Attached is the City's copy of the public right of way easement
taken from Jerry A. Newman over a part of Lot 6 ; Schmid's Acre
Tracts. This easement compliments the other two easements taken
as a part of this lot resubdivision.
The Newman easement is made necessary by the fact that Newman
is a contract purchaser of a portion of the land over which the
right of way easement extends.
The original easement has been recorded in the office of the
Registrar of Titles in Chaska.

Subject: Proposed Lot Split by Gary Carlson
Gentlemen:
We have reviewed the proposed division shown on the certificate of sur-
vey .done by John J. Ryan Company. The owner, Mr. Gary Carlson; is petitioning
to divide off the East 200' of the south portion of the property. The part to
be divided off contains 31,170 Sq. Ft., leaving 118,830 Sq. Ft. in the re-
maining portion. The larger parcel contains the owner's present home and fronts
on Minnewashta St. The smaller parcel is presently vacant and is bounded by a
16z' cartway on the east and south.
SANITARY SEWER AND WATER MAIN The larger,lot is provided with sanitary
sewer service from the Shorewood.Intercep-
tor in Minnewashta St., the smaller from an 8" gravity sewer in the cartway,
which runs southward to the lift station on the north side of Highway 7.
Water service is not now available to this property. There is a 6" water main
stub installed just north of Highway 7 (about 600' south of the property) as a
part of the North Area Project, which could be extended northward to serve the
smaller parcel, as well as the other residences abutting the cartway. Because
of the distance between the Carlson property and the stub, now farmed, it is
probably not feasible to make this extension, unless it is petitioned for by
the abutting owners.
STREET RIGHT-OF-WAY Because only sanitary sewer service was provided by
the North Area Project on this cartway, it was not up-
graded to street standards as were other roads containing both sewer and water.
The City of Shorewood has a tennis court on the east side of the cartway (see
attached plan #2); the existing homes on the west of the cartway also limit
the practical width available for widening its surface.
For this reason, we recommend that the future allowable R/W width for
the cartway be 40', with the widening to be obtained as shown on Plan # 2, and
that approval of the Carlson division be subject to the City receiving a road
easement covering the widening past this property. An easement is also rec-
ommended for road purposes in the triangular area at the southeast corner of
the Carlson property -to make possible a proper future street intersection.
RECOMMENDATION We recommend that the division be approved subject to pro-
vision of the road easements as described above.

available. The Planner recommended the Planning Commission recommend the
Council approve this lot.split subject to the City Engineer's comments.

The property is part df-Lot 6, Schmid's Acre Tracts and borders a eartway
and 62nd.Street. The property is zoned R--1, Sanitary sewer is available
to .the property. The lot is a large "L" shaped lot. Mr. Carlson wants to
divide off the ease 200 feet of the south p#:vrtion of the property. The

City Planner recommended the Planning Commission recommend to the Council
that Mr. Carlson's lot be split into two lots.
The City Engineer reviewed his report of May 8, 1975. The division of
the property will create two lots that exceed the requirements of the Zonis
Ordinance. One 'lot is 31,170 square feet and is adjacent to a road called
cartway. Water is not available to the property. The cartway was not
improved at the time the sewer was installed because the water lines were
not put in. When water is installed the City plans to improve the street
to a 28 foot paved width. The right-of-way is limited by the tennis courts
on Cathcart Field and the two homes on the west. The Engineer feels a
40 foot right -of --way is the most the City can use. In addition the City
Engineer recommends that a 25 foot triangle be taken on the southeast corns
of Mr. Carlson's property to allow more turning radius at the corner.
The City Engineer recommends this division be approved aubject to Mr.
Carlson granting the right-of-way within his property.
Mr. Carlson stated the City Attorney is drawing up the easement papers and
he has agreed to sign them granting the road easements. Mr. Carlson has
three legal descriptions on his property although they all describe the
same thing.

DISCUSSION
Mr. Gary Carlson is asking that the sanitary sewer assessment
be abated from any portion of his property facing 62nd Street.
The reason for the proposed abatement is that the sewer line
is too shallow to give him basement drainage.
ALTERNATIVES
1) Leave the assessment on the property.
2) Abate it with the understanding that -when the property
is split an equivilant assessment will be levied against
the new lot, and also if the existing house is hooked up
to sewer that he be charged an amount equivilant to the
assessment for one unit.
RECOMMENDATION
In that we cannot provide adequate sewer service to the property
I recommend that the council adopt the appropriate resolution
abateing the assessment for sanitary sewer totaling $2,429.00.
The property being identified as Parcel 191 DO.

Dear Barry:
We noted that the subject is on the agenda for tonight's meeting.
Some background might be illuminating.
On Sept. 26, 1973, the village council defered assessments for lateral
and trunk sewer on Mr. Carlson's property, which lies on Minnewashta St, just
east of the Northwestern RR tracks, as shown on the attached sheet. This de-
ferment was to continue until a connection was made to the sanitary sewer.
On Sept. 23, 1974 we received a call from Mr. Carlson regarding his
making a connection with the sanitary sewer. He wanted to connect with the
Shorewood Interceptor, which runs east and west in front of his property.
He needed Sewer Board approval, so we made out the application. He planned
to have Elmer Peterson, a plumber from Orono, make the connection. Origin-
ally the line on Minnewashta St. was too high, but apparently during construc-
tion, it was placed deeper. In any case, we found out that there was a drop
of 2.23' available to Mr. Carlson, assuming his drain was not more than 3'
below his basement floor. The distance would be 140', and the slope of ser-
vice pipe would be about 1.5%, adequate.
We sent the application to the Sewer Board. Upon connection to the
system, defered assessments of $2,429 plus interest would be added to the
assessment roll, as outlined in our letter to the City on Oct. 10, 1974.
The City permit application was made by Mr. Carlson and the assessment was
added to the rolls. We and the City assumed the connection was made.
Apparently the service line was installed (by Mr. Carlson himself)
at too great a slope from the house to the street stub and we learned a short
time ago that no connection was made.

Dear Sir:
A sewer assessment has been placed against my lot based on a
lateral line that runs along the edge of my property on the
southeast edge. This southeast lateral is on an "L" shaped
leg of my property. I am dividing this leg of the "L" (that
is the benifitting portion) off from my homestead and establishing
a new lot. Thus the assessment no longer applies to my homestead
and I please request that it be removed. The assessment will
then be refigured and put back on the new lot.
