A RESOLUTION ACCEPTING PUBLIC
IMPROVEMENTS IN THE FIRST PHASE OF THE AVIENDA DEVELOPMENT
WHEREAS, the City has received a letter from the Engineer of Record for the Avienda
development indicating the public street and utility improvements, except for stormwater
management treatment BMP’s, have been completed in conformance with the approved plans and
specifications; and
WHEREAS, City staff has performed a walk-through inspection and finds the applicable
improvements acceptable for perpetual maintenance and ownership.
NOW, THEREFORE, BE IT RESOLVED by the Chanhassen City Council:
1. The public street and utility improvements, except for the stormwater management
treatment BMP’s, in the first phase of the Avienda Development are accepted for perpetual
maintenance and ownership subject to the conditions provided in this resolution.
2. The acceptance is conditioned upon the developer providing a 2-year warranty bond for
all public streets and utilities.
PASSED AND ADOPTED by the Chanhassen City Council this 12th day of January,
2026.
