Hudson Hollenback called the public hearing to order with the following members present: Jerry Neher, Nick Waritz, Jim Mielke, Tom Noonan, and Mal Mac.Alpine. Dan Herbst was absent. The following interested persons were present: Mr. and Mrs. Edgar Graupmann, 6330 Murray Hill Road Mrs. C. E. Howard, 63701 Murray Hill Road Gary Carlson, Route #1, Box 134, Excelsior Gene Coulter, Great Plains Blvd. The City Planner read the official notice as published in the Carver County Herald. The City Planner reviewed his report of April 7, 1975. This property is outlot D, Bardwell Acres on Melody Hill Road and is zoned R-1. Mr. Hutmaker wants to split a 36,404 square foot lot into two lots. Sewer and water is available. The Planner recommended the Planning Commission recommend the Council approve this lot split subject to the City Engineer's comments. Sill Brezinsky gave the Engineer's report of May 8, 1975. The lot sizes yid setbacks are all in accordance with the ordinance requirements. The `7ineer does not foresee the need for additional utility easements for faure lines through the property. The street was upgraded when the sewer ant water was installed to a 50 foot right-of-way and 28 foot paved width. The 'ity Engineer recommended approval of the lot split. Mrs- 'oward stated she has no objection to the lot split. A motic, was made by Nick Waritz and seconded by Tom Noonan to close the Public .caring. Potion unanimously approved. The City Engineer reviewed his report of May 8, 1975. The division of the property will create two lots that exceed the requirements of the Zonis Ordinance. One lot is 31,170 square feet and is adjacent to a road called cartway. Water is not available to the property. The cartway was not improved at the time the sewer was installed because the waf-er lines were not put in. When water is installed the City plans to imeerove the street to a 28 foot paved width. The right-of-way is limited by the tennis courts on Cathcart Field and the two homes on the west. The Engineer feels a 40 foot right-of-way is the most the City can use. In addition the City Engineer recommends that a 25 foot triangle be taken on the southeast corns of Mr. Carlson's property to allow more turning radius at the corner. The City Engineer recommends this division be approved aubject to Mr. Carlson granting the right-of-way within his property. Mr. Carlson stated the City Attorney is drawing up the easement papers aDd he has agreed to sign them granting the road easements. Mr. Carlson has three legal descriptions on his property although they all describe the same thing. A motion was made by Jerry Neher and seconded by Jim Mielke to close the public hearing. PLANNERS COMMENTS 1. The property under consideration has been platted at outlot D Bardwell Acres containing 36,404 square feet. Lot sizes, dimensions. and setbacks are in accordance with ordinance requirements. SANITARY SEWER AND WATERMAIN Sanitary sewer and water facilities are avail- able in Melody Hill Road abutting the property. Lot C to the north of the Hutmaker property will be -provided service from Ches- Mar Drive. We do not foresee the need for utility easements for future lines through the subject property. STREET Melody Hill Road was upgraded to a 28'-wide surface in conjunction with the North Area Project through acquisition of additional R/W as shown in purple on the attached print. They result in a roadway with total R/W width of 50' from Ches-Mar Drive to the angle point and 52' from the angle to within 123.5' of the eastern end of the original R/W. As shown, the addi- tional easement secured includes a small triangular area in the Southwest corner of the Hutmaker property. No additional roadway easements are required at this time. LOT WIDTH The surveyor's drawing shows the proposed house locations with a 35' setback; on this basis, the western of the two proposed lots has only an 87' width parallel to the roadway. However, it has a 91' width at the 30' setback minimum allowed by the ordinance. RECOMMENDATION We recommend approval of the proposed lot division. Because the petition involves a replat of an existing platted lot, I feel certain documents such as topographic information can be revised, and the certificate of survey as prepared is sufficient to order public hearing per Ord. 33.
