MAYNARD HAPPE: Mr. Happe is adding a piece of property to Lot 5, Bluffview A dition. There will be a permanent- easement for Lakota Lane and a temporary easement for the circle alongside the limits of the street. After much discussion the second and motion were withdrawn as the survey shows a five foot strip of land between the cul-de-sac and the next property. SARGENT PALMER: Mr. Palmer, 7608 Erie, was present with the problem of raw sewage backing up into his basement during the heavy rainfall on June 6. His basement is completely finished. The City Attorney stated the City does not have any insurance coverage for this type of claim. Mr. Palmer was asked to submit bills to the City within 30-days for.' labor,•materials, and future clean up costs to eliminate the odor. SPARKS RT. 5 BOX 226 EXCELSIOR, MINN. 55331 Attention: Mr. Lloyd Schnelle, Village 2dministrator Gentlemen: Following conversations with both Mr. Lloyd Schnelle and Mr. Gerry Schlenk, this will serve as a form of appeal to the Chanhassen Village Council for consideration, and concerns the matter of required hookup dates for connection to the new sewer and water facilities completed this past Fall. ?tire presently own 3.28 acres of property as shown on the attached survey plat, and on which property is located our own home, and a converted barn house which we have been renting as income property. -1e have previously made application to the Village Plan- ning Commission for approval to sub -divide this property - one portion to include the converted barn house with approx. .9 acre of property - and the other to include our house with the remaining 2.39 acres of property - and this was given an informal vote of approval subject to completion of a new re -survey of the two parcels which is being made at the present time, but is not yet completed. Tre have since sold the barn house portion of this property with the approx. .9 acre or ground, and the new owners plan to hook up to the sewer and water facilities tii$ coming Fall. This hookup will involve a distance of less than 150' from the barn house to the sewer and water unit connection, and will be in accordance with our understanding and agreement at the time of our meeting with the Planning 6ommission. ,s to the required hookup dates to the new facilities relative to our house and the remainder of the property, we will very much appreciate further consideration of the following facts: (1) Our house is approximately 180' from the unit sewer and water connections on Galpin Blvd. to the East of our house. (2) Within the preceding six years, we had to invest a sum of $2,400. for a new 390 deep well with submersible pump for good water, and $1,600. for a new septic system, two storage tanks, dispersion tank, and good drainage field - amounting to a total of $4,000. - and both of these systems have been working beautifully with no possible pollution problem as the area is large, the ground high, and neighbors at some distance. (3) Our total sewer and water assessments amount to $12,600., and all of these assess- ments will be paid off in full at completion of sales of both properties. Our appeal to the Council is therefore as follows: In consideration of the foregoing facts, that required hookup of our own house to the new sewer and water facilities be postponed to some date later than the coming Fall of 1974, and especially in view of the excellent present facilities. Estimated costs of such hookup to date have run as high as $1,430., and we quite naturally do not relish the idea of having to pay out this amount in addition to paying off the $12,600. in special assessments just before selling and leaving the property. The idea of closing a deal on our place early this Summer, and then being forced to pay out the additional $1,430. for this hookup just several months later, has already scared off one potential %purchasor and his wife who both loved the place, and were near to taking it - and al- though the fact is appreciated that such connection will have to be made eventually, a grace period of another three or four years on such action could make all the difference in the world in our efforts to dispose of this property.
