Dear Bill:
It is my understanding that the City Council acted to table the
request from Bloomberg Companies for the City to .install improve-
ments within Colonial Grove Second.A.ddition as a public improve-
ment project -
Three :items. will be necessary for this request to proceed further:
1) . Plattir_g and Plan Review Escrow - You should request that
30.o irya� be�veiiy_ amounts established within your
escrow account and, determine whether such funds are
sufficient to pay ail costs associated with final
platting.
2) . Feasibility Study Escrow --- Bob Waibel should additionally
be contact-ed in regards the estiraated costs of preparing
the feasibility study for public improvements, to be
prepared . by Schoel.l and Madson, as well as potential
legal costs in carrying out necessary public hearings.

these potential' costs, Bob should instruct. the engineer's
office to proceed ti-, ith the feasibility. 'study- After
receipt of -she feasibility study and holding, of necessary
public hearings, should the City Council act to proceed

back against benefiting properties. In --that case, the
amounts deposited by you, under this escro,.7 account, v7ould
be reimbursed. The City Council makes no guarantees that
the feasibility study will find the project feasible, nor
that information may arise during the public hearing which
causes the Council to deny proceeding as a public improve -
?:sent project _ if the project is not ordered, all costs.

out public hearings will be paid through this escrow
account and only remaining balances then remi tted to you.
3). Letter of Credit Guaranteeing Assessments - A letter of
credit equal to 110% of the total principal and interest
amount of assessments to be spread, is required. The form
of the letter of credit must be approved by the City
Attorney's office. Maturity for the letter of credit
may coincide with the maturity date of special assessments,
or may be for a shorter period of time if a renewal option
is included within the letter of credit. However, if the
letter of credit is for a shorter period of time- i . e . one
year, and the bank determines not to renew the letter of
credit, the City twill -then be forced to draw upon the
letter of credit for the then remaining principal balance
of outstanding debt. Typically, the bank would rene-,T
such Letter of credit at the then lower principal amount -

hereby requests approval of the division of said lot as shown
on the attached certificate of survey marked "Exhibit A"
which is hereby incorporated herein by reference. The purpose
of the division is to enable petitioner to convey the shaded
area on said exhibit to the owner of the adjoining Lot 3.
No new building sites will be created. The proposed description
has been approved by the Carver County Registrar of titles
as indicated on said Exhibit A.
