Councilman. Geving moved to table action on reconsideration until Mr. Luse presents the City with: a $1,500 letter of credit. Motion seconded by Councilman Neveaux. The following -voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Swenson. No negative votes. Motion carried. LARSON SUBDIVISION REQUEST, 6301 CHURCH ROAD: Terri Larson is requesting to be aide to plat Tract D of Registered Land Survey No. 15 into one single family non -buildable lot, to be attached to the lot at 6301 Church Road. The applicant is also requesting to divide this lot in up to four additional non -buildable lots which can also be sold to abutting lot owners. The Planning Commission, upon duly holding a public hearing on the request, recommended that the.Council grant approval with the conditions recommended by staff. 1. That the plat conforms to the proposed subdivision drawing prepared by Cardarelle and Associates dated August 20, 1980, with the amendment that the parcel shown as Lot 2 be indicated as Outlot A, and 2. That the applicant enter into a platting agreement with the City of Chanhassen to be filed with the plat that would designate that no building permissions are implied or granted in the subdivision. Councilman Neveaux moved to grant preliminary plat approval in the matter of the Terri Larson subdivision, Planning Case P-682, and the approval is to create either two unbuildable lots or six unbuildable tracts, contingent upon a platting agreement being signed by the developer setting forth that none of said lots are eligible for a building permit and that the developer is to return with a final plat electing to go either with the six lots or the two lots. Motion seconded by Councilman Pearson. The following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux, Geving, and Swenson. No negative votes. Motion carried. KERBER BLVD. BIKEWAY IMPROVEMENT PROJECT: This item was tabled until October 27, 1980. Councilman Pearson moved to adjourn. Motion seconded by Councilman Geving. I have reviewed the road access provisions of that deed and find them to be appropriate for City purposes. I have not reviewed the lake access provisions however. Lake access is a private matter between Mr. Lund and Mr. Larson. Prior to issuance of a building permit, Mr. Lund should obtain the signatures of Mr. and Mrs. Larson on the easement deed, and Mr. Lund should file with you a photocopy of the fully executed easement deed. For your own reference, you should note that the proposed easement language is limited to Lot 2'. It does not benefit Lot 1 on which the existing house is located. Comprehensive Plan Proposal: a. Land Use: The city's adopted Comprehensive Plan suggests the subject property and environs assume a low density residential identity upon the installation of sanitary sewer. b. Municipal Utilities: Sanitary sewer and water is in place and in service to the subject property. As you know, the critiera for evaluating a subdivision request is the adopted city plan, zoning ordinance and subdivision regulations. The city's subdivision and zoning ordinance, on the other hand, require all new lots to have at least 15,000 square feet of area and 90 feet of frontage on a public road. 2. All the lots to be created meet or exceed the minimum, requirements as. -set forth in the city's plan for land use, zoning and subdivision. Public Heari As shown in enclosure 3, the planning commission duly held a public hearing on November 9, 1977, to test neighborhood sentiment on Mr. Larson's proposal. As the record shows, no comments were received from the general public. Planning Commission Recommendation As shown in enclosure 3, the planning commission moved to recommend the council grant a short plat approval to Mr. Larson provided the city attorney approves the title and drainage easements are given. Planner's Recommendation I recommend the city council find Mr. Larson's subdivision request to be consistent with the spirit and intent of the city's plan for land use, transportation, utilities,�zoning and subdivision. Dick Dutcher - Would you entertain the notion of donating a portion of the property that abuts the lakeshore to the park for park purposes or for creating a scenic easement or some other easement that would protect that? David Larson - I have 40 feet of lakeshore. I want to retain the ownership and the use of that. There is an area between where the new house would probably go and that Lakeshore that is a wildlife area. I think we could come to some kind of an agreement where we would place restrictions on such things as filling that. My intention is not to do anything other than to leave it natural. I am willing to do that. I think it would be to the best interest of that property, whether I own it or someone else, that they have the assurance and I am sure that the DNR is going to see to it that that piece of property in that area doesn't get developed but rather gets enhanced. I think we should come up with something that on my property says the same thing, that permanently it will be enhanced as well or it will take its natural course rather than being deteriorated by a person or persons. My initial reaction was that this would be the ideal situation in that lot 2 has significant slopes onto Pleasant View Road and provision of direct access to Pleasant View Road may cause undue soil disruption. Also .I believe that since this property is in fact abutting Pleasant View Road, the provision of emergency services would not be negatively effected, and also that the extension of the interior driveway, would assure the City of more suitable and stable access to the lift station at the southern edge of Lot 3. Planner's Comments As you know, the criteria for evaluating a subdivision request is the adopted City Plan and City Ordinance 33. Pursuant to the City Plan, the subject property should assume a low density single family residential identity. The city's subdivision and zoning ordinance, on the other hand, require all new lots to have at least 15,000 square feet of area and 90 feet of frontage on a public road.
