Subject: Variance Request of
Mr. Roger Burns
Gentlemen:
We understand that Mr. Roger Burns has requested a
variance to construct a garage on the street side of his
residence on Huron in Carver Beach. Because of the re-
strictive existing topography, Huron would not be widened
or realigned in the vicinity of his home in connection
with the sewer and water installation.
We trust this is the information you need.
Very truly yours,
SCHOELL &&,/NC.

MEMORANDUM
FROM:
Bruce
Pankonin - City
Planner
TO:
Board
of Adjustments
and Appeals and Roger Byrnes
SUBJ: Front Yard Variance Request
Background
1. Property location: 6724 Huron Street
2. Existing zoning: R-1 Single Family
3. Petition: Five (5) foot front yard variance
4, Date of Public Hearing - June 17, 1975
Planning Report
PLANNER'S COMMENTS:
1. The Board of Adjustments and Appeals has the power and duty to
hear requests for variances from the literal provisions of the
ordinance in instances where strict enforcement would cause
hardship because of circumstances unique to the individual property
under consideration.
2. The Board of Adjustments and Appeals shall not recommend, and the
Council shall not grant, a variance unless they find the following
facts:
-2-
a. That there are special circumstances or conditions affecting
the land, building or use referred to in the application for
the variance.
b. That the granting of the variance is necessary for the preser-
vation and enjoyment of substantial property rights.
c. That the granting of the application will not be materially
detrimental to the public welfare or injurious to property
in the area adjacent to the property for which the variance
is sought.
d. That the grant of the variance will be in keeping with the
spirit and intent of this ordinance.
3. By reason of extreme topographic conditions, the construction
of the petitioned new garage and familyroom could not be adjacent
to west side of the existing structure.
PLANNER'S RECOMMENDATION:
Approve variance request as petitioned if requested construction
conforms to the standards as outlined in number two (2) above.
