On April 1, 1977, the Chanhassen City Council approved plans and
specifications for.construction of an office building by Harry Pauly.
This approval was conditioned on Mr. Pauly and the city entering into
a conditional use permit outlining the scope of Mr. Pauly's contract.
To date, Mr. Pauly has not signed the conditional use permit as
directed by the city council.
Staff would recommend the city council rescind their action of
August 1, 1977, approving Mr. Pauly's conditional use permit if Mr.
Pauly does not sign the appropriate documents and post the required
assurances within a two week period. Further, staff would recommend
the city council initiate a public improvement project to construct
a municipal parking lot behind the business establishments located
in the southwest quadrant of Great Plains Blvd. and West 78th Street.

CONDITIONAL USE PERMIT
PAULY OFFICE BUILDING
WHEREAS, application has been made by Henry A. Pauly, here-
after referred to as the Applicant, for a conditional use permit
to construct an office building on a tract of land within the City;
the location of the proposed officebuilding upon said premises and
the legal description of said tract are as shown as Exhibits A
and B hereto attached and made a part hereof. -
WHEREAS, said premises are within the Central Business District of
the City Zoning Ordinance, which requires a conditional use permit
for the proposed use; and
WHEREAS, the City Planning Commission has given consideration to the
application and has recommended the grant of a conditional use permit
upon certain conditions; and
WHEREAS, the City Council has given due consideration to said appli-
cation and the foregoing recommendations:
NOW, THEREFORE, a conditional use permit is hereby granted to the
Applicant herein to erect an office building upon the described
premises subject to the following terms and conditions, all of which
shall be strictly complied with as being necessary for the protection
of the public interest:
1. Permit Not Assignable. This permit is personal to said
Applicant, and shall not be assigned without written consent of the
City.
2. Description of Property. The premises subject to the within
conditional use permit and the location of the proposed office
b.ui.lding shall be as shown on Exhibits A and B hereto attached and
made a part hereof.
3. Use of Premises. The premises shall be Ltilized as the site
of a 44 by 80 foot office building with accessory motor vehicle
parking, said building and parking area to be constructed as per
plans and specifications dated May 9, 1977 prepared by Criteria, Inc.
on file herein as Exhibit A, except as said plans and specifications -
are modified by this agreement.
4. Use of Structure.. The office building shall consist of
three levels, to be utilized as follows:
a. Lower level for business and professional office use
and tenant storage.
b. Ground level for business and professional offices
and general retail sales and services as that term is
hereinafter defined.
c. Upper level for business and professional off ices.
"General Retail Sales and Services", for purposes of this permit,
are those general retail sales and services contemplated by
Sections 10.01 and 10.02(1) of the Chanhassen Zoning Ordinance,
and shall not include manufacturing or assembly of merchandise for
sale, repair facilities, nor sales of the "drive-in" type.
No changes in the use of the structure shall occur except as may
be permitted by an amended conditional use permit or by a rezoning
of the premises.
5. Architectural Style. The architectural style of the exterior
of the office building shall be that of a late 19th Century rustic
town, utilizing exterior materials symbolic of that era, natural
woods, and earth tones.
6. Limitation on Extent of Use. Due to extensive nighttime
use of available off-street park ni g by neighboring properties, the
use of the premises subject to this permit shall not extend beyond
9:00 P.M. of each day.
7. Street Parking Limitation. The City shall take such action
as is necessary to eliminate the curb cut between the Old Village
Hall site and Pauly's off -sale liquor store and to place a 15
minute parking limitation between the hours of 8:00 A.M. and 8:00
P.M. on the west side of Great Plains Boulevard from West 78th
Street to the northerly limits of the premises subject to the
within permit.
8. Sidewalks and Curbs. The City Engineer shall design all
curbing and sidewalks, including establishment of all elevations,
along that portion of the premises contiguous to Great Plains
Boulevard.
9. Plans and Specifications. Lighting, surface water drainage,
and parking area plans and specifications shall be reviewed and
approved by the City Engineer prior to construction.
10. Schedule of Work. The Applicant agrees that he shall commence
work hereunder on or before , 19 , and shall
have all work done and improvements fully completed to the satis-
faction and approval of the City on or before
197 Upon receipt of written notice from the Applicant of the
existence of causes over which the Applicant has no control which
will delay the completion of the work, the City, in its discretion,
may extend the date hereinafter specified for completion.
11. Performance Bond. For the purpose of assuring to the City
that the construction of the parking area and installation of the
landscaping shall be constructed, installed and furnished according
to the site plans on file herein and to the satisfaction of the City,
and that all costs, including reasonable engineering, legal,
planning, and administrative expenses incurred by the City in

connection with all matters relating to the administration and
enforcement of the within agreement and the performance thereof
by the Applicant shall be paid, the Applicant agrees to furnish
to the City a cash deposit in the amount of $
or in lieu thereof a corporate surety bond in said amount
approved by the City and naming the City as obligee thereunder; said
deposit or bond, as the case may be, being conditioned upon the
performance by the Applicant of his obligations hereunder, said
sum being equal to 110% of thetotal cost of such improvements as
estimated by Schoell & Madson, Inc., the City Engineers, and the
City costs, as estimated by the City Manager.
12. Proof of Title. The Applicant shall furnish the City with
evidence satisfactory to the City that he has acquired fee title to
the premises involved herein prior to commencement of construction.
Said evidence shall include a boundary survey prepared by a licensed
surveyor.
13. Permit Subject to Review. The City reserves the right to
review the within conditional use permit at any time to determine
compliance with all conditions of the permit; and if the City
determines that the Applicant has not strictly complied with the terms
of the permit, the permit may be terminated at the option of the City.
All City expenses incurred in the enforcement of the within permit
shall be the obligation of the Applicant, and may be recovered
by the City as a special assessment against the within described
premises.
14. Standards Applicable. The City Council and Planning Com-
mission have determined that in the grant of the within conditional
use permit, the standards of the Chanhassen Zoning Ordinance have
been met.
15. Acceptance. No grading or building permits shall be issued
until the Applicant has accepted the within conditional use permit
and complied with paragraph 11 hereof.
16. Other Regulations. The Applicant shall comply with all City
ordinances, state laws, and regulations of state agencies and
departments.
17. Building Permits. No building permits shall be issued
until complete building and site plans have been submitted by the
Applicant and approved by the City staff for purposes of verifying
that said building and site plans are in full conformity with all
provisions of the within permit.

PLANNING CASE: P-368 I
1. Petition: As shown in enclosure 2, Mr. Pauly is proposing to
construct a 44 x 80 foot office building and ancillary parking area
directly south of the Old Village Hall on Great Plains Blvd. This
request will require the issuance of a conditional use permit
pursuant to city ordinance 47 - A.
2. Background: As shown in enclosure 1, the subject property is
located on Great Plains Blvd. directly north of the Chicago, Milwaukee,
St. Paul and Pacific Railroad tracks.
3. Existing Zoning: The subject property and environs is zoned
Central Business District (CBD).
4. Municipal Services: Sanitary sewer and water is in place and in
service to the subject property.
5. Comprehensive Plan Proposals:
(a) Land Use: The adopted city plan suggests the removal of
the Old Village Hall and conversion of the city property and subject
property to office/day time commercial use.
(b) Transportation: The city's adopted plan,MnDOT Transportation
Plan and the Metropolitan Council's Functional Classification Plan
indicate Great Plains Blvd. (Temporary STH 101) should function as
a local collector street.
6. Central Business District Committee Recommendation: Pursuant to
city council procedures, the Central Business District Committee met
on Thursday, July 7, 1977, to consider Mr. Pauly's request. Although
Mr. Don Ashworth -2- July 27, 1977
a quorum was not present, Bernie Schneider and Tom Klingelhutz felt
that Mr. Pauly's proposal was consistent with the spirit and intent
of the city's plan for development in the central business district
area.
7. Public Hearing Comments: As shown in enclosure 3, the Planning
Commission duly held a public hearing on Wednesday, July 13, 1977,
to consider Mr. Pauly's request. During this meeting, no comments
were received from the general public.
8. Planning Commission Recommendation: As shown in enclosure 3, the
Planning Commission generally liked Mr. Pauly's proposal, however,
the commission was concerned about a potential truck loading zone on
Great Plains Blvd. and eliminating the curb cut between the old village
Hall and Pauly's Bottle Shop. At the July 13, 1977, meeting "Jerry
Neher moved to recommend the city council approve the plans as submitted
with the modifications that work out and with the recommendation that
the service lane be closed off and limited (15 minutes) parking for
pick up and delivery during the day (suggested time period 8:00 a.m.
to 8:00 p.m.) be installed along the west side.of Great Plains Blvd.
Motion seconded by Dick Dutcher. Motion unanimously approved."
9. City Planner's Comments:
(a) As you know, the City of Chanhassen has been working, for
the last la years, with Harry Pauly and the Bicentennial Commission
to develop a meaningful parking plan and restoration project directly
south of the commercial facilities located in the southwest quadrant
of Great Plains Blvd. and West 78th Street. To date, the City of
Chanhassen has been negotiating with Harry Pauly to purchase a portion
of city property for parking lot purposes.
The concept of constructing an office building and ancillary
parking, as proposed by Mr. Pauly, complies, for the most part, with
the discussions the city has been having with the Bicentennial Commission
and the Central Business District Committee. The only area of non-
compliance, I feel, with previously submitted plans, is Mr. Pauly's
proposal to construct a service land and curb cut along the south edge
of his existing bar and lounge. I feel the continuation of this curb
cut coupled with the expected increase of pedestrian circulation north
and south along Great Plains Blvd. could pose serious problems to the
health and welfare of the pedestrian public. To this end, I suggest
the curb cut (as indicated above) be eliminated and the city instigate
a truck loading zone on Great Plains Blvd. northward from -the city
property.
10. City Planner's Recommendation: I recommend the city council look
with favor on Mr. Pauly's request provided Mr. Pauly and the city enter
into a conditional use permit agreement which incorporates the concerns
contained herein.

REGULAF PLANNING COMMISSION MEETING JULY 13, 1977
Mal MacAlpine called the meeting to order at 7:30 p.m. with the following
members present: Hud Hollenback, Dick Dutcher, Walter Thompson and Jerry
Neher. sties Bridger and Roman Roos came late.
PUBLIC HEARING
CONDITIONAL USE PERMIT - HARRY PAULY
Mal MacAlpine called the public hearing to order at 7:30 p.m. Harry Pauly
was; present. The Planning Commission dispensed with the reading of the
official notice.
The City Planner gave -his report. Mr. Pauly is proposing to construct
a parking lot behind the bar and build a.44' x 80' office building.
Both requests require a conditional use permit. The CBD Committee met
and felt this was consistent with the downtown development. The Planner
recommended the Planning Commission look with favor on the proposal
provided he be bound to the purpose and scope of the documents submitted
to date. The Mr. Pauly post a performance bond to guarantee the constructio
of the parking areas and landscaping areas and pay for all city costs
incurred in processing this application. The City Planner feels the
access drive immediately behind the bar is dangerous. If the access were
closed off possibly the area along Great Plains could be posted as a
loading zone between 8:00 a.m. and 5:00 p.m. There could be a service
lane where trucks could back in to the service doors.
M J Roman Roos came at 7:45 p.m.
A motion was made by Hud Hollenback and seconded by Walter Thompson to
close the public hearing. Motion unanimously approved. Hearing closed
at 7:55 p.m.
CONDITIONAL USE PERMIT - HARRY PAULY: Members commented on the proposal.
Jerry Neher - I like the whole plan generally, very much. I am concerned
that] it is surprising to me that it has never happened before, that
;there hasn't been somebody hit coming out of the driveway. I hate to
see it closed off but I think for safety sake it's the only route to go.
Walte.� Thompson - I think it is very important.that limited time parking
be posted along Highway 101. It is convenient to use th:� back door there
because usual�.y the street is loaded. Other than that x see no problems
once the drivers get educated as to how they operate t}--ar-.
Hud Hollenback - I like the plan and I concur w4 th Bru. ';e ^ a }°-:i::bk the

concern. A limited truck loading area might be one possible solution
in that area if the other were blocked off. 1 gress I won't really comment
on anything else. I like the looks of it. I 1i"-,e anything that says
there is going to be growth going south to Highway 5.

persons were present: Ron Lnright and Xike Sorenson. The Planning Commission dispensed
with the reading of the official notice.
The City Planner gave his report. P1r. Sorenson is proposing to build a retail office
building at 7900 Great Plains Blvd. The Central Business District Committee met and
felt that the proposal is consistent with the fyirit and intent of the Ci.ty's plan
for development. The Planner recommended the Planning Commission find the request
positively consistent with the City's plan for land use transportation, and utilities,
provided he be bound to the scope of the drawings submit
ed to date and the elimination
of the parking spaces as discussed at the lant meeting, and he demonstrates to the
Council the type of screening the outside storage area, and that he post a cash bond
guaranteeing the construction of all the parking areas, landscaped areas, and pay for
all costs incurred by the City in processing this application.
Pie. Sorenson is proposing a full canopy on the building with lighting underneath.
He is also proposing a redwood or cedar fence around the storage area.
A motion was made by Dick Dutcher and seconded by hud Hollenback to close the public
hearing. Motion unanimously approved. 'nearing closed at 8:15 p.m.
CONDITIONAL USE PERMIT - PUKE SORENSION: Members commented on the proposal.
Jerry Neher - T like i s a good use for the land.
Walter Thompson - I think the canopy is an improvement over the bearness of the other.
I am satisfied with the efforts that have been made.
Had Hollenback - I think it's a very appropriate use for a difficult piece of property.
Raman Roos - I think the earth tones and the cedar or redwood is going to tend to
lead it in the direction we want it to go. I personally like it.
Les Bridger - I like the idea. It will be a nice addition. It is a good use of the land.
Mal MacAlpine - I think you have tried to do what we asked you to do.
Dick Dutcher moved to recommend the Council approve the. plan as it is consistent yith
th6 City 's plan for land use. Pbtion seconded by Jerry Neher and unanimously approved.
MINUTES: Hud Hollenback moved to accept the June 22, 1977, minutes as submitted.

NOISE ORDIN94CE AMENDMENT: 06mmidsion, members want to study the proposed amendment
and compare it with the present ordinance.
R,-1B RESIDENTIAL DISTRICT: The Planner recommended the Planning Commission look at
Red Cedar Point, Carver Beach, St. Hubertus, and Shore Acres as possible areas to be
rezoned R-1B. Staff will identify lots that would fall into this zoning for the
next meeting.

LOT 12, AUDITOR'S SUBDIVISION #2: Gene Coulter invited each Council
member to look at Lot 12. The Association would like something done.
This will be an agenda item the first meeting in September. The
engineer is preparing a tentative feasibility study on four areas for
storm sewer; Hill, Erickson, Hughes, and Lot 12. The City Manager
will send Mr. Coulter a letter advising him of what is happening with
the lot.
SEWER LATERAL INSTALLATION, CLARIFICATION OF LOT DIVISION APPROVAL -
DONALD SCHMIEG: Mr. and Mrs. Schmieg were present requesting the
Council to consider whether his lot at 7702 Erie would be a buildable
lot and whether an existing garage could be converted to a residential
home. The lot is 45' x 120' and was previously assessed for water.
A sewer lateral could be installed at this time prior to street
improvements. The garage is 26' x 43' and is currently a non -conforming
use.
Staff suggested three options to the Council:
1. Approve the sewer and water extensions to the property - this
option reaffirms the Council's decision in originally establishing a
water assessment for the lot and would allow building if setbacks
were met.
2. Deny sewer and water service to the property - relief from the
previous water assessment would be required.
3. Require the owner to apply through the typical variance request
process.
Staff finds no record at the County that the alley was vacated. The
City Attorney will clieck into this and bring it before the Council.
CDuncilman Neveaux moved to deny the sewer and water service to the
property and give Mr. and Mrs. Schmieg relief from the previous water
assessment placed on 7702 Erie. Motion seconded by Councilman Waritz.
The following voted in favor: Mayor Hobbs, Councilmen Pearson,
Neveaux, and Waritz. No negative votes. Motion carried.
Mr. Schmieg stated he felt he should not have to pay assessments
for concrete curb and gutter, street, and storm sewer for a lot that
is not buildable.
SEWER MORATORIUM VARIANCE REQUEST - LAKE RILEY BLVD: Adolph Tessness
was present requesting the Council consider relief from the sewer
moratorium on a lot located between Kiowa Trail and Lake Riley Blvd.
The lot is 44,000 square feet in size and does not front on a public
street.
Councilman Neveaux moved to place on first reading an ordinance
amendment clarifying Section 2.02, subsection 2 A. and B. of Ordinance
64 and a variance section, if. necessary. Motion seconded by Councilman
Waritz. The following voted in favor: Mayor Hobbs, Councilmen Pearson,
Neveaux, and Waritz. No negative votes. Motion carried. The applicant
was additionally, instructed to apply for a variance to the zoning
ordinance.
CONDITIONAL USE PERMIT - HARRY PAULY: Harry Pauly was present requesting
approval of a conditional use permit to construct a 44' x 801, three-story
office building on his property south of the Old Village Hall on Great
Plains Blvd. The Planning Commission held a public hearing on this issue
and recommended approval. The City Planner feels that the curb cut
behind Pauly's Bar could pose serious problems to the health and welfare
of the pedestrian public. He suggested the
City Council Meetinq August 1, 1977

curb cut be eliminated and the city instigate a truck loadinq
zone on Great Plains Blvd. He recommended the Council approve
the request and enter into an agreement with Mr. Pauly.
Mr. Pauly stated that if the curb cut is eliminated he v,ould request
that if it doesn't work he be allowed to open it up again.
Bruce Pankonin - If the beer trucks go to some other type of truck
than what we know today, that would have a difficult time negotiating
those radii, then possibly one way in or one way out so that the
trucks can get in there would be appropriate. As of this time the
trucks don't have a problem. I agree with him.
The Engineer has reviewed the lighting plan and drainage plan and
find no problems.
Councilman Neveaux moved to approve the plans as submitted this
evening with the recommendation of the Planning Commission in regard
to the service lane and the limited Parking along Great Plains Blvd.

CONDITIONAL USE PERMIT - MICHAEL SORENSON: Mr. Sorenson was
present requesting approval of a conditional use permit to construct
an office/retail building at 7900 Great Plains Blvd. The building
will be 6800 square feet in size and constructed of decorative
block. The CBD Committee met and felt that this proposal was
consistent with the spirit and intent of the CBD plan conditioned
upon Mr. Sorenson adequately screening the open storage area from
public view. The Planning Commission held a public hearing on
the proposal. The City Planner stated that the applicant should
indicate the type of materials to be used to screen the outside
storage area and should be required to construct a sidewalk along
the frontage. He recommended approval of the plan.
Mr. Sorenson stated at this time he has no plans for the storage
area. The garages will be used to house his trucks. The outside
storage area would be screened with woven cedar or redwood fencing
or something similar.
Council members would like to see a little more of a western motif
on the outside of the building.
Councilman Pearson moved that staff be directed to prepare a conditional
use permit incorporating the basic concept as shown on the exhibit
dated May 22, 1977, including sidewalks and the consideration of
a more western motif. Motion seconded by Councilman Neveaux. The
following voted in favor: Mayor Hobbs, Councilmen Pearson, Neveaux,
and Waritz. No negative votes. Motion carried.

Mr Pauly is proposing to construct a 44' x 80' office building
and ancillary parking area directly south of the old Village ,Hall.
This request will be require the issuance of a Conditional Use
permit pursuant to city ordinance 47-A:
Background
As shown in enclosure 1, the subject property is located on Great
Plains Blvd. directly south of the Old Village Hall.
Existing Zoning
The subject property and environs are zoned CBD.
Municipal Services
Sanitary sewer and water is in place and in service to the subject
property.
Comprehensive Plan Proposal -
The adopted City Plan suggests the removal of the Old Village Hall
and conversion of the city property and subject property to office/
day time commercial use.

Planner's Comments
As you know, the City of Chanhassen has been working for the last
year and one-half with Harry Pauly and the Bicentennial Commission
to develop a meaningful parking plan and restoration project directly
south of the commercial facilities located in the southwest quadrant
of Great Plains Blvd. and West 78th Street. To date, the City of
Chanhassen has negotiated with Harry Pauly to purchase a portion of
the city property for parking lot purposes.
The concept as proposed by Mr. Pauly comply, for the most part,
with the discussions, the city has been having with the Bicentennial
Commission and Central Business District Committee. The only area
of non-compliance with previously submitted plans is Mr. Pauly's
proposal to construct a service lane and curb cut along the.south
edge of his existing bar and lounge.
Planner's Recommendation
I suggest the Planning, Commission look with favor on Mr. Pauly's
request and suggest that he consider eliminating the service.lane
as described above and proceed with preliminary development plans
for the development of the parking lot and office building. The
Planning Commission should order a public hearing to consider
Mr. Pauly's request. Said public hearing could be held on Wednesday,
July 13, 1977.
