As indicated in the attached memorandum dated October 20, 1980, from myself to Mayor Hobbs, the Murphy's are requesting clarification on immediate development possibilities for their property relative to the spec ial'assessments presently placed on said property. The purpose;of�this memorandum is not to discuss assessment philosophy' - but is essentially to point out present compliance difficulty the property has with respect to the zoning and subdivision ordinance and possible development alternatives. The most significant difficulty the subject property has with regard to the subdivision and zoning ordinance is that it is land -locked and does not have frontage on a public street. The Murphy residence and its attendant property presently is accessed via an easement called Pleasant View Circle and. also appears to be- potentially accessible via easement on what is known as%Pleasant View Lane located between the Nelson, and the McNutt--'and-Schroeder properties: Regardless of whether or not these easements are exclusive or not exclusive, it remains doubtful= whether- these accesses could be.:b-rought up to a standard` because of required right-of-way and. -potential cost of improvements to�existing homeowners along' the easements. When taking into account all of the existing conditions in the vicinity of the subject property, the most promising develop- ment potential would roughly resemble that shown on enclosure no. 2 In discussing this matter, the -City Council should remain cognizant of the fact that the attached development scheme is extremely preliminary at this time in that the adoption of that scheme is significantly dependent upon the agreement of all parties adjoining these development areas, the development timing of the properties in exhibit #2` and the resolution of site - specific design problems Puch as the orientation of the Murphy, Nichols, and Xart4k residences to the scheme proposed. Staff is recommending that items 1, 2, 3, 4, and 6 (as outlined in the Schoell and Madson report, attached) be completed. This cost is anticipated to be approximately $4,000. A majority of this work would be required should the City determine that such should be sold as a 5-7 acre parcel for outside development. In either case, whether sold as a larger parcel, or sold as individual lots,, it has been the intent of the City to sell such. This philosophy was approved by the City Council in earlier discussions when considering the total amount of assessments against the parcel. Again, any final sale of this northerly acreage would be contingent upon final approval from the State - thus assuring the City that we were in no way jeopardizing the overall grant for the park property. Again, recognizing that there are only minor dollar differentials between preparation of the preliminary plat and sale as a larger platted lot, this office would recommend that the City keep all options open in a potential sale of the property to assure that the City is receiving the best return for its investment. In addition to the boundary work for the northerly portion, this office would also recommend that the boundary and topographic work be completed for the southerly 20 acres. Based on Staff interpretation of State guidelines and through discussions with State personnel it is our belief that these costs would be applicable grant costs. Preliminary plat, street profiles, drainage plan, utility plan and earthwork computations. 5. Site grading plan. 6. Compute outside boundary closures. 7. Compute and draft final plat and dedication. 8. Stake road for subgrade (once). 9. Stake drainage structure (.once). 10. Stake for gravel base (once) . 11. Stake lot corners (once). This proposal has been prepared based on your concept plan, Exhibit "C". Ile estimate the cost of the above work to be between $8,200.00 and $9,300.00. In estimating these costs, we have used the same ` SCHOELL & MAOSON. INC form as we present to private developers. In this case, we expect that there will perhaps be some items your staff may do themselves so we propose to do the work on an hourly basis and this will no doubt reduce the total cost from that estimated above. Also, if for some reason the development is not accepted beyond some point in the normal process of completion, the City will only be charged for the actual work completed to that. point. We have also estimated the cost of a boundary and topographic survey for the remainder of the property, which is to. be used as the Lotus Lake Community Park. ED DUNN - CONSIDERATION OF PRELIMINARY DEVELOPMENT PLANS: Mr. Dunn was present asking for time on a future agenda for consideration of the Lake Susan West Preliminary Development Plan. Council members tentatively set December.8, 1980. EXTEND "NO PARKING" SIGNS,. GREENWOOD SHORES ASSOCIATION PETITION: A letter was received from the Greenwood Shores Association requesting the extension of "no parking" signs along Utica Lane and Tecumseh Lane to discourage problems in the park. The Park and Recreation Commission recommended the Council install the "no parking" signs as requested. Carol Watson and Don Chmiel were present. 4i - �/ Councilman Neveaux moved to install the "no parking" signs as outlined in the Park and Recreation Commission minutes of July 15, 1980. The Council requests a sign be installed in the park showing the park rules. The Park and Recreation Commission be directed to survey the residents of Greenwood Shores to gain input into what they want in the development of the park and further direct the Park and Recreation Commission to work with the Greenwood Shores Association in the development of a park plan for the Greenwood Shores Park. REVIEW SUBDIVISION AND/OR SPECIAL ASSESSMENT DELETION REQUEST, 5450 PLEASANiT VIEW i IRCLE, THOMAS MURPHY: The issue before the Council is whether Mr. Murphy will be llowed to subdivide his property because of additional assessments placed against ,n it or whether the assessments should be reviewed. The property is currently. landlocked. Councilman Neveaux moved that four trunk sewer and..four.trunk water assessments -be deleted and that Mr. Murphy work with staff to work out the rebate foie overpayment of the additional assessments. Mr. Don Ashworth -2- October 30, 1980 Recommendation A final determination as to the location of the entrance road into the East Lotus Lake park, including potential subdivision of the northerly portion of that property, will occur within the next one year period. As shown in the attachments, this road could be continued through to Highway 101 (assumes agreement by B.T. Land for the second and third phase of Lotus Lake Estates residential development). This option would eliminate the "land locked" and "road frontage" issues. In the alternative, the Lotus Lake Park entrance road could be shifted northward and would again provide the possibility for division of the Murphy property without changing the East Lotus Lake residential plat (assumes that this road would not be extended to Highway 101 as shown, but would end in a cul-de-sac on the Murphy property). Given these two possibilities, this office would recommend that Mr. Murphy be informed that any subdivision of the property is premature and that a one year deferment of the four trunk sewer and water assessments be approved. In this conversation, I had discussed some of the intrinsic problems of the property with regard to access, public utilities, assessments, etc. As a result of this conversation, I had requested that Mrs. Murphy send a letter to myself outlining their immediate desires for the property and, based upon such, I would initiate the proper proceedings, i.e. variance, subdivision, or obtain a statement from the City Council that they could use for sales representation purposes. In discussions today with previous City`Engineer, Bill Brezinsky, and Dale Campbell, Schoell and Madson, it has been indicated that the subject property, like similar properties in the east Lotus Lake public. improvement project area, was -assessed. lateral units for any existing residential structures and an additional trunk charge for vacant.land at the rate of 2� units per acre. As shown on the attached assessment list, the subject property was._ assessed one water and sewer.lateral unit and five trunk water and sewer units. As mentioned above, and as evident in the attached section map, there are significant intrinsic questions as to the manner in which this property should best be developed since it is landlocked. These difficulties coupled with the intention of the Murphy's to sell this property does produce a considerably cumbersome situation when one is asked what specifically can be done with a parcel without having gone through any subdivision or variance processes.
