Petition: As shown in enclosure 1, Elizabeth Novak (owner of Lots 8,
9, 18 and 19 Red Cedar Point) petitions the City Council to initiate
a public improvement project to upgrade Kirkham Road to City standards
between Hickory and Red Cedar Point Drive. In addition, Ms. Novak,
requests the City install sanitary sewer and water in the Kirkham
Road alignment.
Background:
1. As shown in enclosure 2, the subject property is an unimproved
platted street located north of Red Cedar Point Drive in the Red
Cedar Point Neighborhood.
2. Comprehensive Plan Proposals:
a. Transportation Plan: Pursuant to the adopted City Plan,
Kirkham Roadis proposed to be upgraded to city standards north of
the Red Cedar Point Alignment. The purpose of this roadway is to
provide local access to adjacent properties on the east and west.
b. Land Use: Red Cedar Point Neighborhood Plan suggests
property located on either side of the upgraded Kirkham Road alignment
be absorbed as low density residential building sites.
3. Public Improvement Project 71-1E: In 1971, the city council
commenced a public improvement project to bring municipal sanitary
sewer, water and hard surfaced roads to the Red Cedar Point Neighborhood.
The upgrading of Kirkham Road to city standards and the installation
of municipal utilities in said roadway, pursuant to the adopted Red
Cedar Point Plan was not part of the city's improvement project in
1971.

Planner's Comments
1. It appears this petition for public improvement is submitted in
response to the fact that Ms. Novak's property (214DO and 215DO)
received two sewer and water assessments in 1972. The reason the
city assessed this property as two units was the fact that two separate
owners occupied the property at the time the assessment roll was
formulated. Since 1972, Ms. Novak has assembled the two parcels into
one developable unit.
2. It should be remembered, however, the two sewer lateral and trunk
and water lateral and trunk units placed on this parcel were levied
in response to public improvement project 71-1E and not for the Kirkham
Road.upgrading.
3. A perusal of the property reveals that one or possibly two new
dwelling units could be constructed in the Red Cedar Point Neighborhood
if Kirkham Road were upgraded to City standards. Since minimal
property would be benefitted by this public improvement project,
I suggest Ms. Novak circulate a petition in the neighborhood to obtain
additional sponsors for the public improvement project prior to the
City Council ordering a feasibility study to consider extending
Kirkham Road.
4. Since Ms. Novak has assembled Parcels 214DO and 215DO into one
buildable unit, I suggest the City Council abate one of the assessments
for sanitary sewer and water lateral and sanitary sewer and water
trunk as originally established on Juniper. This recommendation is in
accordance with previous decisions made by the Council.

An appeal has been filed with the Zoning Administrator for
a variance of Zoning Ordinance No. 47. The Board of Adjustments
and Appeals will conduct a hearing on this appeal on Tuesday
June 28, 1977 at 6:30 p.m. at 7210 Juniper
All interested persons may appear and be heard at said time and
place.
APPLICANT: Elizabeth Novak
PLANS: The applicants desire to combine Lots 8, 9, 18 and 19,
Block 2 Red Cedar Point, into one buildable single family lot.
The width (length on Juniper Drive) will be 80 feet. When said
lots are combined, City ordinance 47 requires a 90 foot lot width
at the building setback line, hence the herein applied for variance
to city ordinance.
