SUBJ: Request for a Side Yard Setback Variance at 7601 Great Plains
Blvd.
Petition
Mrs. Mingo is proposing to construct an addition to an existing
garage. It is requested that a side yard setback variance of 2 feet
be granted to accommodate the proposed addition. Chanhassen Zoning
Ordinance 47 requires side yard setbacks of 10 feet for single family
residences.
Background
1. Community Location: As indicated in enclosure 1, the subject
property is located northeast of the intersection of Great Plains
Blvd. and West 76th Street.
2. Existing Zoning: The subject property and its environs are zoned
R-1, Single Family Residential district. The subject property contains
26,208 square feet. The existing house presently meets all the setback
requirements of the R-1 district.
3. Utilities: Municipal sanitary sewer and water are in place and
servicing the subject property.
Planner's Comments
1. The Board of Adjustments and Appeals shall not recommend, and the
Council shall not grant a variance unless they find the following facts:
a). That there are special circumstances or conditions affecting
the land, building or use referred to in the application for the
variance.
b). That the granting of the variance is necessary for the
preservation and enjoyment of substantial property rights.

c). That the granting of the application will not be materially
detrimental to the public welfare or injurious to property in the area
adjacent to the property for which the variance is sought.
d). That the granting of the variance will in keeping with
the spirit and intent of the zoning ordinance and city plan.
The Board of Adjustments and Appeals in recommending, and the Council
in granting a variance may impose conditions to insure compliance and
to protect adjacent properties. The Board of Adjustments and Appeals
and the Council shall not permit as a variance any use that is not
permitted under this ordinance for property in the zoning district
where the land which is the subject of the variance application is
located.
2. The existing structure on the subject property was situated at
an angle to the rectilinear property line. The proposed addition
to the structure would continue on the alignment of the existing
structure which places the addition eight (8) feet from the property
at the southeast corner.
3. The existence of double garages on residential properties are
essentially within the character of the neighborhood.
4. In consideration of the juxtaposition of the structure to the
property lines, a minimum side yard setback of eight (8) feet at the
point of the southeast corner of the building is a reasonable solution
to accommodate the property with a double garage.
Board of Adjustments and Appeals
The Board of Adjustments and Appeals held a public hearing on November
10, 1977, and voted to recommend the City Council grant the variance.
Planner's Recommendation
I believe that there are sufficient grounds and finding of fact to
support the granting of this variance. I -therefore recommend that the
City Council approve this request as per the plans submitted.
