My client, Mary P. Knight, is the owner of 3605 Red Cedar Point which happens to be registered as Torrens
property. Kellie and Gregg Geiger (the Geigers), own real property located at 3603 Red Cedar Point Rd.,
Excelsior, MN 55331 (PID: 256600270) which is immediately to the east of Ms. Knight's property. The
Geigers and Ms. Knight resolved a dispute regarding location of their shared property line. As part of that
resolution, a wedge of property lying within the Geiger's legal description is being acknowledged as owned
by Ms. Knight (the "Wedge"). To avoid any future issues with the location of the adjoining property line,
Ms. Knight has commenced proceedings to have the Wedge registered as Torrens property and added to
existing Torrens property at 3605 Red Cedar Point Rd. Coextensive with that action, Ms. Knight is having
the separating boundary line judicially marked. The boundary line and Wedge are depicted on the enclosed
Certificate of Survey, along with legal descriptions for the existing and to be established parcels.
There is also an existing easement for driveway purposes burdening Ms. Knight's parcel and benefiting the
Geigers' property. Since this easement also crosses the Wedge, Ms. Knight and the Geigers agreed to extend
the existing easement over the Wedge. This easement agreement is set forth in the Certificate of Survey
and expressly described in the enclosed Quit Claim Deeds.
A Title Commitment covering the Wedge is also enclosed. We expect the parties having an interest in the
Wedge, including any mortgage holders, will be provided notice of this change as part of the proceedings

to register title for the Wedge. As part of the registration process, any interest in the Wedge contrary to Ms.
Knight's ownership will be extinguished.
The establishment of the Wedge as part of Ms. Knight's property will result in a shift of approximately 0.03
acres of land from what was previously described as the Geigers' property. In other words, the Geigers'
property will be reduced by approximately 0.03 acres and Ms. Kinght's property will be increased by 0.03
acres. We do not expect this shift will result in either lot having impervious surface coverage in excess of
30 percent.
The City of Chanhassen's zoning ordinance, section 20-615, for residential single-family parcels provides
a side yard setback of 10 feet. The agreed upon boundary line does impact the setbacks between the two
parcels. However, the parcels did not previously meet the current setback requirements. The changes
increase the setback compliance for Ms. Knight's property by just under 1 foot at the southern corner of the
garage and to a compliant distance of 11.2 feet at the northern corner of the garage. While the setback for
the Geigers' parcel is reduced, setbacks of 9.5 feet at the north corner of the house and 9.3 feet at the south
corner of the house are maintained. In other words, the non -conformity is reduced by the parties agreed
upon line of occupation. These changes are noted on the Certificate of Survey that is enclosed.
Please accept the application made by my office on Ms. Knight's behalf for approval of the boundary line
adjustment. The parties worked hard to resolve this matter without further litigation. We hope no further
complications are created to stifle that resolution by sending the parties back to Court. If you have any
