RESOLUTION VACATING A PORTION OF CRIMSON BAY ROAD RIGHT OF WAY AS
DEDICATED IN THE PLAT OF CRIMSON BAY
WHEREAS, Adjacent property owners are requesting the vacation of a portion of Crimson
Bay Road public right of way as legally described and depicted in Exhibit A, attached hereto and
incorporated herein (referred to herein as “Right of Way”); and
WHEREAS, pursuant to Minnesota Statutes § 412.851 the City Council of the City of
Chanhassen has conducted a hearing preceded by the statutorily required two (2) weeks published
and posted notice and mailed notice to the abutting property owners, to consider the vacation of the
Right of Way; and
WHEREAS, Public Drainage and Utility Easements will be dedicated where necessary to
replace the vacated Right of Way; and
WHEREAS, There has been a development application submitted to the city by the adjacent
property owners for a Lot Split; and
WHEREAS, the vacation of the Right of Way is necessary to dispose of excess public right
of way that previously served as access to Highway 5, which has been removed by the recently
completed Crimson Bay Road Improvement Project (City Project No. 23-02) with no existing or
future public use.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Chanhassen City Council:
1. The Right of Way is hereby vacated conditioned upon the simultaneous recording of
public drainage and utility easements covering existing utilities; and
2. The vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer
lines, water pipes, mains, hydrants, and natural drainage areas thereon or thereunder, to continue
maintain the same or to enter upon such way or portion thereof vacated to maintain, repair, replace,
remove, or otherwise attend thereof; and
3. The City Clerk shall transmit a certified copy of this Resolution to the County Auditor
and County Recorder.

Exhibit A
That part of Crimson Bay Road as dedicated on the plat of CRIMSON BAY, according to the
recorded plat thereof, Carver County, Minnesota, that lies between the northeasterly line of
Trunk Highway No. 5 (Arboretum Blvd), as dedicated on said plat, and the following
described line:
Commencing at the northeast corner of said Lot 1; thence South 00 degrees 26 minutes 11
seconds East, assumed bearing along the east line of said Lot 1, a distance of 41.97 feet to the
point of beginning of the line to be described; thence southeasterly 65.17 feet along a non-
tangential curve concave to the northeast, having a radius of 64.00 feet, a central angle of 58
degrees 20 minutes 28 seconds, and chord bearing of South 53 degrees 42 minutes 12 seconds
East, to the point of terminus of the permanent right of way easement described in Exhibit A-
1 of Document No. A789134, on file and of record in said county, and said line there
terminating.
The intent is for the above described line to be a westerly prolongation of said permanent right
of way easement per Document No. A789134.
