I understand that they are doing this for the purpose of constructing a two -car garage on the east side of their present dwelling on their property located at 508 West 76th Street, Chanhassen, The plans call for the garage to come.within five feet, seven inches of the boundaryline between our properties. Property location: 508 West 78th Street 2. Existing zoning: R-1 Single Family Residential 3. Petitioner for side yard set back variance to construct an attached garage 5'7" from side lot line. Planning Report PLANNER'S COMMENTS: 1. The Board of Adjustment and Appeals has the power and duty of hearing requests for variances from the literal provisions of the Zoning Ordinance where strict enforcement would cause hardship because of circumstances unique to the individual property under consideration. -2- 2. The Board of Adjustments and Appeals shall not recommend, and the Council shall not grant, a variance unless they find the following facts: a. That there are special circumstances or conditions affecting the land, building or use referred to in the application for the variance. b. That the granting of the variance is necessary for the preser- vation and enjoyment of substantial property rights. c.! That the granting of the application will not be materially detrimental to the public welfare or injurious to property in the area adjacent to the property for which the variance is sought. d. That the grant of the variance will be in keeping with the spirit and intent of this ordinance. 3. The petitioner is proposing to construct an attached garage 26' x 26'. This garage is two feet larger than the "standard" suburban residential garage. 4. The property under consideration as originally plotted in 1963, with the principal structure placed 16.7' from the west lot line. At the time of construction 31.3' was reserved on the east for a single car garage. 5. The City has received a statement from Dwight Leatham, adjacent neighbor, not objecting for the requested variance. PLANNER'S RECOMMENDATION: Question the petitioner's desire to build an oversized garage. Grant variance request.
