This Letter of Credit is set to expire on January 19, 1982. Should you feel that another year of examination of this cul-de-sac is necessary, I would need to know by December 15, in order to inform Romarco that a Letter of Credit renewal is needed. Box 147 Chanhassen, MN 55317 Subject: Berkey Drainage Easement. Gentlemen: We have continued to negotiate a drainage easement to construct a drainage swale across Mr. Berkey's property between County Road No. 15 and Lake Minnewashta. The proposed swale would occupy a 20-foot wide easement along the south line of the Berkey property: The swale would have a maximum depth of 1.5 feet and a 2-foot bottom gently sloping to the edges of the easement. The easement would be sodded. Our estimated construction cost is $825. The Minnehaha Creek Watershed District approved construction of the Swale, as described above, on July 17, 1975, We were re- quested to appear at the March 18, 1976, Minnehaha Creek Board of Managers meeting to describe the original and present drainage in the County Road No. 15 area, The Board took no action other than to encourage us to work with Mr. Berkey in resolving the easement situation and to offer the assistance of the Watershed District Engineer in our endeavors. On April 6, 1976, a meeting was held between Messrs. Berkey, Bloom, Schlenk and Brezinsky to discuss the easement. Mr. Berkey will accept no less than $2,000 for the easement. As an alternative, Mr. Berkey suggests construction of a storm sewer approximately 700 feet north along County Road No. 15 to the Lake Minnewashta - Lake Virginia Creek. The estimated $10,500 cost of this work, if done, would be assessed against the benefitted properties. Gentlemen : - ' The City,of Chanhassen wishes to make application for assist- ance from the Waterways Maintenance -Fund to correct drainage pro- blems in the County Road 15 Area and the West 62nd Street Area of Chanhassen. COUNTY ROAD 15 The City of Chanhassen plans to construct a drainage swale west of County Road 15, approximately 1,800 feet south of State Highway 7. This is the final step in an area drainage improve- ment that was started when the sanitary sewer was installed in 1973. The drainage pattern prior to the sanitary sewer project was as shown on the attached sketch. Runoff from approximately 8.7 acres in Pleasant Acres Subdivision flowed underground through a 15" CMP, overland through a 12" split RCP to the County Road and -then southward along the.County Road through an open ditch to a 15" culvert under the County Road." Because the split RCP and the ditch were inadequate to handle the runoff, flooding occured west of the County Road. At times, in the spring, with alternate freezing and thawing, the water would top the County Road and freeze creating a dangerous condition. To correct the problems the following work was done in con- junction with the sanitary sewer project. 1) A grass swale was substituted for the split RCP. 2) The CMP under the County Road was relocated at the outfall of the swale. Minnehaha Creek Watershed District Page 2 February 26, 1976 _ 3) The ditches on the west side of the County Road were eliminated by widening and lowering the road and filling the ditches. The flooding problem has been eliminated.However, the more efficient system pro- duces a larger and more concentrated runoff east of the County Road. The flow tends to meander across the lowlying properties east of the road, endangering trees. To correct the now.existing condition, the City proposes to confine the.runoff, east of the road in a grass swale as shown on enclosed Drawing No. 7120-100. The-swale would out" let approximately 90 feet from Lake Minnewashta.. Toward this end, the City has been negotiating a drainage easement for the swale. Approval for construction.of this swale was received from the Watershed District on July 17, 1975. The City hopes to obtain an.easement and complete the work on the swale this year. The estimated construction cost of this work, to be done by City forces, is $825 as itemized below: Backhoe 16 hrs @ $25.00/hr. = $400 Sod 150 SY @ 0.60/SY - 90 Labor 40 hrs @ 7.00/hr = 280 Rip rap 5 TNS @ 3.00/TN - 15 Truck 4 hrs @ 10.00/hr' = 40 TOTAL $825 Because this is the last stage in correction of a long existing, area wide, drainage problem, we feel this may qualify for aid from the Minnehaha Creek Watershed District Waterways Maintenance Fund. WEST 62ND STREET The City of Chanhassen proposes to improve the flow and eliminate existing erosion problems in a drainage ditch south of West 62nd Street, between County Road 17 and Christmas Lake. The ditch alignment and.typical ditch section are shown on enclosed Sewer Plan 7503. The profile of the ditch is essen- tially that of the adjacent street. Erosion is occuring along the westerly 300 feet of the ditch, plugging downstream culverts and endangering West 62nd Street and several trees. All other damaged-culverts`�downstream have been replaced by the City within the last 3 years. Because of potential damage to the street,.continuing main- tenance problems and homeowner complaints, the City intends to correct the problem this summer.- Rip rap is to be installed along the easterly 300 feet of the ditch as shown on the Plan Sheet detail. The damaged 15"..CMP will be replaced by a new 18" CMP. The property under consideration is under the control of Donald Berkey and located on the northwest shore of Lake Minnewashta directly north of Pleasant Acres. 2. Existing Zoning: R-1 Single Family Residences. 3. Comprehensive Plan Proposal: a. Land Use: Develop the property under consideration and environ as low density single family. b. Transportation: County Road 15 provides limited local access and through movement along the west shore of Lake Minnewashta between STH 7 and STH 5. This road will be turned over to the City as a local street by Carver County in the near future. 4. Sanitary sewer and water is in place and can serve the property under consideration. Petition: To divide the subject property into three (3) buildable residential lots and two (2) outlots. Outlot A will be redivided in the future, Outlot B will provide private access to Lake Minnewashta for future residents in Outlot A. Mayor and Council -2- November 20, 1975 Planner's Comments 1. The Planning Commission duly held a public hearing on November 12, 1975 to consider Mr. Berkey's subdivision. All adjacent property owner's within 350 feet were also duly notified. 2. A local drainage problem exists in the vacinity of proposed Lot 2, Block 2, Minnewashta Creek Addition. Sufficient area is contained within said lot to handle the drainage problem by the City at a future date. 3. State Statutes require the review by the County engineer for all subdivisions abutting County roads. I talked to Pat Murphy about Mr. Berkey's subdivision, and he said we should consider County Road 15 as a local street and was not concerned about this subdivision. 4. The Planning Commission on October 22, 1975, made the following recommendation to the City Council. "A motion was made by Vivian Beaugrand and seconded by Tom Noonan that satisfactory arrangements be made of payment of Mr. Berkey's bill before preliminary plat approval by the Council. Motion unanimously approved." Mr. Berkey on October 3, 1975, deposited $200.00 with the City to defray all direct City expense incurred for processing his application for subdivision. Mr. Berkey however, owes the City $800 plus dollars incurred by the City for processing his previous petition (1973) to construct single family attached and detached homes on the subject property. Mr. Berkey was mailed a copy of previous charges on November 18, 1975. With these facts in mind and in the spirit of cooperation, I feel the City should require full payment prior to the signing of the final plat and not at this time. 5. The Planning Commission on November 12, 1975, made the following recommendation to the City Council: "A motion was made by Nick Waritz and seconded by Mal MacAlpine to recommend the City Council approve Mr. Berkey's Planning Case SUB 75-01 subject of the transfer of Minnewashta Parkway to the City of Chanhassen and subject to a mutual agreement on the old fees regarding the property and to the plan submitted for approval dated October 2, 1975. The Planning Commission has considered the possible impact of future building and development of Outlot A on the lake access Outlot B and feel that there is' nothing more appropriate that can be done at this time until Outlot A is developed. Motion unanimously approved. Planner's Recommendation I feel the proposed subdivision as submitted is in keeping with the spirit and intent of the City Plan and Ordinance 47. Mr. Berkey should be required to pay all outstanding City charges and work closely with the City to eliminate the drainage problem on County Road 15. The property under 20 acres located in on STH 7 and County to create two lots pectively. consideration contains approximately the northwest corner of the city Road 15. The petitioner proposes containing 1.5 acres and 18.5± res- 2. The property under consideration is presently zoned R-1 single family residence. 3. On February 13, 1973 the Planning Commission order a public hearing for March 6, 1973 to rezone the property under consideration from R-1 to P-1. The Planning Com- mission on March 27, 1973, recommended approval of the zoning subject to certain conditions. On April 2, 1973 the City Council approved the P-1 zoning subject to recommendation of the Planning Commission and entering into a development contract. At that point, the pro- ject was discontinued and the property remained R-1. -2- PLANNERS COMMENT: 1. The procedure to separate the Berkey property into two lots is governed by City Ordinance 33. The petitioner should be required to furnish the city with a certified survey (plat) identifying the dimensions of the lots to be created as per City Ordinance. 2. The petitioner should deposit with the city an escrow account in the amount of $150.00 before a public hearing is ordered. 3. From a planning point of view I feel the small lot (1.5 acres) is a logical separate parcel. If this parcel is created it would relate compatible with future land uses in the area.
