Mr. Scholer is proposing to construct a house on the southerly 71
feet of Lots 9 and 10. This request entails resubdivision of the
subject property, lot frontage variances and lot area variances for
the proposed lots.
Background
1. Community Location: As indicated in enclosure 1, the subject
property is located at the southeast quadrant of the intersection
of Frontier Trail and Chan View.
2. Existing Zoning: The subject property and its environs are
zoned R-1, Single Family Residential District.
3. Utilities: Sanitary sewer and water are available to the subject
property. Lot 10 has been assessed a sewer and water unit and lateral.
Lot 9 has been assessed for sewer and water laterals. No trunk units
have been assessed.
4. Comprehensive Plan Proposal:
a. Land Use: Pursuant to the adopted city plan, the subject
property and its environs are to assume and maintain a low density,
single family residential identity.
b. Transportation: Frontier Trail functions as, but is not
designed as, a collector street. Chan View is to function as a local
street.

Planner's Comments
1. The proposed resubdivision will maintain the individual lot
size of 8,520 square feet or 56.8% of the 15,000 square feet as
required by ordinance 47. Most of the lots in the St. Hubertus
Addition are of comparable size.
2. The proposed resubdivision indicates 71 feet of frontage for the
lots, whereas 90 feet are required.
3. Because of the mobility function of Frontier Trail as a collector
street, local access from abutting properties is discouraged. Local
access to collector streets should be made only through local street
access.
4. The placement of the existing structure by the initial owners has
encroached on the buildable area intended for lot 9.

cedent setting ramifications resultant of a positive recommendation
for this proposal. Should the positive recommendation be forthcoming,
a firm and comprehensive statement denoting the exceptionality of this
request should be entered into the record, so as not to erode the pur-
pose of section 7.05 (5) of Ordinance 47, and the elasticity of the
variance process.
If the City Council concurs with the findings of the Planning Commission
with respect to the proposals consistency to the spirit and intent of the
city plans and ordinances, the applicant should be directed to prepare
a final plat persuant to section 10 of Subdivision Ordinance 33.

our neighborhoods are going to feel with sewer. I would vote to deny
the replatting. I am fairly familiar with that part of town and I
think we are being pressured by the council, realtors, and citizens
to open up estate type developments in other parts of the city. Here
we have them and even with the assessments and interest, etc. I think
it would still behoove the city to look at it carefully versus going
out, ten miles out another road and opening up another estate
development just to make the people happy that want one. I£ we did
deny the petition to subdivide, I don't think we would be doing
those people any real favor. I don't know how long they could
support the type of to+.�7; and homes they !lave but according to the
City Planner these things (assessments) may be called next year
or they may never be called depending on other development in that
area. For those reasons I would vote to deny it.
Jerry Neher - I am in reverse of,liud due to the fact there are
assessments placed on the property there are deferred assessments.
There is nothing to say that it's going to continue on to the point
where we are not going to have to call those assessments in. I
think we have to loci: at the whole city and eventually it has to
come that the lots are going to be subdivided and I can't feel there
is anything to :u` gained by prolonging it or putting it off. We need
sewer hook ups. I would be in favor of grantin,4 it.
Jerry Neher moved to recommend the Council approve the preliminary
plat for Marvel Eggam dated February 8, 1978, and grant a variance
to the.Subdivision Ordinance wherein the requirement for topographic
data be waived. Motion seconded by Walter Thompson. The fol-owing
voted in favor: Roman Roos, Jerry Neher, Dick Matthews, and Wal-tpr
Thompson. Hud Hollenback voted no. Motion carried. �
PUBLIC HEARING
REPLATTING OF LOTS 9 AND 10, BLOCK 1, ST. HUBERTUS
Roman Roos called the public hearing to order at 8:25 p.m. The
following interested persons were present:

The Assistant City Planner read the official notice as published in
the Carver County Herald.
Mr. Scholer is requesting resubdivision of Lots 9 and 10, Block 1,
St. Hubertus and lot area variance and frontage variance to the R-1
requirements. The proposed resubdivision would maintain the individual
lot size of 8520 square feet.
Adolph Tessness previously stated to the City Planner that he had no
objection to the subdivision.
Mr. Scholer explained that there were two assessments for sewer and
two assessments for water but only one unit assessment for each
against the existing house. The lots will remain the same size.
Walter Thompson moved to close the.public hearing. Motion seconded
by Hud Hollenback and unanimously approved. ;r'_YarwnM closed at

PRELIMINARY DEVELOPMENT PLAN - CARVER'S POINT: Ed Dunn, Rod Hardy,
Ste,lios As an is, Jim Hill, Joe Betz, Tom Klingelhutz, John 15eters,
and Iihirley Clasen were present. The developer's are proposing to
rezone =.-he property located south -of Carver Beach Road from R-lA to
P-1 and subdivide the property into 100 building sites
The City Planner gave his report. The open space sedtion of the
guide plan for the neighborhood suggests that it may be desirable'to
acquire an active play area located in the northeast portion of the
proposed plat. There is an existing tot lot across Carver Beach Road.
The Building Inspector commented on the proposal. He feels the lots
abutting County Road ,17 and MSAS 101 should have additional depth
so as to provide screen plantings. He further felt that the
intersection of Carver Beach Road and Penamint could be dangerous.
The Fire Marshal also questioned a Penamint/Carver Beach Road
intersection.
The City Planner recommended ha the applicant work closely with the
Building Inspector, City Engineer, and Planner to develop a suitable
landscape screening along County Road 17 and MSAS 101. In addition,
the developer should wo::k closely with the Building Inspector to
design a street naming plan which will not be confusing. The Planning
Commission should ord(,r a public hearing to test neighborhood sentiment
on the proposed PRD.
The Park and Recreation Commission reviewed the proposed development
on February 7, 1978, and recommended that,the Carver's Point children
would be better served with a neighborhood playground in or adjacent
to the proposed development. This neighborhood play,,fround should
be provided with safe pedestrian access and provide a means to get
over or under MSAS 101. Before making any recommendation, the Park
and Recreation Commission would-like.to review the developer's total
concept and plan for the area and after reviewal make a fok�nal reply
to the Planning Commission. This neighborhood playground should
be designed to meet the needs of all the residents.

Planner's Comments

R-lB zones have -the following requirements to which variances are needed
for the proposed subdivision:
a). Lot Area - 10,000 square feet required; 8,520 proposed.
b). Rear Yard Setback - 20 feet required; 12.7 proposed.
(this dimension pertains to the existing house in relation to the
proposed lot line). The rezoning of this property would constitute a
spot zone and planning staff has historically looked at spot zoning
in a negative light because of its nature of preferenciality to individ-
ual properties and requests.
2. Because of the mobility function of Great Plains Boulevard as a
collector street, local access from abutting properties is discouraged.
Local access to collector streets should be made only through local
street access.
3. The city council did place two sewer unit assessments, and one
water unit assessment on the subject property, however, the placement
of the existing structure by the initial owners has encroached on the
buildable area of lot 9.
Planner's Recommendation
I recommend that the Planning Commission deny this request on the
grounds that the required zoning is a spot zone, it would permit addition-
al housing on a lot of substandard area, and that individual properties
should not egress onto a collector street.
