City Plan Proposal Pursuant to the Carver Beach Neighborhood Plan, the subject property and environs is to assume a low density residential identity. Specifically, all land located east of Nez Perce should be rezoned to allow building on 10,000 square foot lots. Municipal Services Sanitary sewer and water is in place in Kiowa. The subject property was assessed one sewer and water unit. Parenthetically, the City Council would be hard pressed in not allowing the owner of the subject property to utilize the sewer and water assessment that was placed on this property. Planner's Comments In reviewing the petitioner's request, the city council ask the following the City Council should ask the following questions regarding the proponent's request: 1). Does the zoning variance lead to practical difficulties and undue hardships on the part of the property owner in the use of his property? a Don Ashworth -2- e-) March 18, 1977 2). Is the hardship unique to the property? 3). Is the hardship caused by actions on the part of the landowner? 4). Is the landowner unable to acquire adjacent land so as to meet the dimensional standards of the ordinance? 5). Will the proposal alter the essential character of the area? 6). Is the proposal in conformance with the spirit and intent of the zoning ordinance and city plan? If these questions cannot be answered, in the affirmative, by the City Council, then a variance should not be granted. Board of Adjustments and Appeals Recommendation The Board of Adjustments and Appeals met on Thursday, March 17, 1977, to consider Mr. Varner's request for a variance from the area requirements of the City Zoning Ordinance. The Board duly recommends the Council grant the variance request as petitioned. Planner's Recommendation Because the City Council placed one sewer and water assessment on the subject property I believe Mr. Varner is entitled to the use of his property.
