Dear Peter:
As you know, the City of Chanhassen does have in its fi.l.es, a letter
aof credit in the amount of $23,000-from Lyman Lumber as surety that
the improvements for Phase I of'_thesLyman Lumber complex are completed.
As you also probably know, this Letter of credit is set to expire on
July 18, 1980. In reviewing the project, it is apparent that sub-
stantial work has been finished, however it appears that we will need
` to have this letter of credit renewed. In reviewing the site, the
following improvements are yet to be completed:
1. Bituminous surfacing "of driving areas in distribution yard
2. Boulevard sodding and seeding
3. 'Lighting on the eastern portion of the distribution yard
4. Landscaping
For administrative --purposes, we would expect the new bond to be
delivered to the�cIty offices by Tuly,1,.1980. Should substantial
progress be made on the items yet to be completed, please notify me
and arrangements' can possibly- be made -for a.readjustment in the letter
of credit amount®

Dear Bob:
I am writing in response to your letter of May 23, 1980. In that, you dis-
cussed the possible need to renew our letter of credit for our Chanhassen
project, phase.I. I also spoke to you about the letter last Friday.
This letter is our request not to renew the subject letter of credit. We
are substantially complete on the items you listed as needing to be com-
pleted. Of major importance is the bituminous surfacing which was finished
two weeks ago. As to any further lighting of the distribution yard, none
is planned beyond what has already been accomplished. The final two items,
sodding and seeding, and landscaping are in the process of being done. I
gxpect that they will be done by July 18, the letter of credit date.
It is with this in mind that we are requesting not to renew the letter of
credit. If I do not hear further from you, therefore, I do not plan to
renew the letter. "If you have any further question, please give me a call.

I am in receipt of your letter. Iof June 3, 1980 regarding the

correct, i.e. should -the City deny a building variance for lots
512-516, deletion of'one assessment would be required.

Dear Don:
On October 9, 1979, Kay requested several assessment searches,
one of which was for Lots 2969-2980 and 3018-3029, Carver Beach.
These lots were being sold by Mr. Harvey Berg and Kay wanted to
update her assessment cards to reflect the amount still owed by
Mr. Berg.
On the original Carver Beach assessment roll, the Bergs were
assessed a total of six (6) units on lots. (483-484 & 507-511)
(490-496) (512-516) (569-576) (476-482 & 468-472 area only)
(2969-2980, 0 - 29, two units)
However, during the appeal process three units were deleted
(a copy is enclosed), two units for Lots 2969-2980, 3018-3029 and
one unit for 569-576. Thus the properties owned by Mr. Berg were
finally assessed three units for the entire grouping of lots.
The total assessment placed upon these lots was $21,189.00.
After this assessment was levied, two groupings of lots were sold
(483-484 & 507-511) and 490-496. The total assessment then on
properties still owned by the Bergs was $9,310.20. Thus, the
October 9, 1979, letter from Kay requesting,the assessment search. ,
Lots 2969-2980 and 3018-3029 were only assessed an area
charge 150 feet back over 12 lots each 20 feet wide = 36,000 ft.2
x .lOC or $3,600.00. Therefore, the Berg assessment should be
$9,310.20 - $3,600.00 or $5,710.20, which brings us to the problem.
Lots 569-576 are swamp. ,Lots 468-472 and 476-482 have no road,
sanitary or water.

The only grouping of lots to place a full assessment on are
512-516, which are approximately 8500 ft.2
On October 30, 1979, Bob Waibel, Jerry Schlenk and myself
viewed these grouping of lots. There is an existing structure on
Lots 507-511. It was our opinion a similar house could be placed
upon Lots 512-516. In fairness, the owner of Lots 507-311 also
owns Lots 483-484 making this lot group over 10,000 ft.
A variance would have to be granted Lots 512-516 to be
buildable. If this is not done, the City will ,lose this $5,163.00
assessment.

before buildable. These lots are 15 - 20 feet below
the road. Council should consider substitution of
area charge for unit charge on these lots. Situation
-unique to these and Metzig property.
RECOMMEND CONSIDERATION OF REDUCTION AS INDICATED.
JOHN CLARK - Parcel 49DO/5
Unplatted. Property was assessed two (2) sewer units
in accordance with criteria. Water service will be
provided in the future by trunk water connection between
County Road 17 and Galpin Boulevard.
RECOMMEND NO CHANGE.

water lateral -trunk charge for this area. This assessment would
then be replaced by an area charge of $800.00 (Lots are 8,000 ft,2+)
These figures have not been adjusted for previous payments or interest.
If the roadway were extended to serve Lots 476-482, an assess-
ment could be placed upon these lots. Also, if Lots 504-506 were

Some of this $11,805 principal had been paid up to the time of
Kay Klingelhutz's request (October 31, 1979) which further reduced
the amount to $9,310.00.
Subsequently, the Bergs sold another grouping of Lots 2969-2980
and 3018-3029. These lots had $3,600 in area charge placed on them.
Subtracting this, $9,310.00 - $3,600.00 = $5,710.20. Of this figure,
$5,163.00 would be the assessment on Lots 512-516. The $547.20 is
an area charge over Lots 468-472, 476-482 and 569-576.

Petition
The applicant is proposing to construct a 12 foot addition onto the
west side of the existing dwelling at the subject property to wit a
10 foot front yard setback is requested.
Comments
Section 22.02 subsection 1 states. that "The Board Of Adjustments and
Appeals shall not recommend, and the Council shall not grant a var-
iance unless they find the following facts:
1. That there are special circumstances or conditions affecting
the. land building or use referred to in the application for the
variance.
2, That the.granti'ng of the variance is necessary for the pre-
servation andenjoyment of substantial property=:Frights
3. That thegranting of the application will not be materially
detrimental to the public welfare or injurious to property in
the area adjacent to the property for which the variance is
sought.
4. That the grant of a variance will be in keeping with the
spirit and intent of this ordinance.".
Although the applicant may have further information that is intrin-
sic to the request, this office, in perusing the application, has
significant difficulty in determining where this request clearly
fulfills the enabling guidelines and philosophy for granting of
variances.

One of the major basis for variance consideration is uniqueness of
the property or area which usually portends to difficulties of top-
ography or the planning practices that have been observed in the
area (neighborhood) in which the property is located. °Topographic
difficulties and unusual planning practices in the immediate area
do not appear to be present in the case at hand.
Another underpinning to the variance process is that all will benefit
if all will comply. It is true that three garages are becoming very
popular and very useful for single family settings, however it is
unfortunate that this neighborhood was of an era that was not designed
to accommodate this trend on a popular basis.
With it being understood that the applicant may have personal imput
which may qualify the above comments, I feel the granting of this
request would set precedent to the provisions of zoning Ordinance 47.

Comments
As shown in enclosure 1, the subject property is located at the
intersection of Deerwood and Hopi Road in the Carver Beach neighbor-
hood.
According to the Carver` Beach Public Improvement-Proj'Gt assessment
rolls, the subject property has been assessed 1 lateral and trunk
water and sewer unit.
The City Council in levying the public improvement assessments in
the Carver Beach area recognized the fact that much of the property ,
had developed according to past land use practices and in such
recognition set forth a policy that lots as small as 10,000 sq. ft.
could receive building permit privilege. The City Council has
adhered to this policy for new construction proposals and this office,
has in the past, suggested that in new development proposals that
applicants attempt to acquire 12,000 sq. ft.
Recommendation
I recommend that the Board of Adjustments and Appeals recommend that
the City Council deny the request on the grounds that it would be
setting precedent for lot area. Additionally, the Board of Adjustments
and Appeals should encourage the

The applicant is requesting an approximate 8,000 square foot lot
area variance, a 12 foot front yard variance and a 10 foot rear
yard variance for the construction of a foundation on the property
known as Lots 512-16, Carver Beach.
The Planning Report and recommendation of May 16, 1980, were delivered.
Correspondence opposing the proposal was read into the record which
were from William and Karen Moreno, 6727 Hopi Road; Ernie and Violet
Keefer; Nadean Collver; Kathy and Vernon Beckman.
Art Partridge moved to deny the request based upon lot size and that
the City Council further investigate the matter of the pending
assessment on the property. Seconded by Dale Geving. Vote - Unanimous.

Dear Don:
On October 9, 1979, Kay requested several assessment searches,
one of which was for Lots 2969-2980 and 3018-3029, Carver Beach.
These lots were being sold by Mr. Harvey Berg and Kay wanted to
update her assessment cards to reflect the amount still owed by
Mr. Berg.
On the original Carver Beach assessment roll, the Bergs were
assessed a total of six (6) units on lots. (483-484 & 507-511)
(490-496) (512-516) (569-576) (476-482 & 468-472 area only)
(2969-2980, 3018-3029, two units)
However, during the appeal process three units were deleted
(a copy is enclosed), two units for Lots 2969-2980, 3018-3029 and
one unit for 569-576. Thus the properties owned by Mr. Berg were
finally assessed three units for the entire grouping of lots.
The total assessment placed upon these lots was $21,189.00.
After this assessment was levied, two groupings of lots were sold
(483-484 & 507-511) and 490-496. The total assessment then on
properties still owned by the Bergs was $9,310.20. Thus, the
October 9, 1979, letter from Kay requesting the assessment search.
Lots 2969-2980 and 3018-3029 were only assessed an area
charge 150 feet back over 12 lots each 20 feet wide = 36,000 ft.

x .104 or $3,600.00. Therefore, the Berg assessment should be
$9,310.20 - $3,600.00 or $5,710.20, which brings us to the problem.
Lots 569-576 are swamp. Lots 468-472 and 476-482 have no road,
sanitary or water.

The only grouping of lots to place a full assessment on are
512-516, which are approximately 8500 ft.2
On October 30, 1979, Bob Waibel, Jerry Schlenk and myself
viewed these grouping of lots. There is an existing structure on
Lots 507-511. It was our opinion a similar house could be placed
upon Lots 512-516. In fairness, the owner of Lots 507-Fl also
owns Lots 483-484 making this lot group over 10,000 ft.
A variance would have to be granted Lots 512-516 to be
buildable. If this is not done, the City will lose this $5,163.00
assessment.

Dear Don:
On October 9, 1979, Kay requested several assessment searches,
one of which was for Lots 2969-2980 and 3018-3029, Carver Beach.
These lots were being sold by Mr. Harvey Berg and Kay wanted to
update her assessment cards to reflect the amount still owed by
Mr. Berg.
On the original Carver Beach assessment roll, the Bergs were
assessed a total of six (6) units on lots. (483-484 & 507-511)
(490-496) (512-516) (569-576) (476-482 & 468-472 area only)
(2969-2980, 3018-3029, two units)
However, during the appeal process three units were deleted
(a copy is enclosed), two units for Lots 2969-2980, 3018-3029 and
one unit for 569-576. Thus the properties owned by Mr. Berg were
finally assessed three units for the entire grouping of lots.
The total assessment placed upon these lots was $21,189.00.
After this assessment was levied, two groupings of lots were sold
-,(483-484 & 507-511) and 490-496. The total assessment then on
properties still owned by the Bergs was $9,310.20. Thus, the
October 9, 1979, letter from Kay requesting the assessment search.
Lots 2969-2980 and 3018-3029 were only assessed an area
charge 150 feet back over 12 lots each 20 feet wide = 36,000 ft.2
x .10G or $3,600.00. Therefore, the Berg assessment should be
$9,310.20 - $3,600.00 or $5,710.20, which brings us to the problem.
Lots 569-576 are swamp. Lots 468-472 and 476-482 have no road,
sanitary or water.

The only grouping of lots to place a full assessment on are
- 512-516, which are approximately 8500 ft.2
On October 30, 1979, Bob Waibel, Jerry Schlenk and myself
viewed these grouping of lots. There is an existing structure on
Lots 507-511. It was our opinion a similar house could be placed
upon Lots 512-516. In fairness, the owner of Lots 507-�11 also
owns Lots 483-484 making this lot group over 10,000 ft.
A variance would have to be granted Lots 512-516 to be
buildable. If this is not done, the City will lose this $5,163.00 ±
assessment.

The following is a revision to my October 5, 1979, letter.
As requested, I have figured the assessment on the above
mentioned property. The breakdown is as follows:
The original assessment shows:

3 Lateral Water -@ $1,486.00 = 4,458.00
3 Trunk Sewer @ $ 458.00 = 1,374.00
3 Trunk Water @ $ 544.00 = 1,632.00

$21,189.00
My copy of the original assessment shows the Berg property
was initially assessed six units. However, the Carver Beach
assessment appeals dated October 1, 1976, reduced the number
of units to three. The units which were removed were two on
Carver Beach Road and one on Pawnee.
Therefore, the remaining assessment of $9,310.20 should be
broken down as follows:

SUBJ: Zachman Homes Lot Size Variance Request
PLANNING CASE: P-414
APPLICANT: Zachman Homes, Inc.
Petition: Zachman Homes, Inc. is requesting a variance to build
a house on a parcel of land containing 11,100 square feet.
Background:
1. Community Location: As indicated in enclosure 1, the subject
property is located at the intersection of Kiowa and Nymph Road,
in the Carver Beach Neighborhood.
2. Existing Zoning: The subject property and environs are zoned R-1,
Single Family.residential district.
3. Utilities: ;The sub.iect,property is served_by sanitary sewer and water

a. Land Use Pursuant to the Carver Beach Neighborhood Plan,
the subject property is to assume and maintain a low density residential.

b. Pursuant to the Comprehensive Plan, Iroquois is to function
as a local street. Nymph Road at this time is undeveloped.
Planner's Comments
1. The subject property is a portion of a larger parcel of land
(DO 494) which was assessed for three (3) sanitary sewer trunks and
laterals and three (3) water trunks and laterals. The total assessment
for the entire parcel was $21,189.00. The Carver Beach Plan (10,000
square feet increments) formed the basis for the city's assessment formula

2.' As shown in enclosure 3, sanitary sewer and water is stubbed in
to the subject parcel (lots 483,484 and 507 ® 511).

3. From a planning perspective, it appears the proposed combination of
lots is consistent with Carver Beach Neighborhood and city's assessment
policy.
4. In reviewing this variance request, the City Council should ask
the following questions regarding the applicant's request:
a.. Does the zoning variance lead to practical difficulties
or undue hardship on the part of the property owner in the use of his
property?
b. Is the hardship unique to the property?
C. Is the landowner unable to acquire adjacent land so as to
meet the dimensional standards of the zoning ordinance?
d. Will the proposal alter the essential character of the area?
e. Is the proposal in conformance with the spirit and intent of
the zoning ordinance?
f. Is the proposed variance in accord with the city's assessment
policy?
If these questions cannot be answered in theaffirmative by the City
Council, then the variance request should not be granted.
5. Since the subject parcel is a portion of a larger parcel, it would
appear additional property could be attached to the subject property.
However, as shown in enclosure 1, the combining of lots to form the subjec
parcel is reasonable and will not disrupt future combination of isolated
parcels into developable lots. Specifically lots 511 to 516 (located
southeast of the subject parcel) could be combined.with lots 503 - 506
to form a buildable site. These lots, 503 - 506, are vacant and received
only an area assessment pursuant to the Carver Beach improvement project_
Board of Adjustments and Appeals Recommendation: The Board of
Adjustments and Appeals held a public hearing on September 26, 1977.
The Board voted in favor of recommending that the City Council grant
the variance to construct a home on the subject property. The Board
also advised the petitioner to retain as many trees as possible so as
not to alter the present appearance of the area.
Planner's Recommendation: I find this request to be within the
spirit and intent of the Carver Beach Plan and subsequently recommend
its approval.

NORTH FIRE STATION: This item will be on the July 21, .1980, Council agenda for a

INDUSTRIAL REVENUE Boms: Mayor Hobbs asked if there is any way to resr_i&l the
prior approval of industrial revenue bond financing given to property owners v7ho have
not started construction. The City Manager was instructed to notify property owners
of the Council's intent.
HANDS PROPERTY- The Building Inspector is going' through the permit to make sure
all provisions are complied with.
CONSENT AGENDA: Mayor ;Hobbs asked if any member of the Council wished to discuss
any item on the consent agenda. As no additional Garments were received, Councilman
Neveaux moved to approve the consent agenda as recanrended by the City Manager.
