Background
1. Community Location: The subject property, as shown in
enclosure 1, is located on Orchard Lane directly across the street
from Cermak's Nursery.
2. Existing Zoning: The subject property and environs is
zoned R-1, Single Family Residential.
3. Municipal Services: Sanitary Sewer and water is in place
to the subject property. If this division is grantdd by the City
Council, additional sewer and water assessments will be placed on
the property. Since Orchard Lane is built to city standards, no
additional street dedication will be required to the subject property.
4. Comprehensive Plan Proposal: The city's land use plan indicates
the subject property and adjacent parcels assume a low density single
family residential identity.

Planner's Comments
1. The proposed redivision is consistent with the plans for
land use, transportation, and utilities.
2. The subdivision plan would be acceptable if the subdivider
dedicates to the City of Chanhassen required utility and drainage
easements along the property lines.
Planner's Recommendation
Look positively on this subdivision request and order a public
hearing for Wednesday, April 13, 1977. Further, instruct the
petitioner to provide the City of Chanhassen a certified list of
adjacent property owners within 350 feet. This list should be
provided to the City no later than Monday, March 21, 1977.

BACKGROUND:
1. Community Location: The subject property, as shown in enclosure
1, is located on Orchard Lane directly across the street from Cermak's
Nursery.
2. Existing Zoning: The subject property and environ is zoned R-1,
Single Family Residential.
2. Municipal Services: Sanitary sewer and water is in place and in
service to the subject property. If this re -division is granted by the
City Council, additional sewer and water assessments will be placed on
the property and credited against the north area sewer project. Since
Orchard Lane is b ilt to city standards, no additional street dedication
will be required the subject property.
4. Comprehensive Plan Proposal: The City's land use plan indicates
the subject property and adjacent parcels should assume a low density
single family residential identity.
PLANNERS COMMENTS:
1. The proposed re -subdivision is consistent with the spirit and
intent of the City's plan for land use, transportation, and utilities.
2. The subdivision plan will be acceptable if the subdivider dedicates
to the City of Chanhassen required utility and drainage easements along
the property line as outlined in City Ordinance 33.
3. The eventual buyer of Lot B should be encouraged to keep the future
structure on said Lot B as close to Orchard Lane as legally possible.
This would allow the back of the parcel to be re -subdivided sometime

in the future if and when the properties to the east desire to be
re -divided and a roadway is put in.
PLANNING COMMISSION RECOMMENDATION:
As shown in the Planning Commission minutes, the Commission duly held
a public hearing on April 13, 1977, to consider re -subdivision of the
heretofore described parcel of land. As shown in the public record
"Dick Dutcher moved to recommend to the Council that the subdivision
be approved. Motion seconded by Jerry Neher. Motion unanimously
approved."
PLANNER'S RECOMMENDATION:
I recommend approval of the proposed subdivision if the subdivider
incorporates the concerns as outlined above.

SUBJ: Re -subdivision of Lots 33, 34, 35 and 36, Minnewashta Park,
Chanhassen, Minnesota
PLANNING CASE: P-322
APPLICANT: William D. Huntington
PETITION: To resubdivide a portion of Lots 33, 34, 35, 36,
Minnewashta Park into two new building sites.
Background
1. Community Location: The subject property, as shown in
enclosure 1, is located on Orchard Lane directly across the street
from Cermak's Nursery.
2. Existing Zoning: The subject property and environs is
zoned R-1, Single Family Residential.
3. Municipal Services: Sanitary Sewer and water is in place
to the subject property. If this division is grantdd by the City
Council, additional sewer and water assessments will be placed on
the property. Since Orchard Lane is built to city standards, no
additional street dedication will be required to the subject property.
4. Comprehensive Plan Proposal: The city's land use plan indicates
the subject property and adjacent parcels assume a low density single
family residential identity.

Planner's Comments
1. The proposed redivision is consistent with the plans for
land use, transportation, and utilities.
2. The subdivision plan would be acceptable if the subdivider
dedicates to the City of Chanhassen required utility and drainage
easements along the property lines.
Planner's Recommendation
Look positively on this subdivision request and order a public
hearing for Wednesday, April 13, 1977. Further, instruct the
petitioner to provide the City of Chanhassen a certified list of
adjacent property owners within 350 feet. This list should be
provided to the City no later than Monday, March 21, 1977.

Please be advised that Mr. William D. Huntington is proposing
to resubdivide the aforementioned lots in the City of
Chanhassen. This resubdivision, will in all probability, be
approved by the City Council if Mr. Huntington gives the
required drainage and utility easements as specified by
ordinance and pays the eequired filing fee for subdivision
of land.
