In conducting this review, no documentation eras detected that would verify that the neighborhood sign was part of the require- ments of the Western Hills development. Additionally, I have contacted Russ Larson, and he recalls no conditions of development that would have required said sign. If further investigation of this is requested, perhaps the complainants would be able to help -;through recollection of any particular documents or.times- when this issue may have arisen. Great Plains Blvd. ; Under State law, removal and disposal of diseased trees is d-efi.ned as an improvement, or more appropriately, repair, of public improve- ments similar to streets, sewers, water, etc Costs of removal can be 100a assessed back to the abutting property owner similar to assessment of replacement of streets after the usable life of that street has been exceeded. It is unfortunate to lose a mature tree, regardless of what species. It is my understanding, based on comments from municipal official s serving during the period of 'installation of this sign, that the City did authorize Hansen and Klingelhutz to erect this sign as a temporary sign. I do not see where tY,e City can become involved in a claim by yourself against the permit holder -- Hansen and Klingelhutz and/or the Western Hills neighborhood, but I will so advise the City Attorney of your letter. Again, I believe your Mr. & Mrs. Mingo -2- August 20, 1980 Metter does serve to question whether the permit holder was granted a "temporary" permit or whether the intent was a perpetual permit. We have reviewed these plats to determine their conformance with the Village Plat- ting ordinance, as follows: 6.01 a (1) Names and addresses of owners of lands within 200' of the boundar- ies of the plats have not been furnished on the drawing. 7.01 b (2) Full legal descriptions for the lands involved in both plats are not shown. 7.02 a (3) No boundary survey is shown for either plat. Note: Because of some potential boundary problems in the Western Hills 2nd Addition area, the surveyor has not yet completed the boundary survey for either tract. 7.02 g (4) Contiguous land owned or controlled by the subdivider is not shown. 7.03 c (5) Profiles for proposed sanitary sewer and storm sewer and water mains have not been provided. This plat of Western Hills 2nd Addition conforms generally with the overall plan for the area as prepared by Herb BAldwin and approved by the Planning Commission and Council several years ago. A feasibility study for sanitary sewer and water was submitted by our firm to the Village Council in September and approved. It appears that this will remove the necessity for separate submission of preliminary sewer and water profiles. The ordinance requirement for 30-foot minimum front yard setback on Lots 1, 2, 4 and 5 of Sunrise Hills 4th Addition may prevent home construction in the most desirable location because of the slope on each lot from front to back. We recommend that consideration be given to reducing these required minimum front setbacks from 30' to about 20'. RECOMMENDATION The non -conformities noted in Items 1, 2, 3 and 4 should be remedied. Item 6 is covered by the ordinance, and side yards could be shown, although it has become customary to rely entirely on the ordinance for this requirement. Major non -conformities are noted in.Items 8, 9 and 10. We believe the village interest and that of the neighborhood will not be prejudiced by waiv- ing the ordinance requirements in each of these cases, and we so recommend. Gentlemen: Pursuant to your request, we herein submit -a feasibility study for the above -named project. This study is concerned with providing sanitary sewer, water, storm sewer and streets to the proposed Western Hills 2nd Addition. This plat is proposed to contain 72 townhouse units plus 17 single family lots on Long View Circle. The townhouses are proposed to be divided -- 36 units on the east side of Laredo Drive, and 36 units on its west side. Four of the proposed 17 lots on Long View Circle are to be derived from a redivision of Lots 16, 17 and 18, Block 3, Sunrise Hills 2nd Addition. These three lots presently front on Frontier Trail and are served with sewer, water and road access. However, it is our understanding that the developers of Western Hills have an agreement with the owner of these three lots to provide access and utilities off of Long View Circle. For the purposes of this report, we have assumed this redivision to occur. Sanitary Sewer: Sanitary sewer is proposed to be provided in a manner as best described by the.attached Drawing No. 7556-1. All proposed sewers would be directed to the existing sewer at Iroquois and Laredo Drive. The 36 proposed townhouses on the west side of Laredo Drive would obtain sewer service by connection to an existing sewer at Laredo Drive and Del -Rio Drive. Estimated total cost for sanitary sewer laterals is $23,740. This cost is proposed to be assessed to two separate categories - $17,570 to the 17 lots on Long View Circle, and $6,170 to the proposed 72 townhouse properties. For convenienpe a cost summary is attached at the end of this report. Water Main: Water service is also best described by the attached Drawing No. 7556-1. An 8-inch main is proposed to be installed on Laredo Drive from Del -Rio Drive to Iroquois. Connections to existing water are at each end of this main. A 6-inch water main is proposed to be constructed up Long View Circle from Laredo Drive, and continue beyond the Cut -de -Sac to connect Frontier Trail. We suggest that the connection to existing water on Frontier Trail be made so as to eliminate a "dead-end" main on Long View Circle. "Dead -ends" SCHOELL & MADSON.INC. As in the case of the sanitary sewer it is proposed to assess to two categories - $13,190 to the 17 lots on Long View Circle, and $14,325 to the 72 proposed townhouses. Storm Sewer: Storm sewers are proposed to be installed as indicated on the Drawing No. 7556-1. Catch basins would be installed at the inter- sections of Saratoga Drive and Laredo, and Long View Circle at Laredo. A storm sewer is proposed to flow from Saratoga Drive on Laredo to Iroquois, where existing storm sewer runs to the south. Estimated total cost of the storm sewer is $12,400. This cost is proposed to be assessed equally at $6,200 to the 17 lots abutting Long View Circle, and $6,200 to the 72 townhouses. Streets: Streets are proposed to be constructed on Laredo Drive from Del - Rio Drive to Iroquois, and on Long View Circle. It is proposed to construct a 36 foot wide bituminous surface on Laredo to conform to existing width on each end. Long View Circle would be a standard 28 foot wide bituminous surface. Village of Chanhassen September 14, 1972 Page 4 The estimated total cost of streets is $27,810, of which $11,930 is proposed to be assessed against the 17 lots on Long View Circle, $12,350 against the 72 townhouses, and $3,530 paid by the Village of Chanhassen. It is proposed that the Village pay the cost of the increased street width on Laredo because present standards only require 28 foot width. All costs presented herein assume the developer to bear street rough grading costs. In other words, no allowance for street grading cost has been made. Summary: The improvements as proposed herein are feasible from an engineering point of view. Concerning timing, it is possible that grading by the developer, and sewer, water and storm sewer could be completed this Fall. However, such a rapid schedule would be greatly dependent on weather and how quickly the municipal process proceeds. The cost summary attached best indicates costs. Total project cost is estimated at $91,465. This is equivalent to a unit cost of $2,876 per lot for the 17 lots on Long View Circle. The cost summary indicates.separately the cost of trunk sewer and water charges. Trunk charges are not presented as a part of the project cost. They have been collected at the time of issuance of building permits at the rates of $320 per single family unit for sewer, and $380 per single family unit for water.
