Section 6.05, Subsection 5 of Zoning Ord- inance 47 - parcels in the R-lA, Agri- cultural residential District must be 21i acres in size. Section 2.01 of Ordinance 45 - no platting or subdivision of land is permitted in the unsewered area of the city. The easterly portion of the subject property is available to sanitary sewer and municiple water which exists in Minnewashta Parkway. The westerly 3/4 of the subject property would require extention of services along King Road for development of the westerly 3/4 of the subject property. Physical Characteristics ANALYSIS The subject property is composed of hayden Loam soils having varible slope from 6-12%. Field observation of the subject property would indicate that there are no major restrictions to development due to soils or slopes. Although 2 applicable sections of ordinance have been mentioned above, the overriding issue on the subject request is the precedent to sub- divide a parcel which is, for the'most part, unavailable to sanitary sewer service. Specifically, should any subdivision of the property occur that would meet or exceed the minimum 15,000 square feet for the portion of the property along Minnewashta Parkway, the balance of the subject property would fall below the 2k acre provision for the R-lA of Ordinance 47. Although rezoning of the subject property to R-1, Single Family Residential District could be contemplated bringing the required lot area down to 15,000 square feet, such would be inappro- priate until plans have been made by the applicant to furnish sanitary sewer and water to the entire parcel. It appears that ultimate development of the subject property into residential lots along Kings Road will not adversely impact the future access to surrounding properties north of King Road. Planning Report - H- singer September 3, 1981 Page 3 Since the right of way of Kings Road is only 33 feet, it would be customary to require dedication of additional right of way as part of the platting of the property. However, since the existing 33 foot right of way of Kings Road was originally derived from the subject property, and because the existing residents on the subject property is located extremely close to the Kings Road right of way additional dedication as part of this plat would be of marginal benefit at best. If the subject request would proceed to a preliminary plat stage, survey of the septic system including drainfield for the existing residence would be needed. Rd. 15 and Kings Road. The land is owned by my mother, Ruby E. Hunsinger. I am making this petition on her behalf at her request. Our reason for this subdivis- ion is to make the property ready for immediate sale. It is our intent to split the parcel into two pieces by drawing a North -South line 180 ft. East of the present Western boundary. This would create, as the sketch plan indicates, one parcel of .75 acres and another of 2.18 acres +/-. There is one existing dwelling on the property that would be located on the Western (.75 acre) parcel after subdivision. Sewer and water utilities serve that portion of the property fronting Co. Rd. 15. One sewer and water assessment has been levied. Please take the appropriate steps to place this before the planning commission as soon as possible. Rd. 15 and Kings Road, belonging to my mother, Ruby Hunsinger. My interest is that of Personal Representative of the Estate of Elmer J. Hunsinger. There are 2 sewer and water assessments on the property, affecting that portion fronting Co. Rd. 15. The first assessment, put on in 1972, is now nearly paid. The second was put on this year. It is not a deferred assessment but a new assessment or a re -assessment. This assessment may have been based on faulty information in your plat book, Bob, as to the amount of road frontage we have on Co. Rd. 15. Your plat book shows Kings Road to the South side of the section line, whereas it is actually located on the North side of the section line as shown on the enclosed plat. We would like to clear up the building/assessment status of this parcel to make it ready for sale. Please advise us on the follow- ing questions: 1. Could the land adjoining Co. Utilities: The subject property presently is not serviced by munic pal water and sewer. Sanitary sewer and water trunk lines presently follow the alignment of Minnewashta Parkway. 4. Comprehensive Plan Proposal: a. Land Use: Pursuant to the city's adopted Comprehensive Plan, this area is to assume and maintain a residential identity. b. Transportation: The adopted transportation plan specifies that Minnewashta Parkway function as a minor collector and Kings Road as a local street. Planner's Comments 1. The subdivision of the subject property requires Kings Road to be upgraded to public street standards. (Enclosure 2) This upgrading of Kings Road will minimally require 8.5 feet of the subject property for right-of-way purposes, subsequently reducing areas for lots A, B, C and D to 14,700 square feet and necessitating Planning Commission -2- September 9, 1977 a lot area variance of 300 square feet for each lot. 2. The rezoning and subdivision of the subject property additionally require that sanitary sewer be extended on Kings Road to serve the proposed subdivision in accordance with Ordinance 45. 3. The proposed use of Lot F as a lake access is a conditional - use, however, this type of land use is encouraged.
