Community Location As shown in enclosure 2, the subject -property is located at 6220 Murray Hill Road. Existing Zoning The subject property and environs is zoned R-1, Single Family residential. Municipal Services Sanitary Sewer.and water is in place and in service to the subject property. Comprehensive Plan Proposal Pursuant to the adopted City Plan, the subject and environs is to assume a low density single family residential identity. Physiography of the Subject Property Vegetation: The eastern 1/3 of the subject property is devoid of trees, while -!the western 2/3 of the subject property is covered with mature hardwood trees. .—e Q,Mr. Don Ashworth -2- June 14, 1977 Topography The eastern 1/3 of the subject property gently slopes to the north while the western 2/3 of the property falls off rapidly to the north. Planner's Comments As shown in enclosure 2, Murray Hill Road is an 80 foot platted right-of-way with a driving surface of 20 feet. As you know, the city's subdivision ordinance, ordinance 33, requires all residential streets be built on a 50 foot right-of-way. Since Murray Hill Road was platted to standards which far exceed the contemporary street standards of the city, coupled with the fact that the subject property falls off severely to the north, I feel the variance request, as petitioned, is in keeping with the spirit and intent of the city's zoning ordinance, subdivision ordinance and city plan. Planner's Recommendation I recommend the city council look favorably on Mr. Fransdal's request and issue appropriate permits as petitioned. Board of Adjustments and Appeals Recommendation On Tuesday, June 7, 1977, the Board of Adjustments and Appeals held a public hearing on the subject property to consider Mr. Fransdal's request. At that meeting, "A motion was made by Roman Roos and seconded by Will Johnson to recommend the City Council grant the variance and issue the necessary building permits. The following voted in favor: Roman Roos, Will Johnson and Dick Pearson. The Board asked the Council to consider vacating 15 feet on each side of Murray Hill Road, provided the driving parts (of the roadway) is in the center of the easement..." As shown on the print, Murray Hill Road is an eighty (80) foot plotted street with a driven surface of twenty (20) feet. To comply with the. front yard set back of thirty (30) feet and the forty (40) feet of plotted road west of the road centerline totals eighty (80) feet from the road centerline to the front edge of the proposed house.. This distance from the road along with the grade of the lot almost eliminates the proposed house plans and restricts development of the property for any house design. We hereby request a fifteen (15) foot front yard variance which will. allow the proposed development. With this variance, the front line of the -proposed house will be fifty-five (551) feet from the centerline of the road, the` same as it would be if the road were a fifty (50) foot road, which.is .the normal width today for.a secondary road such as Murray Hill Road.
