Bloomberg RE: Proposed re -subdivision of Lot 4, Block 2, Colonial Grove at Lotus Lake ,The undersigned Herbert N. Bloomberg is the owner of Lot 4, Block 2, Colonial urove at Lotus Lake, according to the recorded plat thereof, and desires to re -subdivide said lot as shown on the attached exhibits A & B. The purpose of the re -subdivision is to permit conveyance of the small triangular tract of land designated on Exhibit A to the owner of Lot 3, Block 2 of said subdivision. Certain improvements appurtenant to said lot 3, consisting of a masonry based electric light standard, a portion of the black top driveway and other landscaping features, have been located on said triangular strip since the original residence was constructed on Lot 3 several years ago. The undersigned desires to convey said triangular strip to the owner of Lot 3 for the purpose of clearing the title to that portion of Lot 4 which is subject to the above described encroachments. No new building sites will be created if the requested waiver or variance is granted and it would be a hardship on the undersigned if such waiver or variance is not granted. The undersigned therefore respectfully requests the City of Chanhassen to issue such waiver and/or variance with respect to Land Subdivision Ordinance Number 33 as is necessary to permit subdivision of said Lot 4 in the manner set out above. BOX 1479CHANHASSEN, MINNESOTA 553170(612) 474-8885 STAFF MEMORANDUM DATE: August 11, 1976 TO: Don Ashworth, City Administrator FROM: Bruce Pankonin, City Planner SUBJ: Staska Request to Waive Platting Regulation Attached hereto please find the following documents in support of Mr. Staska's waiver request: Mr. Staska's letter dated August 9, 1976, and Registered Land Survey of Lot D, RLS 13. Background Comments 1. The subject property is a land locked parcel located on the north shore of Lake Minnewashta. As you know, the council on August 2, 1976, granted Mr. Staska a variance to derive local access to the subject property via the existing utility easement across his property (Lot D) and Lot B. Lot B, (directly north of the subject property) granted Mr. Staska an easement for access to Lot D. 2. After securing the necessary permission to construct a house on Lot D, Mr. Staska realized that in order to meet all City setback requirements he would have to remove one mature oak tree. Rather than requesting a variance to Ordinance 47, Mr. Staska is proposing to acquire an additional 25 feet from Lot D. 3. The additional 25 feet attached to Mr. Staska's lot will not create an additional building lot. 4. As you know, Ordinance 33, requires all lands to be subdivided in Chanhassen shall follow the procedures as outlined in the city's subdivision ordinance. However, the County Register of Deeds will accept and file and record any "legal document” (i.e. metes Mr. Don Ashworth -2- August 11, 1976 and bounds description of land) without City Council action. Recognizing the apparant bureaucratic discrepency between the city's subdivision ordinance and the state's requirement for filing documents, I recommend the city waive the subdivision requirements for Mr.,Staska and let him file and have a deed recorded for the 25 additional feet of real estate to be attached to Lot D, RLS 13. Soil tests on Tract D indicate that it will be necessary to remove a large oak tree on the property, due to the size of the excavation. By moving the north property line on Tract D,25 ft. further north, we could save this tree. The owner of Tract B,RLS 13, is in agreement with this request. F. C. The subject property is a legal lot of record, as duly recorded as a platted lot or registered land survey. 2. The waiver will not cause a "substandard" parcel as outlined in the city's zoning ordinance. 3. The waiver will not create a new building lot as defined in the city's zoning ordinance.
