.
3. Utilities: Sanitary sewer and municipal water are available to
the subject property.
Planner's Comments
1. This proposal involves subdivision of lots 11, 12, 13, 16, 17,
18, 54, 55 into four lots to be held in two ownerships. Two of the lots
will be between Pleasant View Road and Lotus Lake. Mr. Schevenius
is proposing to sell the easterly most 45 feet of Lots 17, 12 and 55,
excepting the northern 140 feet of Lot 12, to the owner of lots 18 and
56.
2. Presently lots 54, 55, 17 and 16 have two water and sewer lateral
and two water and sewer trunk units assessed against it. Lots 56 and'.18
presently have one sewer and water lateral and one sewer and water trunk
unit assessed.

3. The geometry of the existing property split in lots 12 and 13,
has created a substandard lot deficient in lot area.
4. Our records indicate that no assessment review by Council was
requested by the applicant prior to the adoption of the assessment
role for the East Lotus Lake project 75-10.
5. As shown in the attached Planning Commission minutes, a public
hearing was duly held to consider this request. The Planning Commission
recommended that the Council approve the subdivision request based
solely on the merits of the plan as submitted with the understanding
that City Council will consider the issue of special assessments.
Planner's Recommendation
In concurrence with the Planning Commission, I recommend that the Council
approve Mr. Schevenius's plans for subdivision with the understanding
that the fiscal issues will be addressed by the City Council.
Manager's Comments
,.A; s
The applicant in making4request (.basically combining 3 lots to form 2)
is also asking that the City Council delete one assessment as a part
of the request. It is this portion of the request which I believe
is of greatest concern (see my letter to Mr. Schevenius dated May 9,
1978)
The Council, upon recommendation of the engineer, has made 3 assessments
against the property and, as such, three building permits could be
issued. This request, to delete an assessment, is of concern to Mr.
Schevenius; i.e. "there would be no point in our selling the piece to
Mr. Smith if we had to pay the $6,207. sewer charge since the charge
would wipe out the value of the sale" (Schevenius letter of April 17,
1978 - attached). In contrast, it is the decision of the owners
to have larger parcels than would be required and, if the assessment
were deleted, other property owners would be forced to pay the deficiency.
Support to the request can be found by recognizing that, had the
owners been able to proceed with the ownership changes when first
discussed, these properties would have been only two buildable lots
at time of assessment and would have only received two assessments.

The purpose of this hearing is to consider preliminary development plans
for the construction of a 55,760 square foot printing facility to be
located on the north side of Highway 5 in Hennepin County. The Council
has directed the City Engineer to conduct a frontage road and utilities
feasibility study for an area north of Highway 5 including this property.
This study will be completed by June 5th. The property is zoned P-4.

As President of the Chamber of Commerce I think the
plan looks very acceptable to the city and I would
recommend that the Planning Commission recommend
approval to the Council.
Bernard Schneider - I think that this is the type of development that
we certainly are looking forward to. There is
apparently no outside storage. It's -going to be
a clean building, very pleasant to look at and we
need a lot more like it.

Last week our application for a property transfer of part of my fatherfs
property to Mr. Joe Smith came before the Planning Commission. One other
matter in connection with this, whether or not we can have one of the
sewer assessm6nts deleted.. they said was a matter for the City Council to
handle, and it was suggested we contact you and the City Treasurer.
Our sale purpose, briefly, is to selll a portion of %lyr fathers s property to
Mr. Joe Smith, our neighbor on the east. His plan is to build a house on
his land and develop the property in a way which he feels will be suitable.
It is rrty intention -to rove to my fatherls house when I can, and the Land
remaining will be a size my wife and I feel we would be able to care for
satisfactorily.
You will recall that I had a number of personal and phone.conversations with
you and Bruce Pank-onin regarding this property. Most of these occurred in
the August « October period in 1977. However, to refresh your memory and
bring ,you up to date I enclose a number of exhibits with comments:
A. Original drawing of property by Joe Smith, the neighbor wishing to
purchase the piece of property.
B. A drawing which is similar to A but deletes the lot lines for clarity.

C. New survey by Egan, .Field & Nova.k, done in accordance with City
Regulations.
D. Copy of my letter of September 18, 1976 to the City Clerk. I was
seeking a written answer to this, but the City Planner, Mr. Pankonin,
phoned ne and asked me to come in and discuss the exact details
with him. In that meeting Mr. Pankonin sdid that he did not think
we would be charged for any more sewer connections than there were
buildable lots. However, he added that an_appli&ation=with-°.dra.wings .
would have to be submitted to the City.
E. Copy of my letter to the City Clerk of September Sr 1977. This letter
I ollowed a conversation with you or Mr. Par-conin. Later it was youy
3'-believeA who: told me the Council was sympathetic and that I should
not worry about the dating of my letter. A series of meetings was
being held anyway. An application, with survey, would have to be
made before action was taken, and it was thought that the most we might
need to pay on the questioned third assessment would be the portion
required from the time the assessments were made until the new
division was accepted. Since some conversations were with sir. Pankonin
and a few with you I am not always certain which person supplied
which information, but the above is the background.
Since these contacts we have waited until the surveyors could do the necessary
work. That is in hard and the matter is now before the City of Chanhassen.
Our request, then, is that we be relieved from payment of the third assessTMrent
on the following grounds:
1. This sale was planned before the sewer assessments went into effect.
2. Since there will be only two houses (ray father's and fir. Smithts) on
two buildable lots it would seem logical to have only two charges.
3. There would be no point in our selling the piece to Mr. Smith if we
had to pay the $6207 sewer charge since the charge would wipe out the
value of the sale. Te would give up something for nothing and lose
the opportunity for a later sale. Neither would it be reasonable to
expect Mr. Smith to pay the 06207 on top of his parchase price.
Instead, -the. purpose of providing my father and Mr. Smith with two -
lots of suitable size would be lost. This is why I sought a written
answer so that we would not experience the layers and surveyors fees
that have accrued if it could not be done. However, on the basis
of my conversations it seemed safe to proceed.
Thank you very much for your attention in this matter.. I am sorry to be
lengthy, but I dial want to cover the material thoroughly since it is an
unusual case. Hopefully, this will answer all questions and result in a
favorable Council decision.

I wish to make a final brief statement before the June 5 meeting.
1. In 1973 or 1974 Mr, Joe Smith, our renter and owner of the adjacent
property, approached my parents with the idea of purchasing their mire
property from them. It was seriously considered by all parties, and,
since I was in Africa, I was asked if I had any objections. I then
expected to stay there until retirement, so I felt I should not
stand in the way.
2, However, because of the political situation in Rhodesia I, in fact,
did return home in 1975 and was then interested in retaining the
property. Mr. Smith graciously agreed to settle for buying a portion
of the land adjacent to what he already owned and build on the enlarged
piece. He had felt that the piece he owned was too small for what
he wanted to do. The new arrangment would allow him a chance to
build to his own specifications and would enable me to have a more
manageable —sized plot to care for.
I state the above points simply because there seem to be those who feel
that the main intent of our proposed transaction is to avoid paying an
assessment and that it might be something very recently planned.
I am also enclosing a copy of the Notification of Audit Results. This
indicates that the property did not receive clearance for sale until
October 24, 1977. We have since been told that we could probably have
gotten around this by certain legal methods, but we did not know that at
the time. In any event, it would have been easier and cheaper to wait
until the audit was completely cleared. Our lawyers did say that something
had been completed in August or September. Perhaps, my sister says, that
was a paper that went to Chaska indicating that the deed could be transferred
from joint ownership to my father's name.
I would like to add here that there were only two houses on the three
buildable lots, and there were.planned to be no more. Now there will be
only two houses on two biddable lots. Obviously, if lot sizes are changed,
and we build another house, we would expect to pay the assessment. This
would be logical and fair.
We appeal, therefore, for relief from the sewer assessment on the basis of
information rendered which to us seems, also, to be the only logical and
fair solution. Thank you very much for your consideration of this matter.

comments in regards to the property division as such are the same
as those presented to the Planning Commission. I have additionally
attached a copy of the Planning Commission minutes for your review.

One portion of your letter of April 17th is of concern to me. Specifical:
those sections regarding the deleting of the assessments against the
lot proposed to be abandoned through the transfer. In reviewing my
files on this issue I find a copy of your letter of September 8, 1977,
with a note from this office asking the Planner, Attorney and Engineer
for their comments. The response received from the City Planner was
that the proposed subdivision would have to follow'nornal platting

feasibility study for an area north of Highway 5 including this property.
This.study will be completed by June 5th. The property is zoned P-4.
Al Klingelhutz - As President of the Chamber of Commerce I think the
plan looks very acceptable to the city and I would
recommend that the Planning Commission recommend
approval to the Council.
Bernard Schneider - I think that this is the type of development that
we certainly are looking forward to. There is
apparently no outside storage. It's going to be
a clean building, very pleasant to look at and we
need a lot more like it.

Our sale purpose, briefly, is to sell a portion of my father's property to
Mr. Joe Smith, our neighbor on the east. His plan is to build a house on

we would be charged for any more sewer connections than there were

and a few with you I am not always certain which person supplied
which information, but the above is the background.
Since these contacts we have waited until the surveyors could do the necessary -
work. That is in hand and the matter is now before the City of Chanhassen.
Our reTiest, then, is that we be relieved from payment of the third assessment
on the following grounds:
1. This sale was planned before the sewer assessments went into effect.
2. Since there will be only two houses (my father's and Mr. Smith's) on
two buildable lots it would seem logical to have only two charges.
3. There would be no point in our selling the piece to Mr. Smith if we
had to pay the $6207 sewer charge since the charge would wipe out the
value of the sale. 'de would give up something for nothing and lose
the opportunity for a later sale. Neither would it be reasonable to -
expect Mr. Smith to pay the $6207 on top of his purchase price.
Instead, -.:the. purpose of providing my father and Mr. Smith with two
lot;3 of -suitable size would be lost. This is why I sought a written
answer so that-, we would not experience the lawyers and. surveyors fees
that -have accrued if it could not be done. However, on the basis
of my conversations it seemed safe to proceed.

Mr. Schevenius is requesting (as shown in enclosure 1), to subdivide
Lots 11, 13, 16, 17, 18, 54, 55, and 56, Pleasant View Addition
into four lots proposed as Tracts A, B, C, and D.
Background
1. Community -Location: As shown in enclosure 2, the subject property
is located between Iroquois and Pleasant View Road on the Northeast
shore of Lotus Lake.
2. Existing Zoning: The subject property and its environs are
presently zoned R-1, Single Family Residential.
3. Utilities: Sanitary sewer and municipal water are available to
the subject property.
Planner's Comments
1. The proposal is to essentially sell the easterly most 45 feet
of lots 17, 12 and 55 excepting the northern 140 feet of Lot 12,
to the owner of lots 18 and 56.
2. Presently lots 55, 54, 17 and 16 have two water and sewer laterals
and two water and sewer trunk units assessed. Lots 56 and 18 presently
have one sewer and water lateral and one sewer and water trunk unit
assessed.

3. The geometry of the existing property split in lots 12 and 13
has created a substandard lot deficient in lot area.
Planner's Recommendation
I find Mr. Schevenius' plan to be within the requirements of Subdivision
Ordinance 33. Of primary importance to a positive staff recommendation
would be the condition that all assessments on lot 17 be remitted before
subdivision approval would be granted. Since there are no utilities
or improvements proposed with the subdivision, I recommend that .the
Planning Commission order a public hearing to be held May 10, 1978.

SUBJ: Schevenius/Smith Subdivision, Pleasant View Addition
Pursuant to your request, I have reviewed the proposed "Subdivision
of Rev. C.W. Schevenius and Mr. Joseph J. Smith involving lots 12,
13, 16, 17; 54, and 55, Pleasant View Addition." Please be advised
that this proposed addition will have to follow the normal platting
procedures as outlined in city ordinance 33. The two parties cannot
describe the property by metes and bounds description and receive
building permits pursuant to city ordinances.
I think the two parties should be advised of these facts at this
time. I would be happy to inform them of such.
