RESOLUTION AUTHORIZING ENTERING INTO A COOPERATIVE AGREEMENT
WITH MnDOT, CARVER COUNTY, AND CITY OF CHANHASSEN RELATED TO THE
HIGHWAY 41 SHARED USE PATH AND UNDERPASS (SP 1008-118)
WHEREAS, the State of Minnesota, Department of Transportation (“MnDOT”) and the
City of Chanhassen (“Chanhassen”) are partnering with Carver County (“County”) to construct a
shared use trail and underpass along Trunk Highway 41 (TH 41), north of West 78th Street within
the city of Chanhassen (“Project”); and
WHEREAS, the Project limits are within MnDOT TH 41 Right of Way from the
intersection of TH 41 and West 78th Street, to 0.20 Miles north of West 78th Street; and
WHEREAS, MnDOT, County, and Chanhassen have prepared construction plans and
specifications for the Project, and MnDOT has reviewed and approved the Project; and
WHEREAS, this Cooperative Agreement (“Agreement”) addresses, among other details,
construction and maintenance responsibilities of the infrastructure components; and
WHEREAS, a separate agreement between the County and Chanhassen will address cost
share for the Project.
NOW, THEREFORE, BE IT RESOLVED, that the Chanhassen City Council does
hereby authorize entering into MnDOT Agreement #1061806 with MnDOT for the purposes stated
above and authorizes the Public Works Director to act on the city’s behalf to approve minor
amendments to the Agreement.
BE IT FURTHER RESOLVED, that the Mayor and City Manager are authorized to
execute all documents necessary to execute the Agreement.
