BACKGROUND
1. The property underconsideration is lots 1982-1986, Carver Beach
Subdivision.
2. Existing Zoning is R-1 Single Family
3. Comprehensive Plan Proposal; Develop property underconsideration
and adjacent parcel as low density single family.
PETITION
To divide the heretofore mentioned lots generally in half for
the pupose of tansfering ownership so as to "square -off" own -
ship patterns.
PLANNER'S COMMENTS
1. The planning duly ordered and duly held a public hearing to
consider the petitions request to resubdivide the property
under consideration. All adjacent properties, within 350 feet
were also duly notified.
2. The Carver County Register of Deeds, upon the advise of the
County Attorny, accepts subdivisions of legally platted lots
by legal description without the approval or review of the
municipality.
3. The resubdivision plan, as proposed is inconformance with the
Carver Beach Neighborhood Plan. No additional dwelling units
will be constructed on the parcel underconsideration.
PLANNER'S RECOMMENDATION
Approve lot resubdivision as proposed, pursuant to planning commission
recommendation dated November 12, 1975.

As I discussed with you on the telephone on September 17, 1975, we represent
the Wilsons and the Rossings in an exchange of land for the purpose of straightening
a Lot line between their properties. As the enclosed drawing shows the Wilsons
own Lots 1985 through 1991 inclusive, Map of Carver Beach at Long Lake, Carver
County, which lies in the City of Chanhassen at the above indicated address. This
property is subject to a mortgage to IDS Mortgage Corporation. Their neighbors,
the Rossings, own Lots 1982-through 1984 and other land. As you can see the
Wilson'.s property contains a dogleg to the North on Lots 1985 and 1986.. The
parties wish to exchange the Northerly portion of 1985 and 1986 for the Southerly
portion of Lots 1982 through 1984 as shown on the enclosed drawing.
The proposed legal description for the land to be given out by the Wilsons is as
follows:
That part of Lots 1985 and 1986, Map of Carver Beach at Long
Lake lying Northwesterly of a line described as commencing at
a point on the Northeasterly line of said Lot 1986, 45 feet
Southeasterly of the Northeasterly corner of said Lot; thence
running Southwesterly to a point on the Southwesterly line of
Lot 1982, said plat, 45 feet Southeasterly of the Northwesterly
corner of said Lot 1982.
In exchange, the Wilsons would receive land described as follows:
That part of Lots 1982, 1983 and 1984, Map of Carver Beach at
Long Lake, lying Southeasterly of a line described as commencing
at a point on the Northeasterly line of Lot 1986, said plat,
45 feet Southeasterly of the Northeasterly corner of said Lot;

thence running Southwesterly to a point on the Southwesterly
line of said Lot 1982,.45 feet Southeasterly of the Northwesterly
corner of said Lot 1982.
The Rossings' home lies approximately on Lot 1964 near the rear of the Lot
and they have been using with the Wilson's consent the Northerly portion of
Lots 1985 and 1986 as their own backyard, The proposed transfer would
perpetuate that use. In exchange the Wilsons gained a more useably shaped
property.
The land exchange will not involve any payment of money by either party. ,
We shall need a partial release of mortgage for the land owned by the Wilsons
to be transferred to the Rossings, and you will want an extension of the
Wilson's mortgage to include the land being acquired by the Wilsons.
I understand you will need approval for the partial release from the Veterans
Administration and that you will see to processing that application for
approval. There is a proposed sale of one of these properties upcoming and
we will appreciate your help in accomplishing this land exchange in time for
that closing.
