SUBJ: Variance Petition
Background:
Attached hereto please find Application for Rear Yard Variance
initiated by Henry Coudron, 6681 Powers Blvd; sketch plan of
requested variance; and Board of Adjustments and Appeals minutes.
On April 23, 1975, the Board of Adjustments and Appeals duly
held a public hearing on the site to consider a twenty (20)
foot Rear Yard Variance for Mr. Henry Coundron. In addition,
all adjacent property owners within 350 feet of the subject
property were duly notified by the City.
Planner's Comments:
1. The Board of Adjustments and Appeals shall not recommend,
and the Council shall not grant, a variance unless they
find the following facts:
a. That there are special circumstances or conditions
affecting the land, building or use referred to in
the application for the variance.
b. That the granting of the variance is necessary for the
preservation and enjoyment of substantial property rights.
C. That the granting of the application will not be
materially detrimental to the public welfare or injurious
to property in the area adjacent to the property for
which the variance is sought.

d. That the grant of the variance will be in keeping
with the spirit and intent of the Zoning Ordinance.
I am presuming that The Board of Adjustments and Appeals, in
recommending approval of said variance, found substansive facts
to support granting said variance. I believe there would be
practical difficulties and peculiar hardships if the literial
provision of Ordinance 47 were enforced. These include the
existing position of the house, proposed garage and difficulty
in maneuvering from the garage.
Since Councilman Kurvers attended said Board of Adjustments
and Appeals meeting, maybe he could fill us in on the details.
Planner's Recommendation:
Approval of requested variance if the council finds all
conditions as outlined in No. 1 above can be substantiated.

HENRY COUDRON VARIANCE REQUEST.
PERSONS PRESENT: Willard Johnson, Frank Kurvers and Tom Gabbert.
Walter Hayes, an interested citizen was also
present.
A motion was made by Willard Johnson and seconded by Frank Kurvers
to grant Mr. Coudron a 20 foot variance on his rear yard set
back to construct a garage. Motion carried.
His neighbor, Walter Hayes, had no objections.
